Migrant teachers claim scam CNN Video
Filipino teachers learn lessons in courage in Baton Rouge
By MFeria
Philippine Daily Inquirer First Posted 11:55:00 08/15/2010

MANILA, Philippinesâ€"At first they were fearful and embarrassed to admit that they had gotten themselves into a situation of “virtual slavery.” Complaints of human trafficking and debt bondage are
more likely to come from uneducated domestic workers in the Middle Eastern kingdomsâ€"not from Filipino teachers in the United States of America.
But for a chance to work in the US, the teachers, over 350 of them, had coughed up over P700,000 (about $15,000) each to a California-based employment placement company and its local recruitment partner. Some of them hocked their homes to raise the placement money. Those who couldn’t produce instant cash were referred to partner lending agencies that charged them compounding interests of 43 to 80 percent.
To their chagrin, the fees and payment demands, which included 30 percent of their salaries for two years, did not stop even after they got there. They were also overcharged for rent and visa renewals. Their travel and working papers were in the hands of the agency, and when they complained or asked too many questions, the recruiter reportedly shouted at them and threatened to send them home.
It was like a racketeering trap, teachers claimed. “We were herded onto a path, a slowly constricting path, where the moment you realized that something was not right, you were already past the point of no return,” said Ingrid Jomento-Cruz, who began her overseas teaching stint in 2007.
The subjects of the teachers’ complaints are Universal Placement International (UPI), owned by one Lourdes “Lulu” Navarro, its Philippine-based partner, PARS International, run by Navarro’s brother, Emilio Villarba, and some officers of the East Baton Rouge school system in Louisiana, where many of them were assigned.
It began with a blog
Their struggle to free themselves began with a blog. After months of silence, a few of the teachers launched in the first week of November 2008 www.pinoyteachershub.blogspot.com, where they posted “An Open Letter to Our Fellow Filipino Migrant Teachers.” They listed down their complaints and invited others to air their views.
No one dared list their real names. They went by the tags “Gurong Sulong,” “Sinag ng Tala,” “Gurong Kritical,” “Gurong Gala,” among others.
Discovering their strength
After one secret meeting at the end of that week, Sinag ng Tala wrote: “This day is a special day. I was looking for something that I did not even notice I lost...I almost gave up. But then I started to share my fears, my apprehensions, my angst, my agonies. Suddenly, others did the same. Sharing. Describing their fears. Listening. Acknowledging each other’s wounds...Then out of nowhere, something struck me. Suddenly, I realized that I finally found what I was looking forâ€"my strength.”
For the next few weeks, the blog was abuzz with research material. Overcharging of fees, they learned, was a violation of the Migrant Workers and Overseas Filipinos Act of 1995. It was also against regulations in the state they were assigned to collect fees in advance.
Anger and rage
Some of the teachers initially reacted with rage: “Queen Latifah back West and her minions (apparently referring to their California-based recruiter) just love to make our lives a living hell...I wonder how they sleep at night...Having charged us twice or even thrice the usual placement fee sure gave them the label of certified public f-ck-ups! I wonder how they sleep at night.” More expletives peppered the outburst, which was signed, “Orgasmic Chagrin.”
The anger subsided. The blog posts on November 10 and 13 talked of the need for unity and action. “We are a small axe but with our combined strength, we can surely chop this rotten tree down,” wrote Gurong Kritical.
It hurt to acknowledge that they were “modern-day slaves,” wrote Gurong Gala on November 13. But healing, she added, would come by “claiming due justice.”
The first “Taste of Victory” was posted on November 15. The teachers had confronted Lulu about the overcharged rent. They figured that Navarro, with a tongpats (overcharge) of $300 per apartment (they occupied at least 40 apartments, four teachers to a unit) was ripping at least $12,000 a month from them. They were able to bring down their per-bed rate from $310 to $275.
They also forced down the charges for visa renewals from $1,800 to $2,000 per individual, to $1,000.
These were charges in addition to the millions she collected from them before they left. She was also paid about $47,000 by the East Baton Rouge school system for the recruitment service.
A libel suit
Navarro had threatened to sue the teachers for libel. But courage was infectious. “Make my day!” wrote Orgasmic Chagrin. “We are just exercising our right to free expression,” wrote others.
“Who is Lulu Navarro?” responded another post. The group had discovered that Navarro had been convicted of and imprisoned for defrauding the California Medi-Cal system of more than a million dollars, and had pled guilty to money laundering in New Jersey.
By this time, the teachers’ blog had started attracting pledges of support from other groups. On November 20, the blog featured a statement on migrant rights from the Manila-based Partido ng Manggagawa. On December 6, a statement of support from the Filipino-American Association of Greater Baton Rouge appeared on the blog.
Christmas gloom
There seemed to be a tinge of depression when Christmas came around. “We had a taste of a white Christmas last week, but the fun just melted so fast...It’s hard to have a merry Christmas if our pockets are empty and we can’t even send enough pamasko (Christmas goodies) back home.”
Also, the debate over what was to be done was heating up.
“Anonymous Teacher” posted contrary arguments: Would not all the “drama” they were creating lead to their losing their jobs? “Many Filipinos in the US started with a lot worse situations than we have now. (But after) years of perseverance and patience, they reaped their success in the end,” said the blogger.
Anonymous Teacher reminded the others that nobody had forced them into signing Navarro’s contract. “Your financial difficulty is a product of your own decision. You did whatever had to be done. There are consequences in your own actions. Business is business...A contract is a contract. It is a mutual agreement,” the author stressed. For the privilege of coming to America, some thanks were due to Navarro, the post said.
Warned Anonymous Teacher: “Employers do not want drama...Think about your own actions, guys. I suggest that you just work and impress your employer within your job description...I hope you will not lose your job. Your family will suffer very badly as a result.”
Stand up or turn a blind eye?
The teachers’ hub was silent over Christmas. At the end of the year, December 29, Gurong Sulong posted the blog’s most reflective article.
It is true, she began, that a contract is a contract. But, she argued, “A contract as a mutual agreement can only be enforced if it is not contrary to law.” “Clearly,” she pointed out, “there are some provisions in the contract that are contestable and could be voided.”
As for being business-like and professional, “We are not asking for charity,” she said. “We simply want to be treated fairly and professionally.” References to Filipino values of pagtitiis and pagtitimpi (enduring suffering or abuse), or utang na loob amidst tyranny, she argued, were out of place.
“Most of us come from modest backgrounds too and we know what paghihirap (hardship) means. I agree there are more Filipinos who underwent greater hardships. But that is not a reason to turn a blind eye to oppression. There is no logic in that assertionâ€"just because others experienced more hardships, therefore it’s ok for us to be subjected to abuses...(That) in effect is condoning illegal and corrupt activities.”
As for their jobs, Gurong Sulong argued that in fact, it would be hard to separate teaching from their struggle.
“As teachers we mold children. And how can we mold them to be strong, freedom-loving citizens if we ourselves cannot stand up against tyranny. How can we teach them the bravery of Martin Luther King, the resolve of Mahatma Gandhi, the literary advocacies of Mark Twain, if we don’t even internalize their messages?”
She concluded, “Do not equate standing up against injustice as something negative or something to be ashamed of. The bedrock of this very country is in fact the struggle for equality, freedom, fairness, and justice.”
* * *
On September 30, 2009 the teachers, backed by the Louisiana Federation of Teachers (LFT), filed a complaint with the Louisiana Workforce Commission (LWC) and the US Department of Labor seeking remedies against UPI for violation of state employment service regulations.
On April 10, 2010, the LWC ruled that UPI had charged the teachers certain fees which were prohibited and premature under state laws, and ordered it to repay the Filipino teachers $1.8 million in illegally charged fees.
UPI, through their lawyer, was quoted in US publications as saying it would appeal the decision.
On Aug. 5, 2010 the American Federation of Teachers (AFT), with the LFT, the immigrant justice project of the Southern Poverty Law Center, and private law firm Covington and Burling LLP, filed in behalf of the teachers a class suit against Navarro on human trafficking and racketeering charges. The plaintiffs, now out in the open, are Mairi Nunag-Tanedo, Ingrid Cruz, Donnabel Escuadra, Rolando Pascual, and Tomasa Mari (on behalf of themselves and other similarly situated individuals).
A+ for bravery
In April 2010, Cruz and other officers received the International Honoree Award from the AFT, with high commendations for their “personal courage, willingness to speak up and to believe in collective action.”
In her acceptance speech, Cruz, president of the newly formed Filipino Educators Federation of Louisiana, thanked the American teachers for supporting them.
“A few years ago, we were voiceless, vulnerable, and scared. Today we are organized and will never be silent again about our human and labor rights...Standing tall, we can say we have learned our lessons well at every step of the journey that led to this award.”
With their American colleagues, she said, they also discovered the true spirit of bayanihan, a cherished Filipino value of community heroism and cooperation. The teachers presented the AFT with a painting showing the traditional bayanihan, wherein neighbors and friends together hoist a new community members’ home on their shoulders to bring it to a better place.

