D E C I S I O N

CARPIO, J.:

The Case

This is a complaint for disbarment filed by the members of the Board of Directors[1] of the Rural Bank of Calape, Inc. (RBCI) Bohol against respondent Atty. James Benedict Florido (respondent) for “acts constituting grave coercion and threats when he, as counsel for the minority stockholders of RBCI, led his clients in physically taking over the management and operation of the bank through force, violence and intimidation.”

The Facts

On 18 April 2002, RBCI filed a complaint for disbarment against respondent.[2]  RBCI alleged that respondent violated his oath and the Code of Professional Responsibility (Code).

According to RBCI, on 1 April 2002, respondent and his clients,      Dr. Domeciano Nazareno, Dr. Remedios Relampagos, Dr. Manuel Relampagos, and Felix Rengel (Nazareno-Relampagos group), through force and intimidation, with the use of armed men, forcibly took over the management and the premises of RBCI.  They also forcibly evicted Cirilo A. Garay (Garay), the bank manager, destroyed the bank’s vault, and installed their own staff to run the bank.

In his comment, respondent denied RBCI’s allegations.  Respondent explained that he acted in accordance with the authority granted upon him by the Nazareno-Relampagos group, the lawfully and validly elected Board of Directors of RBCI.  Respondent said he was merely effecting a lawful and valid change of management.  Respondent alleged that a termination notice was sent to Garay but he refused to comply.  On 1 April 2002, to ensure a smooth transition of managerial operations, respondent and the Nazareno-Relampagos group went to the bank to ask Garay to step down.  However, Garay reacted violently and grappled with the security guard’s long firearm.  Respondent then directed the security guards to prevent entry into the bank premises of individuals who had no transaction with the bank.  Respondent, through the orders of the Nazareno-Relampagos group, also changed the locks of the bank’s vault.

Respondent added that the criminal complaint for malicious mischief filed against him by RBCI was already dismissed;  while the complaint for grave coercion was ordered suspended because of the existence of a prejudicial question.  Respondent said that the disbarment complaint was filed against him in retaliation for the administrative cases he filed against RBCI’s counsel and the trial court judges of Bohol.

Moreover, respondent claimed that RBCI failed to present any evidence  to prove their allegations.  Respondent added that the affidavits attached to the complaint were never identified, affirmed, or confirmed by the affiants and that none of the documentary exhibits were originals or certified true copies.

The Ruling of the IBP

On 28 September 2005, IBP Commissioner Leland R. Villadolid, Jr. (Commissioner Villadolid, Jr.) submitted his report and declared that respondent failed to live up to the exacting standards expected of him as vanguard of law and justice.[3]  Commissioner Villadolid, Jr. recommended the imposition on respondent of a penalty of suspension from the practice of law for six months to one year with a warning that the repetition of similar conduct in the future will warrant a more severe penalty.

According to Commissioner Villadolid, Jr., respondent knew or ought to have known that his clients could not just forcibly take over the management and premises of RBCI without a valid court order.  Commissioner Villadolid, Jr. noted that the right to manage and gain majority control over RBCI was one of the issues pending before the trial court in Civil Case No. 6628.  Commissioner Villadolid, Jr. said that respondent had no legal basis to implement the take over of RBCI and that it was a “naked power grab without any semblance of legality whatsoever.”

Commissioner Villadolid, Jr. added that the administrative complaint against respondent before the IBP is independent of the dismissal and suspension of the criminal cases against respondent.  Commissioner Villadolid, Jr. also noted that RBCI complied with the IBP Rules of Procedure when they filed a verified complaint and submitted duly notarized affidavits.  Moreover, both RBCI and respondent agreed to dispense with the mandatory conference hearing and, instead, simultaneously submit their position papers.

On 20 March 2006, the IBP Board of Governors issued Resolution No. XVII-2006-120 which declared that respondent dismally failed to live up to the exacting standards of the law profession and suspended respondent from the practice of law for one year with a warning that repetition of similar conduct will warrant a more severe penalty.[4]

On 5 July 2006, respondent filed a motion for reconsideration.  In its 11 December 2008 Resolution, the IBP denied respondent’s motion.[5]

The Ruling of the Court

We affirm the IBP Board of Governors’  resolution.

The first and foremost duty of a lawyer is to maintain allegiance to the Republic of the Philippines, uphold the Constitution and obey the laws of the land.[6]  Likewise, it is the lawyer’s duty to promote respect for the law and legal processes and to abstain from activities aimed at defiance of the law or lessening confidence in the legal system.[7]

Canon 19 of the Code provides that a lawyer shall represent his client with zeal within the bounds of the law.  For this reason, Rule 15.07 of the Code requires a lawyer to impress upon his client compliance with the law and principles of fairness.  A lawyer must employ only fair and honest means to attain the lawful objectives of his client.[8]  It is his duty to counsel his clients to use peaceful and lawful methods in seeking justice and refrain from doing an intentional wrong to their adversaries.[9]

We agree with Commissioner Villadolid, Jr.’s conclusion:

Lawyers are indispensable instruments of justice and peace.  Upon taking        their professional oath, they become guardians of truth and the rule of law.  Verily, when they appear before a tribunal, they act not merely as representatives of a party but, first and foremost, as officers of the court.  Thus, their duty to protect their clients’ interests is secondary to their obligation to assist in the speedy and efficient administration of justice.  While they are obliged to present every available legal remedy or defense, their fidelity to their clients must always be made within the parameters of law and ethics, never at the expense of truth, the law, and the fair administration of justice.[10]

A lawyer’s duty is not to his client but to the administration of justice. To that end, his client’s success is wholly subordinate.  His conduct ought to and must always be scrupulously observant of the law and ethics.[11]  Any means, not honorable, fair and honest which is resorted to by the lawyer, even in the pursuit of his devotion to his client’s cause, is condemnable and unethical.[12]

WHEREFORE, we find respondent Atty. James Benedict Florido GUILTY of violating Canon 19 and Rules 1.02 and 15.07 of the Code of Professional Responsibility.  Accordingly, we SUSPEND respondent from the practice of law for one year effective upon finality of this Decision.

