the problem here of drawing the line is where does one draw it?  rape and murder as against cohabitation and estafa?  the nitty-gritty is almost impossible, considering that at the international level countries have different cultures and have therefore different takes on crimes.  pregnancy without a husband in the middle east is a crime; it is not in our country.  meanwhile, immunity is immunity, and all signatories of the vienna convention have to abide by it.  the exception of course is for the country to waive the immunity and have their diplomat tried in the host country.  panama has refused to waive, according to the news.

i can't blame them.  for other countries, the philippine judicial system may give the impression that it's difficult to trust.  where else is a chief justice being impeached at the moment and a former president being barred from traveling?  such show of seeming government disarray is matched only by pakistan.  from our own vantage, we can hardly say outright that we can trust pakistan's judicial system.  add this to our sullied reputation, thanks in part to our media that tend to downplay the good about our country but give prominence instead to sensational negative stories.

there are other ways for accused diplomats, of course.  they can be tried in their own country.  (that's what the u.s. does for their erring soldiers, right?  and these soldiers have no diplomatic immunity.  it gives the impression that more often than not the u.s. would rather try their own citizens rather than trust the judicial system of other countries.  as for that u.s. soldier accused of raping a filipina some years back, if i remember right, the charges were dropped, on the alleged victim's own volition.)

PH declares Panamanian diplomat in rape case ‘persona non grata’

By Tina Santos
Philippine Daily Inquirer
9:26 am | Saturday, May 12th, 2012

MANILA, Philippines â€" The Department of Foreign Affairs has declared the Panamanian diplomat accused of raping a 19-year-old Filipina persona non grata (PNG).

The DFA’s decision came after the department received late Friday afternoon a Note from the Panamanian government saying that it has decided not to waive the immunity of Erick Bairnals Shcks, a member of the administrative and technical staff of the Panamanian Embassy.

The DFA said Saturday that the Note was delivered by Panama Ambassador Roberto Carlos Vallarino Moreno.

“In accordance with Article 9 of the Vienna Convention on Diplomatic Relations, Mr. Shcks should be recalled or terminated of his functions by the Panamanian Government. If no action is taken by the Panamanian Government within a reasonable period of time after he was declared as PNG, the Philippine Government will cease to recognize Mr. Shcks as a member of the Embassy and will accordingly be stripped of his immunities,” the DFA said in a statement.

This decision declaring him as PNG was immediately conveyed to the Department of Justice for appropriate action, it added.

Panamanian suspect in rape of Filipina leaves Philippines

By Tina G. Santos
Philippine Daily Inquirer
9:29 pm | Friday, May 11th, 2012

MANILA, Philippinesâ€"The Panamanian national accused of raping a 19-year-old Filipina left the country Friday night, according to an airport official.

Erick Bairnals Shcks left the Ninoy Aquino International Airport before 8 p.m. on board Royal Dutch Airlines flight KL 808 bound for Amsterdam.

According to the airport official, who refused to be named for lack of authority to speak to the media on the issue, Shcks was accompanied by the Panamanian ambassador to the Philippines Roberto Carlos Moreno on the trip.

Airport personnel said the two checked in quietly and did not avail of the customary diplomatic assistance given to dignitaries at the airport.

Shcks’ alleged victim on Thursday went to the Department of Justice to seek help.

However, Justice Secretary Leila De Lima said that Shcks, a technical officer of the Panama Maritime Authority and a diplomatic passport holder, was covered by the immunity granted to foreign diplomats as stated in the 1961 Vienna Convention on Diplomatic Relations.

She said Shcks may leave the Philippines anytime, and there is no legal basis to hold him here.

“We really cannot do anything because of that diplomatic immunity. That’s an international agreement,” she said.

Shcks was accused of raping the victim in his rented condominium unit in Makati City on April 23, a few days after he purportedly befriended her.

De Lima noted that the Department of Foreign Affairs had already issued a certification that Shcks had diplomatic immunity.

