IGLESIA ni Cristo would press charges against individuals behind a dubious INC letter endorsing the presidential candidacy of Davao City Mayor Rodrigo Duterte, the religious sect’s spokesperson said on Monday.

The letter, purportedly signed by INC executive minister Eduardo Manalo and marked with the INC logo, began circulating online a few hours after President Aquino made an unscheduled visit to Manalo.

INC spokesperson Edwil Zabala said the letter did not come from their executive minister. Inquirer.net sent Zabala a copy of the document.

“The moment we identify the person/s responsible for this fraudulent ‘letter’ containing the forged signature of Bro. Eduardo Manalo, we will charge them in court,” Zabala told Inquirer.net.

A member of Duterte’s camp forwarded to reporters a photo of the document, dated May 2, via instant messaging.

“Through this letter, I am announcing that our organization is endorsing Rodrigo Roa Duterte,” the letter quoted Manalo as saying in Filipino.

“We’ve seen that Rodrigo Duterte is  a good example, God-fearing  and a spring of hope for our countrymen,” it added.

Duterte, Vice President Jejomar Binay, Sen. Grace Poe and Sen. Miriam Defensor Santiago also met with INC officials in the hopes of clinching the endorsement of the group, whose voters are estimated to reach 1.7 million this year.

Zabala said INC members would be the first to know once the INC leadership announced its choices for the May 9 elections.

He said the announcement would  be “very near (election) day itself.”

1 The world is everything that is the case.

1.1 The world is the totality of facts, not of things.

1.11 The world is determined by the facts, and by these being all the facts.

1.12 For the totality of facts determines both what is the case, and also all that is not the case.

1.13 The facts in logical space are the world.

1.2 The world divides into facts.

1.21 Any one can either be the case or not be the case, and everything else remain the same.

Facts and Trivia / Kobayashi Maru
May 02, 2016, 03:33:22 PM
The Kobayashi Maru is a test in the fictional Star Trek universe.

It is a Starfleet training exercise designed to test the character of cadets in the command track at Starfleet Academy. The Kobayashi Maru test was first depicted in the opening scene of the film Star Trek II: The Wrath of Khan and also appears in the 2009 film Star Trek. Screenwriter Jack B. Sowards is credited with inventing the test, naming it after a friend whose last name was Kobayashi. The test is sometimes mentioned or depicted in ancillary Star Trek media, including novels and video games. The test's name is occasionally used among Star Trek fans or those familiar with the series to describe a no-win scenario, or a solution that involves redefining the problem and testing one's character.

The notional primary goal of the exercise is to rescue the civilian vessel Kobayashi Maru in a simulated battle with the Klingons. The disabled ship is located in the Klingon Neutral Zone, and any Starfleet ship entering the zone would cause an interstellar incident. The approaching cadet crew must decide whether to attempt rescue of the Kobayashi Maru crew â€" endangering their own ship and lives â€" or leave the Kobayashi Maru to certain destruction. If the cadet chooses to attempt rescue, the simulation is designed to guarantee that the ship is destroyed with the loss of all crew members. --Wiki

(BANAT NEWS)

Poems and Poets / Drunk As Drunk
May 01, 2016, 10:08:45 AM
by Pablo Neruda

Drunk as drunk on turpentine
From your open kisses,
Your wet body wedged
Between my wet body and the strake
Of our boat that is made of flowers,
Feasted, we guide it - our fingers
Like tallows adorned with yellow metal -
Over the sky's hot rim,
The day's last breath in our sails.

Pinned by the sun between solstice
And equinox, drowsy and tangled together
We drifted for months and woke
With the bitter taste of land on our lips,
Eyelids all sticky, and we longed for lime
And the sound of a rope
Lowering a bucket down its well. Then,
We came by night to the Fortunate Isles,
And lay like fish
Under the net of our kisses.

"IF YOU cheat Duterte (Rody) there will be a revolution. I will lead the revolution!"

"Now you see the influx of the people to the meetings of Duterte, wherever he goes the people will not allow cheating," ni Quiboloy atol sa press conference nga gihimo diha sa CJFI Residential Care Center sa Children's Joy Foundation Inc. (CJFI), Purok 8, San Miguel, Barangay Indangan, dakbayan sa Davao, Huwebes sa buntag.

