Oil giant BP is to put $20bn (£13.5bn) in a compensation fund for victims of the Gulf oil spill and will not pay shareholders a dividend this year.

Barack Obama announced the compensation deal after talks at the White House with senior BP executives.

Shortly afterwards, BP chairman Carl-Henric Svanberg said dividends would not be paid for the rest of this year.

The payout fund is to be run by Kenneth Feinberg, a lawyer who oversaw compensation after the 9/11 attacks.

In his current role as Mr Obama's "pay tsar", Mr Feinberg sets salary limits for executives at firms in receipt of federal bailout funds. - BBC

This time, Kobe Bryant(notes)  got plenty of help from his teammates.

He and his fellow starters built a double-digit lead in the first quarter and the reserves expanded it from there in an 89-67 victory over the Boston Celtics on Tuesday night, tying the NBA finals at three games apiece.

The decisive Game 7 is Thursday night at Staples Center. History might be on the Lakers’ side considering they haven’t lost consecutive home playoff games since 2000.

Scribbled on the greaseboard in the Lakers’ postgame locker room was “1 to the ring.”

After being hopelessly outplayed in losing Game 5 at Boston, the Lakers’ reserves responded in a big way to save their season. They outscored the Celtics’ bench 25-13, led by Sasha Vujacic(notes)  with nine points and Lamar Odom(notes)  with eight points and 10 rebounds, including nine on the defensive boards.

“We were just as a unit unbeatable no matter who was on the floor,” Vujacic said. “We are going into Game 7 very confident.”

Los Angeles coach Phil Jackson had said before the game that his bench had to prove itself, and he noted the reserves play better at home than on the road.

Jackson was right.

Health and Food / Vitamin B Prevents Lung Cancer
June 16, 2010, 05:13:07 PM
By Michelle Roberts
Health reporter, BBC News

People with plenty of a B-vitamin in their blood appear to be at a reduced risk of lung cancer, even if they smoke, a European study suggests.

High levels of Vitamin B6 and the amino acid methionine cut the risk by half, a study of 400,000 people suggested.

These occur naturally in nuts, fish and meat or can be taken as supplements.

But experts told the Journal of the American Medical Association that stopping smoking remained the best way of reducing lung cancer risk.

And, as yet, it is too early to say that taking vitamins would provide any extra protection, they say.

Higher vitamin levels could simply reflect healthier lifestyles.

More studies are needed before scientists can be confident that increasing levels of B-vitamins in the diet can reduce the risk of lung cancer, and also to understand why this might be, says the World Cancer Research Fund (WCRF) which was involved in the research.

Game Result: Lakers vs Celtics Game 6
By LA Times

The Lakers were faced with a must-win situation in Game 6 of the NBA Finals at Staples Center on Tuesday night, and they did that and more to even their best-of-seven series and three games apiece.

Behind a dominating effort from all corners, the Lakers routed the Celtics, 89-67, controlling the pace of the game, ruling the boards and completely shutting down the Celtics' bench to set up a deciding Game 7 on Thursday night.

Kobe Bryant led the Lakers with 26 points, Pau Gasol added 17 and Ron Artest scored 15, and the Lakers got substantial contributions from reserves Lamar Odom, Shannon Brown, and Sasha Vujacic when it mattered.

The fourth quarter was played only as a formality, with the Lakers leading by 25 after three periods.

After three quarters, the Lakers bench had outscored Boston's, 24-0, an emphatic answer to questions about the Lakers depth that were raised while the Celtics won two of three games in Boston to take the series lead.

The Lakers, who struggled inside during the last two games at Boston, dominated inside in Game 6, outrebounding the Celtics, 52-39. Gasol had 13 rebounds and Bryant 11. No Celtic approached double figures in rebounding.

The Celtics, who held a 3-games-to-2 lead coming back to Staples, are 11-0 in the NBA Finals after holding that lead. Thursday will find out whether they go to 11-1 or 12-0.

This will be the first NBA Finals to be decided in a seventh game since the 2005 Finals, won by the San Antonio Spurs over the Detroit Pistons.

Na-demoralized na ang Boston, Bid. Let's see what they can do in Game 7. I think Boston could not endure the feisty Lakers crowd on Friday morning.

This team's back is against the wall. The Lakers don't have another loss to spare if they want to win a championship and they have quite the task set out before them.

Two wins in two games against a team that has won three of five against them over the last two weeks, a team that beat them in the 2008 NBA Finals and a squad that more or less played them to a hilt during the regular season.

If any team could pull off a Finals win down 3-2, it's these Lakers. But paper don't play, and the defending champs still have to execute and follow through if they want to win their latest ring.

With that in mind, here are five ways the Lakers can both extend their season Tuesday night and pull off the clincher on Thursday.