“Under the existing jurisprudence, DFA is the primary agency with competence and authority to make such [a] declaration and certification. The only orders we refuse to obey are those made with grave error,” she added.

De Lima said that the only way the victim may pursue her criminal complaint against Shcks was for the Panamanian government to waive his immunity through the DFA.

Panamanian diplomat accused of raping 19-year-old Filipina leaves PH

11-May-12, 7:48 PM | Eric Apolonio, InterAksyon.com

MANILA, Philippines - Panamanian rape suspect Erick Bairnals Shcks quietly left the Philippines Friday night.

Accompanied by the Panamanian ambassador to the Philippines Roberto Carlos Vallarino Moreno, Shcks boarded KLM Royal Dutch Airlines flight KL808 bound for Amsterdam at the Ninoy Aquino International Airport Terminal 1 in Pasay City.

The two checked in quietly without the customary diplomatic assistance given to dignitaries at the airport and presented their tickets at the KLM counter. Moreno was a Business Class passenger while Shcks was on economy flight.

Shcks, a 35-year-old technical officer of the Panama Maritime Authority who holds a diplomatic passport, was accused of raping a 19-year-old Filipina last April 23.

However, the  Philippine government could not file a case against Shcks due to his diplomatic immunity.

Last Thursday , Philippine Department of Justice Secretary Leila de Lima said that “we really cannot do anything because of that diplomatic immunity. That’s an international agreement."

“The Department of Foreign Affairs had already issued a certification that Shcks had diplomatic immunity," she added.

The Philippine Senate earlier approved the motion of Majority Leader Vicente Sotto to conduct marathon hearings on the issuance of multiple certifications by the DFA that resulted in the dropping of rape charges against Shcks.

“We will have a marathon hearing on this,“ Senator Loren Legarda assured Sotto after Senate President Pro Tempore Jinggoy Estrada referred the issue to the Senate committees on foreign relations and justice and human rights.

Senate president Juan Ponce Enrile supported the move. “We better look into this. My God, raping a Filipina, even a diplomat, at least he must be held in court and answer accordingly, i support the move."

Mura ang gipagawas sa baje based sa ahong nabatian ni Mike Enriquez sa TV nga mura kono ug gipugos ang baje ug pasud sa bay. Ambot pud ug nganong wa man mosinggit tong bajeha. Ang aho lamang pud nga unta makatilaw tong Panamanianaha. Maajo ra no? Gipareha ra nija sa kadtong US serviceman nga nangrape man kaha pud to pero karon wa na dinhis Pilipinas. Kalaay ning atong gobyerno.

tanang condo naay cctv.  condo ang gipuy-an ni panamanian.  adto tingali makita ang katag o scattered kun si bugsay pay pasultihon.  unsa man ning pugosa pagpasulod ni inday, giguyod kaha siya?  makadagan ug siyagit baya siya, makit-an sa cctv, naa dayon ang roving nga security.

tinuod, laay gyod atong gobyerno, bisag sa akong pag-ilis ug driver's license, arang laaya.  pero, in this case, international laws prevail.  malas si inday.  she can't save face sa iyang boyfriend ug lola nga nasuko kay dugay siyang nipauli atong gabhiona.
#33717
di pod hinoon ko kasabot nganong nakipag-date nga naa man siyay boyfriend gahuwat niya sa ilang balay.  hinoon, di pa man tuod bana mao nga wa tingali siya magtoo nga but-an siya kun kinsay uban niyang ma-date.  pero nganong nikuyog pa man tawon siya sa sulod sa balay sa laki; gikan man kaha silang ga-date, mapugos ba diay siyag sulod sa balay?  kay nikuyog, mora hinoon ug nangitag engkuwentro.

i wish to read up more on what the nuances are aning diplomatic immunity for crimes "committed in the performance of duties".  offhand, kun pinolosopohon, morag wa man tingaliy crime mahitabo while a diplomat performs his duties, gawas kun siya ang nag-drive unya nakaligis.  o kaha espionage, nga mahimong i-expel dayon sa host country.  (my understanding is mahimong persona non grata, but still di man tingali makiha o mapriso.)

meantime, here's something from the Vienna Convention: Article 31.1c Actions not covered by diplomatic immunity: professional activity outside diplomat's official functions.

giklaro nga "professional activity".  i don't think the alleged rape belongs to this.