Let copies of this decision be furnished the Office of the Bar Confidant, to be appended to respondent’s personal record as attorney.  Likewise, copies shall be furnished to the Integrated Bar of the Philippines and in all courts in the country for their information and guidance.

         SO ORDERED.

                                                                  ANTONIO T. CARPIO

Powder coating makes steel cabinet more durable
by Tess Superioridad Baluyos

Cagayan de Oro City, PIA -- What makes one steel cabinet different from other steel cabinets? It could be its size, its color?

"Its durability!" quickly says Engr. Francis Celis, owner of Jacsons Enterprises. The big difference is made possible by a technology intervention called "Powder Coating."

Powder coating technology is a process of which steel cabinets or vaults are finished with an electrostatic powder coating. The powder is applied to all sides including the bottom panel. Powder coating is more durable than enamel and it is scratch-resistant, providing a lifetime quality appearance.

"Powder coating technology has been there for the last 25 years and it is becoming more popular due to its high durable effect. I first heard about it in Malaysia and I have been wanting to adopt the technology. However, due perhaps to its high price, it was not popular then because not everybody can afford it," Engr. Celis says.

Jacsons Enterprises started in the early 70's in Iloilo City as a single proprietorship owned and founded by Jose Celis. It was later incorporated as Jacsons' Metalcraft Enterprises, trading office equipment such as typewriters, calculators and steel cabinets.

In the early 80's, the business shifted to steel manufacturing, mainly steel cabinets and other related steel and metal products.

As part of its long-range business plan to expand to other regions, the company decided to open a distribution outlet in Cagayan de Oro City as a franchise, in favor of Engr. Celis, who is also an incorporator.

While attending a national convention of the Metals Industry Association of the Philippines (MIAP) in Manila, an engineer from the Metals Industry Research and Development Institute (MIRDC) mentioned to Engr. Celis about the Small Enterprises Technology Upgrading Program (SETUP) of DOST.

Engr. Celis clearly recalled that the SETUP assistance extends not only financial but also the technical aspect. His interest was heightened, as he wanted to go into powder coating, just like what they do in Malaysia.

Months later, two engineers of MIRDC-Engineers Roy Sagrado and Royce Donasco, based in Cagayan de Oro City, contacted Engr. Celis. He was also assisted in the preparation of the project proposal and the compliance of other requirements. Misamis Oriental Provincial Director Cecilia Aca-ac was also there to assist.

In 2005, a SETUP technology assistance in the amount of P980,000 was granted to Jacsons' Enterprises for the acquisition of production equipment like the batch-type bake oven, powder spray paint booth, powder spray gun and powder sieving machine.

Today, Jacsons' Enterprises is the only powder coating manufacturing plant in region 10. It employs 40 workers (20 in the production and 20 in the office and marketing) and gets about 20% of the powder coated steel cabinet market share in Mindanao.

It has established dealers and distributors in Davao, General Santos City and in Caraga Region. The company plans to increase its production from its present capacity of 200 units per month to be able to cope with the increasing market demand in Mindanao and to supply the whole of the Visayas region. They also plan to export their products to Asian countries.

For now, he is serving the demand of big government agencies and multinational companies in the region for powder coated products.

Engr. Celis confessed that he used to have second thoughts about accepting support from government agencies due to bureaucracy. His experience with DOST, however, has changed his perspective. In fact, he is thankful for the continued assistance he receives from the various agencies under the DOST like MIRDC, ITDI and yes, from the DOST in region 10 and its Misamis Oriental Provincial Office.

EastEnders scriptwriters have revealed the Queen Victoria pub will be burned down as part of a major storyline later this year.

The scenes will spell the end of the current pub set ahead of the soap's move to high definition in the autumn.

It has not been announced whether any characters will die in the blaze, although several are being written out, including landlady Peggy Mitchell.

Actress Barbara Windsor is leaving the BBC One soap after 16 years.

In October, Windsor revealed she planned to leave the show, saying she would be "so sad to leave Peggy behind".

"EastEnders has been wonderful to me and it's no secret that it changed my life all of those years ago," she said.

Since then it has also been announced that Minty Peterson, played by Cliff Parisi, taxi driver Charlie Slater (Derek Martin) and student Libby Fox (Belinda Owusu) are also being written out.

In April, Lacey Turner - who plays Stacey Branning, announced she would also be leaving the soap. - BBC Online

Who shot and killed Barquio at dusk last Thursday at the Dao integrated bus terminal?

This is the question on most people’s minds when it became clear that Barquio was executed by a determined killer.
Barquio had just emerged from a tricycle at the Dao integrated bus terminal on his way home after posting bail for an illegal possession charge last June 10.

The 43-year-old barangay councilor of Zamora , Talibon, however, never made it home alive.

Two suspects who obviously trailed him, his wife and two sons from the time he left his detention cell in Camp Dagohoy on a motorcyle moved in for the kill.

One of them shot him with a .45 caliber revolver with a silencer, wounding him the first time. The victim tried to run in the direction of the mall near the terminal perhaps hoping he would be safe there.

The killer was not to be denied, however, and he stalked his prey, unrelenting until he made sure Barquio was finished.

Barquio was rushed to the Gov. Celestino Gallares Memorial Hospital but attending physicians declared his dead on arrival. The victim sustained gunshot wounds on his head and the body.

With the gangland-style execution carried out in full view of horrified onlookers, there was no mistaking that the killers, or the one who sent them, wanted Barquio dead.

Sources in Talibon confirmed that Barquio lived a jaded life.

He had been previously accused of robbery but the case did not prosper.

The victim was also implicated in the killing of a policeman’s brother although he was not formally charged.

Witnesses said Barquio’s suspected involvement in other illegal activities is widely known but few come out in the open.

When he was drunk, Barquio reportedly bragged about his exploits and people said they do not want to find out if he was telling the truth or not.

There were also unconfirmed reports of suspicious-looking characters visiting his residence.

