TWEAKS are still being made to a much-awaited mining policy change with no definite schedule as to when a Palace executive order (EO) will be issued.

"The EO (executive order) is still being reviewed," said Leo L. Jasareno, Mines and Geosciences Bureau director yesterday said.

President Benigno S.C. Aquino III last Wednesday told reporters that while he had some questions regarding the draft order submitted last Monday, the policy would likely be issued before the week ended.

Palace officials on Friday afternoon said the president had yet to sign the EO as Executive Secretary Paquito N. Ochoa, Jr., Environment Secretary Ramon Jesus P. Paje and Mr. Jasareno were still meeting to address Mr. Aquino’s concerns.

Asked about the results of the meeting, Mr. Jasareno said: "Some provisions are being edited but these are just standard revisions, mostly just replacing words or finding more specific terms, so that the provisions will not be subject to so many interpretations by people."

No date for the release of the new policy has been set, he said.

"It does remain to be a priority. I think it’s bound to come out very soon."

Mr. Aquino, speaking in Davao last week, said he had questions regarding revenue sharing -- an issue that has been contested by the industry, which claims that it is contributing more than enough to national coffers.

"Do we need legislation to effect a better return for the state?" he asked, adding: "The basis to impose higher fees or royalties ... is also being fleshed out."

Also in Davao, a legislator said the Senate would move to discuss possible amendments to the 1995 Mining Act once the mining policy is issued.

Sen. Francis G. Escudero, chairman of the Senate environment committee, on Saturday said legislation would address gaps the EO cannot address such as revenue sharing.

Mr. Escudero said the Senate "decided to await the mining EO before we act on the (proposals to amend the mining laws) so that we can be consistent."

The new mining policy, he said, should also strengthen investments but also require mining companies to come up with initiatives that would help the economy, including the establishment of processing facilities, before shipping products outside the country. -- B. A BILL that aims to improve the plight of the poor by addressing their basic needs and providing livelihood has been approved on second reading in the House of Representatives.

According to a statement released yesterday, House Bill No. 4484, or the Magna Carta of the Poor, the poor are those living under the poverty threshold set by the National Economic and Development Authority. Last year, the National Statistical Coordination Board stated that an average family of five who earns less than P7,607 per month or P91,289 per year are considered poor.

Salient provisions of the bill are:

• basic food items such as rice and sugar that have been seized from smugglers will be turned over to the Department of Social Welfare and Development for distribution to the poor;

• subcontractor and contractors of public works projects will be required to source a third of their manpower from the poor who reside in the project area;

• loans for livelihood will also be granted by concerned agencies for those who want to engage in business;

• poor students can avail of a socialized education program that will also allow attendance in college; and

• a provision for socialized housing.

The bill also plans to authorize accredited partners such as nongovernmental organizations, people’s organizations and private firms to accept donations or grants. -- MJOC

But the FPI, notorious for making threats and often failing to follow through, will face opposition from 40,000 fans planning to attend the sold-out show in Indonesia.

Little Monsters -- as Lady Gaga fans are called -- tweeted their determination to see the pop idol perform in Indonesia, 90 percent of whose 240,000 million inhabitants identify themselves as Muslim.

One page on Facebook, which is wildly popular in Indonesia, was seeking dancers for a Lady Gaga flashmob, which sees people perform a choreographed dance in a public place.

The flashmob is "to show our appreciation to Lady Gaga for planning to visit and to tell others who don't approve of her that there's nothing wrong with being her fans," said Anggiat Sihombing, an 18-year-old university student who set up the LadyGagaIndo account.

"We like her because she is a famous musician who makes use of her popularity to do good deeds, like establishing a foundation to protect kids who have been bullied."

The Lady Gaga Indonesia Facebook page has more than 42,000 "likes".

"Lady Gaga is not an ordinary human being. She uses her popularity to defend minority groups, especially gays and lesbians," said Hartoyo, general secretary of gay rights group OurVoice, who goes by one name.

"I would die for her," he said.

Despite the opposition to her tour, the "Poker Face" singer has not toned down her performances -- at the Seoul show on April 27 she rode onto the stage on horseback, wearing a black bodysuit and an enormous black metal headpiece.

There were small protests outside the show, with two foreign Christian protesters holding placards that read "Lady Gaga. Go home!" and "Sexual purity, virginity, fidelity", while about 20 South Korean Christian activists prayed.

In the Philippines, a youth organisation urged people to stay away from the star's May 21 concert, saying it posed a threat to moral values in Asia's largest Catholic nation.