Gethsemane (I Only Want To Say)
(Webber-Rice)

I only want to say,
If there is a way,
Take this cup away from me
For I don't want to taste its poison,
Feel it burn me.
I have changed.
I'm not as sure, as when we started.

Then, I was inspired.
Now, I'm sad and tired.
Listen, surely I've exceeded expectations,
Tried for three years, seems like thirty.
Could you ask as much from any other man?

But if I die,
See the saga through and do the things you ask of me,
Let them hate me, hit me, hurt me, nail me to their tree.
I'd want to know, I'd want to know, My God,
I'd want to know, I'd want to know, My God,
Want to see, I'd want to see, My God,
Want to see, I'd want to see, My God,
Why I should die.
Would I be more noticed than I ever was before?
Would the things I've said and done matter any more?

I'd have to know, I'd have to know, my Lord,
Have to know, I'd have to know, my Lord,
Have to see, I'd have to see, my Lord,
Have to see, I'd have to see, my Lord,
If I die what will be my reward?
If I die what will be my reward?
Have to know, I'd have to know, my Lord,
I'd have to know, I'd have to know, my Lord,
Why should I die? Oh, why should I die?

Can you show me now that I would not be killed in vain?
Show me just a little of your omnipresent brain.
Show me there's a reason for your wanting me to die.
You're far too keen on where and how, but not so hot on why.

Alright, I'll die!
Just watch me die!
See how I die!

Then I was inspired.
Now, I'm sad and tired.
After all, I've tried for three years, seems like ninety.
Why then am I scared to finish what I started,
What you started, I didn't start it.
God, thy will is hard,
But you hold every card.

I will drink your cup of poison.
Nail me to your cross and break me,
Bleed me, beat me,
Kill me.
Take me, now,
Before I change my mind.

i've always been appreciative of this process because it also holds true for loss and grief.  what made this more fascinating for me was the rock opera broadway/movie hit 'jesus christ superstar' of old, the libretto of which was a collaboration by composer andrew lloyd webber and lyricist tim rice (he of the lion king's fame).  these 2 guys were said to be still in their 20s when they came up with this rock opera hit.  i could not help but think of one song, my most favorite of the lot---gethsemane (i only want to say) as sung by jc in the story.  both the music and the lyrics are faithful to the kuber-ross 5 stages of dying.  (it means it was jesus the man, and the song made the divine very accessible, like a suffering friend.)  it is fascinating.  i'll try to post it in the thread for music if i find it.
#33725
who can say that if the scenario had been different, if those middle-aged foreigners took up their challenge instead of shooing them away, those girls may have ended up crying rape.
#33726
what followed next was more shocking.  2 midteeners, they couldn't be more than 16 years old in my estimate, also stopped by them and sat down, smiling ear to ear.  i guess those 2 guys have had enough at that point; the girls were brusquely waved away.

is this what we have become?  i asked my lunch companions.  those young girls' aggression was incomprehensible.
#33727
soon an attractive 20-something in office clothes (a decent light suit) stopped by them and sat down smiling.  i can't hear their exchange, but she seemed to have introduced herself and the 2 white males asked her to go away.  they looked distracted and irritated.

not unlikely.  di ko ganahan manaway sa atong kababayan ug kabaro pa gyod, pero gingilngigan gyod ko kausa sa cebu, bag-o pa atong february.

in an ayala center restaurant where i took lunch, i was seated beside the glass panes facing the corridor where there are restaurant seats for smokers and those who prefer fresh air and where an endless stream of mall-goers pass by.  2 middle-aged male caucasians were seated there, concentrated on what seemed to be a serious talk.

i just feel uncomfortable with gabriela's logic, though.  she's not a cheap girl, they said; she comes from a rich family.  whaaaattt?  being cheap is only for the poor then?  come on.

some other previous thread in this forum had also focused on guyabano as an anti-cancer miracle.  the latest is a study of our very own scientists and researchers from the university of sto. tomas who also made positive conclusions.

please note that a study mentioned in the article (this thread's beginning) goes all the way back to 1976.  after almost 40 years, the claims haven't become mainstream.  imagine if it were so; big pharmaceuticals with their resources and topnotch research teams of scientists would have by now gotten into the act with guyabano-based anti-cancer miracle pills, duly patented.

let's just enjoy guyabano with all its nutrients as a rich, fun, accessible, and easy to grow fruit.