Surprise meeting leads to arrest
Sunstar Daily Cebu

FORMER internal revenue officer Nieto Racho was on his way out of a courtroom after attending trial in Cebu City yesterday morning, when Assistant Ombudsman Virginia Palanca-Santiago spotted him.She immediately ordered his arrest.

Judge Macaundas Had-jirasul of the Regional Trial Court Branch 8, who issued a bench warrant of arrest against Racho last year, right away scheduled his arraignment at 2:30 p.m. yesterday.
Assisted by his lawyer, Charisse Cabatingan, Racho pleaded not guilty to charges of violating Article 171 of the Revised Penal Code, or falsification of a public document.
The Office of the Ombudsman-Visayas had charged Racho over an unexplained P5.8 million in three Cebu-based banks. He did not declare the amount in his statements of assets and liabilities (SAL).
In May 2003, former deputy ombudsman for the Visayas Primo Miro ordered Racho’s dismissal from government service. He was then chief of the Bureau of Internal Revenue’s Special Investigation Division.
The anti-graft office found him administratively liable for falsification and dishonesty.
Atty. Cabatingan told reporters yesterday her client did not receive the subpoena, which is why Racho failed to attend his arraignment last Feb. 16, 2009.
Although the accused posted a surety bond of P24,000, Judge Hadjirasul already ruled last year the bond should be forfeited because Racho skipped his arraignment.
On March 7, 2009, Hadjirasul issued the arrest warrant.
Cabatingan confirmed yesterday that Racho was going to post another bond of P24,000 yesterday. She declined to comment further, while Racho also declined requests for an interview.
Judge Hadjirasul scheduled the pre-trial conference of the case in September this year.
Based on case records at the anti-graft office, the investigation against the tax official began after a news organization submitted certifications of Racho’s 1999 deposits in three banks, amounting to P2.93 million, P1.63 million and P1.22 million.
But an examination of Racho’s SALs from 1995 to 2000 showed he only declared P1 million as his cash in the bank.
In his counter-affidavit, Racho did not deny the existence of the accounts, but questioned the anti-graft office’s authority to conduct the investigation.
Racho said he has been in government service for 36 years with an unblemished record.
He entered the government service in 1968, joining the Cooperatives Administration Office, and stayed there for five years. He then joined the Commission on Audit before he transferred to the BIR. (GMD)

Korina, ’di na makakabalik sa ABS-CBN?
by Vinia Vivar

Aside from Ressa, naroroon sina Julius Babao, Karen Davila, Alex Santos, Henry Omaga-Diaz, Bernadette Sembrano, supervising producer Cheryl Favila and Director, Multi-Platform Strategy, Program Development and Customer Satisfaction na si Anna Rodriguez.

"A good rule of thumb for us is exactly what happens in government when you run for office. You campaign, and you either don't get the office or you resign in the process. There's a one-year rule. I think it's a good rule for us to take on because in the campaign, while Korina herself did not run for office, she also campaigned. It will be hard to think that she will be able to say reports on Vice President Binay. So a one-year break and we'll assess again,” paliwanag ni Ms. Ressa.Natanong din kung totoo ba ang tsismis na babalik na rin si Kabayang Noli de Castro at say ng lady executive, "Let me put it this way. I'm very,
very happy with the anchors that we have. They work very hard to give you the news. So at this point in time, I don't see our news anchors changing.”

Isa sa mahalagang nabigyan ng linaw ng News and Current Affairs team ay ang akusasyong Aquino station ang ABS-CBN at biased daw sa pagre-report during the campaign.

“We are not an Aquino station, at least, the news,” paglilinaw ni Ms. Ressa. "People have said we're biased, and I always answer back, 'Bias is in the eyes of the beholder.' An independent monitoring group, the Center for Media Freedom and Responsibility, analyzed all of the news programs of GMA-7 and ABS-CBN during elections and they came out with a study that showed that ABS-CBN had no bias in their coverage.

“I don’t think the way we report the news will change in the administration. We are in many instances, harder than any of our competition, because, we, even internally, we really try to push aside vested interests. Our goal is to serve the Filipino people the best way possible and that means telling them the way it is even if it’s hurtful to us.”

“Willie Revillame was campaigning for a candidate, perhaps they weren’t happy with the way we were reporting on it. Our goal is not to make them happy, our goal is to tell the truth. So on that day, we ran Willie saying that we are biased, that same report, we also ran Kris saying that we’re evil people,” pahayag pa ng lady executive na bahagyang natawa sa huling sinabi.

Tungkol naman sa isyung may malaking utang na loob daw ang may-ari ng ABS-CBN (Lopez’) sa mga Aquino, ani Ms. Ressa, "Look at our reports, look at our reporters. We're not the ones,  we have no utang na loob. Ako as a reporter, as a journalist, I have no utang na loob to anyone except the people I write reports for.”

ABS-CBN employees decry termination of contracts
By Kristine L. Alave
Philippine Daily Inquirer
First Posted 09:03:00 06/21/2010

http://newsinfo.inquirer.net/breakingnews/nation/view/20100621-276775/ABS-CBN_employees_decry_termination_of_contracts

MANILA, Philippinesâ€"(UPDATE) About 1,000 workers of media giant ABS-CBN decried the dismissal of their contract following their refusal to accept the company's terms for regularization.
Antonio Perez, president of ABS-CBN Internal Job Market (IJM) Workers' Union, said the company terminated the contract of employees who decided not to accept the terms for regularization at midnight on Wednesday.
"We condemn this unjust practice tantamount to illegal termination and constructive dismissal," Perez said. Reports from union sources said scores of their members received on Thursday memoranda notifying them of the end of their work with the company.
Perez said their members urged the company to accept them as regular employees without the conditions imposed.
“The law mandates we should enjoy it after six months of service; some of us have been Kapamilyas for many years now and have raised our own pamilyas already while serving ABS-CBN. We want no waiver of whatsoever rights or grievances accompanied with the regularization. We want long-term job security," Perez said.
ABS-CBN does not recognize the union, which is registered with the Department of Labor and Employment.
The union represents about 1,000 workers in the technical operations division, production division, and news and current affairs division of the network, doing camera work, lights, sounds, VTR, and others for almost all entertainment and news programs.
According to Perez, ABS-CBN president Gabby Lopez chatted with some of their members online on Tuesday to discuss the matter of regularization.
"During the chat, he categorically said that if those workers offered regularization will not accept it until 12 midnight of Wednesday, then they will be terminated," Perez said.
The management offered regular employment to workers in exchange for dropping complaints against management. The conditions also included no back-pay or recognition of the delayed regular status, Perez said.
He noted that the terms were “bogus” and were designed to kill the union.
“Such bogus regularization has been forced by the management to deplete the membership of our union and eventually banish it," he said.
In a statement, Bong Osorio, head of the ABS-CBN corporate communication unit, said the regularization process the broadcast company carried out was legal.
“The ABS-CBN management has been involved every step of the way in the issue and a decision to regularize some of them has been made. The regularization process was carried out in accordance with the law,” he said.
He explained that “the existing Internal Job Market (IJM) in ABS-CBN is a database which provides the network a list of accredited technical or creative manpower who offer their services to the company. It is aligned with the requirements of the Labor Code, and those listed in our IJM roster are taken care of in accordance with the law.”

