SCHWARTZ-JAMPEL SYNDROME

Schwartz-Jampel syndrome, which is an inherited disorder, causes muscle stiffness and weakness.

There are two types of Schwartz-Jampel syndrome â€" one which becomes apparent in later childhood, and another which is apparent at birth.

The disease, which cannot be relieved by medication or sleep, leaves muscles permanently tense.

Other symptoms can include joint deformity, a curved spine and a short stature.

But he was eventually adopted by father Will and his wife Colleen Drummond who read about the animal's plight on Facebook.

Colleen, who has been part of the family since Owen was three, said: 'As soon as they met, the effect Haatchi had on Owen was incredible.

'Before his arrival, Owen didn't like going out.

'When he first started school, he became more aware of being different, and he became even more withdrawn.'

Owen's condition requires regular hospital treatment but the simple joy of being around the 'energetic puppy' makes it easier for him to cope with.

Haatchi himself had a difficult start in life, suffering horrific injuries when he was tied to a railway line and hit by a train. He was found days later, cowering, with a mangled tail and back leg.

By the time he was taken to a vet's surgery, nothing could be done to save his leg and tail and both had to be amputated.

Haatchi's future looked bleak as the RSPCA and UK German Shepherd rescue centre struggled to find him a new home.

Speaking about his decision to bring Haatchi into the family, Will said: ‘It was more he chose us than we chose him.

‘At the foster home, they brought Haatchi in and he came bounding up to her (Colleen). And it was the first time he had wagged his tail since the operation.

‘She broke down and had to persuade me to take him â€" and it didn’t take a huge amount of persuading.’

‘That day he was still hiding in his wheelchair. But he got more confident when people were complimenting his dog and then he realised that people were looking at Haatchi more than him in his wheelchair.’

Will said that he and Colleen were initially hesitant to go about writing a book but decided to try it after Owen and Haatchi’s victory at Crufts.

‘We spoke to Owen about it and he loved the idea. And that’s how it started,’ Will said.

‘He likes the fact he is now an author and he is thrilled by it. He loves the fact people are able to read about his syndrome and understand it.’

Owen suffers from Schwartz-Jampel syndrome, which means his muscles are always tense.

The schoolboy's father, Will Howkins, adopted the pet from a rescue centre. The pair can be seen walking down the road together after becoming the best of friends.

Will said that when he and Owen’s stepmother, Colleen Drummond, went to get the dog they did not know it would have such a strong impact on their boy, explaining that they wanted Haatchi as a dog for the family.

‘We had no idea that it was going to help Owen,’ he told MailOnline.

‘About three weeks after we brought Haatchi home Owen wanted to take him for a walk in his wheelchair.

Speaking on This Morning on ITV, the confident schoolboy now says his life has transformed because of his pet.

He said: 'I used to be scared of strangers and I used to put head (down) like that before Haatchi came.

'But when Haatchi came I wasn't scared.

'He changed how I felt about being in a wheelchair. He's special because he changed my life.'

And now the youngster has helped pen a book - called Haatchi and Little B - about how the dog has completely transformed his life.

Owen told ITV's This Morning: 'He's my best friend in the whole world.'

Speaking about the moment he met Haatchi, he said: 'He put his head on my lap and that's how we became best friends forever.'

Activist Nato Reyes of leftist group Bayan said they welcome the striking down of the law's take-down clause and warrantless collection of data but have concerns over online libel.

"This constitutes a continuing threat against free speech. It is another huge step back for freedom of expression," he said, adding that his group will file a motion for reconsideration before the High Tribunal.

Reactions

The Cybercrime Prevention Act was signed into law in September 2012, 11 years after a first version was filed in Congress. A temporary restraining order, which was later on extended, was issued a month after, pending the decision of the High Court.

Aguto said his division â€" which deals with cybercrimes â€" welcomes the SC decision, as the law will help in their operations and can bolster the state's legal defense against cyber criminals.

"I understand this will be an additional cost to the telecommunication companies. But as far as the law enforcement is concerned, it would be a good and a very effective tool for us to get the necessary information from the telcos (telecommunication companies)," he said of the law.

The SC cited the guarantee against double jeopardy or being punished more than once for the same offense â€" a guarantee outlined in the Constitution â€" in deciding on Section 7.

Libel is punishable by Article 353 of the Revised Penal Code, while child pornography is punishable by RA 9775 or the Anti-Child Pornography Act.

A person convicted of libel or child pornography can only be punished once, under the coverage of a single law.

National Bureau of Investigation (NBI) Cybercrime Division Chief Ronald Aguto explained to Rappler that it will also be hard for both law enforcement and the prosecution to prove the "attempt to commit a cybercrime."

Aiding and abetting the commission of a cybercrime, he added, might unduly cover certain players in the online industry.

Section 7, which pertains to liability of a cyber criminal under other laws, was declared unconstitutional only in the following cases: online libel and child pornography.

A separability clause contained in Section 29, Chapter VIII of the law allows the rest of the law to "remain in full force and effect" even if certain provisions are held invalid.

Nuances in other provisions

Three other provisions were not struck down and remain in the law, but they will not apply in certain cases as decided by the SC. Among these provisions is online libel, which is constitutional as far as the original author is concerned.

Section 5, which pertains to aiding or abetting the commission of a cybercrime and to the attempt to commit a cybercrime, was declared unconstitutional only in the following cases: child pornography, unsolicited commercial communications (or spam), and online libel. Section 5 will apply to all other cybercrimes outlined in the law.

Even the Solicitor General, in his defense of RA 10175, admitted before the SC that Section 19 is "constitutionally impermissible, because it permits a form of final restraint on speech without prior judicial determination."

Section 12 would have allowed law enforcement authorities with due cause to collect or record by technical or electronic means "traffic data" in real time.

Section 4 (c)(3) of the law says that "the transmission of commercial electronic communication with the use of computer system which seek to advertise, sell, or offer for sale products and services are prohibited" unless certain conditions â€" such as prior affirmative consent from the recipient â€" are met. This was ruled unconstitutional.

Among the hotly-debated issues during the oral arguments was the law's provision on online libel.

The Supreme Court decision, penned by Justice Roberto Abad, ruled online libel to be constitutional but with an exception â€" that is, in cases where it covers persons other than the original author. Recipients of, and netizens who react to a potentially defamatory post, will not be covered by online libel.

Unconstitutional provisions

Three provisions were voted down as categorically unconstitutional:

    Section 4 (c)(3) which pertains to unsolicited commercial communications
    Section 12 which pertains to real-time collection of traffic data
    Section 19 which pertains to restricting or blocking access to computer data

The SC decided that Section 19 â€" granting power to the Department of Justice (DOJ) to restrict computer data on the basis of prima facie or initially observed evidence â€" was not in keeping with the Constitution. The said automatic take-down clause is found in Section 19 of the cybercrime law.

MANILA, Philippines (2nd UPDATE) â€" The Supreme Court on Tuesday, February 18, upheld as constitutional most provisions of Republic Act 10175 or the Cybercrime Law, including online libel â€" subject to one condition.

The High Court also struck down a provision of the law that gives the state the power to take down online content without a court warrant.

Seeking to strike a balance between fundamental freedoms and government control, the High Court decided on the constitutionality of Republic Act 10175 a little over a year after oral arguments were heard on Jan 15, 2013.