1. Start defending

As is usually the case, if it weren't for all those unforced turnovers, the Celtics would be a fantastic offensive team. And even with those unforced turnovers in this series, the C's have been pretty darn good.

A whole lot of the credit for Boston's sound offensive play has to go toward the Lakers, who just aren't defending the way they did during the regular season. The Celtics have put up 112, 111 and 109.5 points per 100 possessions in their wins, numbers well above the 103.7 points per 100 possessions the Lakers gave up in the regular season and the 107.7 per 100 the C's averaged.

In those wins, the Celtics have compiled 43 turnovers, many of them unforced. Take away those miscues and the carnage for L.A. could be worse.

Los Angeles' paint defense has just become too susceptible, and though Andrew Bynum's(notes) injuries are the biggest reason (taken as a whole â€" with help defense, shot-blocking and rebounding tossed in â€" he is Los Angeles' best defender, not Ron Artest(notes)) behind the swoon, the Lakers can still do better. Artest, and this team's guards, are going to have to help more in the paint, taking charges and lopping off good sightlines.

The Laker D was a pleasant surprise during the regular season, but it is one loss away from doing this team in.

2. Determine their offensive scheme

Seems like a bit of a laugh, no? Haven't these guys run the triangle offense for years?

Well, not as much this season. And in the face of a Boston defense that limits ball movement and basically scares you out of trusting teammates or your own passing abilities, the Lakers have retreated and run more two-man game than triangle. And running a two-man game against a defense featuring Kevin Garnett(notes)? You're just asking for it.

The Lakers either need to commit to a free-wheeling five-man offense that develops rhythm early, sustains it when the going gets tough and cashes in on all that spacing and turned heads later in the game. Or they need to start executing more frequently with the two-man game. Because while a hybrid of both styles could work occasionally, Los Angeles just hasn't shown the patience thus far to pull off a combination of the two.

Of course, with their backs against the wall and two potential games at home to work through, this would seem as good a time as any to develop that patience.

If not, though, the Lakers have to go one of two ways. And if they go the first way, running the triangle and looking to make people besides Kobe Bryant(notes) dangerous, then...

3. Paul Gasol(notes) has to step up.

Not literally. Though Kevin Garnett had five steals in Game 5, only one came as he wormed his way around Gasol and poked the ball free on an entry pass, and that was off a bad pass from Luke Walton(notes) as Gasol was rolling into post position, not once he'd established it. But beyond that, as distasteful though you might find it that Gasol is getting his tail handed to him by Garnett, the fact remains that the Lakers have been frustratingly impatient with the way they've used their 7-foot All-Star.

Bryant gave him one chance â€" one chance! â€" in the opening possession of the third quarter in the loss on Sunday before launching into his dominant stretch. Gasol missed a lay-in after blowing past Garnett, the shot was blocked by Kendrick Perkins(notes) and this gave Bryant all the reason he needed to not let his teammates see the ball again for the next quarter.

If Gasol is going to be out there, and you're going to be on a team featuring a crummy bench, Derek Fisher(notes), a talented guy like Lamar Odom(notes), a great finisher despite his injuries in Andrew Bynum and an offensive zero in Ron Artest, then you need to find a way to make offensive threats out of what little this lot provides. And the Lakers' offense, when run properly, has proven it can do that.

It has yet to prove that it can score and eventually win consistently by eschewing the ball movement and going to a Kobe-centric attack. But if it tries that way again, well...

4. Kobe has to drop at least 40 points.

At least.

If he's going to be the man, ignore the cutters and the offense and what got them there, then he can't top out at 38 points, as was the case in Game 5.

That 19-point third quarter? If he's going to pull that off and take the Lakers out of their offense as a result? Then he needs to duplicate it in the fourth quarter.

He can't be a martyr again, pointing to "the way he kept his team in it" in the third quarter as things fall apart in the fourth. Spare me. He, more than anyone else in this league, understands the risks inherent in dominating the ball that early in a game and taking the Lakers out of their structure. And if he's going to work that way, he's going to have to work it until the end.

And not shoot 2 for 6 in the fourth quarter, as we saw on Sunday. Supposedly this game's best closer, Bryant has shot 9 for 33 in the fourth quarter in this series, a dreadful 27 percent, needing 6.6 shots to score 7.4 points per quarter (aided by free throws and 3-pointers).

This cannot sustain. If it's going to be a one-man show, it has to be a one-man show until the end. And if anyone can pull that off, it's Bryant, especially with just two potential games to go. He has the talent, the smarts and the competitive fire to pull it off. It's not the smartest nor easiest turn to lean into, but if this season is any indication, it will be what the Lakers will do down the stretch.

And if that is the case, 9 for 33 can't continue.

Finally, if Los Angeles is to extend the season Tuesday night...