“We realize we cannot please everybody, but we believe that we are doing what is right for the best interest of the company, employees, and shareholders. The move was implemented to ensure that ABS-CBN is in-step with the fast changing multi-media industry landscape,” he added.

Osorio also said the workers’ union is not recognized by the government.
“The call to have the ABS-CBN IJM workers' union recognized has been dismissed by the appropriate government quasi-judicial body,” he said in the statement. When asked what body this is, his staff said the labor department.

Radio man’s murder seen warning for logging foes

Philippine Daily Inquirer

http://newsinfo.inquirer.net/inquirerheadlines/regions/view/20100617-276176/Radio-mans-murder-seen-warning-for-logging-foes

DAVAO CITYâ€"THE DEATH OF ANTILOGGING broadcaster Desidario Camangyan on Tuesday could be a warning for environment activists in Davao Oriental.
Sr. Stella Matutina said activists were now uncertain about their safety because even the 52-year-old Camangyan, who was perceived to have wielded some sort of influence, was attacked and killed by suspected illegal loggers.
Camangyan, a staunch antilogging advocate that worked for Sunrise FM in Mati City, was gunned down while hosting a singing contest in Mabini, Davao Oriental.
Matutina said Camangyan’s death worried environmentalists and made them think whether or not to continue with their effort to stop illegal logging and mining activities in the province.
“We now worry about our safety,” she said by phone.
Matutina also said other environmental activists like her had been receiving threats even prior to Camangyan’s death.
But Matutina admitted that if they will be cowed by the attack on Camangyan, illegal loggers and miners would flourish.
Supt. Querubin Manalang, police spokesperson for Southern Mindanao, said investigators have yet to establish the motive and the identity of the suspect in the killing of the broadcaster.
He said the police were not only looking at illegal mining and logging, but also alleged illegal activities of politicians, who came under fire from Camangyan.
Matutina urged authorities to step up their efforts to solve Camangyan’s murder and put the perpetrators behind bars.
“We denounce this killing,” she said.
The recent killings of two radio journalists, both within the span of less than 24 hours, in the country has again sparked international outrage directed at the outgoing administration of President Macapagal-Arroyo.
In a statement posted at its website, the International Federation of Journalists (IFJ) said Ms Arroyo must be held accountable for the twin killings. The group also said President-elect Benigno Aquino III must act quickly to stop the killings.
“These killings, barely half a month before President-elect Noynoy Aquino takes office, show that enemies of press freedom in the Philippines are confident they can continue to get away with murder,” IFJ Asia Pacific director Jacqueline Park said.
She also said Aquino must, once he is Chief Executive, compel law enforcers and justice officials to take “all necessary action to end the killings of media workers, and to see justice prevail against the perpetrators of these vicious crimes.”
“And Gloria Arroyo must be held accountable for her failure to act on more than 100 killings of media workers during her presidency. As a congresswoman in the new Congress, she remains at the forefront of our attention to seeing that justice is done.”
On Tuesday, unidentified motorcycle-riding men shot Joselito Agustin of dzJC Aksyon Radyo at the boundary of Laoag City and Bacarra town in Ilocos Norte. He died early the next day. Dennis Jay Santos, Inquirer Mindanao and Alcuin Papa in Manila

Cops to file raps vs suspect in slay of Davao Or. radioman

DAVAO CITY, Philippines â€" Police are set to file criminal charges against the suspect in the killing of Mati City broadcaster Desidario “Jessie” Camangyan last week.

Senior Supt. Jose Jeorge Corpuz, deputy director for operations of the police in Southern Mindanao and head of Task Force Camangyan, confirmed to the Inquirer that they were already coordinating with the prosecutors office for the filing of case against the alleged gunman.

He said they have witnesses, one of them the wife of Camangyan, Ruth, who helped them identify the suspect.

Corpuz, however, refused to identify the suspect and also chose not to disclose the motive as it might derail their operations.

He assured the family of Camangyan that the police are closely watching the suspect.

“We are closely monitoring him. He is still in the area. The witness has identified him as the one who shot the victim,” Corpuz told the Inquirer by phone.

Raps filed against Ilocos Norte exec, aide
By Cristina Arzadon, Jeffrey M. Tupas, Orlando Dinoy

http://newsinfo.inquirer.net/inquirerheadlines/nation/view/20100622-276867/Vice-mayor-in-media-slay
MANILA, Philippinesâ€"Police on Monday filed murder charges against the newly elected vice mayor of Bacarra, Ilocos Norte, and his aide in connection with the killing of radio commentator Jovelito Agustin last week.
Supt. Bienvenido Rayco, head of Task Force Agustin, said Bacarra Vice Mayor-elect Pacifico Velasco, his aide Leonardo Banaag and two others were also facing attempted murder charges in connection with the strafing of Agustin’s house on May 7.
The two other suspects were identified as Ricky Acosta and Moymoy Baldemor.
The charges were separately filed with the Laoag City and Ilocos Norte prosecutors’ offices on Monday.
Agustin was one of the three journalists shot dead during a five-day period after the lifting of the election-related gun ban on June 9.
Nestor Bedolido was murdered in Digos City in Davao del Sur on June 19 and broadcaster Jesiderio “Jessie” Camangyan was killed in Manay, Davao Oriental, on June 14.
The killings raised to 103 the number of media workers murdered in the country since President Gloria Macapagal-Arroyo assumed office in 2001.
Police are set to file criminal charges against the suspect in the killing of Camangyan.
A government interagency body that tracks media killings announced Monday it had sent a team to Digos City and Manay town to investigate the murder of Camangyan and Bedolido.
Justice Undersecretary Ian Norman Dato, who was recently appointed chair of Task Force 211, said the team sent to Mindanao would “conduct a thorough investigation and immediate identification of the assailants.”
Task Force 211 is known as the Presidential Task Force against Political, Extrajudicial and Media Killings.
President Macapagal-Arroyo created Task Force 211 in 2007 at the height of the spate of unresolved extrajudicial killings of political activists in the country.
Agustin, who worked for the dzJC-Aksyon Radio, was shot in Barangay Barit on the night of June 15 while he was on his way home to nearby Bacarra. He died in a hospital at about 1 a.m. on June 16.
Agustin’s nephew, Joseph, who shared a motorcycle ride with the broadcaster, survived the attack and has become an eyewitness to the murder.
Rayco said Velasco was implicated in the murder of Agustin because of his association with Banaag, the suspected gunman.
Velasco’s car
Police earlier identified Banaag as the man who shot and killed Agustin, based on the account of the victim’s nephew.
“The car used during the [May 7] strafing incident belongs to Velasco. Banaag and Velasco were seen together before, during and after the May [10] elections,” he said.
Investigators have reviewed previously taped radio programs of Agustin and discovered that Velasco had been at the receiving end of harsh commentaries for nearly two weeks due to the official’s graft case, Rayco said.
Velasco has been convicted of graft by the Sandiganbayan. The decision, which has been affirmed by the Court of Appeals, is pending resolution at the Supreme Court.
Velasco is a former Bacarra mayor and provincial board member before he ran and won as vice mayor in the May 10 elections.
Agustin started airing critical commentaries against Velasco before the elections and continued attacking him in his program even after May 10, police said. “This may have motivated Velasco to retaliate against Agustin,” Rayco said.
The Philippine Daily Inquirer has been trying to reach Velasco since last week, but the official could not be reached as he is reportedly confined in a Quezon City hospital for an undisclosed illness.
Task Force Camangyan
In Mati City, Senior Supt. Jose Jeorge Corpuz, head of Task Force Camangyan, confirmed to the Inquirer that the police were already coordinating with the prosecutors’ office for the filing of a case against the alleged gunman.
The task force has witnesses, one of them the wife of Camangyan, Ruth, who helped identify the suspect, said Corpuz, deputy director for operations of the police in Southern Mindanao.
Ruth and the couple’s 6-year-old son were in the audience when a gunman shot the broadcaster on June 14 before midnight while hosting a singing contest in Barangay Makopa.
Camangyan of Sunrise FM was known for speaking out against illegal loggers on the East Coast of Davao Oriental.
Suspect monitored
Corpuz assured the family of Camangyan that the police were closely watching the suspect.
“He is still in the area,” Corpuz told the Inquirer by phone.
Camangyan will be buried on Thursday.
Some journalists in Mati were rejoicing over the news that charges would be filed against the suspected killer of Camangyan even as they continued to receive information that more journalists would be attacked.
Next target
Joanna Mabini, a colleague of Camangyan, said a ranking Church official had advised journalists to be careful because “someone will follow Camangyan in the few next days.”
“The next target, we were told, is a woman,” Mabini said. She believes that it could be her.

