The white caped crusader pope, which was actually painted on paper and affixed to the wall with water-based glue, had drawn immense popular interest around the Borgo neighborhood of tiny cobblestoned streets near St. Peter's Square.

Residents living in low lying and mountainous areas under Signal No.1 were alerted against possible flashfloods and landslides.

Basyang intensified into a tropical depression before it entered the Philippine area of responsibility. It now packed maximum sustained winds of 55 kph  near the center and moved west at 30 kph.

It was last located 768 kilometers east northeast of Hinatuan, Surigao del Sur. It was forecast to make landfall over Surigao provinces late Friday or early Saturday.

Moderate to heavy rains were forecast due to the weather disturbance.

Basyang was expected to exit PAR on Monday.

Meanwhile, fishing boats and other small seacraft were advised not to venture out into the eastern seaboards of Central and Southern Luzon and of Visayas due to Basyang and the prevailing northeast monsoon.

FOI bill

Drilon made the statement two days after Santiago dared her colleagues to include in the freedom of information (FOI) bill a provision that would require the publication in a website of the basic salary, allowances and other sources of personal income of all public officials.

During her interpellation of FOI bill sponsor, Sen. Grace Poe, Santiago revealed the total monthly income of a senator was P1.4 million.

Confidential

But Drilon admitted that aside from a senator’s P90,000 salary, he or she was also entitled to a confidential budget of up to P280,000.

Drilon said there were certain instances when expenditures were confidential, and only during this circumstance was a simple certification by the concerned senator allowed in lieu of supporting receipts.

Drilon said these expenditures fall under items “extraordinary and miscellaneous expenses” (EMEs) and “other maintenance and operating expenses” (OMOEs), which have a total monthly allocation of P280,000.

He said the amount was used “to cover for expenses necessary and incidental to the performance of the official functions of the senator or in aid of legislation which includes, but is not limited to, gathering data relative to a legislative inquiry or to a concern or advocacy being advanced by the senator.”

Drilon said EMEs and OMOEs also cover expenses incurred to ensure the safety and security of the conduct of legislative inquiries and investigators and of persons invited to become witnesses.

Senate President Franklin Drilon. INQUIRER FILE PHOTO

MANILA, Philippinesâ€"Sen. Franklin Drilon agreed with Sen. Miriam Defensor Santiago that the P1.4 million each senator receives monthly isn’t his or hers to take home.

According to Senate President Franklin Drilon, the amountâ€"actually P1.45 millionâ€"is for each office to cover the staff salaries, allowances and office operating expenses, including supplies, communication and local travel, among others.

“But these funds are not meant to end up in the personal purses of the senators because they are used to keep their offices running to say the least. The amount is there to finance the full operations of their offices in pursuit of their legislative commitments,” Drilon said, adding that proper accounting procedures were followed.

Between these two clashing narratives is the mute testimony of grainy images captured by the condo’s CCTV cameras.  They show things that people themselves couldn’t see at the time they happenedâ€"like the precise moment and sequence at which they entered or emerged from the elevator. These images can be harnessed to lend credence to one version of the events or the other. Yet the recordings do not speak for themselves. Thus, we may never know the full story behind this incident.

Could he have considered the possibility that the supposed rapist was instead the victim of a frame-up?  If he did entertain such thoughts, chances are they would have been quickly dispelled by the earnest request of a seemingly contrite Navarro that the incident be kept out of the media. Paradoxically, a crime was made invisible by the very act of reporting it to the police. Yet there was nothing extraordinary in the policeman’s willful blindness to an offense that was staring him in the face.  He was clearly led to believe that everything was the result of a domestic misunderstanding, and maybe he thought he was doing everyone a favor by not making a fuss about it.

But accounts changed overnight. Navarro and his lawyers now claim he was set up and mauled by people who were out to extort money. He said he could not tell the policeman on duty at the police station what had really happened because he feared for his life and was confused.  With the support of his friends in the media, however, he has decided to come out to denounce Lee and Cornejo. Not to be outdone, Lee and Cornejo have also made themselves available to the media, giving their version of the events and how they took the trouble to report the matter to the police on the night of Jan. 22.

Private security guards see many things in the course of their work, but they notice only what it is their duty to notice. It is not their business, for example, to watch out for illicit relationships.  Their principal responsibility is to guard and control access to the premises to which they are assigned, and to assist the legitimate occupants when such assistance is requested.  On this particular day, the guards of Forbeswood chose to be more discreet than vigilant.

