SUV registered under Butuan bishop's name

MANILA, Philippines - A 2009 silver Mitsubishi Montero Sport parked at the bishop's palace in Butuan has been spotted by an ABS-CBN News team.

Based on the records of the Land Transportation Office, the vehicle was purchased in September 2009 and was registered under the name of Bishop Juan De Dios Pueblos.

The purchase was sealed 2 months after the Philippine Charity Sweepstakes Office (PCSO) released P1.7 million that was deposited in BPI Butuan.

Lawyer Alim Pangandaman, director of the Department of Transportation and Communications (DOTC) in the Caraga region, said his office verified the information.

However, pro-life groups and other lay leaders said there is nothing illegal about the PCSO donating luxury vehicles to bishops, even if these are registered under their names.

Lawyer Romulo Macalintal said the donations are made "in the service of the church."

A group is now collecting more than P8 million to be donated to the CBCP.

The amount is the cost of the 7 vehicles purchased through PCSO funds. They are leaving it up to the CBCP whether to use the money to pay the PCSO or buy replacement vehicles.

PCSO chairperson Margie Juico, meanwhile, cleared the bishops of any wrongdoing.

At a mass Tuesday at the PCSO, Juico said there was no malice in the bishops' request.

She also praised the CBCP for apologizing to the public.

Juico said they consider the church as a partner in public service.

For Retired Lingayen-Dagupan Archbishop Oscar Cruz, meanwhile, there is no excuse for the the actions of his colleagues.

"Kulang kasi sa delikadeza, sorry to say, mali ang mga kapatid kong mga obispo," he said. "Ang tubig pag may kaunting dumi, marumi pa rin."

Cruz considers the controversy a blessing in disguise, which agents of the church like him can reflect on.

The CBCP is leaving it up to the bishops concerned whether to return the vehicles.

Their decisions may be known during the continuation of the Senate hearing into the PCSO fund mess on Wednesday. - Report from Jing Castañeda, ABS-CBN News; ANC

In a joint press conference, Chen said the pair had "found a lot of common ground", but that there were still "different opinions on certain issues," and accused Washington of spending "so much money on the military."

"I know the US is still recovering from the financial crisis, it still has some difficulties in its economy... Isn't it placing too much pressure on taxpayers?"

Mullen, however, later said on Twitter: "Good discussions with my Chinese counterpart. Will not agree on everything but now is the time to focus on those things we CAN agree on."

Vietnam and the US are to hold joint naval activities this month, with the latter again saying they are long-planned and unconnected to recent tensions.

China, the Philippines, Vietnam, Brunei, Malaysia and Taiwan have overlapping claims to parts of the South China Sea, which is believed to have vast oil and gas deposits, while its shipping lanes are vital for global trade.

Vietnam and the Philippines have in recent months accused Beijing of taking increasingly aggressive actions in staking its claims.

In May, Vietnam said Chinese marine surveillance vessels cut the exploration cables of an oil survey ship inside Hanoi's exclusive economic zone.

And Philippine President Benigno Aquino has accused China of inciting at least seven recent incidents, including one in which a Chinese vessel allegedly opened fire on Filipino fishermen.

In response, China has insisted it wants to resolve disputes peacefully but remains firm in its claims to most of the South China Sea, even waters within the Philippines' economic exclusion zone.

Speaking to reporters after arriving in Beijing on Sunday, Mullen said Washington was concerned about freedom of navigation, but suggested that the disputes would be "resolved peacefully".

With ties sometimes fraught between the two militaries, he stressed that the US was in no way seeking to contain China's dramatic rise, but said it would remain active in the Asia Pacific region for a long time.

Chinese Vice Foreign Minister Fu Ying, speaking in Hong Kong on Monday, meanwhile, said "diplomatic wisdom" between China, the Philippines and Vietnam was needed to "make sure that our differences will be contained".

Mullen is also expected to address rising tensions with North Korea and measures to boost security cooperation between China and the United States during his four-day trip.