"Mayor Duterte has the balls to do that, not any presidentiables can do that. They are just fooling the people. That is why I'm passionate with this, no matter what, let us support Duterte to become president."

"Do not fail the season of electing a leader like Duterte. If you fail this one, we have reached (a point) of no return for the Philippines. He is 71 years old, he can still exhaust his energy to turn this country around. I'm sick and tired of the same political standard we experience, we want change!"

Antonio Trillanes IV kabahin lamang sa duwa sa politika.

"In the long stretch of this political season you expect something like that to come out."

When it comes to the future of artificial intelligence, the ultimate battle between man and machine may come to mind â€" but that’s really the stuff of science fiction. AI actually has a presence in our daily lives on a much more useful and less apocalyptic level. Think personal assistant devices and apps like Alexa, Cortana and Siri, web search predictions, movie suggestions on Netflix and self-driving cars.

The term “artificial intelligence” was coined back in 1956. It describes a machine’s ability to perform intelligent behavior such as decision-making or speech recognition.

In the last two decades or so, big strides have been made in artificial intelligence â€" from IBM’s Deep Blue computer beating chess champion Garry Kasparov and the company’s Watson computer winning “Jeopardy!” to social robots like Jibo and online chatbots. Today, advanced computer systems can see, hear, learn, draw conclusions and solve problems. Robotics and AI have innovated education, health care and business.

But the question remains: Will future AI be friend or foe?

Some big names in the tech and science communities, including Tesla CEO Elon Musk, Bill Gates and Stephen Hawking, warn against the dangers of artificial intelligence. But most AI researchers reject doomsday scenarios, saying that while machines may be as smart as â€" or even smarter than â€" humans, they’re algorithms that can’t really think for themselves beyond what their programmers have coded them to do.

Researchers do say, however, that there are pitfalls to giving computers too much responsibility. These advanced systems can have programming glitches, not know how to respond to unexpected variables, misunderstand human instructions and be vulnerable to cyberattacks. But researchers do believe humans can safely control and regulate the development of AI.

So, whether you’re prepping for the AI apocalypse or you think robots are the wave of the future, when it comes to artificial intelligence, at least you can say, “Now I Get It." -- https://www.yahoo.com/

‘Curve Ball’

“His comments were a curve ball to the market,” said Joey Cuyegkeng, economist at ING Groep NV in Manila. “It more or less shakes the confidence of investors that gains in reforms are irreversible. We estimate something like 70 to 80 percent of the peso’s weakness is attributable to the local developments.”

The cost of protecting Philippine sovereign debt against non-payment for five years has risen eight basis points since April 19 to 104, according to data provider CMA. The credit-default swap contracts were at 93 on March 18, the least since July 2015. A three-month gauge of expected swings in the peso climbed 54 basis points in April to 5.70 percent, data compiled by Bloomberg show.

“Duterte’s governance philosophy doesn’t seem to have much focus on economic policy, and his lack of national experience is a drawback,” said Mixo Das, a strategist at Nomura Holdings Inc. in Singapore. “We are overweight on the Philippines but we’ll re-evaluate our position if Duterte’s win looks more certain.” -- http://www.bloomberg.com/

‘Business as Usual’

Duterte’s spokesman sought to calm market jitters by saying uncertainty usually arises in the weeks before an election, and it will be “business as usual” should the mayor be elected president. The front-runner will provide businesses the “right and proper atmosphere” to prosper without sacrificing the welfare of the people, Peter Lavina said in a statement Tuesday.

The latest poll conducted by Social Weather Stations showed Senator Grace Poe in second place, while Mar Roxas, the candidate backed by Aquino, was third and Vice President Jejomar Binay fourth. While all the contenders are championing reforms started by the outgoing president to boost infrastructure and create more jobs, Poe and Roxas are viewed by economists as the most capable of delivering on their promises.

Duterte has won support from locals by transforming Davao from a city battling crime and gangs in the 1980s to what his campaign calls one of the nation’s safest. A controversial figure, the 71 year-old former lawyer and prosecutor is facing a backlash for comments he made April 12 about the rape of an Australian missionary in a 1989 prison riot. He told the U.S. and Australian ambassadors not to meddle in Philippine politics after they condemned the remarks.