5. Somebody else has to show up.

Where would the Lakers be had Derek Fisher not gone off in the fourth quarter of Game 3? Or if Ron Artest hadn't appeared somewhat passable on offense in Game 1? Or if Lamar Odom hadn't hit 5 for 5 shots and killed a Celtics run by his lonesome with an offensive rebound and putback in Game 3?

Some other Laker has to come through. It doesn't have to be a white-hot performance, but somebody needs to kill a run with a big shot or stop. Someone needs to take two charges in a quarter. Someone needs to put Boston in the penalty. Somebody needs to find their way toward taking and making open 3-pointers in transition or make the extra pass in a momentum-swinging possession. I just realized that Lamar Odom can do all of these things, but that's beside the point.

It doesn't have to be a clear, Sixth Man of the Year-winning performance. It just has to be a couple of sound four-minute spurts from people who just haven't been contributing all that effectively in this series. Teams win games in this league by winning stretches, by owning a four-minute turn here or a seven-minute series there with some superstar on the bench with three fouls or the other team's starting point guard out there with four bench players.

And unless Los Angeles starts winning or at least matching these little battles, then the Lakers could see it all end Tuesday night.

Maicon and Elano scored second-half goals as Brazil broke through a solid North Korean defense to win its opening World Cup match 2-1 Tuesday.

Brazil escaped with a hard-fought victory in the Group G match after struggling to get past the defensive setup of the North Koreans, who are making their first World Cup appearance in 44 years and, at No. 105, arrived as the tournament’s lowest-ranked team.

“The opener is always harder,” Dunga said. “There is the anxiety, the players are more nervous than usual, trying to do too much. But we are satisfied.”

The doctor accused of giving Michael Jackson a lethal dose of anaesthetic will be allowed to work in California as he awaits trial, a court has ruled.

During a brief procedural hearing, a Los Angeles judge said he did not have the authority to ban Dr Conrad Murray.

Members of the popstar's family were inside court to hear the ruling.

Dr Murray, 57, denies involuntary manslaughter of Jackson, who died last June. A preliminary hearing has been scheduled for 23 August.

California's attorney general had asked the judge to suspend the cardiologist in the run-up to the trial. -bbc

“It was built for the use of the school children and residents of Pinayagan Norte, as well as for anyone for that matter. Aside from the library, the public elementary school students also enjoy the privilege of having a complete set of supplementary textbooks for each one of them,” nagkanayon ang e-mail ni Dr. Nath nga gipadala ning ubos ninyong alagad sa pamantalaan.

Health and Food / E.coli-tainted Lettuce in Arizona
June 15, 2010, 07:52:58 AM
A recall of E.coli-tainted lettuce expanded late Monday as another food company said it was recalling lettuce grown on an Arizona farm currently under investigation by the U.S. Food and Drug Administration as a potential source of the outbreak.

According to the Associated Press, California-based Andrew Smith Co., said it is recalling lettuce sold to Vaughan Foods of Moore, Okla., as well as a distributor in Massachusetts. Andrew Smith spokeswoman Amy Philpott told the AP that she would not identify the Massachusetts distributor because the lettuce in question is already past its expiration date.

In the meantime, the FDA is investigating the Yuma, Ariz.-based farm as a potential source of contaminated lettuce that has so far sickened 19 people nationwide. Possible E. coli contamination has already prompted the recall of Freshway Foods' romaine lettuce, which is sold in 23 states and the District of Columbia, the FDA said last week.

By Judy Flores, PNA: Negros Oriental 2nd District Rep. George Arnaiz is fully supporting the implementation of the country’s law on the use of crash helmets by motorcycle riders amid apprehensions raised by some sectors, especially in Dumaguete City, on the practicality of the law.

Arnaiz said that it is imperative that motorcycle riders wear protective head gear as this could save their lives.

He cited as an example his son-in-law, who is still in a comatose stage following a road accident a few months back in Dumaguete.

According to Arnaiz, his son-in-law was usually conscientious in wearing a crash helmet when driving his motorcycle, but on the day of the accident, for some reason, he was not wearing one.

Arnaiz, a passionate rider who sometimes goes on countryside visits on board his trail bike, said he understands the sentiments of many people here who need to invest in crash helmets, but “we are talking about saving lives here,” he said.

Records show that most of the road accidents in the province involved motorcycles, Arnaiz pointed out.

He also noted the absence of implementing guidelines on the new law on helmet use that was passed sometime last March but even without these, authorities can actually enforce a previous similar law on crash helmets if they wanted to.

Hello Everyone,

I realize that many of those who come to this site are looking for lost relatives in Bohol whom they haven't seen for decades. I've been receiving text messages and emails asking me if I could help them find their lost relatives in Bohol. Of course I can't extend help to all. Though I've extended assistance to some who requested my help but I am not a superman - I'm still a student. Tracing family names in various towns requires time, money, and effort. But the Internet, through TubagBohol.com, can help anyone reconnect lost friends and relatives.