Lost parakeet shocks cops by telling them its home address

OK, quick show of hands: How many of you have asked yourselves, "Why do I constantly talk to my pets?" This is why. A runaway (flyaway?) parakeet in Japan was returned to its owner after the bird repeated its address to police officers. The cops had been called after the bird did its best Andy Dufresne impression, somehow escaping from its home and flying into a Yokohama city hotel. After sitting quietly in a cage in the police station, the bird shocked the officers by reciting its address. "We had not expected his owner to be identified in this manner," one policeman said. The only way this would've been cooler? If it had involved a talking dog.

Zeisler said she initially went to the Weatherford Animal Shelter to get a German shepherd for her mother. When she asked about shepherds, she was told they only had one, but he was in the back because nobody wanted him.

They brought out the dog and it was love at first sight, she said.

Zeisler has fallen a couple of times when she didn't heed Bear's warning. The dog will fetch her medicine or stay with her, whichever she seems to need, she said.

As National Hero Dog, Bear gets free dog food for a year, the trip to California for him and Zeisler, a stay at an oceanfront hotel in Huntington Beach and a plaque.

The ceremony honoring Bear was held at the Nokia Plaza in downtown Los Angeles.

As a by-then conscious Zeisler was being loaded into an ambulance, Bear did not hesitate to jump in with her and accompany her to the hospital.

The dog recognizes the signs of imminent seizures and will lean on Zeisler's legs so she can sit down before they happen, explained the society's Ana Bustilloz.

Bear never had any training, but three days after Zeisler took him home he started alerting her to possible problems. "He figured it out on his own," Bustilloz said.

The sometimes daily seizures started after a horse riding accident 18 years ago.

California group gives Texas dog national hero award

By SUE MANNING
5/7/2012

LOS ANGELES â€" Three years ago, Bear was a 100-pound German shepherd nobody wanted at a Texas shelter.

Debbie Zeisler came to his rescue. She has lost count of the times since then that he has come to hers.

On Monday, Bear was honored with the 30th National Hero Dog award by the Society for the Prevention of Cruelty to Animals Los Angeles.

Last May, Zeisler had a seizure, fell down some steps, hit her head and lost consciousness in her front yard. Bear scratched on every front door in their Millsap neighborhood but nobody answered. A Parker County animal control officer saw the frantic dog and went to help. Bear led the officer to Zeisler.

Tyrannosaurus Rex Joseph Gold (his full name) will certainly have a fun time proving his identity when purchasing alcohol or after getting pulled over for speeding. Perhaps he'll just bite them in half instead.

Entrepreneur legally changes his name to Tyrannosaurus Rex

By Mike Wehner
Tecca

Name recognition is a big deal in the world of small business, but going so far as to legally change your name to one of the most iconic creatures ever to walk the planet might be a bit of overkill.

A 23-year-old Nebraska native who was born Tyler Gold has left that moniker behind in favor of Tyrannosaurus Rex. His name change was even approved by a judge, though we have a hard time understanding how the court kept from bursting out in laughter.

