Former Panglao mayor Dr. Doloreich Dumaluan filed a complaint on Friday at the National Police Commission (Napolcom) against the
provincial police commander for gross misconduct and grave abuse of authority.Bohol PNP Prov'l Director Edgardo Ingking and Dumaluan clashed last week when the police chief barred the former mayor from seeing a detainee at Camp Dagohoy who is the suspect in shooting Dumaluan last August 25 near his resort in Bolod, Panglao.
In his complaint, the former mayor said Ingking is "using his office to advance his own personal interest and the interest of other people" with regards to the investigation of the shooting incident and handling the suspect, Teodulo Macalandag, who is detained at the police camp.
Dumaluan also alleged that the provincial police commander offered to provide a lawyer to Macalandag when the latter has already expressed willingness to tell the truth and reveal what he knows of the shooting incident and the people who are involved in it during the clarificatory hearing conducted by the Office of the Provincial Prosecutor last September 9.
"His (Ingking) act of preventing me to see Macalandag at Camp Dagohoy without any reasons, and his act of publicly declaring on during an interview over the airlanes that I could no longer enter the camp and I will be arrested, should I insist, constitute gross misconduct and grave abuse of authority," Dumaluan said.
It may be recalled that the former mayor has filed charges of frustrated murder and attempted murder against Macalandag at the Office of the Provincial Prosecutor.
According to Dumaluan, even when he was still confined at the Chong Hua Hospital in Cebu City to extract a bullet embedded on his left shoulder following the shootout, he already received information that Macalandag already revealed the whole story behind the shooting and has mentioned the people behind it.
It was during his visit at the Camp Dagohoy detention cell on September 8 that Dumaluan talked personally to Macalandag where the latter purportedly "narrated voluntarily the whole story and the people responsible".
On the following day, Dumaluan and Macalandag met again at the latter's detention cell "to clarify statements made by the suspect".
According to Dumaluan, it was during his second visit at the camp that Ingking learned of his meetings with Macalandag.
The former mayor alleged that after he left Macalandag's detention cell, Ingking also went to see the suspect "offering to provide him a lawyer for his defense".
"This information shocked and surprised me since instead of helping me, as the victim of the shooting incident, investigate and find out who else were responsible, Ingking wanted to help the defense of the very person who shot me by offering him a lawyer," Dumaluan said.
On their second meeting at Camp Dagohoy, Macalandag allegedly asked Dumaluan to see a priest which was the reason the latter returned the next day together with Fr. Lemuel Cañizares and Fr. Jojo Lagoros.
However, as the three of them entered the camp's gate, they were informed by the guards that Dumaluan could no longer visit Macalandag upon orders of the provincial commander.
"Again, I was shocked and surprised that Ingking would prevent me from seeing Macalandag when I was allowed to do so in my prior visits, besides this particular visit was upon request of the detainee," Dumaluan pointed out.
Dumaluan asked the Napolcom to dismiss Ingking from service as he also challenged the provincial police director to voluntarily resign from his post.