In this light, I had set up a Bohol Ancestry section here in TubagBohol. Please Follow Here.

This board/section is intended for exclusive discussion of Boholano clans/lineage/descendants. For example, if your family name is Makabudbud, you can just start a new topic/thread ("All the Makabudbud in Bohol") and you list all the Makabudbuds that you know of in the world. Who knows one of the lost, unknown Makabudbuds living outside Bohol would find your thread here in TubagBohol and see a familiar name posted in your thread. So that's how we could start to regroup the lost dots and lines of our Bol-anon DNA. :)

Please avoid discussing unrelated things other than the people related to that family name. If you have other things to say, just go to General Topic and start a new topic there, or better yet, send a PM to the person concerned. We may be forced to delete a post that talks about weather and movies when it should have talked about lost relatives in Bohol.

We just want to make the Bohol Ancestry Section clean and neat and focused and organized where people can really trace their lost relatives and friends by just following a topic/thread.

So, start now a new thread for your own Bol-anon Clan, and let's see how many lost dots and lines we may be able to reconnect.

Thank you,
Michael Ligalig

Carmen Councilor-elect Ramonito A. Torrefranca, is getting an edge to get elected as the next president of the Philippine Councilors' League (PCL) - Bohol chapter.

Torrefranca who is the outgoing vice mayor of Carmen town reportedly received the endorsement of outgoing PCL-Bohol president Kagawad Brigido Imboy who got elected as board member during the last election.

Earlier reports surfaced that Imboy shifted his earlier commitment of support to Torrefranca instead to City kagawad Edi Borja who is the incumbent PCL-Bohol chapter vice president.
The election of PCL is set either in July or September.

Torrefranca, who had served as councilor of Carmen before his vice-mayoral stint, eyes a retraining of all the elected councilors on the legislative matters and secure more benefits for them if he becomes PCL-Bohol chapter president.

Whoever will be elected president of the PCL-Bohol chapter will sit as ex-officio member of the Provincial Board.

Meanwhile, the president of the Liga ng mga Barangay (LnB) provincial federation will also be elected in July.

The post will be vacated since its current president, Board Member Concepcion Lim who is the provincial ABC president, will assume as the next vice governor of the province.

The executive vice president, Romulo Cepedoza from the town of Danao will likewise be out of the roll of councilors after he was elected as Provincial Board member of the second district, during the May 10 polls.

Three names surfaced as probable bets for the LnB presidency, namely: Crispina Vergara of Mabini, Efren Tanjay of Ubay and Faro Cabalit of Tagbilaran City.

Whoever gets elected as LnB president will likewise sit as ex-officio member of the Sangguniang Panlalawigan representing the barangay captains. - source: Bohol Chronicle

Molina and committee member Board Member Amalia R. Tirol and his staff conducted an ocular inspection in this booming seaport being utilized by Lite Shipping company and other vessels to inter island ferry service.

Molina’s committee is tasked to make recommendation to the delineation of the proposed project in this area based on the Provincial Development Council Resolution No. 05-2010.

Molina and Tirol saw for themselves the almost-completed development or expansion of the concrete port of Catagbacan, which is about 30 meters deep. Both conferred with the Loon municipal officials as to the supporting documents for the port zone.

Finding the area conducive to  big cruise ships that may be calling port, Molina said he would favorably endorsed for  approval by the Sangguiang Panlalawigan.

PDC wanted the port zone defined and drawn based on the proposal. The  proposal referred to the Committee on Zoning “covers a total area of 378,444.58 square meters and a land area of 3,050 square meters,” the PDC Resolution said.

The PDC resolution cited as ground for the port zone demarcation is that the improvement of ports for national economic progress and “there are available funds therefore appropriated by the Philippine Ports Authority,” is one of the basic programs of President Gloria Macapagal Arroyo.

“Said port zone is ideal for big commercial vessels, and may substantially contribute to the increase of the income of the municipality of Loon, Bohol,” said the PDC resolution.

Bohol Latest News / Panglao Island Master Plan
June 13, 2010, 09:22:57 AM
By PIA Bohol

Striking a balance between people, planning for the environment and profits is what the Panglao Master plan can boast of, says architect Felino Palafox Jr during a radio interview here within the week.

Palafox and Associates were commissioned to craft the Panglao Island Masterplan in efforts to bridle the unplanned development that might ultimately destroy the island that has the potential to become a world-class tourist destination.

During an interview before the master plan presentation in Panglao, Palafox Jr assured that the Pangao Master Plan takes the best practices in the world and takes a balance among the three factors unlike other areas where profit is the only consideration.