He held talks Monday with China's vice president Xi Jinping, who is widely expected to take over as president next year, and will visit military bases in the eastern provinces of Shandong and Jiangsu on Tuesday. -- http://news.yahoo.com/

China's top general criticises US exercises
By Allison Jackson | AFP â€" 4 hrs ago

China's top military officer said Monday the timing of US naval exercises in the South China Sea was "inappropriate," after talks with his American counterpart aimed at cooling the territorial dispute.

General Chen Bingde urged the United States to be "more modest and prudent in words and deeds", amid growing tensions over China's claims in the strategic and potentially resource-rich region.

He also criticised Washington over its military spending and accused the US of "placing too much pressure on taxpayers" in the wake of the global economic crisis, in unusually provocative remarks before a foreign visitor.

"On various occasions, the US side has expressed that it does not have the intention to intervene in the disputes in the South China Sea," Chen told reporters after meeting Admiral Mike Mullen in Beijing.

"However, we are observing the latest joint exercises between the US and other countries, for example the Philippines and Vietnam.

"We acknowledge that those exercises were there in the past, however the timing of these joint exercises is inappropriate as we see it."

The Philippines recently finished 11 days of naval drills with the US Navy close to the South China Sea, although both sides emphasised the event is held annually and aimed at deepening defence ties.

Mullen is the first chairman of the US Joint Chiefs of Staff to visit China since 2007 and his trip comes as military ties between the two powers are tested by Beijing's growing assertiveness in the South China Sea.

The far western Arizona town of Quartzsite was in a state of upheaval Monday after the town council ousted the mayor from power and declared a state of emergency, all over an online video that shows a woman being arrested.

Mayor Ed Foster told The Associated Press on Monday that the town council held a last-minute meeting that was closed to the public Sunday night, declaring a state of emergency in the 3,600-person town just east of the California city of Blythe.

The council's declaration put police Chief Jeff Gilbert in charge, making Foster the "deputy chief executive of nothing right now," he said. It also allows the five-member council to meet without public notice and suspend all public comment at the meetings until they declare the state of emergency over.

Hala, kuyawa gud ning balitaa...  :-\

Foster said the council declared the emergency because they claim they've received threats from members of the public who saw a video posted on YouTube.

The video shows a woman identified as Jennifer Jones being arrested and hauled away from a council meeting after she said the council was violating open-meetings laws. Jones was speaking during a public comment period, and Foster is heard on the video telling other council members who ordered her removed that "the lady has the floor."

"She's exercising her First Amendment rights," Foster says in the video before telling officers: "You are in violation of my rules of order."

The officers remove her, anyway, and in the process injure her elbow, which is now in a sling, Foster said.

The video has gotten nearly 30,000 views and has people from across the U.S. and world sending messages of support to Foster and messages of outrage to the council. Foster has a Facebook page of supporters and on it, people have posted messages that include, "Kudos from Mississippi. Keep the rats scurrying" and "You have Colorado's support!"

Foster said a woman from England sent him a note with just one line: "How could America be considered a beacon of democracy in the world when freedom of speech does not exist in Quartzsite, Ariz.?"

Foster was elected in May 2010 on a campaign promise to investigate corruption allegations in the town.

He said since being in office, he has discovered that every pay period, eight to 10 paychecks go to unnamed people and that he has been denied access to financial records to find out where the money goes at every turn.

He said that's been happening since 1991 and amounts to $250,000 every year. "That's literally millions of dollars," he said.

He said he's gone to Gov. Jan Brewer's office, the Attorney General's Office and the FBI with his allegations and pleas for an investigation, and that he's been ignored. He said he was contacting the FBI on Monday with information about Sunday's meeting declaring an emergency, which he said was illegal because it was closed to the public and in violation of open-meetings laws.

Spokespeople for Brewer's office, Attorney General Tom Horne's office and the FBI did not immediately respond to requests Monday about whether Foster has come to them for help.

Foster also said he has been targeted repeatedly by police Chief Gilbert, arrested or investigated for "bogus" reasons that weren't prosecuted and didn't prove any wrongdoing.

Most recently, he said Gilbert cited and released him on charges of disorderly conduct and interference six weeks ago when he tried to stop him from arresting Jones for the third time because she had sued the town for $2 million on allegations of police harassment.