The increasing incidence of highway robberies in the towns near Talibon and Barquio’s associations with unidentified men made his neighbors more uneasy.

They, however, felt it would be better to just shut their mouths and leave their suspicions to themselves.

There were stories, again unconfirmed, that the policeman’s brother was slain because he was suspected of being an asset.

With the killing, some of his neighbours say they feel like a thorn had been pulled out. Again, they refuse to elaborate.

With the manner the killing was carried out efficiently, it is doubtful if the killers left many clues aside from the two empty shells from a caliber .45 revolver.

Except for the black Yamaha DT 123 motorcycle, little else is known of the suspects who wore black bonnets and bonnets to conceal their identities.

Tagbilaran Mayor Dan Lim said the people of Tagbilaran have little reason to fear.

“Indications point either to a personal vendetta or a contract for a specific target,” the mayor said.

To killers like this, Lim said no place is off-limits and no target is safe.

Police investigators are considering many angles with Barquio’s death.

One is his former alleged involvement with the underground New People’s Army many years ago in Mindanao .

Another is revenge by those whom he allegedly rubbed the wrong way.

What the police refuse to confirm is that Barquio was killed by vigilantes who suspected him of involvement in robberies and hold-ups.

It is too soon to know the real story.

Investigative story by Sunday Post

A wild chase Thursday afternoon perpetrated by a suspected gun-for-hire involving a target who was a Talibon barangay kagawad ended a few meters away from the stairs of the east entrance of the Island City Mall with the victim suffering a fatal bullet wound in the head causing his death.

The victim identified as Rodrigo Barquio y Didumo, 43, a barangay kagawad of Zamora, Talibon town, was on his way to his hometown when a lone gun man came from behind and shot hit.

The barangay councillor missed the first shot prompting him to run for his life towards the ICM from the Integrated Bus Terminal.

The suspect who was believed to be a hired gun gave chase and caught up with his quarry among the parked vehicles fronting the east entrance of the mall.

According to taxi drivers in the vicinity, when Barquio stumbled to the ground, he was executed in gangland fashion by a 38 cal. snub-nosed revolver by the lone assailant.

The suspect then casually fled from the scene boarding a waiting DT motorcycle.

The suspect was said to be wearing a black jacket. He wore a bonnet when fleeing the crime scene.

The same eyewitnesses revealed that two others on board a Honda XRM acted as lookout while the killing took place. The look out followed the motorcycle boarded by the gunman.

The ill-fated barangay captain had just been from the headquarters of the Philippine National Police to post bail arising from an illegal possession of firearm charge.

His house in barangay Zamora was raided by elements of the Provincial Investigation and Detection Management at dawn on June 8. The raid which was carried out on the strength of a search warrant issued by Executive Judge Fernando Fuentes III yielded  a 38 cal. revolver.

With the illegal possession case, he posted a cash bond of P60,000 granting him temporary liberty.

As he was out of the PNP compound, the victim, together with his wife Delia, and five children, hailed a motor tricycle enroute to the Dampas terminal.

Interviewed later, Delia narrated that she already noticed that as they left  the PNP compound, he noticed two men riding in tandem followed them until they alighted at the terminal.

She believed that one of the men who followed them while on board a tricycle was the gun man.

It was the second time that the barangay kagawad was shot.

Last May 28, Delia’s husband was also shot by an unknown person hitting him in the left side of his body. The wife was not sure if the same suspect in the earlier shooting was the same person involved in the latest incident causing his death.

Mall bystanders brought the dying victim to the Gallares Memorial Hospital after the Thursday shooting but attending physicians pronounced him dead on arrival.

Four days since the violent incident happened, police are still tracking the whereabouts of the suspects who were believed to be gun-for-hire.

The elections for new officers of the Liga ng mga Barangay, Bohol chapter, yesterday at the Bohol La Roca Hotel, went ahead despite a court order sought to stop the proceedings.

Taloto Barangay Captain Faro Cabalit who is the city Liga president made a last ditch rally to stop the elections only to be turned down by the election organizers led by outgoing Liga president Concepcion Lim.

The lady Liga president resigned from her post yesterday after winning the position of vice governor during the May 10 elections.

Cabalit who was groomed to oppose the candidate backed by the Liga majority walked out from the elections after realizing the futility of his bid to stop the balloting.

He never came back after the last vote was counted with his opponent topping the polls with 38 votes. The city Liga head only managed to poll four votes.

The choice of the Liga majority, Crispina Vergara, Liga president of Mabini town, was backed up by 38  federation presidents who rallied by her side making her the runaway winner.

Vergara is a first degree cousin of Mabini Mayor Stephen Rances who was elected vice mayor in the last polls after completing his term as mayor.

With the  court action sought by Cabalit, the question now hanging over the head of the new Liga president was that can she sit legally as ex-officio member of the Sangguniang Panlalawigan of Bohol?

This surfaced following  Cabalit’s question of  the conduct of the special election of the vacant presidential and vice-presidential positions of the Liga.

He said he had secure a court order for a temporary restraining order (TRO) issued and signed by acting Executive Judge Suceso A. Arcamo of Regional Trial Court of Bohol Branch 47.

Judge Arcamo said the TRO was effective for 72 hours, “restraining the Liga--Bohol thru its president Hon. Concepcion O. Lim and all persons acting in her behalf from holding the special election on June 19, 2010.” “The court finds time of the essence and indeed there is an extreme urgency to issue a seventy-two hours TRO.”

But it was learned that a Liga committee composed of Liga presidents Romeo Labor, Rolando Ibale and Elenito Llorente, outrightly rejected the court order presented by Cabalit during the assembly yesterday prior to the election because the court order was not addressed to them.

The court order docketed as Civil Case No. 7774 directed the Liga--Bohol chapter represented by past president Concepcion Lim. Lim said she has already resigned as Liga president in the morning of June 18, 2010 but the court order was reportedly served in the afternoon of the same day.

The special election went on undisturbed with federated president Crispina  was elected winning the vote.