“For two days, a motorcycle-riding man has been going to our house, asking about me. A house help said the man wore a mask so she did not see his face. This is really getting scary,” she said.
No longer a journalist
Mabini used to host a program over Radyo Natin and Sunrise FM, where Camangyan used to broadcast his commentaries on various issues.
In Digos City, the family of Bedolido is demanding justice even as the police insist that he was not a practicing journalist.
Senior Supt. Ronald de la Rosa, police chief of Davao del Sur, said Bedolido was no longer a journalist when he was shot dead on Saturday night.
De la Rosa said Bedolido, who used to work for the weekly magazine Kastigador, was a “black propaganda writer” for a politician.

“If we count him as a journalist, then he should be active in writing for an independent media outlet,” the police official said. Kastigador is allegedly financed by a local politician.
In 2007, Bedolido wrote for the newsletter of the provincial government, De la Rosa said.
But Boying Torecampo, who also writes for Kastigador, said Bedolido was a consultant.
“He was an editorial consultant but he did not want his name in the staff box because he was planning to produce his own magazine,” Torecampo said.
Bedolido was gunned down while he was buying cigarettes at the corner of Rizal and Quezon Avenues in Digos City.
Bedolido’s son, Marxlen, believes the killing was politically motivated. “There is a politician involved that is why we are seeking justice,” said Marxlen, 22.
Gubernatorial candidate
Marxlen said his father wrote for Claude Bautista, who lost in the gubernatorial race in the May 10 elections.
He said minutes before the killing, his father got angry after receiving a call on his mobile phone. After the call, Bedolido went out to buy cigarettes in a nearby store.
A few minutes later, Marxlen heard gunshots and saw his father, bloodied and on the ground.
“We have recovered his cellular phone and we have some leads,” De la Rosa said.
Late Monday afternoon, De la Rosa announced that police had come up with a sketch of the suspect. He, however, refused to show a copy of the sketch.
In a statement, the National Press Club (NPC) called on incoming President Benigno Aquino III to form a super body to ensure that the enemies of the press are prosecuted while cutting off their influence in the courts, the prosecutors offices, the police and the military. VIENNAâ€"Media watchdog IPI called Monday for an end to killers' impunity in the Philippines and more action from the newly elected government, after reports of a third journalist killed in a week.
"This continued targeting of journalists is linked to the impunity that the killers enjoy in the country," IPI director David Dadge said in a statement.
"If President-elect Benigno Aquino wishes to stamp out corruption as he promised during his election, the Philippines needs a fully functioning media, a media that is not constantly under threat of attack," he added.
Gunmen shot and killed Nestor Bedolido, a 50-year-old newspaper reporter, in Digos City in Davao del Sur on June 19. He was the third journalist slain in a week, police said Sunday.
Last week, two other journalists known as outspoken critics of corrupt local officials were shot dead in separate attacks.
On June 14, broadcaster Jesiderio “Jessie” Camangyan was killed in Manay, Davao Oriental. Less than 24 hours later, radio commentator Jovelito Agustin was slain in the northern Luzon province of Ilocos Norte.
Dadge urged Aquino and the new government Monday "to tackle the issue of impunity in the murder of these journalists and those slain in recent years and prosecute those responsible."
The Philippines is considered one of the most dangerous places in the world for journalists.
Last year alone, 38 journalists were killed there, according to IPI.

2 cops duel over ‘VK’ machine
by Jerico Javier    Monday, 21 June 2010 20:21
Journal Online
THE  “video karera,”  game, although illegal, must be doing  brisk business that a cop who owns one machine was willing to shoot it out with a fellow law enforcer, who confiscated it, in Tondo, Manila early yesterday.

Case officer, PO3 Donald Panaligan, of the MPD-General Assignment Section said being hunted down is PO1 Dranreb Cipriano, who is detailed at the Philippine National Police headquarters in Camp Crame, Quezon City.

Cipriano fled after shooting PO2 Alfredo Custodio,  assigned at the Manila Police District-District Police Intelligence and Operations Unit, who is being treated at the Mary Johnston Hospital for a gunshot wound in the stomach.

Panaligan  said the fight between the two cops happened at 1 a.m. yesterday on Capulong Highway near the corner of  Velasquez St.

According to Ruby Custodio, the victim’s wife, her husband and Cipriano argued over a  video karera machine  that Cipriano owned and  which Custodio confiscated.

At the height of their argument, both cops drew their guns and Cipriano managed to shoot Custodio first.

The suspect then took the gun of the wounded victim before escaping on foot.

Panaligan said that charges are being prepared against Cipriano

200 batang bar girls ‘naisalba’

by Mar Empaynado
Monday, 21 June 2010 20:20

Journal Online

VICE President Noli de Castro and officials of the National Housing Authority- Home Guaranty Corporation and the owners of a construction company were charged with plunder before the Ombudsman over the alleged midnight deal in connection with the Smokey Mountain Reclamation Project worth P6 billion.

In a 22-page affidavit, Allan Pojas Ramos charged De Castro along with NHA general manager Federico Laxa, HGC executives and Reghis and Michael Romero, both owners of R-II Builders.

Ramos’ lawyer Ricky Gabrillo said the respondents blatantly violated the Anti-Graft and Corrupt Practices Act and Republic Act 7080 or the Plunder Law.

Gabrillo said De Castro wanted the government to pay R-II Builders P4 billion despite the fact that the project was not completed.          Under the “anomalous” Memorandum of Agreement and Compromise Agreement acquired by the complainant, the government stand to lose a huge amount of money since the NHA had to pay R-II Builders more than P4 billion, way above its capital spent for the project which was P200 million.

Gabrillo added that the government had earlier paid R-II Builders P806 million for the Smokey Mountain reclamation project and construction of low-cost housing.

Under the agreement, R-II Builders had to shell out money for the project but with the assurance of HGC, the construction firm managed to get a loan from the Social Security System and Government Service Insurance System.

De Castro and lawyer Jerome Canlas, counsel of R-II Builders, denied the allegations and said there was no midnight deal since the transaction took effect in 2005.

AT least 30 individuals joined hands in trying to stop the Department of Education from further giving sex education to elementary pupils by bringing the issue to court.

In a class suit filed before the Quezon City Regional Trial Court, the petitioners led by pro-life couple lawyers Jo and James Imbong named Education Secretary Mona Valisno and Undersecretary Ramon Bacani as respondents.

The group asked the education officials to cease from including sex education in the school curriculum under department memorandum 261 S. 2005.

Imbong said the court should grant them a temporary restraining order and preliminary injunction declaring the memorandum null and void, claiming that teaching sex education to the youngsters violates the right of parents to nurture the moral character of their children.
Besides, the teachings, according to the petition, were patterned after western models and would alter the lifestyle, behavior, attitudes and values of  Filipino children on sexuality.

“Reading the modules it was a shock to discover that they teach population control and family planning in mathematics, science, English, health education, livelihood and Araling Panlipunan among others,”  Jo Imbong said.

She cited the alleged psychological impact of these teachings on the minds of the students and its adverse effects saying early sexual intimacies, promiscuity, teen contraception, teen pregnancies and abortions were noted in the years following enforcement of sex education in schools.

On Sept. 8, 2005, the DepEd issued memorandum no. 261 series of 2005 directing the implementation of the UNFPA assisted project “Institutionalizing Adolescent Reproductive Health Through Life Skills-based Education”.

The petition said the memorandum calls for the teaching of sex education to pupils at least nine years old in grade school both in private and public schools with the program being funded and supervised by the United Nations Population Fund.

It questioned why kids as young as nine  will have to be trained about reducing fertility, preventing HIV/AIDS and other reproductive health components like family planning services, condoms, IUDs and contraceptive pills.

Commissioner Elias Yusoph refuses to elaborate
on the demands of the kidnappers.