Citing that the Pangalo Airport was a given in the plan, Palafox said their planners also considered the critical environment of the island given its variety of marine resources and dive spots and heritage spots in its plan.

As to the general description of the plan, Palafox, during the radio interview revealed that the plan was to give snapshots of the future for the stakeholders to plan around.

Panglao masterplan is about doing a multi-centered development corridor in the center of the island, Palafox said.

And to balance development, the main architect of the globally renowned Palafox and Associates put up a tree-trunk analogy and its road networks branching off to the resorts.

He also revealed that the plan includes a narrow circumferential road belting the island, conscious also that traffic noise can impact on the tourism industry.

Citing Boracay, Palafox said for Panglao, they made sure its not a doughnut type of development where only the outer sides are built-up areas while the center is empty.

Much to the development also is around the soon to be constructed airport, he added.

The airport has more of its benefits than disadvantages, Palafox said, apparently dousing cold water anew to the locals who still are steadfast in their stand to oppose the air facility which can spur more tourism activity in the island.

Corporal Desmond Doss was the first conscientious objector to earn the Congressional Medal of Honor, the United States’ highest military award. A devout follower of Christ, Doss believed that it was not right for him to kill others, but he wanted to serve his country so he volunteered as a medic. During boot camp, his fellow soldiers ridiculed him for refusing to fire a rifle. They mocked him when he read his Bible and knelt beside his bunk at night to pray. But in combat, it was a different story.

During the World War II battle for Okinawa in May 1945, Doss repeatedly risked his life to rescue scores of wounded men. Through his unselfish actions, he earned the gratitude and respect of his former critics and of those whose lives he saved.

In the face of unjust criticism, Peter told his fellow Christians, “Even if you should suffer for righteousness’ sake, you are blessed. ‘And do not be afraid of their threats, nor be troubled’ ” (1 Peter 3:14). He urged them to honor God in their hearts and be ready to give a respectful reply to anyone who asked about the hope within them (v.15).

May our response to a hurting world that’s often hostile to Christ be one that demonstrates God’s love.

We’re told to love the enemies
That in this life we face,
For showing love that’s not deserved
Reveals to them God’s grace. â€"Bosch

To return good for good is human; to return good for evil is divine.

One of the great privileges of serving at Moody Bible Institute was hearing about graduates who had impacted the world for Christ. Their stories of sacrifice, perseverance, and passion for the gospel were inspiring.

In the late 19th century, Mary McLeod Bethune spent 2 years studying at Moody in Chicago, training to become a missionary in Africa. But after she graduated, no mission board would give her the opportunity, as an African-American woman, to serve on the mission field. Unable to fulfill her dream to go to Africa, she didn’t give up on her calling to serve Jesus. Undaunted, she started a small school for African-American girls in Florida that would eventually blossom into Bethune-Cookman College. She became a powerful force for change in the status of women.

Mary’s legacy was forged by her determination to serve Jesus even in the face of shattered dreams. She knew that God had entrusted to her “the ministry of reconciliation” (2 Cor. 5:18)â€"and she wouldn’t give up.

That wasn’t just a mandate for Mary McLeod Bethune. Telling people they can be reconciled to God through Christ is a calling given to all of us. Look for a way to make a difference for Jesus todayâ€"right where you are!

Wherever You have placed us, Lord,
Give us the courage to proclaim
To people who are lost in sin:
“You can be new in Jesus’ name.” â€"Sper

One of the qualities God looks for in His people is a heart that is willing to serve Him.

Putting up palliative but sustainable solution to inefficient community garbage disposal, environment authorities here call on concerned individuals to join hands and plant mangroves.

Coming in as a major part in the activities drafted by the Department of Environment and Natural Resources (DENR) for the month-long observance of the Environment Month in June, mangrove planting teams from the DENR Penro and Cenro offices get to Tagbilaran, Dauis, Panglao on June 10 and in Clarin town on June 21 to do their share of mitigating the effects of humanity to the environment.

Aside from mangroves stopping soil erosion and spawning areas for a myriad of marine resources, mangrove ecosystems is also an efficient sieve that screens of garbage and stop them from going out to pollute our seas, explains PENRO Canda, who is also an excellent forester.

Mangroves also protect coastal communities from erosion, storm surges and even tsunamis as the mangrove root system is excellent in dissipating wave energy, according to wikepedia.

Mangroves also slow down tidal water enough that its sediment is deposited as the tide comes in, leaving all except fine particles when the tide ebbs, building their own environment, it continued.

Moreover, the environment formed by the intricate mesh of mangrove roots offer the perfect quiet marine regions for young organisms including oysters barnacles, sponges while lobsters, crayfish and shrimps use the muddy bottom as their homes.

Mud crabs and crayfish that live on the mangrove areas help mulch fallen leaves making perfect food for tiny organisms and newly hatched fish which use the shades and the intricate roots as their refuge against natural predators.