‘Rather Unflattering’

“Duterte represents uncertainty,” said Edwin Gutierrez, who helps oversee about $11 billion as head of emerging-market sovereign debt at Aberdeen Asset Management Plc in London. “He’s a bit of a one-trick pony with his law and order message. I don’t think he’d do anything to upset the apple cart with economic policy, but I don’t see economic reform as being his priority. The comparisons to Trump are obviously rather unflattering whether justified or not!”

The peso fell 0.1 percent to 46.81 per dollar as of 1:30 p.m. in Manila, while the nation’s benchmark stock index dropped 0.9 percent. The currency is headed for its worst month since August and reached 46.943 on Tuesday, the weakest level in seven weeks. ING Groep NV said it’s reviewing its forecast for the exchange rate to weaken to 47.60 by the year-end. Local-currency bonds have handed dollar-based investors a loss of 0.5 percent this month, a JPMorgan Chase & Co index shows.

“We could see the peso hitting 48 per dollar before heading back to 46.50 by the end of the year,” said Jonathan Ravelas, chief market strategist at BDO Unibank Inc. in Manila. “It’s driven by fear and the normal reaction of local investors is to buy the dollar.”

A controversial city mayor’s tightening grip on the Philippine presidential race has made the nation’s currency Asia’s worst performer this month.

The peso slumped 1.6 percent in April as opinion polls showed Rodrigo Duterte, the crime-busting leader of Davao city -- who made inflammatory comments about rape and extra-judicial killing -- extended his lead before the May 9 vote. He spent 22 years running the city of 1.5 million people and trailed his two closest rivals in a Bloomberg survey of economists on which candidate would best steer economic policy.

Outgoing President Benigno Aquino has won rating upgrades and investor plaudits for transforming an economy once dubbed the “sick man” of Asia, achieving the highest growth since the 1970s. Duterte’s popularity has been boosted by peoples’ anxiety over crime and, like U.S. Presidential candidate Donald Trump, supporters praise him for straight-talking. As the election looms, Philippine bond risk has climbed from near an eight-month low and foreigners have pulled $41 million from local stocks this month.

But it gets worse: Gershoff and Grogan-Kaylor also compared the negative effects of spanking with those of "physical abuse" against children. Both were associated with the same harmful outcomes, according to the news release.

"We as a society think of spanking and physical abuse as distinct behaviors," Gershoff said. "Yet our research shows that spanking is linked with the same negative child outcomes as abuse, just to a slightly lesser degree."

And yet spanking continues: In 2010, researchers at the University of North Carolina published the results of a 2002 survey on corporal punishment. Nearly 80% os U.S. preschoolers experienced spanking as a form of discipline, and nearly half of 8- and 9-year-olds were hit with objects such as paddles or switches.

A 2013 poll found that 81% of Americans "say parents spanking their children is sometimes appropriate," according to NBC News.

If those numbers sound high, know that corporal punishment inside the home is "technically legal" in all 50 states, NBC News reported:

"Statutes vary from state to state but generally say that the physical punishment must be reasonable or not excessive, although Delaware passed a law in 2012 that said it couldn't cause any injury or pain. Proposed legislative bans in several states have failed to pass, and courts have generally upheld parents' right to spank."

Laws aside, the researchers hope their findings will make parents think twice about spanking their kids.

"We hope that our study can help educate parents about the potential harms of spanking and prompt them to try positive and non-punitive forms of discipline," Gershoff said. -- https://www.yahoo.com/

Here's What Getting Spanked as a Kid Did to Your Personality, According to Science
Mic Tue, Apr 26 10:01 AM PDT

If you got spanked as a kid, it probably didn't do you any good. In fact, it may have made your behavior even worse, new research suggests.

The more kids get spanked, the more likely they are to "defy their parents and to experience increased anti-social behavior, aggression, mental health problems and cognitive difficulties," according to experts at the University of Texas at Austin and the University of Michigan.

Their study, published in the Journal of Family Psychology, analyzed five decades of spanking research representing around 160,000 children, according to a news release.

The study focused on "what most Americans would recognize as spanking, and not on potentially abusive behaviors," researcher Elizabeth Gershoff said in a statement. Spanking was defined as "an open-handed hit on the behind or extremities."

The results were not good: Gershoff and her co-author, Andrew Grogan-Kaylor, discovered that the more adults were spanked as children, the more likely the were to develop a range of negative outcomes later in life â€" including mental health issues.