Comelec executive's son kidnapped in Lanao
By Cecille Suerte Felipe (The Philippine Star) Updated June 22, 2010 12:00 AM

MANILA, Philippines - The son of Commission on Elections (Comelec) Commissioner Elias Yusoph was kidnapped by unidentified men allegedly demanding the nullification of the results of the elections in several towns in Lanao del Sur.
Police said 22-year-old Nuraldin Yusoph was kidnapped by hooded gunmen while praying at the VicBato Alih mosque in Barangay Sabala Amanao, Marawi City late Sunday.
Several hours later, the elder Yusoph received a call from the supposed kidnappers demanding that he nullify the election results in the towns of Malabang, Pilong, Taraka, and Masiu in exchange for the release of his son.
The Comelec held special elections in the four towns following a failure of elections during the May 10 polls.
Autonomous Region in Muslim Mindanao (ARMM) police director Chief Superintendent Bienvenido Latag said they have yet to identify the group behind the kidnapping.
Latag said police are coordinating with the Yusoph family since initial findings indicate that the kidnapping could be politically motivated.
Comelec spokesman James Jimenez, however, confirmed the kidnappers made contact with Yusoph and announced their demands.
“There is proof of life and he is calm and in good condition. Commissioner Yusoph was allowed to talk to his son right after the kidnapping,” Jimenez said.
Jimenez said the Yusoph family and the Comelec are closely coordinating with the

police in the effort to secure the safe release of the younger Yusoph.
“Right now we’re establishing what they need, what they want but the policy is no negotiation. I don’t think that there’s any reason to assume (a change in the policy),” he said.
According to Jimenez, the kidnapping of the son of the Comelec official could be classified as election-related.
“It’s not exactly about nullification of votes, although it has something to do with elections,” Jimenez said.
Although the kidnapping could be election-related, Jimenez said the authorities have yet to identify the culprits.
He said it would be unfair to tag losing candidates as being behind the kidnapping. -With Sheila Crisostomo, John Unson

Ruffa Gutierrez kayang-kaya ang pagiging dalagang ina
by Ambet Nabus-Journal

Kaya sa wish nilang tanta-nan na rin sana sila ng mga in-triga, samahan natin sila as they indeed deserve to celebrate good life ‘di ba?

DESPERATE MAYOR DRAGS CHURCH

The signs of desperation - on top of his tasteless language - of the City Mayor Dan Lim is showing off his Emperor's robe.
Desperate that soon enough the whole world will know about his dictatorial and corrupt ways at City Hall after realizing that independent Manila and Cebu-based (internationally-accredited) media-freedom groups will soon detonate news regarding his excessive trampling of human rights here, the City Mayor is punching blind at the wind.
When the media-freedom groups were in town, the City Mayor was as meek as a lamb in his Mayor's Report (Saturday) - but soon after (they left) renewed his relentless attacks against Station DYRD-Bohol Chronicle. Little did he know that their monitoring did not stop there.
Not even a Roman Catholic himself, the City Mayor has canonized himself once again as the spokesman and accountant of the Catholic Church. He claimed yesterday in his radio circus that Station DYRD was receiving an "annual financial subsidy" from the Church.
It was so easy to demolish that. All Station DYRD's Chito Visarra did was to pointedly ask the Head of the Church here Bishop Leonardo Medroso who categorically denied that there was any such subsidy.
Mayor Lim says there is a "subsidy"; the bishop said there is "no subsidy". And Bishop Medroso is an honorable man. Then one of them is a liar[?]
The desperate man is now dragging the institution of the Church - clutching at straws while the deepening waters reach his neck level. How low can a man get?
The only financial subsidy, in fact, that Station DYRD got was through the Catholic Media Network (of which the station is a long-time member) which gave the one-time grant to all its 40-member stations. This was part of the effort to expand the evangelization aspect of the Good News. Is that bad news for this non-Catholic mayor - for why is he so anxious indeed about efforts in helping the gospel reach many radio listeners?
In a previous public statement, the Mayor who turned church accountant (without the appointment papers) told parishioners that part of the Sunday Mass collections went to station DYRD.
Maybe the church should file libel charges against this apparent blasphemy from a confused man - who not only keeps City Hall accounting records off the public (which are public documents) but now advertises the church accounting records (that he had not seen) on collections and peddles a lie as truth.
But that futile, infantile effort to divide us and the church is of no moment to us now. We will just continue to help the church the best we can.
So far, Station DYRD airs the good Bishop Medroso's reflections every morning beamed from the Bishop's Palace at 6 o'clock and re-broadcast before sign off. Since Father Patrick Peyton's "The Family that Prays Together, Stays Together" in 1961, the station had also regularly had the rosary prayed on air every 8 o'clock in the evening. Of course the numerous special church occasions and announcements.
One can find in this paper, likewise, our sincere effort to offer free space to the cause of evangelization. Those Catholics who listen and read these church-based materials from our twin media outfits and were instead led to spiritual perdition may perhaps file for the mayor's canonization as saint instead?
Let us spare the venerable institution of the church to be used as a tool for one's indefensible positions. It is obvious that the Mayor wants to discredit this media who had brought issues against him (and several others outside of the city) because he is losing the war.
Imagine that months before the election, the Mayor proudly paraded his popularity as 80%-20% or 8 out of 10 people. On election day, despite news of harassment, disenfranchisement, vote buying and electronic rigging , this dropped to 60-40% or 6 out of 10 people during the actual election. A hollow victory- from where he came from allegedly.
Meantime, Station DYRD that he so derides, (based on the latest Feb-March HNU survey) rode on a crest of high popularity on programs and time slots that mattered most -- which means credibility has its merits. And if he is honest enough, the Mayor must accept the HNU Radio Survey reports since he wanted people to believe his HNU pre-election survey results as well.
What is good for the goose must be good for the gander - don't you think?
Now not content with other forms, the new publicized harassment game of the Mayor, per the Philippine Daily Inquirer, is to file libel cases against the paper and/or the station. We welcome such libel suits.
It is a citizen's perfect right to avail of remedies under the law. We welcome these suits because this will be the public's and the media's golden opportunity to finally arrive at the truth behind the anomalies at City Hall.
If the matter goes to the courts, then media shall avail of the coercive subpoena processes, so we can compel the production of the City Hall documents that the Mayor ha[d]s for so long a time, concealed from the public.
We shall subpoena the accounting records so the public will know the true state of the unliquidated advances and missing vouchers. We shall subpoena the records of the Mayor's intelligence funds [to court], so the court will determine if this media was right in exposing the irregularities in City Hall.
We shall subpoena the anomalous multi-million peso loan documents with DBP involving the shameful and shameless anapog road project. We shall subpoena the contracts regarding the Gallares extension rehabilitation and the DPWH standards of road construction measure and see if the sore thumb sticks.
We shall subpoena all the documents related to the Agora "sweetheart deal" that reportedly cheated the city of millions of pesos in a crooked deal hatched by the City.
It is easy to subpoena realtors and engineers to understand the going rates in related sitios in the city compared to that subsumed in the Agora ROT deal.
We shall subpoena the appointment papers of all members of the dreaded task force and those "casuals" hired before and during the election year. We shall subpoena all documents related to the so-called benefits to senior citizens. And so forth.
Finally, we shall avail of every right to cross examine the complainant-to-be, Dan Lim himself, so he will have to personally respond, under oath and on the witness stand, all these public interest issues that have been discussed in media. (Dan Lim's laughable and distorted theory is that discussion of public issues tantamount to libel)
We expect a stream of high-caliber lawyers who would only be more-than-willing to personally cross examine Dan Lim---in our behalf---to finally extract answers, which Dan Lim himself has long evaded, and concealed from the public.
Cross examination, as we know, is a person's fundamental, constitutional right to elicit the truth and to confront the charges leveled against him.
Truth, as we also know, is always a defense.
We assure our readers and listeners full media coverage if or when the mayor takes the witness stand.
How exciting this unfolding legal drama will be.
Dan Lim will be doing a great service not only to the media, but the general public as well. For it has been quite a time now that our media enterprise has been seeking the publication of these hidden public documents.
We subpoena these documents and then publish, inform verbally (through radio) and share them with the public. Public documents they are, remember? This is our media institution's duty to society.
As a bonus, that should help surge our chart-topping sales and circulation and listenership, by further arousing our readers' and listeners' already titillated curiosity about the growing pile of dirt inside the City Mayor's Office
.
So, our response to Mayor Dan Lim's libel threats, bring it on, City Mayor.
With the impending libel suits, we can only refer to the words of the Bible: "And you shall know the truth. And the truth shall set you free."