Vergara, said to be a protégé of Lim got a total of 38 votes as against only four votes for her lone opponent Taloto barangay captain Cabalit.

Her running-mate Antequera’s federated president Maxelinda Ayco was also elected as provincial federated vicepresident, garnering a total of 32 while her rival Panglao federated president Cerino Hormachuelos got nine votes.

Immediately after their proclamation, both Vergara and Ayco took their oaths before Regional Director Pedro Noval of the Dept. of Interior and Local Government (DILG).

ELECTIONS IRREGULAR?

Cabalit said in an interview that the said election was irregular and violated the prescribed reglamentary period within which the said special election should be held based on the Election Code of the association.

He  said  the conduct did not observe the 15-day period upon which notices of such holding of special election shall be forwarded to all qualified members, in this case to 48 members, including this city.

He said he only received the notice for the conduct of such election in less than a week’s time.

After the rejection of the order, Cabalit skipped the election upon the advice of his  counsel but his name was still included in the candidates for Liga president. He said he should not have attended the election proceedings because in the first place it was “illegal” though his candidacy was for president was considered. He was voted upon in absentia, however.

Under section 1 Article XI of the Constitution and By-Laws of the LnB, the incumbent national Liga executive board “is authorized to order the holding of such elections for the Liga chapter concerned.” Thus, the 4th Liga executive board has passed Resolution No. 04-SPE-10-51- s. 2010, effecting such special election.

The national Liga board authorization of the special election is based on Section 2, Article XII of the same constitution and By-Laws that provides that in the event of vacancy due to “voluntary resignation” (in the case of Lim) the vice-president in the case of provincial Liga “shall assume the office for the unexpired term.

“In the case of a vacancy in the office of the executive vice-president and/or vice-president in the national Liga, the same shall be filled through an election among the bonafide and chapter members.”

The conduct of said special election was witnessed by the DILG regional director, Comelec Provincial Supervisor lawyer Eliseo Labaria and Provincial Secretary  BOniafcio Quirog of the Sangguniang Panlalawigan. (With reports of Sen Guingguing and Ric Obedencio)

Bohol is one  of the 10 provinces and one city chosen by the Department of Education as pilot centers in the teaching of sex education to  Grave V and VI pupils.

In a check with Dr. Lorna Rances, Bohol schools division superintendent last night, she said she was not sure if the pilot study was about sex education. Her instruction was for Adult Reproductive Health (ARH). Whether they are  the “same banana” (ARH or SE), Dr. Rances is yet to receive a memorandum to this effect.

Whatever specific subject is going to be taught beginning this school year, Dr. Rances confirmed that ARH will be test piloted in three school districts namely Ubay, Carmen and Talibon with expansion districts like Dauis, Buenavista and Loboc.

As to the specific schools in these districts, Dr. Rances did not identify.

Bohol along with Ifugao, Mountain Province, Masbate, Eastern Samar, Maguindanao, Lanao del Sur, Sulu, Tawi tawi and Sultan Kudarat. The lone city in the list is Olangapo.

WHAT’S IN A NAME?

A news story that appeared in the Cebu Daily News last Tuesday showed that the DepEd is teaching sex education not ARH  although they may end up with the same connotation.

The story said the DepEd has been teaching sex education before it was integrated in other subjects like Biology but this time the Catholic Church is protesting a specific United Nations Population Fund Project to teach sex education in schools.

Education officials insist that the bishops have nothing to worry about because DepEd was open to deleting portions of the teaching modules that the Church would find offensive.

“In Grade V, teaching about the reproductive system is very clinical” said DepEd Asst. Sec. Teresita Inchiong. “They have models showing the flow of the sperm cell. Copulation is not there (but) the flow of the egg cell meeting (the sperm cell) is there”.

For Grade V, sex education would be included in the Science and Health subject that would have lessons on the reproductive system.

For Grade VI, it would be integrated in Edukasyong Pantahanan at Pangkabuhayan and it would include lessons on the  “proper behaviour between peers of different gender”, personal hygiene, and the problems caused by unwanted pregnancy.

Tagbilaran Mayor Dan Lim yesterday thanked the Cebu Citizens Press Council (CCPC) for sending a fact-finding team to investigate the allegations raised by the Bohol Chronicle and Peter Dejaresco.

“For a change, I have been the given the opportunity to respond to the allegations and to air my side, something that has been deprived me by the owners of Bohol’s biggest media organization, Peter Dejaresco and Bingo Dejaresco, for the past two years,” Lim said.

The mayor also thanked the fact-finding team and Sun Star Daily for publishing the “fair and exhaustive report” in the paper’s July 18 issue.

Lim, however, said he wanted to raise a few points “for the sake of emphasis”.

“First, Peter Dejaresco has consistently if not deliberately failed to show proof of tax payments before 2004,” he noted.

The mayor said mere claims are not enough to erase the suspicion that they were given preferential treatment by previous administrations.

“They now make a big deal of the payments they said they deposited but it is not for them to make the assessment of how much they owe the city,” he added.

The mayor also disputed the Dejarescos’ claim that the allege harassment started in response to their exposes.

“These alleged exposes have turned out to be nothing but hot air. They have gone to nearly every government office but to this day only the harassment case filed before the Ombudsman went beyond first base,” he added.

Lim said it is “amazing” that while the reporting and commentaries the past two years virtually pictured him as “the devil incarnate”, the only complaint where he was asked to comment was a harassment case filed by Bingo Dejaresco.

“I am not a masochist but their attacks in fact motivate me to work harder and give my best,” the mayor added.

As for the alleged attacks on their workers, Lim said they are always free to seek redress before the courts of law as two of them have actually done.

He noted that it has come to a point where it would be better for a neutral court or party to investigate their complaints.

“I cannot make a credible investigation if I happen to be the object of their complaints,” he pointed out.

Lim said that modesty aside, he is comfortable with his public service record before his constituents, pointing to his “comfortable margin of more than 8,000 over the candidate virtually endorsed by Peter Dejaresco and Bingo Dejaresco”.

