Opening Remarks in the BIATF Session (October 23, 2020, 1pm)

Maayong hapon sa tanang talahurong myembro sa BIATF.

Usa sa mga epekto sa COVID19 mao ang paglimita ang kalihukan sa mga tawo, sa mga pamilya ug sa komunidad. Tungod kay ang virus makatakod man, ang atong mga lihok dili lang limitado, hugot usab kining gibantayan ug gi-record. Usa kini ka sistema, dili lang tungod nga ang mga taw nga posibleng natakdan atong ma-monitor apan usa usab kini ka pamaagi sa contact tracing aron dali natong mabantayan kung kinsa ang mga taw nga na-infected. Mao kini ang realidad sa tibuok kalibutan, sa atong nasud ug dinhi sa Bohol.

Mao nga dili ikatingala nga niadtong nigawas ang mga litrato ni Panglao Mayor Nila Montero sa social media samtang didto siya sa Cebu, daghan ang mga nangutana: Unsa man ang tumong sa iyang pagbyahe? Kinsa man ang kauban sa Mayor? Nagkuha ba ang Mayor ug ang iyang mga kauban ug mga rekisitos nga gikinahanglan aron makagawas ug makabalik siya sa Bohol? Nasunod ba ang mga health protocols sa iyang pagbyahe paingon sa Cebu, ug pauli dinhi sa Bohol?

Pagkahibaw nako sa maong sitwasyon, Akong gi-istorya si Col. Clarito ug verbally ako siyang gitahasan nga mopahigayon ug imbestigasyon sa maong sitwasyon tungod kay mandato man kini niya ubos sa BIATF Ordinance. Under the BIATF structure, the TASK GROUP LAW ENFORCEMENT AND PUBLIC SECURITY, headed by the Provincial Police Director, is tasked, among others, “to act on all complaints and reports of violations of COVID-19 related laws and issuances, initiate or cause the investigation and prosecution of criminal actions against any person, whether public official and employees or private individuals and entities, violating the laws, EOs, rules and regulations providing for the health protocols and all other measures enacted to combat COVID-19”.

Sulod sa usa ka semana, nakadawat ang atong buhatan ug investigation report apan akong gi-uli ang maong report tungod kay usa kini sa investigation report gikan sa Panglao Police Chief ug igo lang endorso padung sa atong buhatan ug dili kini produkto sa imbestigasyon nga gihimo sa Head sa BIATF Security Cluster.

Ang ikaduhang report nga atong nadawat, nikabat ug duha ka semana usa nila nasumite tungod kay adunay meeting nga gitambungan si Col. Clarito sa Cebu. Sa makausa pa, atong gi-uli ang maong report tungod kay ang unod sa maong report naghisgot lang ug IATF National ug Regional Issuances, apan walay rekomendasyon kung unsa ang mga lakang nga angay natong buhaton.

Ang ikatulo ug ang final nga report nga atong nadawat ug maoy atong hisgutan sa atong Meeting karon. Ang maong report adunay duha  ka rekomendasyon. The first recommendation is: “let the case against Mayor Montero and company be Dropped and Closed.” The second recommendation is :” let all the members of Bohol IATF to convene and to harmonize the variations on the issuances from the Local and National IATF.”

Pinasubay sa ikaduhang rekomendasyon ni Col. Clarito, ang BIATF naghimo ug meeting karon, physically ug online, aron maminaw ta sa iyang report ug presentasyon, ug aron mahatagan ta ug katin-awan sa giingong variations on the issuance from the local and National IATF. Kung pananglitan adunay mga panabangi sa atong mga protocol o balaud dinhi sa Bohol ug sa National IATF Issuances, kinahanglan nga mahibaw ta ug unsa kana ug mahatagan ug tsansa nga matul-id ang sayop kung tinuod man adunay sayop. Along the way, I am sure that he will use the case of Mayor Montero, to demonstrate to us these “variations” or “conflicts of laws” to explain his recommendation that the case against Mayor Montero and company be “dropped and closed.”

Daghan ang nag-ingon nga kinahanglan ko nga mohatag ug agresibong aksyon mahitungod sa maong isyu ug daghan usab kong nadawat nga kritisismo sa atong pagpakahilom sulod sa pipila ka mga adlaw. Gi-aksyonan man unta nato ning maong isyu pinaagi sa pagmando sa PNP nga mopahigayon ug imbestigayon mahitungod niini. Maong usahay diko kasabot sa ilang gi-ingon nga mohatag ug aksyon kay nilihok man ta.

Kabahin sa atong pagpakahilom, buot nakong ipaambit sa tanan, nga isip Gobernador sa Bohol, nanumpa ako sa inyong atubangan nga panalipdan ang konstitusyon sa Pilipinas. In our Constitution is enshrined the command that no Filipino can be deprived of life, liberty or property without due process of law nor be denied the equal protection of the laws.  We have the right to be presumed innocent until proven otherwise. Mao ni ang rason nganong gipili nakong magpakahilom. I wanted to allow due process to take its course.  Due process defined as the requirement that legal matters be resolved according to established rules and principles and that individuals be treated fairly. Obligasyon nako nga isiguro nga ang maong katungod mahatag ug respetohon sa tanang mga Bol-anon. This is the reason why I gave the case to the PNP because they are the trained personnel who can make sure that an investigation will be properly and fairly conducted.

Karong hapon, ang mata sa tibuok Bohol nagtan-aw kanatong tanan. Let us spare each other from grand words and legal maxims that only a few people understand. We can agree to disagree, but let us speak plainly, respectfully, and simply to each other. Ang importante nga mogawas ang kamatuoran ug kinahanglan wala nagkasumpaki ang atong mga balaud ug respetohon nato kini. Kung atong ipadayag ang kamatuoran ug isiguro nga ang atong mga balaud respetohon sa matag Bol-anon, mas mapalig-on nato ang partisipasyon ug pagtuo sa katawhan sa sistema sa atong pang-gobyerno.

I ask you all to join me in bowing our heads, here in now to ask for Divine Guidance, Wisdom and Humility for all of us, and to be reminded that we are all Bol-anons and seek only for the protection, well-being and prosperity of our Province and our People.