No subsidy to dyRD - Church
Radio station dyRD is not receiving annual financial subsidy from the Church, according to Bishop Leonardo Medroso yesterday.
He issued the statement after City Mayor Dan Lim, falsely [in his weekly radio program] alleged to the public that dyRD is a recipient of annual subsidy from the Catholic Church.
Lim's statement was flatly denied by the bishop when interviewed over the phone yesterday afternoon.
"DYRD has no financial link with the Church," the bishop [categorically said] declared in rebuking the mayor's false and malicious allegations.
"Ingna siya" (tell him), referring to the mayor, that there is no such subsidy," Medroso said in a tape recorded interview.
DYRD, as a member of the Catholic Media Network ((CMN) like other CMN radio stations availed of a one-time fund assistance to acquire a new transmitter which is part of CMN's program to increase the coverage of their member stations in order to increase its audience reach in spreading the Good News.
"It's just a one-time financial assistance entitled to every CMN-member station which would wish to improve its technical facilities," said Fr. Francis Lucas, CMN president.
The one-time grant was P320,110, a mere 18% of the total technical enhancement project of the station which cost P1.8 million.
The tirade of the mayor against the Bohol Chronicle Radio Corp. continues after teams from independent media groups in Manila and Cebu visited the city a couple of weeks ago to investigate the media harassment happening in the city.
In his statement issued to the probe team, Lim alleged that BCRC resorted to attack city hall governance after the corporation was assessed of its taxes paid to the city government.
Reacting to the mayor's statement, Peter Dejaresco, GM of the twin media enterprise said that documented chronological sequence of events prove that the letter from the late city treasurer Visitacion Acero came two months after Lim received criticisms on the drainage issue, and it was never the other way around.
The drainage issue which was sparked by the flooding along CPG North Avenue and the opening of the drainage outfall fronting the city port happened in November 2008. This generated heavy media coverage including editorial of this paper which criticized the city mayor for his flip-flopping stand on whether to cut the illegally tapped sewerage or not.
Two months later, on Jan 26, 2009, Treasurer Acero wrote BCRC of its alleged tax deficiencies. The media outfit filed formal charges against Acero at the Department of Finance (DOF) Manila which reprimanded the treasurer for her course of action.
Since then, Mayor Lim refused to issue the Mayor's Permit to the media company nor did he issue any computation of alleged tax discrepancies.
Previously, the mayor himself had consistently issued mayor's permits to the Bohol Chronicle from 2004 to 2008, clearly showing the city had no tax-related complaints against the Bohol Chronicle.
When visited by the media probe team, the mayor suddenly issued a statement published in a Cebu daily that the corporation has more than P800,000 tax delinquency which no notice has been issued by the office of the city treasurer.
Two media-freedom groups from Manila and Cebu are currently documenting the raging controversies affecting City Hall and the media in Bohol in general. Funded by the Freedom Fund, the Manila group is documenting with passionate dedication the travails of the press in less than permissive environments - all over the country - the way it is doing on the world-shocking Maguindanao Ampatuan Case.
City Mayor Dan Lim, members of the media and ordinary citizens were randomly interviewed to validate the claims by all parties.

Politics behind barangay polls

A special election for the top two positions in the province-wide league of barangays was marred by political interventions. Said posts will be left vacant upon assumption of the newly elected local officials on June 30.
Vice Governor-elect Concepcion Lim who is Liga ng mga Barangay president will automatically vacate her post as well as ABC Danao President Romulo Cepedoza, the group's vice president who got elected as provincial board member during the May elections.
The political intervention came after Tagbilaran ABC President Faro Cabalit got the full endorsement of Tagbilaran City Mayor Dan Lim who was hell bent in his campaigning for support during the last three days prior yesterday's elections held at Hotel La Roca, this city.
Mayor Lim, through his radio program, enticed ABC presidents in the province to vote for Cabalit with the commitment for free trip to China.
In fact, on the eve of the election, it was reported that Cabalit was assured of 21 ABC presidents (out of 47) after the pronouncement for a free trip to China circulated among the barangay officials.
The mayor justified his offer of the travel perks as his way of showing support to Cabalit who is always in tandem with the mayor in his radio program. He likewise reacted that he wants to prove that he can mount an opponent against Vergara whom he said was supported also by politicians, referring to V-Gov-elect Lim.
The offer for the free China trip followed after barangay captains identified with Vergara were all set to fly for Hongkong which was already scheduled by the Liga as part of their benchmarking activities to other places.
"The Hongkong Trip" was not intended to buy votes since it was agreed upon much earlier by the Liga to be part of their educational and learning trip, according to the outgoing Liga president.
However, despite Mayor Lim's campaign for the city ABC president, Cabalit got only four votes against Mabini ABC President Crispina Vergara who pooled 38 votes.
Vergara was supported by Vice Gov.-elect Lim who is the Liga's outgoing president.
Her running-mate, Antequera's federated president Maxelinda Ayco was also elected as provincial federated LnB vice-president, garnering a total of 32 votes while her contender Panglao federated Liga president Cerino Hormachuelos got 9 votes.
DILG Regional Director Pedro Noval administered the oath of Vergara and Ayco as the new president and vice president, respectively.
Based on the attendance of the LnB, five towns ---- Loboc, Inabanga, Dauis, Pilar and President Carlos Garcia --- were not represented during yesterday's special election as their respective Liga presidents did not show up, said a staff of the provincial Liga office.
Only the election for president and vice president was held even as the position for secretary is vacant due to the election of Joe Nicanor Tocmo as town mayor.
The post of treasurer was also left vacant by Vergara who run for president.
The LnB Bohol got the go-signal from the LnB national executive board to conduct the said special election so that there will be no vacuum of the presidency and vice-presidency.
Vice Gov-elect Lim resigned as Liga president last Friday to pave the way for the special election .
In her valedictory address, she wanted to be the Liga's adviser.
Vergara said in her inaugural but short speech that she was thankful to those who voted for her. She also urged her colleagues to work together for the betterment of the LnB.
JUDGE ARCAMO ISSUES TRO
RTC Judge Suceso Arcamo of Branch 47 issues a temporary restraining order (TRO) to hold the proceedings of yesterday's election for president and vice president of the Liga.
This surfaced after defeated Liga presidential bet Cabalit questioned the conduct of the special election of the vacant presidential and vice-presidential positions.
Judge Arcamo said the TRO is effective for 72 hours, "restraining the LnB Bohol provincial chapter thru its president Hon. Concepcion O. Lim and all persons acting in her behalf from holding the special election on June 19, 2010." "The court finds time of the essence and indeed there is an extreme urgency to issue a 72-hour TRO."
However, LnB Election Committee, composed of Liga presidents Romeo Labor, Rolando Ibale and Elenito Llorente, rejected outright the court order presented by Cabalit during the assembly of the LnB prior to the election because it (court order) was not addressed to the committee.
The court order docketed as Civil Case No. 7774 directed the LnB Bohol chapter represented by past president Concepcion Lim. Lim said she has already resigned as Liga president in the morning of June 18, 2010 but the court order was reportedly served in the afternoon of the same day.
The special election went on undisturbed.
Cabalit claimed the said election was irregular and violated the prescribed reglamentary period within which the said special election should be held based on the Election Code of LnB.
He said that the conduct did not observe the 15-day period upon which notices of such holding of special election shall be forwarded to all qualified LnB members, in this case to 48 members, including this city.
He said he only received the notice for the conduct of such election in less than a week's time.
After the rejection of the order, Cabalit skipped the election upon the advice of his counsel but his name was still included in the candidates for LnB president. He said he should not attend the election proceedings because in the first place it is "illegal" though his candidacy for president was considered. He was voted upon in absentia, however.
Under section 1 Article XI of the Constitution and By-Laws of the LnB, the incumbent national Liga executive board "is authorized to order the holding of such elections for the Liga chapter concerned." Thus, the 4th Liga executive board has passed Resolution No. 04-SPE-10-51- s. 2010, effecting such special election.
The national Liga board authorization of the special election is based on section 2, article XII of the same constitution and By-Laws that provides that in the event of vacancy due to "voluntary resignation" (in the case of Lim) te vice-president in the case of provincial Liga "shall assume the office for the unexpired term.
"In the case of a vacancy in the office of the executive vice-president and/or vice-president in the national Liga, the same shall be filled through an election among the bonafide and chapter members."
Vergara is said to serve only as ex-officio member of the provincial board until October this year when the barangay elections takes place or until qualified officers shall have been elected.
The conduct of said special election was witnessed by regional director Pedro Noval of the Dept. of Interior and Local Government, together with Comelec provincial supervisor Atty. Eliseo Labaria.
It was learned that the LnB special election was hurriedly conducted to pave the way for some 23 LnB members to depart today for "Lakbay-Aral" abroad in Macau, mainland China
Prior to the special election, some LnB members have already packed their bags, as if ready to go, when they arrived at La Roca Hotel where the election took place.
They were slated to depart this city today.

