Retired Navy and American National Held in Illegal Detention for 12 Hours
“He was kicking me and shortly after forced me with a knife until he had me locked onto our metal bar enclosed porch terrace where I stayed for 12 hours overnight from 8:O’clock PM until 8; O’clock AM the following morning until the police had been summoned to assist and get me out from feeling like what was similar to being inside of a cage.†Joe explained his ordeal as much as he could and said “I feel so violated, embarrassed and humiliated coming to a place that harps itself as a peaceful place to come and to live and visit and then to have this happen really tends for me to want to think twice that maybe I am better off to fly back home to America!â€
In a special interview with the victim Joe Banys 50 years old and retired U.S. A. Navy man of 20 years, from the state of Illinois who is married with a native of Mabini Bohol. Joe started off discussing his ordeal right away what had taken place last Feb 28th, and said in no way that he want anyone to think he hates the Philippines after what has happened to him because he said he really loves the Philippines as he had been staying here during his days in the Navy.
After being held in illegal detention and also known by another phrase as unlawful detention which are considered a grave act of holding someone without having any good purposes or without any lawful purpose for that long of amount of time that Joe had been in or for any amount time is considered as part of an international law with having to deal with any persons who interfere or threaten the human rights of other persons.
Joe and his wife along with her offspring and also living with what Joe refers to as a very unwanted relative Ivan of his wife were renting and residing at a residence on Calceta St. located four houses past provincials Governor Erico Aumentado residence in where the 12 hour event occurred.
During a separate interview with Tagbilaran City’s PO3 Mario Judelito J. Torrejos and Joe last Friday PO3 along with this writer of Bohol standard were able to convince Joe to go ahead with plans on filing for charges on the next following Monday morning with Tagbilaran City Police station in were PO3 Torrejos said that he would be the one to help and assist with Joe’s filing.
PO3 Torrejos explained further with Joe that Ivan is in absolute no legal authority to have any hold on him.
PO3 said in his observation stated that he sees Ivan as the root of Joe’s problems that have included threatening, harassing, and can see that it is causing an emotional drain on Joe.
Joe stated that it is not the first time that Ivan has threatened him with a knife it had been about the third time.
Several times Joe has asked Ivan to leave the residences that they have lived in together. But according to Joe he cannot shake him off that easily. When Joe was first locked inside the place he described earlier as Cage like, he remembers the people across the street were laughing while he was shouting for help and they did not get help for Joe.
Joe had seen a passer by early the following morning and motioning by sign language that the passerby will get a hold of the police. And by 8; 10’am four members of the Tagbilaran City police had arrived to order Ivan to immediately release Joe from his caged in ordeal in where he was closely being watched by Ivan who had held a knife on him all night.
Joe was without food and water for long lengths at a time until allowed one time to use the restroom and get one glass of water.
Ivan had been playing the music so loud that it was hard for Joe to get the attention of someone to help him right away.
Joe has since moved out of the residence on Calceta St. and rented a room somewhere in Barangay Cogon and that his wife had moved out to an unknown place with his passport, furniture and other personal belongings.
Late last night Joe’s wife had shown up at the police station where the two had argued for some time about things going on and Joe’s wife reported that ‘Ivan had also stolen around 10.000.00 in pesos from the bedroom of Joe and she had told Joe to keep his room locked up and also told Joe that he was just too trusting to never lock his door.
Joe was able to update his reports in the police blotter before leaving the police station last Friday night, and the final words he told his wife while leaving “I came here to Bohol to relax and rest in peace and silence not that I want all your relatives always coming over to the point that I cannot be comfortable.â€