Mangroves still stand as the biggest and most productive source of food for coastal communities but the mangrove studies in the past decade bare that some estimated 150,000 hectares (370,050 acres) per year or about 1% per annum mangrove forests are lost top destruction, according to the United Nations Food and Agriculture Organization (FAO).

The loss of a single hectare of mangroves is estimated to cost local communities between 200 and 900 thousand US dollars in lost revenues, due to the importance of these plants as an input in local products and services, says a website article from earthtrends.wri.org.

Over the economic and environmental benefits of mangrove reforestation, DENR urges everyone to join them on the project set on June 10.

John Ruiz III, Bayan Muna-Bohol coordinator, thanked Boholanos for their electoral support for progressive party list groups and senatorial candidates Satur Ocampo and Liza Masa who ran under the Nacionalista Party.

Proclaimed winners by Comelec recently were the following activist party list groups: Gabriela (two representatives), Bayan Muna (two) and Anakpawis, Kabataan and ACT Teachers with one representative in Congress each.

Bohol gave these groups the following mandate: Bayan Muna (11,613) ranked No. 10, Gabriela (11,353) ranked No. 12, ACT Teachers (9,660) ranked No 15, Anakpawis (6,333) ranked No. 16 and Kabataan (6,133) ranked No. 17. Liza Masa got 45,605 votes while Satur Ocampo garnered 39,856 votes.

John Ruiz in his failed bid to be council man of Trinidad town was still thankful for the 2,268 voters who "believed in my platform and principled politics for change", indicating that there is a considerable segment of the voting populace who do not believe in "traditional politics and their ways."

The Makabayan Coalition in Bohol considered the results of the Bohol voter support as a "victory" since this was achieved in the midst of "political harassment, intimidation and violence and acts preventing the group from effectively campaigning."

Calape - Bohol / Calape Election Protest Thrown Out
June 13, 2010, 08:20:05 AM
By Bohol Chronicle

The electoral protest on the election results in Calape town was dismissed by the Regional Trial Court, Branch 48.

It was the first among the many cases decided upon by the court pertaining to the 2010 electoral protest.
The case filed by Ma. Aileen D. Veloso, who landed 9th in the May 10 election, was junked by the court after she failed to place a filing fee worth P3,000.

Veloso, the protestor garnered 6,789 votes while protestee Gaudencio G. Marapao, who landed in the 8th spot, garnered 6,795 votes.

Both ran for the 8-seat Sangguniang Bayan in Calape town among 18 aspirants.

Protestee Marapao, thru his counsel Atty. Lord R. Marapao IV, pointed out in the counterclaims that the election protest was insufficient in form and content and prayed for the dismissal of the case and claimed for moral and exemplary damages and attorney's fee.

According to RTC Judge Pablo R. Magdoza, the electoral protest filed by Veloso "requires the revision or examination of ballots, or the verification or re-tabulation of election returns, or may require bringing copies of other election documents and paraphernalia to court…the protestant shall make a cash deposit with the court, in addition to the filing fee of P3,000".

Police remains clueless in barangay captain slay.

Police remains clueless on the murder of the barangay captain in Cadapdapan in the town of Candijay, who was strafed to death with M16 at his residence in the last days of the gun ban.

This only proved that the gun ban, which ends today, had been loose even to the bulky high-powered firearms.

Cadapdapan barangay captain Ricardo Perocho was watching TV with his children at around 7:30 Saturday evening when the gun men attacked him.

Perocho is the first casualty after the May 10 elections. There were more when election was approaching, even at the height of gun ban.

Candijay Police Inspector Alfredo Kuhay and the Scene of the Crime operatives (SOCO) still await the results of the tests currently conducted by the PNP Crime Laboratory at Camp Dagohoy.

Police refused to give a hint on the possible motive of the incident.

His son, Charlie, immediately took his younger sister to a safe place upon the first burst of gunfire.

After the rapid burst of gunshots, the children found their father already dead at the living room.

Dark days in the neighboring provinces seemed to have spilled over to Bohol, finally, as the brownouts had grown more frequent and longer during the last 36 hours.

The latest lasted for over an hour late afternoon yesterday, the second longest to the May 19 brownout which lasted almost four hours.

Tagbilaran City experienced three brownouts yesterday- -one in the morning, one after lunch and in the late afternoon.

The spokesperson of Bohol Light Company, Inc. even said their consumers must be thankful that the situation here is not as worst in the neighboring provinces where the everyday brownouts would last four to six hours.

The brownouts caused delays in several tasks that rely on power supply like those that involve computers and appliances in the offices and residences.

This came after the assurance of President Arroyo in February that by March after the inauguration of Cebu Energy Development Corporation (CEDC), the neighboring province of Cebu would have stable power supply with additional 250-megawatts.