It is equally intriguing that Lee and company brought Navarro to the police.  The night duty officer at the Southern Police District precinct who received them and documented their account of what had happenedâ€"allegedly a citizen’s arrest in the face of an attempted rape committed by Navarro against Cornejoâ€"entered the testimonies of the concerned parties into the police blotter, and did nothing more.  The supposed rapist, who bore signs of severe physical beating, was neither detained nor physically examined by the police. The police saw nothing strange in the supposed rape victim’s decision not to file a complaint.  Like the security guards at the condo building, the SPD officer inquired no further, in the interest of respecting privacies.

The whole story is a perfect case study for a sociologist who likes looking at events from the standpoint of a second-order observer.  Unlike the first-order observer (that we all are in daily life) who collects information about the world in the course of his/her actions, the second-order observer focuses on how others see the world. On the premise that every way of seeing is also a way of being blind, the second-order observer zeroes in on the blind spots of particular ways of seeing.  These blind spots, which hound every perspective, explain why individuals do not react or respond to situations in ways that may seem natural or logical to others.

To illustrate: The security guards at the condominium building allowed Navarro to proceed to the unit occupied by the woman he was visiting, Deniece Cornejo.  He came through the lobby and so they did not see him as an intruder. We can assume that the guards either recognized him from past visits or he had been cleared by Cornejo.  When Navarro, shortly after, was brought down to the lobby, hands tied, by Cornejo’s friend Cedric Lee and his companions, we can be certain this was noted by the guards and duly entered in their log book.  That the guards did not intercept them suggests that they had been made to see the whole affair as a private matter. This is fascinating: Something unusual is normalized by making it transparent.

The incident has all the elements of an intriguing in-depth news report with a long shelf life. There’s violence, there’s sex and money, there’s show-biz celebrity and glamour, there’s TV network competition, and there’s visible mobilization of legal and political muscle.  More important, there are two sharply contrasting versions of what happened, leaving open the question of who is the victim and who is the victimizer.

Information has come in trickles, and each day brings new revelations and new players.  The public is kept buzzing by the addition of new voices that take one side or the other.  Netizens weigh in with their own theories and judgments, highlighting details that others don’t see.

Seeing something others don’t

By Randy David

The big topic of coffee shop talk these days is not the signing of the last annexes to the peace accord with the Moro Islamic Liberation Front. Nor is it the government’s latest bid to sidestep the constitutional issues triggered by the Disbursement Acceleration Program by arguing that the program has ceased, and therefore the case against it in the Supreme Court is moot and academic. The hottest subject of the week, rather, is the horrific mauling of the TV actor and comedian Vhong Navarro while visiting a female resident of a condo unit in a posh part of the city.

Campaign promise

Various FOI bills have been introduced in Congress over the years.

Senate Bill No. 1733 seeks to grant the public access to government information, excluding only sensitive national security issues. Most legislators are against the bill, fearing publication of government workings that public officials would rather keep from the people.

President Aquino, who had promised to support the bill during the 2010 presidential campaign, has expressed reservations over a provision that would make transcripts of Cabinet meetings available to the public, except those pertaining to national security and diplomacy.

With such a provision, a Cabinet official may think twice about making statements in such meetings, Aquino said.

Duty to disclose

In her interpellation, she said that the law must draw a distinction between the mandatory duty to disclose and the duty to permit access to information.

Santiago said that in some countries, an FOI act covers only information under control of the state. She acknowledged the need for “presidential communication privilege” and that other executive officials are entitled to the “deliberative process privilege” to preserve the quality of decision-making.

She suggested that the FOI include among its exceptions those already provided under the National Internal Revenue Code, AIDS Prevention and Control Act, and Inter-Country Adoption Act, “in addition to information provided by foreign governments.”

Santiago added that a previous Supreme Court ruling stressed the provision in the Philippine Mining Act requiring the Department of Environment and Natural Resources “to maintain the confidentiality of confidential information supplied by contractors who are parties to mineral agreements.”

“Under the Bill of Rights, on the one hand, the provision of communications and correspondence shall be inviolable. On the other hand, the right of the people to information on matters of public concern shall be recognized,” she said in a statement.

