Oil Survey Petition raffled to another court

The plea to stop the seismic survey scheduled in the seas of Bohol suffered delay with the Regional Trial Court executive judge deciding to raffle the case instead of acting on the urgent motion.

The petition for a Temporary Restraining Order was raffled to the sala of Presiding Judge Achilles Melicor, RTC Branch 4. No specific date was set for the hearing of issuance for a temporary restraining order as pleaded.

A petition blocking the conduct of an oil seismic exploration in the Bohol Strait was filed by City Mayor Dan Lim and 30 other petitioners representing non- government organizations (NGOs), fisherfolks and local government units.

The petition was for certiorari, prohibition, injunction with prayer for preliminary injunction, temporary restraining order and ex-parte temporary restraining order.

Lawyers Raul Barbarona, Doni Piquero, Florendo Columnas and Danilo Bantugan, signed as counsels for the petitioners, while named respondents are Department of Environment and Natural Resources (DENR)-VII OIC regional director Allan Arranguez, Department of Energy (DoE) Sec. Rafael Lotilla and NorAsian Energy Ltd. Chairman Rufino Bomasan.

The petitioners’ lawyers said they were surprised at the response of the court citing urgency of the issue. The seismic survey is now going on in the Cebu strait particularly in the seawaters of Sibonga and the same waters comprise the eco-marine system that can affect the Bohol seas.

The Nor-Asian survey will cover 2,040 square meters of seas that will span through the coastal municipalities of Calape, Loon, Dauis and Panglao, Maribojoc and Tagbilaran City.

The survey that was supposed to start June 19 using the ship MV Pacific Shore was temporarily stopped in an agreement brokered by Bohol Gov. Erico Aumentado together with the affected parties.

When the survey starts, the seas within the 8.5 kilometer radius will be closed to navigation to protect the sensitive cables that are laid out underneath the seawaters.

Fishermen will be prohibited to fish in the area while payao will be towed away from the restricted radius resulting to loss of income during the duration of the survey.

Petitioners also cited the lack of environmental impact studies to determine the long term damage of the seismic activity.