“I won in all of the City’s 15 barangays which was made more impressive if you note the vicious and relentless attacks against me for the past two years,” he added.

Prior to the election, Lim said the results of the survey conducted by the Holy Name University showed that 82 percent of those polled approved of his performance.

Lim confirmed that he and Peter Dejaresco were the best of friends before.

“If he thought our friendship was enough for him to get special treatment though, he is wrong,” he added.

The mayor said even his own sister had to pay higher taxes when he took over.

“Over her protestations, I made the proper assessment because I always believed that no one is above the law, not her, not Peter Dejaresco,” he added.

As to the free time slot for the mayor’s report, he said it was also given to his predecessors.

“If I knew that it was given in exchange for the unpaid taxes before 2004, I would not have availed of it in the first place,” he added.

Lim said he is aware that after three years, he will bow out of office.

“If I am abusive and an enemy of press freedom as Peter Dejaresco claims, it will be the end of me,” he pointed out.

The mayor said what bothers him, however, is the fact that there is no end in sight for the excesses and abuses of people who find refuge as media practitioners.

“While Peter Dejaresco and Bingo Dejaresco can complain to their colleagues after all their efforts to discredit me has failed, the people of Tagbilaran and Bohol have nowhere to go to seek redress,” he added.

Lim, however, reiterated his commitment to serve the people of Tagbilaran for the next three years.

“The mandate that they gave me in the May 10, 2010 elections is the sweetest of all not only because it gave me the biggest winning margin in Tagbilaran’s history but because it was given in spite of all the mud, dirt and filth thrown my way,” he added.

Lim said he is confident that objective people will give him “a fair shake”.

“After all is said and done, I believe that history will judge me as it will judge Peter Dejaresco and Bingo Dejaresco,” the mayor concluded.

Countdown to granting of 45,000 land titles for Boholanos nears its end and the local Department of Environment and Natural Resources (DENR) has accomplished the awarding of 27,000, reports Environment officer Nestor Canda.

A land title is a legal term which encompasses all the bundle of rights of a property owned by a person, defines wikipedia.

Simply said, a land title is a legal evidence of ownership of a piece of property and upon which, a transfer of the property by sale or donation necessarily requires the conveyance of the same title document.

In the country, it is estimated that about 46% of the 24.2 million parcels of land remains untitled and about 70% of these, or 7.8 million are residential lands, according to the Land Administration and Management Project (LAMP) website.

Reasons vary as to why a huge number of parcels of land remain untitled, a town assessor explains.

Processing and application for title can be costly, time consuming and tis can uncover a variety of other land problems, legal disputes, back taxes, encumbrances and even false claims, she said.

Now, the government has put in place a system wherein people can file their applications and pay the minimal amout to be able to finally get the proof of ownership of the lands.

The program is also part of the governments effort to streamline processes, enforce a system in land administration and management and finally give to the land owners the right to use the land in any way they deem as appropriate, she added. That system is called the LAMP, she continued.

In granting land titles, the government aims to award some 102,000 titles at the end of the LAM project, Canda explains meaning LAMP , which would close by the end of December this year.

Aside from Bohol, the five year project, funded by a World Bank grant and a technical assistance by the Australian Agency for International Development (AusAID) and the government of the Philippines is also implemented in Leyte and Bukidnon Provinces.

LAMP he said is the government’s offer of easy and affordable, fast and transparent process of getting land titles and assure the land security tenure so they can decide better what to do in their lives, said Canda who is also a LAMP Project Manager here.

With the project nearing its end, Canda said they are now studying the new system of sustaining the project though initiatives by the local governments.

In Bohol, it was Maribojoc which has effectively started an LGU led continuing project, one that may be duplicated in other areas so that land owners with out titles can finally get one. (PIA-Bohol)

Other than Panglao Airport Project, which was endorsed for continued support by the new Administration, majority of Bohol’s next development would be gyrating off to the island’s northeastern towns.

And if the proposed projects get implemented, it would seem that the general region comprised of the cluster of towns from Clarin to Ubay would be the next economic growth center in the island.

At the recent meeting of Bohol’s key development councils including the Provincial Peace and Order, Sangguniang Panlalawigan and the League of Municipalities of the Philippines, the joint council meeting endorsed the $3M Compact loan for the Ubay Airport Development project by Korean Official Development Assistance with the Civil Aviation Authority of the Philippines as project proponent.

Also endorsed was the P38M Bohol Holistic Enterprise for Livestock based Livelihood Opportunities (Hello) for funding under the Korean International Cooperation Agency (KoICA), an integrated poverty alleviation intervention that would be implemented mostly in the region’s poverty saddled towns.

Head of project implementer, Dr. Stella Marie Lapiz said the project would benefit families in San Isidro, Danao, Dagohoy, San Miguel, Trinidad, Bien Unido, Sagbayan, Clarin, Inabanga, Buenavista, Getafe, Talibon, Ubay and President Garcia.

Part of the endorsed projects which concentrates on the second district of Bohol is the three bridges proposed for the Tulay ng Pangulo which are all located in the Mabini-Ubay road namely Pasanan, Biabas and Ondol bridges, at an aggregate cost of P61M and following the Austrian Assisted Bridges Program.

Moreover, the councils also pushed for the inclusion of the Bohol Dairy Production and Meat processing the in the Korea-Philippine Multi-Industry Cluster Agreement. The centere was initially identified to be placed at the Ubay Stock Farm.

Other than those, also resolved was the request for the Philippine Ports Authority to jumpstart soonest the Ubay Port Causeway to its highway access to avoid traffic jams and accidents in its present access.

Meanwhile, the P500M Ubay Port development, a component of the Strong Republic Nautical Highways has just been completed and now effectively connects the town to the neighboring islands by ferry boats.

Govenor Erico Aumenatdo however stressed that the proposed development would spur economic activity and would pluck the people from the harsh poverty situation in the region.  (PIA-Bohol)

Philippine Business News / Crime in Bohol Island
June 20, 2010, 06:24:19 AM
Criminality in Bohol dipped 10% during the period May 1-31 despite the usual rise in crimes by the fiesta month owing to the bulk of well-wishers that can camouflage the entry of criminal elements from nearby islands.