The Mindanao areas have also been experiencing daily brownouts of four to six hours.
Brown outs started hitting Bohol when the election was approaching but by a matter of minutes only, with an hour being the longest then.

The situation has been observed to have worsened with the brownouts getting longer and more frequent.

It has become daily here.

Power shortage has been blamed on the insufficient reserves in the Visayas grid and the aging power plants. The hydro electric plants are also affected due to low water level following the absence of rains during the past months.

Gov. Erico Aumentado, for his part, has negotiated with the TRANSCO- -now National Grid Corp. of the Philippines, for the implementation of Bohol Backbone Transmission Project costing about P1.6 billion.

The outgoing governor said it could "enhance Bohol's power distribution from 69 kilovolts to 138 KV with high tension overhead steel towers from the Leyte-Bohol Interconnection Project-Ubay substation to the new station in Corella.

Showbiz & Celebrity / The Karate Kid Deception
June 12, 2010, 04:49:45 PM
by Mike Krumboltz
Yahoo Buzz

Reasonable audiences could assume that a movie called "The Karate Kid" would be about a kid who, well, does karate. But, in the case of the newly released feature starring Jaden Smith  and Jackie Chan, that assumption is only half right.

The truth is that Mr. Smith's character (aka "the kid") does not practice karate, but the art of kung fu. This inconvenient truth was picked up on in various reviews and blogs. Misleading? Maybe. But nobody seems too surprised that the forces behind the remake elected to stick with the well-known title rather than practice a little truth in advertising. Why mess with a successful franchise?

Web searchers were quick to pick up on the minor controversy, sending online lookups for "kung fu vs. karate" and "difference between kung fu and karate" to significant gains.

USA and Canada / The Lost Abby Sunderland
June 12, 2010, 03:43:36 PM
BBC News: A 16-year-old US sailor who went missing while sailing solo around the world has been found safe and well.

Abby Sunderland's yacht was spotted by an aerial search team in the southern Indian Ocean, midway between Australia and Africa.

Three ships are on their way to pick her up - the first is expected to be with her in 24 hours.

The teenager's family lost contact with her for some 20 hours, after she said she was caught in 30ft (9m) high waves.

Shortly after contact was lost, at about 1300 GMT on Thursday, the yacht's emergency beacons were manually activated, more than 3,220km (2,000 miles) from the coasts of both Africa and Australia.

A Qantas Airbus A330 search plane - scrambled from Perth early on Friday - spotted the teenager's boat, called Wild Eyes, and made contact with her.

Search co-ordinator Mick Kinley, of Australia's Maritime Safety Authority, said the boat's mast was broken but the keel was intact, and the young sailor "sounds like she's in good health".

One of the country’s most wanted fugitives was flown back to Manila on Saturday, four days after he was arrested in Bangkok, Thailand, for violation of immigration laws in that country.

Escorted by Philippine authorities, Jose Ma. Panlilio arrived at the Ninoy Aquino International Airport in Pasay City around 6 a.m. aboard a Cebu Pacific flight from Bangkok, according to Chief Supt. Leonardo Espina, Philippine National Police spokesman.

Agents of the Philippine Center for Transnational Crime led by Chief Insp. Edgardo Hernandez immediately brought Panlilio to the Philippine National Police Custodial Center at Camp Crame.

“He will be temporarily detained in Camp Crame pending proper disposition on the return of his warrant of arrest with the issuing court,” Espina said.

Panlilio, son of the late socialite jeweler Fe Panlilio, is the primary suspect in the murder of half-brothers Ariel Real and Albert Gutierrez on July 15, 2003.

“There was no reason for me to overturn (Gonzalez’s) decision since the host had no direct or indirect participation in the stampede. There is no proximate cause in his being the host of ‘Wowowee’ in the stampede that ensued in Ultra,” Agra told reporters .

BBC News - Arkansas floodwaters hit campsites and leave 16 dead

At least 16 people have died in the US state of Arkansas after floodwaters hit campsites in a mountainous national park, state governor Mike Beebe says.

Two dozen people were taken to hospital and some 30 others remained unaccounted for.

Helicopters are taking part in the search in a remote, mountainous area in the state's south-west.

The operation is focused on campsites along the Little Missouri and Caddo rivers in the Ouchita Mountains.

Mr Beebe said the deaths had occurred at about 0530, when the floodwaters reached their peak.