"She called me and I went to the scene and I told the chief, 'What, are you crazy? Are you trying to give her and her attorney a field day in court?" he said. "And then he arrested me."

Foster said he also is the target of a recall election, in which 171 signatures were gathered, and that one of the town council members resigned from office to run against him in hopes of ousting him next month.

"I ran on a campaign promise to look into this money and I've been stymied, stifled and stopped at every turn," Foster said. "Every time you get into a political thing like this, it always goes back to money." -- http://news.yahoo.com/

'Emergency' declared in AZ town over allegations
By AMANDA LEE MYERS - Associated Press | AP â€" 13 mins ago

PHOENIX (AP) â€" The far western Arizona town of Quartzsite was in a state of upheaval Monday after the town council ousted the mayor from power and declared a state of emergency, all over an online video that shows a woman being arrested.

"I'm going to tell you frankly, this council is out of control," Foster said. "The chief has been out of control for some time and I've asked the state government to help a number of times," to no avail.

Foster described the government and Gilbert as corrupt and abusive of their power, and said all their recent actions are frantic efforts to cover up millions of dollars of money from lining some of their pockets.

Both Gilbert's and the town hall's phone numbers rang busy most of the day Monday, and all five council members and the town manager did not immediately return email requests for comment.

A man who answered the town hall's phone later Monday and did not identify himself said he would deliver a message to Town Manager Alex Taft but said council members were unavailable.

Vice Mayor Barbara Cowell told The Arizona Republic on Sunday that Foster's characterization of the council imposing "martial law" was inaccurate, saying that a recording of the meeting will be made available to the public Monday.

Cowell defended Quartzsite's leaders by saying the town is audited every year and that they're not corrupt.

"Our people work so hard," she said. "We've had to cut back on staff ... just to keep us solvent."

“It’s really heartbreaking to see these girls, 14, 15, 16 years of age working in this kind of job,” pulong ni Dr. Mercado

And if she sees Andres doing the same thing all over again? "Pag ginawa ng sheriff ulit yan, upakan mo ulit," Duterte told his daughter.

What if the situation was reversed and it was the vice-mayor who was punched during the demolition?

"Barilin kita. Bakit mo ako suntukin? Ako nga ang peacemaker para walang gulo e to prevent bloodshed tapos suntukin ako. I'll shoot you," he said.

The vice-mayor said his daughter is ready to accept the consequences of her actions including possible disbarment as a lawyer and even dismissal as a local official.

"She is not ready to apologize. She offers no excuses. No apologies, no nothing. So be it. All the yakkings of the mouth, millions of them...You want blood? We will give it to you. My daughter says she can live without the title of being a lawyer. She can win the elections next time around. So go ahead, they can do the worst. She is willing to receive the orders tomorrow," he said.

Duterte said that if ever his daughter is dismissed from service, she could always run again and win the next election. "Ang sabihin ko sa kanya, maghintay ka. Ilang buwan lang takbo ka ulit. Tapos ang storya," he said.

DAVAO CITY, Philippines - Davao City Vice-Mayor Rodrigo Duterte lashed out at his critics anew Thursday, saying the dirty finger he flashed in public last Monday was "freedom of expression."

In an interview with local media, Duterte "flipped the bird" anew.

"Ito naman si Etta, sabi violation of human rights mag-ganun ako (showing the dirty finger)," he said, referring to Commission on Human Rights (CHR) Chairperson Etta Rosales.

"It is a sign of anger, it is a sign of extreme disgust. It means galit ako sa iyo," Duterte said, blurting out expletives.

He said this was in response to reports that the CHR wants to have him sanctioned.

His son Paul, who is a city councilor and president of the city's league of barangays, also flashed a dirty finger in front of journalists when asked about his reactions to his father's stand on the issue.

The older Duterte earlier flashed a dirty finger and cussed at critics of his daughter Sara following her widely publicized punching of a trial court sheriff last Friday.

“Ano? Mga columnist? Oh! (shows dirty finger) ta#@n*a (expletive), hindi lang sampal ang inabot noon. (Expletive), you wage a battle against your own people using policemen?” he said.

Rosales, meanwhile, shrugged off Duterte's latest outburst.