For the police force, the month also featured a change in command in Camp Dagohoy from Boholano PSSupt Anthony Obenza to Pssupt. Rodolfo Llorca.

Some politicians sought for Obenza’s transfer due to insinuations of bias. It was Governor Erico Aumentado who is also running for the Second District as Representative who appointed Obenza.

Scoring the victory, police authorities ascribe to the intense operations brought about by the National Firearms Control Program and the successful conduct of comprehensive programs and operations that heightened police visibility in the past month of May.

Camp Dagohoy also ascribe the intensified election ban and heightened operations as contributing factor effecting to the lessening of reported criminal activities.

According to police crime data at Camp Dagohoy, May crime count amounted to 222 cases, some 10% less than the previous month of April, which registered 249 index and non-index crimes, a report during the recent Provincial Peace and Order Council meeting held at the Bohol Tropics revealed.

The merry month registered 175 index crimes, some 20 cases lesser than last month which showed some 195 cases. Non index crimes also went down to 47 from 54 of last month, or some 7 cases left.

Still leading the reported criminal activities is theft at 73, followed by physical injuries at 38 and robbery at 37.

Over the development, police authorities bared that the force is to intensify its intelligence and monitoring activities while concentrating on motorcycle riding criminal elements and robbery groups for the month.

Meanwhile, at the current manpower problems, local police authorities still insist a strong police community relationship may alleviate the problem. (PIA-Bohol)

Initial steps in placating the development of the Loboc River as a potential source of processed water for Bohol’s thirsty towns tentatively shuffled as Mayor Leon Calipusan proposed the resource based project for endorsement.

At the joint meeting of the Provincial Development Council and three more Bohol key groups, Calipusan pushed for the endorsement of a project he called the Loboc Water Supply Development project.

Citing the current need for potable water to enhance Bohol’s tourism potential, Calipusan went on to say that the excess water in his town could actually be tapped for domestic, commercial or industrial purposes.

The Loboc river flows at a staggering rate of 56,355 cubic meters a day, the mayor said implying that aside from its being the channel for the famous river cruises, the river could also add up to the town’s fiscal resources when used judiciously.

He argued that developing the river resource would ensure sustainable bulk supply of processed water for Loboc and nearby towns as well as elevate the sanitation levels of the watershed areas.

Loboc’s successful endorsement for the project officially puts up the proposal on the showcase for interested organizations with a potable water supply in its investment portfolio.

While not necessarily saying that the LGU would own the project, the mayor of the tourism town made famous by its river cruises and singing groups, implied that interested groups can now start opening up their funding and development proposals for the river resource.

Observers also said that Mayor Calipusan’s projected project amount is appropriate as the project could operate on a funding somewhere in the vicinity of P800M.

Installation of mainlines, reservoirs and a water processing plant would ensure that the operators would store adequate supply for distribution to its consumers.

Asked as to the mode of the project implementation, Calipusan said his local government is presenting three options: LGU operated utility, an openâ€"access mode where outside investors are invited to invest of any other option subject to the agreements entered into by the local government and the project proponents. President Gloria Macapagal Arroyo's issuance of Administrative Order No. 204 will surely warm the hearts and lessen the burden of the public school teachers.

President Arroyo, in an effort to minimize the load of the public school teachers in the performance of their duties, has authorized the increase in their cash allowances for the purchase of chalks, erasers, forms, and other classroom supplies and materials from P300 to P500 each per annum.

This is indeed a big help to the teachers who often times have to spend not only for the chalks, erasers and school forms but also for the visual aids which are posted in their respective classrooms.

President Arroyo, under Administrative Order No. 204 which she signed last Oct. 19, ordered the Department of Budget and Management (DBM) to charge the funding support necessary to implement the order against the available savings of the national government.

The public school teachers will be pleased to know that the Administrative Order will take effect immediately, which shows that the President means business and is really sincere in relieving some of the burdens of the public school teachers in order to make them more effective in their task of mentoring the youth of the land.

As the President stated in the AO, "I hereby order an increase in said cash allowance to lessen the teachers' burden during actual teaching and enable them to better stir classroom interaction."

It is the enunciated policy of the State to provide quality basic education in public schools and support the needs of the teachers by providing the environment for them to effectively undertake their functions in the classroom.

The President's move underscores more than ever the important role that teachers play not only in molding the youth of the land to become productive and model citizens of the country but in seeing to it that the country's political exercises are properly implemented and the citizens' right of suffrage are safeguarded, even to the extent of putting their lives in danger. President Gloria Macapagal Arroyo cap her nine-year palace regime with no less than a turn over and inauguration of nearly P368 million Ubay Port expansion project Thursday, June 24.

The visit, which nails the claim that her administration has so far implemented the most number of mega-million key development support infrastructure here would be her second this year, next to the launching of the Tourism super regions last February.

The President, who would be turning over the reins of power of the country to President elect Benigno Aquino III on June 30, was instrumental in funding and completing the implementation of the Bohol Irrigation Projects I and II, the Bohol Circumferential Improvement Project, the Leyte-Bohol Power Inter-connection Project, four of the Strong Republic Nautical Highway Roll-On-Roll-Off ports and the yet un-awarded Panglao Airport.

Since its opening and prior to the port expansion project, Ubay has been serving regular four times a day Cebu slow boat routes.

It also serves ferry boat schedules to Bato and Maasin in Leyte where the passengers or cargo follow the Maharlika Highway on to Manila and off to other destinations in northern Luzon.

From Bato or Maasin, regular trips by bus also can take passengers to Mindanao via ferryboat from Southern Leyte to Surigao and on to any land destination in the country’s southern provinces.

The old port in Ubay used to be 3,726 square meters inclusive of the almost 500 sqm cause way is now nearly ten times its size, now at 32,604.90 sqm, data from the Philippine Ports Authority Project Monitoring Office show.