Gold had to field a series of questions regarding his request, including whether he was choosing to change his name to avoid creditors or law enforcement. He noted that he had no troubles in either the legal scene or with bad debt, and he merely wanted a recognizable name to help promote himself as an entrepreneur.

in international relations and brinkmansip, eyeball-to-eyeball could mean tutokanay, budlatanay hangtod ang usa mamilok.

as of this point, if china plays hardball brinkmanship, there's no reason why the philippines shouldn't do the same.

brink·man·ship n.
The practice, especially in international politics, of seeking advantage by creating the impression that one is willing and able to push a highly dangerous situation to the limit rather than concede.

even the smallest boy at the playground needs to stand up against a bigger bully, whatever it takes.

wow!  the chinese government really know how display muscle and pander to their constituents.  a good way to distract the public from their ongoing power play and scandal.  as for the lady who made the gaffe that china owns the philippines, ugh, could one say that that's what she gets for being more conscious of her form rather than substance?  :o

Orangutans at Miami zoo use iPads to communicate

philstar.com, May 10, 2012

MIAMI (AP) â€" The 8-year-old twins love their iPad. They draw, play games and expand their vocabulary. Their family's teenagers also like the hand-held computer tablets, too, but the clan's elders show no interest.

The orangutans at Miami's Jungle Island apparently are just like people when it comes to technology. The park is one of several zoos experimenting with computers and apes, letting its six orangutans use an iPad to communicate and as part of a mental stimulus program. Linda Jacobs, who oversees the program, hopes the devices will eventually help bridge the gap between humans and the endangered apes.

13. It is important to note that, even in the absence of an actual armed attack against either the Philippines or the US, Article III of the MDT provides that the Philippines and the US, “through their Foreign Ministers or their deputies, will consult together from time to time regarding the implementation of this Treaty and whenever in the opinion of either of them the territorial integrity, political independence or security of either of the Parties is threatened by external armed attack in the Pacific.” (italics supplied).

14. The recently-concluded Two Plus Two meeting, at the Ministerial level, is a new mechanism for such high-level consultations.

12. As additional information, under the US Constitution, the US President as Commander-in-Chief may commit US armed forces into action overseas although the US president is obliged to notify the US Congress within 48 hours of such action, as provided for under the US War Powers Resolution of 1973. The same Resolution requires that such commitment of US armed forces could not go beyond 60 days, with a further 30 day withdrawal period, without US congressional authorization. This means that a US congressional authorization is needed only if the engagement of US armed forces abroad would go beyond 60 days.

10. On November 16, 2011, Secretary Clinton and Secretary del Rosario signed the Manila Declaration which states: “The Republic of the Philippines and the United States today reaffirm our shared obligations under the Mutual Defense Treaty.” (Source: “Manila Declaration on US-Philippine Alliance, 16 November 2011)

11. On April 30, 2012, during the Two Plus Two meeting in Washington, D.C., Secretary Clinton reiterated that the US “reaffirms our commitment and obligations under the mutual defense treaty.” (Source: “Remarks during Press Availability, State Department, Washington, D.C. April 30, 2012)

9. During the question and answer session in the same media event, Secretary Clinton was asked by a correspondent from ABS-CBN this question: “What will America do if China attacks Filipino forces in the Spratly Islands?” Secretary Clinton’s reply was: “Well, as to your first question, the United States honors our Mutual Defense Treaty and our strategic alliance with the Philippines. I’m not going to discuss hypothetical events, but I want to underscore our commitment to the defense of the Philippines.” (Source: “Remarks with Philippines Foreign Secretary Albert del Rosario After Their Meeting,” Washington, D.C., June 23, 2011)

7. On June 23, 2011, Secretary Hillary Clinton reaffirmed to Secretary Albert del Rosario during their meeting in Washington, D.C. that the US “will honor its treaty obligations to the Philippines.”

8. In her remarks to the media after the said meeting, Secretary Clinton declared: “The Philippines and the United States are longstanding allies, and we are committed to honoring our mutual obligation.”

6. On May 24, 1999, US Ambassador to the Philippines Thomas C. Hubbard wrote a letter to Foreign Secretary Domingo L. Siazon affirming that “the US Government stands by its statements in the Vance-Romulo letter of January 6, 1979.” Moreover, in the same letter, Amb. Hubbard cited Defense Secretary William Cohen’s statement that “the US considers the South China Sea to be part of the Pacific Area.” (italics supplied).