"We found that spanking was associated with unintended detrimental outcomes and was not associated with more immediate or long-term compliance, which are parents' intended outcomes when they discipline their children," Gershoff said.

Adults who were spanked as children were also "more likely to support physical punishment for their own children." On and on goes the cycle.
#3559
They also worried that spanking was only linked to bad outcomes for kids in studies that weren’t methodologically outstanding. It’s hard to study real-world outcomes like this; there are only a few controlled experimental studies in which some mothers spanked their kids and some didn’t, in a laboratory setting. Those were included in this analysis, along with cross-sectional and longitudinal studies, for a total of 75 studies, 39 of which hadn’t been looked at by any previous meta-analyses. Altogether, these studies included data from 160,927 children.

The researchers looked at the effect sizes from these studies, to see how strong their results were. There were 111 different effect sizes for 75 studies (some of the studies included more than one result). Of those, 108 found that spanking was linked to poor outcomes. Seventy-eight of the negative results were statistically significant. Only nine results indicated that there could be a benefit to spanking, and only one of those was statistically significant.

“Thus, among the 79 statistically significant effect sizes, 99 percent indicated an association between spanking and a detrimental child outcome,” the study reads. Those outcomes were: “low moral internalization, aggression, antisocial behavior, externalizing behavior problems, internalizing behavior problems, mental-health problems, negative parentâ€"child relationships, impaired cognitive ability, low self-esteem, and risk of physical abuse from parents.”

Harsher forms of abuse were excluded from the analysis, so this paper shows that spanking alone puts children at risk for some serious problems. The authors also looked at a subset of studies that compared spanking with physical abuse, and found that both were linked to bad outcomes “that are similar in magnitude and identical in direction,” they wrote.

Given that spanking is still such a commonâ€"and controversialâ€"form of punishment, careful examination of the research will be important for parents and policymakers alike. And as the researchers concluded here,“there is no evidence that spanking does any good for children and all evidence points to the risk of it doing harm.” -- http://www.theatlantic.com/

The Strong Evidence Against Spanking

A review of the available research finds that physical punishment is significantly linked to bad outcomes for kids.

JULIE BECK  10:00 AM ET

Around the world, an average of 60 percent of children receive some kind of physical punishment, according to UNICEF. And the most common form is spanking. In the United States, most people still see spanking as acceptable, though FiveThirtyEight reports that the percentage of people who approve of spanking has gone down, from 84 percent in 1986 to about 70 percent in 2012.

“The question of whether parents should spank their children to correct misbehaviors sits at a nexus of arguments from ethical, religious, and human-rights perspectives,” write Elizabeth Gershoff of the University of Texas at Austin, and Andrew Grogan-Kaylor of the University of Michigan, in a new meta-analysis examining the research on spanking and its effects on children.

The researchers raised concerns that previous meta-analyses had defined physical punishment too broadly, including harsher and more abusive behaviors alongside spanking. So for this meta-analysis, they defined spanking as “hitting a child on their buttocks or extremities using an open hand.”

Then the other day, I stumbled upon a posting on Facebook by a certain Mike K. Cohen. It seems that in Cohen’s view, dealing with simpletons may also require a simplistic explanation of the consequences of a Duterte presidency, particularly that part about severing ties with the US. I quote the post, as follows:

“A few people are smiling about the bravado of a comment of Rody Duterte on severing ties with US if he wins. The impact of that short list:

Goodbye all visas and green cards

Goodbye all call centers jobs

Goodbye McDo, Shakeys, 7-11 all US brands

Goodbye all balikbayan boxes

No more Western Union

No more padala

No more trade

No more tv shows or movies

No more concerts or US music

Lastly goodbye to the Internet, Facebook, Twitter and all Apple products

Likewise any and all trade with the US directly or indirectly... that is what severed ties means... a total end to relationships of four million Filipino Americans and their families back home, that would last for up to six years... Perhaps Mayor Duterte needs to think more next time before he speaks -- the last leader who tried to sever ties and declare war on the USA is sitting in a US prison his name is Noriega -- the last US ally to sever ties over a ‘feeling offended...’ he’s still in US supermax prison. Google him -- Manuel Antonio Noriega.”