GMA "goodbye" visit set

Outgoing President Gloria-Macapagal Arroyo who will be winding her last few weeks as the nation's chief executive will be making her last official visit to the province next week.

Bohol, which is known as an Arroyo province, not until the May elections, is one of the top beneficiary provinces of the developmental projects funded by the Arroyo administration.

Mrs. Arroyo will be making her "good-bye" on Thursday next week during the inauguration of the P500-million port expansion project in Ubay town, the hometown of outgoing Gov. Erico Aumentado.

Bohol could be recorded as one of the provinces where Pres. Arroyo visited the most especially during her last term as chief executive.

Her love for Bohol was evident on the several occasions where she stayed overnight at the various resorts in Panglao, notably Bohol Beach Club, Amorita, Panglao Island Nature Resort and the recently closed Alona Palm.

The President twice brought her Cabinet to Amorita (the former Crystal Coast Resort), acquired by the Victory Liner group from the family of the late businessman Nanong Lim, the owner of Hotel La Roca and Crystal Coast Resort. The visit of the President will come while Boholanos will be asking her on what happen to the much publicized Panglao Bohol International Airport which she originally set for completion this year.

Gov. Erico Aumentado who earlier expressed optimism for the airport project now seems to admit that the project's chances for realization is deem and remote since the Manila International Airport Authority (MIAA) failed to award the project to the winning bidder.

The President's entourage will include Philippine Ports Authority General Manager Oscar Sevilla, Assistant Manager for Operations Raul Santos, and Acting Port District Manager for the Visayas Alex Cruz.As a strong ally, outgoing Gov. Aumentado rarely had an invitation turned down by the President including the slated inauguration of Ubay port expansion which is one of the 17 ports identified as priority out of 28 projects under the Strong Republic Nautical Highway program, a landmark accomplishment of the Arroyo administration.

The old Ubay port, which has been Bohol's roll on-roll off gateway to Manila and Mindanao, can now accommodate bigger cargo ships in addition to the usual passenger ships with its expansion to 3.5 hectares after the completion of the project's phases 1 and 2 that covers the widening of the causeway and construction of a roll on-roll off ramp.

It used to be just 3,726 square meters including the causeway that used to be just 496.85 meters long and 7.5 meters wide that connects it to the main road.

Even prior to its expansion, Ubay port has already been serving as "Bohol's principal gateway to Leyte, Samar; which is connected by barge to Matnog in Sorsogon and eventually on to Manila and vice versa".

Philtranco, Megastar, and Bolaños Bus lines are serving the Manila-Bohol route with at least two trips a day.

The port has also been the gateway to Mindano via Southern Leyte through "barge from Ubay to Southern Leyte then barge again to Surigao del Norte and then land trip to all points of Mindanao".

It also accommodates four vessels plying the Cebu-Bohol route daily.

The improvement of Ubay port will cater to the expected influx of cargo and passengers as Aumentado, who starts his come-back stint to Congress in July, has prepared a bill proposing Ubay to be declared a Science City- -the second after Muñoz in Nueva Ecija and the first in the Visayas.

The port will also complement the Ubay domestic airport, presently categorized as feeder airport, that Aumentado also eyes for improvement to become a real operational airport that will accommodate domestic aircrafts and training aircrafts of aeronautic schools.

After completing the civil works in Ubay port, Sevilla and the other PPA officials moved on to the groundbreaking ceremony last Friday for the P38-million Loay Commercial Port back-up area.

The expansion project will set Loay port as another roro connection of Bohol and Mindanao, in addition to Jagna port and the recently improved Ubay port. (Angeline Valencia)

BY THE BOHOL CHRONICLE
The alleged 'sweetheart deal" involving the Agora market signed by City Mayor Dan Lim and a private business consortium simply refuses to die down.
Last Friday, Regional Trial Court Branch1 Presiding Judge Patsita Sarmiento-Gamutan issued an Order directing that the proceedings of the Agora case be continued to July 16 as well as the rest of the tentative settings set in open court during the hearing last March 19, 2010.
Likewise, it also brushed aside the defendants' argument that the complaint should be dismissed by reason of plaintiff Victor De la Serna's failure to indicate his MCLE compliance.
"It is untenable," the court said.
"Although lawyers by profession, plaintiffs did not sign the complaint as counsels but as parties who seek to enforce their rights as ordinary citizens. As such, the complaint is considered sufficient in form even if no MCLE compliance is indicated," the court concluded.
The dates for continued hearings are set on June 30, August 13 and 27, September 3, 10 and 24 and October 8, 2010, all at 9:00 o'clock in the morning.
SWEETHEAR DEAL

Plaintiffs Victor De la Serna, Alexander Lim and Zotico Ochavillo, all lawyers, alleged that city hall officials are benefiting in this grossly disadvantageous, anomalous Agora "sweetheart deal".
On the first day after the Agora case was filed in court, Mayor Dan Lim declared in his several government-paid radio programs that this case cannot even take "first base".
The city mayor however was proven wrong. After five judges inhibited from hearing the case, the Supreme Court Regional Administrator designated Judge Gamutan to handle it.
From then on, the wheels of justice went grinding, shattering the myth created by the city mayor of his claimed invincibility from legal actions.
Complainant-lawyer Victor De La Serna had already took the witness stand as the hearing continued for the petition for Issuance of a Writ of Preliminary Injunction on the case that questioned the alleged "sweetheart deal" entered into by the city mayor with an alleged favored private consortium.
The plaintiffs want also the declaration of the ROT contract as null and void for being grossly disadvantageous to the city government.
As basis, petitioners had presented the contract of the Torralba market owners (Torralba and Sons Realty, Inc.) and developer Juan Apostol (Aldea Photo) that rented P120 per sq. meter for a period of 20 years under the same build-operate-transfer scheme involving a lot along the same busy strip of CPG Avenue, in this city.
In the City Square contract, involving the old Agora market located less than 50 meters away from the Torralba property, the city government gets P30 only per sq. meter rental for a period of 25 years.
On the other hand, the lease contract between the developers with the stall renters obtained by the petitioners showed it is being leased out at P600 per square meter, plus a mandatory 10 months rental to be paid in advance.
"From P30 per sq.m, the Agora lot is now being rented for P600 per sq. m. With an estimated 7,000 sq. m. total rentable area from the first floor to the third floor, the private consortium is estimated to rake a total income of P81 million a year, while only P5 million goes to the city government," petitioners said.
Petitioners estimated the total value of the Agora ROT project at P500 million; computed at P81 million on the first year, P44 million every year thereafter, for 25 years.
CITIZENS' RIGHTS

Earlier, a motion to dismiss was also filed by defendants Juan Apostol and the City Government represented by City Mayor Dan Lim arguing that plaintiffs Dela Serna, Lim and Ochavillo are not parties-in-interest of the Agora case because they do not appear to be injured or affected by the Rehabilitate-Operate-Transfer (ROT) contract entered by the city government with a private business consortium.
This was also denied by the court citing a long line of cases, wherein concerned citizens, taxpayers and legislators when specific requirements have been met, have been given standing by the Supreme Court.
"The issues raised are of paramount importance to the people of Tagbilaran City who stands to be injured if the allegations in the complaint are proven true and who stands to be benefited if the contract is nullified and the door opened to another contract which is no longer grossly disadvantageous to the people and taxpayers of the city," the Court declared.