"Nako-kornihan ako sa kanya at di ko siya papatulan. Marami pa kaming gagawin, walang magagawa kung mabulaklak talaga ang bunganga niya... bahala na taumbayan kung gusto nila ganun public official," she said. - Report from Francis Magbanua, ABS-CBN News Southern Mindanao

Disbarment case filed vs Duterte
By Ira Pedrasa, abs-cbnNEWS.com

MANILA, Philippines - A lawyer has asked the Supreme Court to disbar Davao City Mayor Sara Duterte for repeatedly punching a trial court sheriff during the demolition of  informal settlers’ shanties in the Agdao district last July 1.

A source said it was not sheriff Abe Andres, who was at the receiving end of the punches, who filed a petition before the Office of the Bar Confidant.

It was lawyer Fernando Perito, a crusader for lawyers’ ethics, who filed the petition.

Perito, a lifetime member of the Integrated Bar of the Philippines, had filed similar cases in the past. The last of these was the disbarment petition versus former Presidential Commission on Good Government Chairman Camilo Sabio for supposedly trying to influence the decision of his younger brother, former Court of Appeals Justice Jose Sabio Jr., in the case of Manila Electric Co. against the Government Service Insurance System in 2008.

Efforts to reach the Office of the Bar Confidant remain futile.

In a separate interview, SC spokesman and Court Administrator Jose Midas Marquez said, “I don’t have any information on that, but we have to remember that disbarment against lawyers are confidential in nature.”

Andres earlier said he does not have any plans of filing a case, including any criminal case, against Duterte. This does not preclude others from filing against her, however.

Duterte earlier said she got frustrated with Andres for refusing to grant her request for a 2-hour extension before pushing through with the demolition.

She remains adamant until now, and refuses to apologize to Andres, even at the risk of disbarment.

7 bishops to face Senate
SUV recipients ready to return vehicles to PCSO
By Chona Yu, Christian V. Esguerra, Philip C. Tubeza
Philippine Daily Inquirer, Radyo Inquirer

The seven Catholic bishops criticized for receiving donations of sport utility vehicles from the Philippine Charity Sweepstakes Office (PCSO) during the Arroyo administration will face senators investigating the controversy.

Butuan Bishop Juan de Dios Pueblos and his fellow prelates received summonses from the Senate last Thursday and decided to attend the inquiry and formally respond to accusations of wrongdoing.

“We will attend as a group,” Abra Bishop Leonardo Jaucian  told the Inquirer on Saturday.

The Senate blue ribbon committee opened last Tuesday a public inquiry into the donations approved by the PCSO board during the Arroyo administration. The hearings will resume this week.

Jaucian also said he had decided to return to the PCSO the Mitsubishi Strada pickup that his diocese had purchased using a P1.107-million donation from the agency two years ago.

Jaucian said that at its plenary assembly that began yesterday at the Pope Pius XII Catholic Center in Manila, the Catholic Bishops’ Conference of the Philippines (CBCP) decided to leave to him and the six other prelates the choice of whether to return the SUVs or not.

“The decision to return or not is given to individual bishops,” Jaucian said. “Everyone is willing to return the vehicles.”

Earlier, Pueblos and Cotabato Archbishop Orlando Quevedo indicated that they were ready to let go of the vehicles. They said the vehicles were being used for charity missions and related programs, and never for their personal service.

I am absolutely convinced that no wealth in the world can help humanity forward, even in the hands of the most devoted worker in this cause. The example of great and pure characters is the only thing that can produce fine ideas and noble deeds. Money only appeals to selfishness and always tempts its owners irresistibly to abuse it.  --Albert Einstein

Dueling Dogs?

Otto von Bismarck, enraged by Rudolf Virchow's constant criticism, one day ordered his seconds to arrange a duel. Virchow consented, with a small stipulation:

"As the challenged party, I have the choice of weapons," he explained, "and I choose these two large sausages... One," he continued, "is infected with deadly germs. The other is perfectly sound. Let His Excellency decide which he wishes to eat, and I shall eat the other."

[The chancellor, informed of the meeting, called the duel off with a burst of laughter.]
