I dont think jonelle will do that again!!! I mean at first she confessed that she's involved or she knew a little thing about what happenned(according to my sources, I mean it was all over the newspaper), but right after naa na siya michael enriquez iyang atty. daw gbawi niya tanan iyang first na confession, then ngpahospital2 silang duha sa mom niya puli2, first day eang mama then next siya na pud, na ngcause ug delay sa investigation until she got her lawyer then,... from then on dako na siya ug bout na musulti against ni bai..then naa pa jd me nadunggan na if wala lang daw tong narecover ang wallet sa gipuy-an niya, paduong na siya lakaw out of cebu!!!what for????para mgtago na and she thought dili jd siya mahibaw-an!*&^k!

You have the right to be speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense." accdg. to my source they already submitted their affidavit, i also heard the hearing will start on monday..let's just hope this will be over soon..

Let's pray that justice will be served. Teletech agent murder case court hearing is coming.

There is always a fear in a lawyer’s mind that some judges would make up their mind before the counsel presents his entire case. Some judges set up their own fancy ideas or notions and think themselves to be superior than other men. Some time we mistakenly call them strong judges. Such judges always think that they are right and will not listen to arguments or suggestions tending to show them to be wrong. Keeping the mind open, flexible is one of the greatest judicial virtues and it is the insignia of intellectual humility.

Lesson:

 8) Stay away from drugs, alcohol and different kind of sex affair (ex. lesbian). Remember credibility (ex. primary suspect's alibi) is very important.

Psychological factors that figure into why people commit crimes.

1. The Spiritual Equipment

- Feeling or emotion
An emotion usually originates as a result of something you see, hear or think about. This feeling amy be pleasant (e.g. love, gladness) or unpleasant (hate, jealousy, rage). The result of this feeling is a certain action, like assault or murder. Man's life is thus affected to a large extent by his feelings or emotions, and therefore it is accorded a distinct place in the causation of anti-social behavior.

- Character
Character is the moral part of the personality that regulates daily behavior. If a person has defects in their character such as aggressiveness, cunning, intolerance or brutality, he will find it difficult to rationalize between right and wrong in moments of emotional upset and will not be able to exercise self-control.

2. Self Concept

The self-concept has been identified as a very important aspect in human life: a person must be able to have respect for himself; to be "his own best friend". This is how a person sees himself. If a person believes that he is worthless, and that society does not care what happens to him, this attitude (self-perception) may well lead to crime.

3. Stress

Stress can lead to irrational conduct, even to crime. If a person labors under severe emotional distress, that person may feel compelled to act in socially unacceptable manners. Stress has become a major problem in modern life, leading to broken families and deviant behavior.

4. Depression

Depression can be a psychosis and also a neurosis. A psychosis is a severe mental illness in which insight was lost. Persons with psychotic depression might believe that the sins of the world are upon them, and that they are a burden to society.

5. Personality disorders

Psychopathy, addictions and deviances can be listed under personality disorders.
Once there is a disintegration of personality, deviant behavior can be expected.
Many serious crimes are committed by persons whose personalities do not conform with the norms accepted by society.

Are you a psychologist? "Most criminals, if not caught, will repeat their crime due to psychological problems."

Best friend becomes your horrible enemy.

A best friend is the person you share a significant portion of your self with and receive the same in exchange. They usually know your thoughts, feelings, desires and deepest secrets. They have been beside you during times of turbulence and also celebrated your every success.

Your best friend has the power to hurt you more than any other person, possibly because they have been exposed to what you think and feel. They understand what motivates you, as well as what breaks you down. After lowering your defenses in a relationship based on total trust, they can be a dangerous ally. They've had a glimpse into your heart and mind and know ways to use it against you.

Why the philippine government is perpertually corrupt? Introduce the jury system this coming election 2010.

The failure to find the right solution to the perpetual government corruption in the Philippines is due, in fact, to the failure of knowing its fundamental cause. The compadre system often blamed as its chief cause is not, but a mere product of, a basic underlying cause - wrong analysis equals wrong solution.

The basic cause: The disenfranchisement of the people by the government of their participation in the justice system is the primary and ultimate cause of government corruption. Like in almost all corrupt governments of many countries, the Philippine justice system is a total government monopoly which primarily benefits, directly or indirectly, government officials while the people are mere secondary beneficiaries and treated like second class citizens after the elections. Public officials are not afraid of the people because the Filipino people have no clout in their justice system.

The ultimate solution to make Philippine public officials more fearful of abusing their authority is to implement the supreme power of the Filipino people, as declared in their Constitution, by way of establishing a device for their participation in the Philippine justice. Without such a device, the people's sovereign authority is nothing but a toothless power no matter how much they demonstrate that power in the streets. The people should be the boss in their justice system and not the other way around.

The Filipino People Have Supreme Powers But They Are Beggars of Justice

The Filipino people's assertion for justice cannot be heard on their side because their voices are disenfranchised. Their show of force in the streets is merely an informal statement of their will but fundamentally they are just beggars of justice because public demonstration is not a formally organized body of citizens that is capable of an orderly investigation of the misconduct of public officials upon which they can base their decision to indict or convict and to send corrupt officials to jail.

We may be wondering why the Philippines is not as stable as the United States although we have copied, and tried to improve, the American Constitution and also in spite of the fact that we are comparably well educated as the American people are. Any Filipino who has lived in the U.S. knows this. The BASIC CAUSE for the wide disparity of the social stability between the U.S. and the Philippines is due to the EXCELLENT JUSTICE SYSTEM in the U.S. compared to its poor counter-part in the Philippines. In the U.S., the highest dynamic authority of justice are exercised by the common American people, and not by their government officials. The supreme authority of justice in the Philippines is totally the opposite - the Philippine government is the boss. In the U.S., the people are the real boss of justice. American prosecutors and judges need to show their evidence to the people upon which the people make their decision to indict or to convict a public official or any person who commits a major crime. They accomplish this by means of their local direct representative groups, called Grand Juries (to secretly investigate and indict) and Trial Juries (to publicly try and convict).

If law enforcement include different angle on the relationship between hate and fear (Ex. sex, drugs, money and lesbian affair).

Motive is important because without an understanding of why people commit certain crimes in the way they do, we are left to begin at square one on every investigation, something we simply don’t have the time or the resources to do.  That’s where profiling comes in.  If law enforcement knows that certain elements of a crime, and certain evidence found at the crime scene, may suggest the type of person who did the crime, then we are on our way to the “why” of the crime that can then take us to the “who” â€" the person who committed the crime.

"Most criminals, if not caught, will repeat their crime due to psychological problems." So credibility is very important from either the suspect or the witness.

Jonelle Enfectana, 26 yrs. old

There is increased recognition that people interviewed by the police are often psychologically vulnerable due to modest intelligence, mental health problems, disturbed mental state, and personality problems. The current study aimed to investigate differences in the mental state and personality between suspects and witnesses. The participants were 78 individuals (47 suspects and 31 witnesses) who had been interviewed by the police. They were assessed psychologically immediately after the interview with the police was completed. Significant differences emerged between the two groups with the suspects being more depressed, hopeless, compliant and personality disordered than the witnesses. Four of the suspects claimed to have made a false confession to the police due to their immediate need or psychological problems.