A river gauge at Langley, just south of Albert Pike in the Ouachita National Forest, showed the water rose 8ft (2.4m) in one hour, according to the US Geological Survey. - bbc

Philippine Laws / A Crime Of A Pinoy Seaman

Pinoy Bar Exam Review: Criminal Law

After drinking one (1) case of San Miguel beer and taking two plates of "pulutan", Binoy, a Filipino seaman, stabbed to death Sio My, a Singaporean seaman, aboard M/V "Princess of the Pacific", an overseas vessel which was sailing in the South China Sea. The vessel, although Panamanian registered, is owned by Lucio Sy, a rich Filipino businessman. When M/V "Princess of the Pacific" reached a Philippine Port at Cebu City, the Captain of the vessel turned over the assailant Binoy to the Philippine authorities. An information for homicide was filed against Binoy in the Regional Trial Court of Cebu City. He moved to quash the information for lack of jurisdiction.

Question: If you were the Judge, will you grant the motion?

Answer:

Yes, the Motion to Quash the Information should be granted. The Philippine court has no jurisdiction over the crime committed since it was committed on the high seas or outside of Philippine territory and on board a vessel not registered or licensed in the Philippines (US vs. Fowler, 1 Phil 614).

It is the registration of the vessel in accordance with the laws of the Philippines, not the citizenship of her owner, which makes it a Philippine ship. The vessel being registered in Panama, the laws of Panama govern while it is in the high seas.

Philippine Laws / Bigamy in the Philippines

Philippine Bar Exam Review

Abe, married to Liza, contracted another marriage with Connie in Singapore. Thereafter, Abe and Connie returned to the Philippines and lived as husband and wife in the hometown of Abe in Calamba, Laguna.

Question: Can Abe be prosecuted for bigamy?

SUGGESTED ANSWER:
1) No, Abe may not be prosecuted for bigamy since the bigamous marriage was contracted or solemnized in Singapore, hence such violation is not one of those where the Revised Penal Code, under Art. 2 thereof, may be applied extraterritorially. The general rule on territoriality of criminal law governs the situation.

Ate Thel, we cannot go beyond the facts presented as this is a bar exam question. We can only discuss the given situation here and exhaust all the possible legal answer to the question, setting aside some other possible circumstances that we think might have been part of the main issue.

Bar Exam Review: Criminal Law

BB and CC, both armed with knives, attacked FT. The victim's son, ST, upon seeing the attack, drew his gun but was prevented from shooting the attackers by AA, who grappled with him for possession of the gun. FT died from knife wounds. AA, BB and CC were charged with murder.

In his defense, AA invoked the justifying circumstance of avoidance of greater evil or injury, contending that by preventing ST from shooting BB and CC, he merely avoided a greater evil.

Question: Will AA's defense prosper? Reason briefly.

Answer:

No, AA's defense will not prosper because obviously there was a conspiracy among BB, CC and AA, such that the principle that when there is a conspiracy, the act of one is the act of all, shall govern. The act of ST, the victim's son, appears to be a legitimate defense of relatives; hence, justified as a defense of his father against the unlawful aggression by BB and CC. ST's act to defend his father's life, cannot be regarded as an evil inasmuch as it is, in the eyes of the law, a lawful act.

What AA did was to stop a lawful defense, not greater evil, to allow BB and CC achieve their criminal objective of stabbing FT.

Philippine Laws / The Conspiracy of A, B, C and D

Bar Exam Review: Conspiracy

A had a grudge against F. Deciding to kill F, A and his friends, B, C, and D, armed themselves with knives and proceeded to the house of F, taking a taxicab for the purpose. About 20 meters from their destination, the group alighted and after instructing E, the driver, to wait, traveled on foot to the house of F. B positioned himself at a distance as the group's lookout. C and D stood guard outside the house. Before A could enter the house, D left the scene without the knowledge of the others. A stealthily entered the house and stabbed F. F ran to the street but was blocked by C, forcing him to flee towards another direction. Immediately after A had stabbed F, A also stabbed G who was visiting F. Thereafter, A exiled from the house and, together with B and C, returned to the waiting taxicab and motored away. G died. F survived.

Question: Who are liable for the death of G and the physical injuries of F?

Answer:

A alone should be held liable for the death of G. The object of the conspiracy of A. B, C, and D was to kill F only. Since B, C, and D did not know of the stabbing of G by A, they cannot be held criminally therefor. E, the driver, cannot be also held liable for the death of G since the former was completely unaware of said killing.

For the physical injuries of F, A, B and C. should be held liable therefore. Even if it was only A who actually stabbed and caused physical injuries to G, B and C are nonetheless liable for conspiring with A and for contributing positive acts which led to the realization of a common criminal intent. B positioned himself as a lookout, while C blocked F's escape. D, however, although part of the conspiracy, cannot be held liable because he left the scene before A could enter the house where the stabbing occurred. Although he was earlier part of the conspiracy, he did not personally participate in the execution of the crime by acts which directly tended toward the same end (People vs. Tomoro, et al 44 Phil. 38).

In the same breath, E, the driver, cannot be also held liable for the infliction of physical injuries upon F because there is no showing that he had knowledge of the plan to kill F.