Phase 1 of the expansion project which include the construction of a back-up area, reinforced concrete pier, RORO ramps, dredging, putting up of mooring and fendering facilities and port lighting was awarded to Marra Builder Incorporated in 2008. It was completed 720 days later.

The Project’s phase 2 was bid in September of 2009 and was awarded anew to Marra, who is expected to complete the projects phase in November of this year.

With the new and rehabilitated areas, the port in Ubay now accounts for a 3,330 sq meters of access road, 7,202.65 sq m of working area, 19,873 open storage areas, 1520 sq. m of parking spaces and 387 sqm of RORO ramps.

Other items in the project include a passenger terminal building, office building and other structures.

Moreover, local government officials are also endorsing another project: the new port access road connecting to the national highway, to be funded by the public works department.

Meanwhile, as the project would be turned over, next in line would be to upgrade the Ubay feeder airport into the main airlift facility support for northeast Bohol, Governor Aumentado said.

He has also said the facility, aside from Tapon wharf, would be very crucial infrastructure support to the proposed of the Multi-Industry Cluster (MIC) already submitted for Korean funding. (PIABohol)

Talk of the Town / Walay Kasilyas sa Bohol?
June 20, 2010, 06:06:41 AM
by Rey Anthony Chiu, PIA

It's s*** all right and so nobody appears to give a damn about it.

For the price of a thousand pesos and some community labor counterpart, many have asked why government funds have not been channeled to purchase an alternative sanitary toilet system, absent of which could send the Seaweed Capital dream goodbye.

The urgency of putting up the right interventions to arrest the sanitation issue in the islets of northern Bohol resounded Tuesday as concerned residents and non-government organizations shrug why there isn't much action from government to save the northern seas from fecal coliform contamination and Danajon from an ecological disaster.

And just as the residents of Nocnocan island in Talibon are concerned, Bohol local officials apparently use the bureaucracy as convenient escape to tarry in addressing the stinking issue of water and sanitation in Talibon and Ubay, observers have aired.

Population at Nocnocan is 1981, all cramped in 7 clustered puroks of a total of 309 households. Of them, 262 of the households do not have sanitary toilets or plain toilets at all, reports Ms. Jocelyn Cabanes during the Bohol Press Day at Jjs Seafoods Tuesday.

Cabanes, Nocnocan Elementary School grade II teacher raised the issue of urgency in helping the island people arrest the problem of sanitation as it balloons daily.

"Look at how we pollute our seawater?" she asked.

In the island, you multiply 262 families by 5 people on the average, and that's the waste (human excreta) that finds its way to the sea every day.

While some 55 families own toilets, these are either unsanitary or water reliant toilets that again impact on the water supply, she added.

The wastes which are not properly disposed can attract flies which also hop on the food, bringing sickness, malnutrition and more poverty, she stressed as she explains the need to immediately address water and sanitation.

"Sanitation refers to the hygienic and proper management and collection, disposal or reuse of human excreta and community liquid wastes to safeguard the health of individuals and communities", the Philippines Sanitation and Sourcebook Aid defines.

Just as sanitation programs in the island aim to improve health conditions, promote dignity and enhance quality of human life as well as protect the environment, in Nocnocan, the Department of Interior and Local Government (DILG)-German Development Foundation (GTZ) piloted the non-water reliant sanitation systems, owing to the fact that water still remains a top problem in the island, said Vicente Delector Jr. of the GTZ.

In this line, a technology called the Urine Diversion Dry Toilet (UDDT) was promoted to conserve on the scarce water supply and control liquid seepage into the sea.

UDDT is an alternative toilet system that uses a double-vault dry toilet which is easily adaptable to diverse cultural needs. A fundamental principle in the system is urine diversion and adequate dessication in an alkaline environment.

The dry toilet consists of two vaults: one in use and the other inactive. The two-receptacle toilet seat facilitates the diversion of urine which passes through a hose and is stored for future fertilizer use while the excrement, which falls into the other chamber is covered with lime or ash and soil after each use.

The ecological dry toilet saves water, is simple and inexpensive to install, requires little space, and can be installed inside or outside of the house. As an additional benefit, the user regularly harvests organic soil conditioner, free of pathogenic organisms, as well as a constant flow of natural fertilizer (urine), Delector emphasizes.

Provincial Planning and Development Administrative Officer and lawyer John Titus Vistal, during the activity's opening rites said that Bohol has been officially working on ecological sanitation protect for four years.

DILD-GTZ Water and sanitation program has been into technically assisting communities, in this case, Nocnocan as it implemented the pilot project, and in fact non-government organizations who saw the environmental protection component of the project have intended to put up the technology in their assisted communities, reported GTZ authorities here in Bohol.

On the other hand, Capitol, in its fourth year of project involvement has yet to apportion a budget to immediately assist and arrest the sanitation problems of the island communities.

BEMO and the PPDO agree that they have still to lobby for more funds for the procurement of the UDDT and its immediate installation in Ubay and Talibon.

The Poverty Data Monitoring System, a unique data collection and retrieval toll for Bohol planners show that both towns and their island barangays still hug the lines of the towns with barely passable sanitary toilets.

The implications could be rather unnerving with the reality of water contamination spreading in the seas where seaweeds are grown off Danajon, Bohol's rarest marine environment.

In the school in Nocnocan, Cabanes said only two classrooms have toilets. In her class in Grade 2, some kids have been telling her its their first time to use a sanitary toilet. The idea of bringing eco-sanitation into the schools is one mission she commits, she said.

Dirty, that's how she capped it, and her efforts may just be bucket in an ocean.

It’s the dirty little secret shampoo companies don’t want you to knowâ€"when you wash your hair with one of those nutrient-rich shampoos, most of the nutrients and active ingredients in the product don’t actually end up in your hair, they wind up down the drain… along with all the money you spent on the shampoo.

Why does this happen? Because the shampoo molecules they contain are too large to penetrate the cells of hair and more importantly the tiny hair follicles where our hair actually grows. They sit atop the follicle until we wash them away.