That last point should send some chills up Duterte’s spine. Jose Maria Sison and his motley forces will not be able to protect him from the CIA. And if Duterte thinks China will, then he’s more simple minded than he has already shown himself to be.

These people can’t even understand the fact that crime cannot be eliminated by someone who is, himself, guilty of criminal behavior, and justice cannot be dispensed by someone who has no respect for the rule of law. And about the promise of a corruption-free society, Duterte’s rabid admirers cannot see that Duterte’s mind, mouth, attitudes and entire being are so corrupt that he makes the hustlers at Customs and BIR look like altar boys.

So how else do you convince the Duterte fanatics that voting their idol to Malacañang is like self-flaggelation and like banging one’s head against a stone wall?

How do parents stop an emotionally disturbed child from doing drugs? How do they dissuade a daughter from running off with that married dirty old man? How do you keep a whole nation of fanatics from pushing the country off the cliff?

The exhortations of the Catholic hierarchy doesn’t seem to help. In a nation of Catholics, it has become fashionable for Catholics themselves to accuse the clergy of hypocrisy. It is also taken for granted that the Catholic Bishops Conference has more bark than bite and can never rally a Catholic vote.

The activist women’s groups are up in arms against Duterte for making light of rape and debasing feminine dignity -- but will their efforts be enough to stir the outrage of women voters?

How do you convince a blinded, mesmerized, unthinking people -- not just the so-called poor but also the wealthy and supposedly enlightened -- that delivering the country into the hands of Duterte is virtual suicide? How do you make their simplistic minds see the light?

Maybe Duterte -- who is not famous for thinking before he lets bile spew out of his mouth -- doesn’t realize the implications of his threat against the US and Australia. But surely the captains of Philippine commerce and industry understand the consequences of being dubbed a pariah in the international community.

But have we heard even a word of caution against such a reckless actuation by someone who would be president of the country?

Some Duterte fanatics have argued that the US and Australia need the Philippines as much as we need them and that they would never abandon our country, whatever the aggravation. These simpletons fail to see that turning the screws on our hapless country does not necessarily mean letting go of their strategic position here. They’ll just make life more miserable for the Filipino people, with greatest impact on the masses.

And talk about the masses, it appears that there is a growing wave of support for Duterte among them because of the fantastic belief that he will rid the country of criminality and corruption in three to six months. And not just the masa -- even supposedly intelligent individuals from the so-called Class ABC have been taken in by the double-talk. Apparently spurred by extreme frustration over the incompetence of the current administration and the endemic corruption in Philippine society, these people are willing to believe anything.

No amount of logical explanation seems to convince them that Duterte’s promise is no better than that of a sideshow medicine man.

As a matter of fact, on the basis of the fantasy of a crime-free and corruption-free government, they are willing to forgive Duterte for his profanity, his boorishness, his immorality, and his oft-announced murderous tendencies.

Aquino has just appointed a new Acting AFP Chief of Staff, Lt. Gen. Glorioso Miranda. Will he choose to ignore Duterte’s in-your-face defiance -- nay, in-your-face insult -- of everything that the men under his command have been fighting and dying for?

By the way, is former President Fidel V. Ramos, a former defense chief and former AFP chief of staff, still convinced about supporting Duterte despite his being a Communist coddler? No peep from Ramos, either.

Duterte has told the US and Australian ambassadors to shut up and has threatened to sever relations with the two countries if he ever assumes the presidency -- because they protested his depraved remarks concerning a slain Australian lay minister.

Meanwhile, here’s how a rabid pro-Duterte columnist in a major daily spun Duterte’s slamming of the foreign diplomats:

“It is not really the Duterte remark on a beautiful Australian that offends. What offended the American and Australian ambassadors and the Filipino elite was that an obscure, uncouth, ill-mannered, common Filipino should break their stranglehold on the Filipino nation... That was the context of the anger against Duterte.”

This columnist -- who happens to be a woman -- chose to completely ignore Duterte’s psychotic remark about wanting to ravish a rape and murder victim and chose instead to twist the topic to a purported foreign “stranglehold on the Filipino nation.”

If you’ve ever heard a more non sequitur commentary, this one was it. And this person is supposed to be an opinion maker? Good grief!!!