5. On January 6, 1979, US Secretary of State Cyrus Vance, in his letter to Philippine Foreign Secretary Carlos P. Romulo, cited Article V of the MDT and stated that “… as provided in Article V, an attack on Philippine armed forces, public vessels or aircraft in the Pacific would not have to occur within the metropolitan territory of the Philippines or island territories under its jurisdiction in the Pacific in order to come within the definition of Pacific area in Article V.” (italics supplied).
#33779
4. Article V of the MDT further provides that “an armed attack on either of the Parties is deemed to include an armed attack on:

a. the metropolitan territory of either of the Parties, or

b. on the island territories under its jurisdiction in the Pacific Ocean, and

c. its armed forces, public vessels or aircraft in the Pacific.”
#33780
3. Article IV of the MDT states: “Each Party recognizes that an armed attack in the Pacific area on either of the Parties would be dangerous to its own peace and safety and declares that it would act to meet the common dangers in accordance with its constitutional processes.”
#33781
2. As stated in the MDT’s preamble, both the Philippines and the US desire to publicly declare, through the MDT, their sense of unity and common determination to defend themselves against external armed attack, so that no potential aggressor could be under the illusion that either of them stands alone in the Pacific Area. (refer to the 3rd paragraph of the MDT’s preamble.)

DFA chief clarifies US support under Mutual Defense Treaty

The Philippine Star
May 10, 2012

MANILA, Philippines - The following is the statement of Foreign Affairs Secretary Albert del Rosario on the Philippines-US Mutual Defense Treaty:

In view of inaccurate information on the subject of whether or not the US is prepared to respond to its commitment to the Philippines under the Philippines-US Mutual Defense Treaty (MDT), the Department of Foreign Affairs would like to establish as a matter of record that:

1. The Philippines and the United States entered into a Mutual Defense Treaty (MDT) on August 30, 1951 in Washington.

While his group has the support of Gov. Edgar Chatto, Vice Gov. Concepcion Lim and First District Rep. Rene Relampagos, Veloso has kept himself visible in barangays. He has gone his way attending to vital community concerns like delivering road repair materials in response to people’s clamor, which otherwise has fallen to deaf city hall ears. With support clubs and organizations, he has spearheaded surgical-medical missions like free tuli. Consistently service-oriented, the former vice mayor has initiated mass feeding for children as in Cogon, for example, where his program has been carried out by the Sangguniang Kabataan (SK) led by chairman Rodney Magallano. Veloso has kept strong link with the sector of the women so that they had him and Oppus as their invited guest speakers capping the city celebration of the Women’s Month in April. He has maintained his low profile even if he has also involved himself in sports development of the youth sector.

kidding.  all these activities, and still the newswriter calls it a low profile?  this sounds like a press/praise release for veloso.

true..
however, it is still your choice if you want to be rich because of of the answers to my BIG WHY..
Why do i Need to be rich..
Simple.. i want to help more people.. i want to build schools and create a foundation for kids and elder people..

yes, we cant bring our richness to heaven.. but we can touch everyone's lives through our help from our richness..

you don't have to be rich to create all this, honest.  one can start by having one's heart in its proper place, getting the proper energy, organizational skill, and knowledge of what and who to tap for resources.

no foundation in the world is funded from one's own pocket.  if you tell me otherwise, then you don't know foundations.  some foundations are even organized as tax shelters by corporations.  that's a fact.

World Daily News / Re: Libya Has Missiles
May 08, 2012, 11:54:16 PM
countries are like people.  there's double standard too.  when suspected missiles belonged to gadhaffi and saddam, they were called threats, as iran's current nuclear ambition is a threat.  when they belong to israel, they are called defense.  but consider who's aggressive when it comes to potential war in the middle east nowadays and who are the ones who need to defend themselves.  come on, it's common knowledge that the west looks the other way when it comes to israeli nuclear weapons.

don't get me wrong.  israel has the right to exist.  but so do the palestinians.  now look at the latest israeli incursion into more palestinian lands.