“We have to be able to finish the antagonism between these two provisions lest critics question the constitutionality of the FOI law in the Supreme Court.”

Santiago added that the FOI bill should be reconciled with the existing Data Privacy Act and other laws as well.

Conflicting provisions

The senator also cited the maintenance and other operating expenses (MOOE) given to every senator’s office every month. “It is long past overdue to dismantle the MOOE which is a secret source of additional income for every senator,” she said.

“We should tear apart the veil of secrecy which covers total incomes of politicians. A public website should allow the citizen to access every senator’s sources of income, including MOOE, chairmanship of certain committees, membership in the Commission on Appointments, or in the oversight committees,” Santiago added.

Santiago said that while she was an ardent supporter of the long-pending FOI bill, there are two constitutional provisions that might clash with each other in the proposed measure.
#15057
Talk of the Town / Re: Senators take home P1.4M a month
January 29, 2014, 11:45:34 AM
“The basic monthly salary of a senator is P90,000. But if you add all other legitimate sources of income such as allowances and honoraria, the total monthly income of a senator could be placed at some P1.4 million,” she said.

“There are some senators who did not finish high school or college. Do we really want to pay them this high a salary? That is a valid concern that voters might want to address, if they have access to information,” she said.

Santiago said she wanted the public to compare the monthly income of the highest-paid public official, the President, with the income of the “lowest-paid janitor in the bureaucracy.”

“In the corporate world, there is an algorithm for determining how much should be the salary of the highest-ranking officer, because it cannot be more than the salary of the lowest employee, when multiplied by a certain factor. That should also be the practice in the public sector,” Santiago said.
#15058

Santiago told the committee headed by Sen. Grace Poe that the transparency measure should require the publication in a website of the basic salary, allowances and other incomes of all government officials amid widespread public outrage at the fat bonuses executives of the Social Security System and other state-owned firms had awarded themselves.

“It is urgent to stop corporate greed in the state bureaucracy. Those people help themselves to outrageous allowances and bonuses as if the government is an enterprise for profit. That is a sclerotic view of public service,” the feisty former trial judge fumed.

She was particularly scathing on the emoluments of members of the upper chamber based on computations by its finance and administrative services department.

The huge savings that would be generated when Congress is abolished can be used to finance more urgent needs, like the rehabilitation of areas devastated by Supertyphoon “Yolanda,” he added.

We do waste a lot of taxpayer money on Congress, but I will not go as far as to call for its abolition. Limiting its session time would be enough.

That’s what is done in other countries. Urgent bills are accumulated and then the legislature is called to a session, for a limited time, to act on these bills. The legislators are paid only when they attend the sessions, unlike here when they are paid for the whole year and even when they do not attend sessions.

Not a bad idea. It would reduce absenteeism in Congress and save the people a lot of money.

“In year 2011, the Senate’s budget was P2.6 billion, HR (House of Representatives) with P8.3 billion, and the CA with P400 million. In 2012, the Senate’s budget was P2.9 billion, the HR  P5.8 billion and the CA P500 million. Again, with this huge amount and their respective pork barrels, the years 2011 and 2012 did not likewise prove to be very significant years for Congress in terms of performance and accomplishment. It only came up with the reproductive health bill and the postponement of the elections in the Autonomous Region in Muslim Mindanao to synchronize with the 2013 national and local elections, as their major legislation.”

Makalintal proposed the amendment of the Constitution to abolish Congress. Legislation can be enacted by the provincial boards which accurately know the needs of their constituents, he said.

This was revealed in a statement given to me by election lawyer Romulo Makalintal.

“While Congress also passed the 2014 budget in 2013, the same should not even be considered an accomplishment since it is Congress’ obligation to pass [it]…,” Makalintal said. “As a matter of fact, the Constitution provides that if Congress fails to pass the budget law for a particular year, the budget for the preceding year is ‘deemed reenacted and shall remain in force and effect.’