Tagbilaran mayor sued

Cebu Daily News First Posted 09:54:00 04/17/2010

TWO radio station personnel in Tagbilaran City filed a complaint against city mayor Dan Neri Lim for ordering the cut off of electric supply in their homes.

Gerardo Cajes, radio technician of dyRD-AM; and Jeremias Pabe, radio broadcaster of the same station asked the Office of the Ombudsman in the Visayas to hold Lim and the other respondents criminally and administratively liable for graft charges.

They also requested that Lim and building official Teodoro Estoque be preventively suspended while investigation is conducted.

They said Lim cut off their power supply since they are affiliated with the radio station which has an “endless conflict” with the mayor.

“The inconvenience of darkness and the trouble of not having electricity are now being experienced by two unlucky families. Just because they can be closely linked to station DYRB-AM, they are also suffering the vindictiveness of Lim,” they said.

Also named as respondents were Engr. Eulogio Signe, general manager of the Bohol Light Company Inc. (BLCI); Engr. Ray Grapa, operation manager; and and Rotelio Lamdagan, consumer services supervisor.

The complainants’ homes have been dark without electricity for the past 18 days.

They have yet to secure a permanent electric service connections because of lack of necessary documents.

On March 29, they were however informed that their temporary electric service connections are due for disconnection since Mayor Lim allegedly withdrew the warranty of the temporary electrical connection.

Station dyRD-AM is the sister company of Bohol Chronicle, a bi-weekly newspaper./REPORTER ADOR VINCENT S. MAYOL

Bohol media firm accuses mayor of harassment

By Jhunnex Napallacan
Inquirer Visayas
First Posted 02:16:00 06/08/2010

Filed Under: Media, Conflicts (general), State Budget & Taxes

CEBU CITYâ€"A media institution in Bohol has accused the mayor of Tagbilaran City of harassment by not issuing its business permit since last year.

Peter Dejaresco, general manager of Bohol Chronicle Radio Corp. (BCRC), said Mayor Dan Lim had also refused to accept the company’s tax payment. BCRC owns the community newspaper Bohol Chronicle and radio station dyRD.

Lim, who was elected to a third term on May 10, countered that the owners of the media company were just playing “God” to avoid paying the correct taxes even before he became mayor in 2004.

He said he discovered this only two years ago when he applied the matrix system in the tax collection or comparing the tax payments of the different establishments.

But Dejaresco said his company’s plight had nothing to do with tax issues but of Lim getting back for its critical reports.

He claimed that City Hall started harassing the media company when it criticized Lim for the opening of the drainage outfall along the shorelines of Graham Avenue near the port as it would endanger the environment.

Since then, Dejaresco said, BCRC was surprised to receive in 2009 a letter from city treasurer Visitacion Acero stating nonpayment of taxes. Acero, who died in late 2009, had signed the previous mayor’s permits issued to BCRC.

Dejaresco said BCRC had been “religiously” paying its taxes based on the city’s assessment.

It tried to pay its taxes in 2009 twice, but Lim refused to accept the payment, he said.

To show good faith and willingness to pay, he added, the tax amount was deposited in court.

Dejaresco said BCRC also filed a harassment case against Lim, the city treasurer and an accountant at the Ombudsman in the Visayas.

Lim said BCRC was found to be paying even less taxes than Sunday Post, a weekly newspaper smaller than Dejaresco’s company.

To prove that he did not favor anyone, the mayor said he even ordered his own sibling who runs the resort-hotel Bohol Tropics to pay taxes at least three times higher than its previous tax payments.

Lim said BCRC got angry with the city government and refused to have its books scrutinized to prevent City Hall from making the correct assessment of taxes.

He denied refusing to accept the tax payment of BCRC.

But Dejaresco said records would show that BCRC had been paying taxes based on the city’s assessment.

He denied that the company refused to open its financial records for review, saying it was Lim who withheld its documents when it applied for permit.

Lim said Dejaresco’s newspaper and radio had been attacking him for two years, but he added that he just kept silent.

Lim said he was even the target of unfounded accusations, such as being the protector of illegal gambling, drugs and prostitution.

This is just one case of media abusing a politician, claiming that the Dejarescos are playing “God” by ordering their people to attack him, he said.

Lim said he was collating evidence for libel and damage complaints that he planned to file against BCRC and its people.

EDGAR M. CHATTO.

Iyang giklaro nga way kalabotan ug way kasayoran si Chatto sa rebokasyon.

Kinsa man karon ang lider nga wa nitunong?

(BANATNEWS)

Philippine Business News / Abu Sayyaf Group Update

“Expect more firepo¬wer in the next few days. They are on the run tired and wounded. We’ll soon get all of them for good. We’re slowly closing in and breaking into their positions. They may be familiar with the terrain but we own them during nighttime. We’ll crush them all,” ani ng source.

Midnight contract for Bohol airport
By Neal Cruz
Philippine Daily Inquirer

Filed Under: Contracts, Eleksyon 2010, Inquirer Politics

Other Most Read StoriesxClose thisWITH the elections only three months away, the laws already prohibit “midnight contracts.” The election also prohibits the start of new government infrastructure projects at this time, so close to the elections. The reasons are obvious: to prevent the award of contracts to friends of the outgoing administration in “aid of election.” Violation of this ban carries penalties of imprisonment and hefty fines.
Yet here is the outgoing administration of President Gloria Macapagal-Arroyo about to award a P1.52-billion (that’s billion) contract for the Panglao-Bohol Airport Development Project.
Not only that, the contract is about to be awarded not to the lowest bidder but to one of the highest bidders. Some people in this outgoing administration may be providing for their future, when they would be out of cushy government jobs.
Here is the story: For the first phase of the airport project (construction involving site grading and drainage works) the Prequalification, Bids, and Awards Committee (PBAC) invited bidders as the law provides. Eighteen bidders showed interest. Seven withdrew later, two did not show up. There were four non-complying bidders and five complying bidders. Of the latter five, First United (FUCC) had the lowest bid of P948, 106, 320.
The others had the following bids: Equiparco, P1,277.087,411.67; Sunwest, P1,498,888,888.00; Policarpio, P1,505,421,190.22; and Lao, P1, 512, 283, 791.15. The government estimate of the cost is P1, 523, 399, 203.00. Except for FUCC, which bidded less than P1billion, the four other bidders clustered tightly together near the government estimate.
This is abnormal and suspicious, according to veteran contractors. In a truly competitive bidding, they said, the bidders usually distance themselves from the government estimate. Yet here, four of the five bidders clustered around the estimate. “This is glaring evidence of rigging,” they said. The contract would be awarded to the highest bidder of these four.
Early on, a group of bidders, claiming the blessings of top government officials, approached the other bidders and “tried to pressure them to conspire with them and together rig the bidding. The project, they said, was “meant to raise funds for the coming elections.”
Rebuffed, the group prevailed on the PBAC to postpone the bidding, from Jan. 25 to Feb. 5 and then from Feb. 5 to Feb. 11, although there were no compelling reasons for the postponements.
During the bidding, the favored bidder submitted the highest bid. So how would it get the award when the law says the contract should be awarded to the lowest bidder?
No problem. A way would be found, “by hook or by crook,” to disqualify the other bidders on some technicality, they said. On the other hand, the deficiencies of the favored bidder would be overlooked. Never mind if the government stands to lose more than half-a-billion pesos. The group stands to benefit by that much.
The lowest bidder complained to this column not because he wants the contract to be awarded to him but because the laws already prohibit the awarding of contracts at this time, with the elections so near, and the administration due to step down in three months. “Midnight contract” na ’yan,” he said.
That is correct. Any government contract awarded now would be, like midnight appointments, null and void and those who participated in it will face stiff penal sanctions. Wait until after the elections and the new administration takes over.

Kinsay sad-an aning tanan?