“Mabuhay ang NPA!” Rodrigo Duterte has exhorted in his speeches. And Jose Maria Sison, Communist Party of the Philippines’ (CPP) founder has acknowledged Duterte’s promise that if he becomes president, the New People’s Army -- the CPP’s armed unit -- will have one foot in Malacañang.

Ready for coalition.”

It’s on YouTube, in case anybody wants to check.

While it makes sense to negotiate peace with the NPA, Duterte’s idea of a “coalition” grants the latter undue belligerent status. Are Duterte and Sison envisioning “power sharing” along the template that marked the dirty wars in Central America?

Have we heard a single expression of outrage from the top brass of the Armed Forces of the Philippines or of the Philippine National Police over what Duterte and Sison said? Nada. Nothing. Zilch. Why is the silence of the military brass so deafening?

In humans and in other species, PAF is known as a critical component of the immune system. It triggers inflammation, which is a key process in bringing in protective immune cells to fight off pathogens.

Quinn then looked at the molecular and genomic makeup of tissue from corals competing with algae in the Southern Line Islands. Using genetic sequencing technology, the research team found that PAF and the genes responsible for its production were more abundant when the coral was being damaged by its algal competitors. That suggests that PAF production is a stress response activated when coral competes with algae, and that the coral's immune system was responding in much the same way as a human body fighting an infection.

Researchers estimate that the evolutionary lineages of corals and humans diverged about 550 million years ago. It's likely that PAF arose as an immunological molecule around that time and it has been functioning in various species' immune systems ever since.

"Despite the complexity of our immune system, a lot of the same things have been going on for 550 million years," Quinn said.

Knowing what PAF levels look like in healthy and unhealthy coral reefs could provide oceanographers with a biomarker for these ecosystems' health, he added. -- http://phys.org/

Researchers set out to catalog the molecular makeup of coral reef ecosystems as part of the National Geographic Society's Pristine Seas project. The underlying goal of this project is to better understand the dynamics of healthy ocean ecosystems.

"Our oceans are rapidly declining and we need to understand what's normal before there's no 'normal' left," said the study's lead author, Rob Quinn, assistant project scientist at the Skaggs School of Pharmacy and Pharmaceutical Sciences at the University of California, San Diego. "We need to find out what healthy reefs look like so we can identify those transitioning to unhealthy."

While working as a postdoctoral researcher at San Diego State University, Quinn, along with SDSU biology professor Forest Rohwer, Mark Vermeij of the Caribbean Research and Management of Biodiversity foundation, and other colleagues, analyzed coral tissue samples that had been collected from coral reefs off the Southern Line Islands in the central Pacific Ocean, about 2000 km south of Hawaii. These coral reefs are considered among the most remote and pristine reef systems in the world.

Quinn analyzed the molecular contents of the tissue samples with a technique called mass spectrometry, which uses coordinated ion beams to sort out the individual molecules present. Looking at the readout, one molecule in particular stood out to him: platelet activating factor, or PAF.

"It was basically the most abundant molecule we detected in coral," Quinn said.

Coral reefs face many threats. Ocean acidification, algal takeover caused by overfishing and exploding populations of harmful microbes all jeopardize the health of the world's most productive and diverse marine ecosystems.

The reefs are not defenseless, however. Like humans, they have a type of immune system that helps protect them. A new study published today in the Proceedings of the Royal Society B has found that one particular molecule found in reef ecosystems plays a similar immunological role in corals as it does in humans. From an evolutionary standpoint, this suggests the molecule's immune function dates back at least 550 million years.

A white Labrador was honored as a hero for rescuing seven people in the aftermath of the devastating earthquake in Ecuador last week before dying from exhaustion at the age of 4.

Dayko, a dog that worked for the Ibara fire service, spent several days searching for survivors after the magnitude-7.8 earthquake, The Telegraph reports.

The fire service’s Facebook page said the resilient pup collapsed on Friday and died from a "massive coronary myocardial infarction and acute respiratory failure."

The firefighters added, "This four legged friend gave his life in the line of duty. Thank you Dayko for your heroic efforts in Pedernales and in various emergencies where you were present."

The April 16 earthquake killed at least 654 people and wounded more than 2,000 others. Ecuador’s president has said reconstruction could cost billions of dollars.

"You held high the name of the K9 unit," the firefighters told their dog.