Why is that a problem? Think about it this wayâ€"if you wanted to fertilize a plant, where would you pour the fertilizer? On the leaves? Of course not! You’d pour the fertilizer on the root and the soil where it’s needed most. Our hair works basically the same wayâ€"if you want to treat your hair right, you need to treat the roots.

But if regular shampoo can’t penetrate the hair follicles where our roots grow, what are we supposed to do? - source: howlifeworks.com

Outgoing Iloilo city mayor Jerry Treñas said that the definite solution to the power crisis hounding the city is at hand.

Treñas said that the first commercially viable coal-fired power plant in Western Visayas will be operational by September this year.

He said that coal fired power plant will augment the increasing power needs of the city especially that more investments are in store within the coming years. The mayor also said that national business players are currently monitoring the city’s capacity to provide enough power for their growing economic activity.

Treñas admitted that investors, particularly from the business processing and outsourcing (BPO) industry are hesitant to put up call centers in Iloilo City due to the frequent power outages.

These call centers could eat up a large chunk of power during peak hours and could not afford to loss power while serving clients abroad, he said.

The coal fired power plant is expected to generate 164 megawatts and located in a 24-hectare site at Brgy. Ingore, La Paz, Iloilo City. The power plant is owned by the Global Business Power Corp. and costs P16 billion. - PNA

"Just like for any other exam, you have to prepare well in order to pass." This was the reaction of Civil Service Commission (CSC) Chair Francisco T. Duque III on the low passing rate in the career service examinations.

"It is the mandate of the CSC to ensure that entrance into the career service is based on merit and fitness. We need to get the most qualified to enter government because these are the people implementing vital programs and services for the public. This is why we administer competitive examinations. We're setting a standard here," Duque said.

Recently, the CSC released the results of its November 15 Career Service Examination-Paper and Pencil Test where 6,334, or 10.15% of 62,389 examinees, passed. The passing grade is 80.

Historical data from the CSC show that career service examinations since April 2005 have yielded an average of 4,417 passers per schedule for the Professional level of examination, and 1,498 passers per schedule for the Sub-Professional level, or a 9.14% and 13.4% average passing rate, respectively.

The area of the test that examinees find most difficult is Analytical Ability for the Professional level, and Numerical Ability for the Sub-Professional level.

The Professional Examination covers vocabulary, grammar and correct usage, paragraph organization, reading comprehension, analogy, logic, and numerical reasoning. The Sub-Professional Examination tests for vocabulary, grammar and correct usage, paragraph organization, reading comprehension, clerical operations, and numerical reasoning. - source: government website

That week was a difficult time for Evelyn B. Reonal. Her daughter-in-law just had a caesarian operation and because she and her husband were jobless, Reonal felt obliged to pay for their hospital bills. The P100,000.00 cash she found on top of a counter would have been more than enough to pay off the bills. But she decided to do the right thing and surrendered it to the bank where she found it. Eventually, the money was returned to the rightful owner.

Such exceptional display of honesty was one of the reasons why Reonal, Cashier I at the Department of Public Works and Highways-Albay Engineering District, won the Dangal ng Bayan Award in 2008. The Dangal ng Bayan is one of the three awards given to outstanding public officials and employees under the government’s Honor Awards Program (HAP), which aims to promote a culture of excellence and to recognize and reward state workers for outstanding work performance, contribution and superior accomplishments; or for consistent manifestation of exemplary ethical behavior in the public service.

The Dangal ng Bayan is bestowed to an individual for performance of extraordinary act or public service and consistent demonstration of exemplary ethical behavior, on the basis of observance of the norms of conduct provided under Republic Act 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees.

The Presidential Lingkod Bayan Award is conferred on an individual or group of individuals for exceptional contributions resulting from an idea or performance that had a nationwide impact on public interest, while the Pagasa Award is granted to an individual or group of individuals for outstanding contributions that directly benefit more than one department of the government on a certain degree of standards. - civil service homepage

Young sexy star Cristine Reyes arrived over the weekend from a disastrous US tour, which left her and sister Ara Mina not fully paid for the work they’d done.

In a phone-patch interview aired June 15 on “Showbiz News Ngayon,” Cristine confirmed she and sister Ara were not paid in some shows in the US for their concert “Sister Act.”

“Meron pong show na hindi po bayad. Meron akong isa, dalawa na hindi bayad. Si Ate marami kasi mabait ‘yon e, hinahayaan lang niya. Ako, hindi ako pumayag. Hindi na kami nag-show sa Vegas dahil tumakbo yata ‘yong producer doon,” Cristine shared.

And in one show, they appeared gratis et amore.

“Sa Oxnard, hindi kami talaga magso-show dahil wala pa ring bayad. Pero, ang daming tao. Sayang naman ‘yong mga kilalang tao, so tinuloy na lang namin ‘yong showâ€"for the love of ‘yon.”

Cristine said she’s charging all this to experience.

“Wala naman tayong magagawa kung magagalit sa tao. Hayaan na lang natin. Next time na lang, kailangang masigurado na lang kung ano ang nakalagay sa kontrata,” she said.

p.s what kind of show kaya yon sa vegas?

Singer-actress Geneva Cruz has only got three words to people who want to know more updates about her breakup with KC Montero and about her son, Heaven, who is in the US with her ex-husband Paco Arespacochaga: “Enough is enough.”

“Sobrang sagad na kasi nagsalita na ang buong mag-anak ko. I know celebrities live in a fishbowl but we are people, too, who need time to heal and maybe truly understand what really happened [to us]. Healing won’t come if people keep asking about it, especially whose fault it is. Kahit sino, pag ganyan na haunted, magbre-breakdown,” she told Bulletin Entertainment during the press conference for “Legally Blonde The Musical” on June 15.

For over a month now, Geneva and KC Montero’s breakup has hogged headlines, reaching a climax a few days ago after she revealed it was Heaven himself who had suggested the separation.

“Siya (Heaven) mismo ang nagsabi, ‘Mom, you know what, for the good of the family…tapusin mo na,’” Geneva said on “Showbiz Central” on June 13.
