For committing a crime so brutal and highly condemnable that to allow it to flourish would signal the reign of terror and lawlessness and eventually shatters society to smithereens, a thing that every man of sane mind would abhor to happen, a former Jagna policeman was meted out imprisonment for life.
Thus ruled Presiding Judge Venancio Amila of the Regional Trial Court Branch 3 in a 12-page decision he handed down last week against SPO1 Joel Sabang y Redillas in the killing of German national Peter Leo Oskar Kernke four years ago. Sabang was a member of the Jagna police station when committed the crime.
In finding the policeman guilty beyond reasonable doubt, Judge Amila took cognizance of the testimony of Rosanna Bucio, live-in partner of the German national.
In her testimony, Bucio confirmed that she had an eye to eye contact with the back rider of a motorcycle when it overtook them along Grahan Avenue. Bucio was driving a Honda CRV with her live-in partner by her side. They were on their way home to their residence in Booy.
The German and his love mate just came from their computer shop along Gallares St. when their car was overtaken by the motorcycle on the wrong side along Graham Avenue. They were waylaid by the motorcycle riding men near the gate of their house. The gunman who turned out to be Sabang was the back rider of the motorcycle as pinpointed by Bucio.
In handing down the life sentence, the presiding judge also ordered the accused to pay the heirs of the slain German national. The actual damage was pegged at P50,000; moral and exemplary damages, P100,000. Bucio who was hurt in the shooting incident was indemnified of P102,000 for her hospitalization expenses, moral damages of P30,000 and exemplary damage of P20,000.