What will Beijing do in response to the tribunal’s impending final award? Ignoring it in silence does not appear to be a feasible option. Some have speculated that a largely adverse decision might lead China to dramatize its protest by withdrawing from the UNCLOS system, as permitted upon one year’s notice. Yet denunciation of the treaty could not occur in time to relieve China of its obligation to comply with the arbitration award, and such an extreme reaction to a judgment of the world community would cause China even more long-lasting damage to its reputation than failure to comply. China would also be surrendering its future opportunities to influence the development of UNCLOS as it relates to many other issues important to Beijing.

It seems more likely that Beijing will continue to disparage the decision through official and unofficial statements, contesting its validity on both jurisdiction and the merits. Also, although Beijing chose not to participate in organizing the proceedings, it has already sought to discredit the process by which the tribunal was constituted, even attacking the independence and impartiality of the arbitrators. Its Foreign Ministry recently condemned the arbitration as “a political provocation in the guise of law.” Such attempts, of course, only further harm China’s quest for so-called soft power.

Yet the situation is not hopeless. Experience has shown that China’s foreign policies and legal positions are not written in stone. An increasingly vigorous effort by those nations that have their own maritime disputes with China to promote their settlement through diplomacy that includes resort to international legal institutions may ultimately prove effective. If all affected nations in the East China Sea and the South China Sea “bombard the headquarters” in Beijing by taking their international law disputes with China to international legal institutions â€" rather than relying exclusively on endless, fruitless, and unequal bilateral negotiations or American military gestures â€" there is hope for a turnabout.

Surprisingly, India’s Prime Minister Narendra Modi, usually regarded as a nationalistic leader, provided an encouraging example of how a big power should respond to a disappointing result in UNCLOS arbitration with a weaker neighbor. Despite the fact that India’s claims against Bangladesh over jurisdiction in the Bay of Bengal were generally not vindicated, Modi calmly accepted the July 2014 decision rather than inciting xenophobic popular protests against alleged foreign unfairness. Modi emphasized that the arbitration, by putting hoary divisive issues behind the parties, had established the basis for future cooperation.

The arbitration tribunal of five impartial experts that has been considering the Philippines suit against China under the U.N. Convention on the Law of the Sea (UNCLOS) will soon hand down its final decision. Although the tribunal will not decide territorial sovereignty questions or set maritime boundaries, it may well determine, among many other issues, whether there is a legal basis for China’s notorious “Nine-Dash Line” that ambiguously claims over 85 percent of the South China Sea and whether any of the islands in dispute are entitled to a 200-nautical mile exclusive economic zone.

If, as it promises, Beijing rejects the outcome, it will harm the UNCLOS system that Beijing, which has ratified the agreement, played a significant role in negotiating. It will also hurt Beijing’s own interests by reinforcing the image of lawlessness that it has acquired by its expansive territorial claims and assertive maritime actions â€" including a relentless drive to convert disputed submerged features, low-tide elevations, and rocks into islands, airfields, and ports. There is still hope that Beijing might change course, but it will require a recommitment to UNCLOS principles from affected Asian nations, and from the United States. It will also require other major countries increasing pressure on China, such as the G-7’s surprisingly strong April 11 statement of support for the arbitration.

In January 2013, the Philippines’ stunning initiation of UNCLOS arbitration against China brought the system of third-party dispute resolution into the world of Beijing’s maritime disputes. China insisted then that the UNCLOS tribunal lacked jurisdiction, but refused to submit its jurisdictional objections for the tribunal’s impartial decision. In October 2015, the tribunal ruled that it did have jurisdiction over certain issues and postponed determination of its jurisdiction over other issues until it issued its decision on the merits of the Philippines’ claims. That decision is now imminent.

But this is preeminently about politics, not only law. Beijing’s opposition reflects the current primacy of highly nationalistic elements within China’s military and political leadershipBeijing’s opposition reflects the current primacy of highly nationalistic elements within China’s military and political leadership over those Chinese international law experts, both within and outside government, who believe that China should test its challenges to the tribunal’s jurisdiction and to the Philippine claims before the tribunal itself â€" regardless of whether or not it’s legally obligated to do so. Under the fear-inspiring command of President Xi Jinping, it requires an act of courage for any international law or foreign relations specialist within the government to contradict prevailing policy, although academic debate continues to be allowed.