P35.2B for just one law in 2013

By Neal H. Cruz
Philippine Daily Inquirer
Tuesday, January 28th, 2014

Do you know that we taxpayers spent P35.2 billion last year for just one insignificant law? That’s how much we spent for Congress, including the Commission on Appointments (CA) which is composed of senators and congressmen, and their pork barrel, which had not yet been declared unconstitutional by the Supreme Court last year. In return, Congress last year passed only one minor law: the one-page Republic Act No. 10632, which suspended the 2013 Sangguniang Kabataan elections. For that one law, Filipino taxpayers spent P35.2 billion! That merits a place in the Guinness Book of World Records.

could be any rapist's victim.  if these airbrushed images are to be believed, she's pretty.  and a vamp.  the eyes and the mouth--both deliberately "sexified".  her condo unit was open?  she invited vhong to come?  ugh.  we still can't make out what is to be believed in their sordid story.

Capitalizing on the unendingly-popular cat craze, Susan Michalsâ€"the exhibition curatorâ€"said she made sure to avoid the novelty aspect of kitschy cat material and keep their influence strictly inspirational: cats as muses, allowing each artist to depict their own work of art based on the animals’ “unpredictable personalities, and the beautiful traits of their physicality” in various types of mediums including painting, photography, and sculpture.

try getting familiar with their ethereal characters, and some epic novel in the league of war and peace just might be had. :)

another footnote:

the case made rene cayetano a household name, which catapulted him to the senate.  now his two children are there, courtesy of name recall.(?)  some reports alleged that the actress pepsi paloma never stood a chance in terms of justice; not a cent even went to her after the out-of-court settlement that involved some amount of money changing hands.

but he doesn't go for the death penalty when the crime hews closer to home...

here's looking back to the early '80s:

Pepsi Paloma was an underaged Filipino-American actress who successfully made a name for herself during the early 80’s making sexy movies. She was one of the three “softdrink beauties” (the others were Coca Nicolas and Sarsi Emmanuelle) who simultaneously hit the big screen. Her list of films include:

- Room 69 (1985)
- Virgin Forest (1985)
- Matukso kaya ang angel (1984)
- Virgin People (1984)
- Naked Island (Butil-Ulan) (1984) …. Gunding
- Snake Sisters (1984)

In 1982, she lodged a rape case against “Eat Bulaga!” hosts Joey de Leon, Vic Sotto, and Richie D’Horsie (also known as Richie Reyes). Paloma’s lawyer in the rape case was a much younger Rene Cayetano who would later be elected as a Philippine senator. The rape case was settled out of court.

Afterwards, she stated that she was coerced to sign an affidavit of desistance by Tito Sotto (another “Eat Bulaga!” co-host and a future Philippine senator) to drop the case which had a punishment of death. De Leon, Vic Sotto and D’Horsie admitted guilt and made a public apology to Paloma.

In 1985, still burdened by her past, Pepsi Paloma hanged herself to death.

This was consistent, he said, with the rationale of R.A. 7659 or the Death Penalty Law, which provides that death penalty is appropriately necessary “due to the alarming upsurge of such crimes which has resulted not only in the loss of human lives and wanton destruction of property but also affected the nation’s efforts towards sustainable economic development and prosperity while at the same time has undermined the people’s faith in the Government and the latter’s ability to maintain peace and order in the country.”

In his bill, Sotto proposed that  death penalty be imposed for heinous crimes specified under   the Death Penalty law and all other laws, executive orders and decrees imposing death penalty.

“Republic Act No. 7659 is thus hereby revived,” said the bill.

“The imposed penalty of death shall be carried out through lethal injection. Republic Act No. 8177 otherwise known as the Act Designating Death by Lethal Injection is thus hereby revived and activated,” it further said.

Sotto bill revives death penalty

Sen. Vicente Sotto III. INQUIRER FILE PHOTO

MANILA, Philippinesâ€"Alarmed  by the  influx of heinous crimes,  Senator  Vicente  “Tito” Sotto  III  has sought the revival of Republic Act 7659 or the Death Penalty Law in the country through lethal injection.

In filing Senate Bill 2080 known as “An Act imposing death penalty in the Philippines,” Sotto  sought to repeal Republic Act No. 9346 otherwise known as “An act prohibiting the imposition of Death Penalty in the Philippines…”

“The influx of heinous crimes committed poses an alarming situation in the country nowadays,” he said in his explanatory note in the bill.

“The indiscriminate and horrendous brutality happening everywhere rightfully and justifiably compels the government to resort to the ultimate criminal penalty provided for by no less than our constitution- the death penalty. The imposition of life imprisonment proves to be a non-deterrent against criminality,” said Sotto.
