(Stampede kills 145 at remote Hindu temple in India By GAVIN RABINOWITZ, Associated Press Writer
Sun Aug 3, 4:04 PM ET)

Thousands of panicked pilgrims stampeded Sunday at a remote mountaintop temple in northern India during celebrations to honor a Hindu goddess, sending dozens of people plummeting to their deaths and trampling scores more. Police said 145 people were killed.

Rumors of a landslide apparently started the panic at the shrine in the foothills of the Himalayas, said C.P. Verma, a senior government official in the Bilaspur district.

Pilgrims already at the Naina Devi Temple began running down the narrow path leading from the peak. There, they collided with devotees winding their way up.

With a concrete wall on one side and a precipice on the other, there was nowhere to escape and they were crushed. At one point a guard rail broke and dozens of people fell to their deaths.

The bodies of the devotees â€" many dressed in brightly colored holiday clothes â€" carpeted the path, intertwined with flattened iron railings. Many still held the flowers and food they planned to offer at the temple.

Police said they used a cable car at the shrine to ferry some of the bodies down, and helicopters flew in to take the wounded to hospitals.

At the Bilaspur hospital in Himachal Pradesh state, rescue workers unloaded bodies wrapped in brown blankets from a truck and laid them in neat rows so they could be identified by relatives.

"I rushed to the spot in search of my three children who had gone to pay obeisance at the hilltop shrine," Jawahar Khurana told the Press Trust of India news agency as he searched the bodies.

"I fail to understand why God was so cruel to us," he said.

All the bodies were taken to the Anandpur Sahib hospital in the neighboring state of Punjab where authorities were carrying out autopsies, senior police officer R. N. Dhoke told The Associated Press by telephone from the hospital. He said the death toll was not expected to rise further.

Many of the dead were women and children, he said, and another 37 people were injured and in hospital.

Tens of thousands of worshippers had flocked to the remote temple in the foothills of the Himalayas to celebrate Shravan Navratras, a nine-day festival that honors the Hindu goddess Shakrti, or divine mother.

The temple is about 155 miles northeast of New Delhi.

Deadly stampedes are a relatively common occurrence at temples in India, where large crowds â€" sometimes hundreds of thousands of people â€" congregate in small areas lacking facilities to control such big gatherings.

Sunday was the second day of the festival and authorities sought to reassure other pilgrims. "There is no need to panic, everything is normalized now," Verma said.

Hello Guys, have you read this prophesy from Juseleeno?.
Do you think this is a hoax?.

Mr. Juseleeno Nobulega DaRoose is Brazilian, born in 1960, 47 years old now, his occupation is a teacher, he is a normal citizen, having a very poor life with his wife and kids. All the events which Mr. Juselleno predicted had clear indication of the year, month date of the disasters, incase any third party wants to confirm the facticity of his prophesy, Mr. Juselleno always put the story which he predicted to the notarization office or post office for the approval.

Somebody asked him, how old did he start the prophesy dream, he answered: 9 years old, from 1969, he dreamed 3 events a day, sometimes 9 events, the times he dreamed is different every day. He said all the prophesy dreams were automatically in his dream. When Mr. Juseleeno was 19 years old, he met the famous Brazilian prophesy Saint Mr. Franciscoshabiz, after that the worldwide disaster events were increased in his prophesy dream. Mr. Franciscoshabiz was two times the candidate for the Nobel Prize, he is a very famous differential functional person, at the same time he is also the Charitarian. The events which Mr. Juseleeno predicted are already more than 80000, firstly let’s look at below a few big worldwide events and huge disaster from his prophesy.

?
? Princess Diana was assassinated;
Mr. Juseleeno sent a warning letter to Diana via post office on 4th March,1997 “ I got the message from the God that someone is planning to kill you in the car accident, your life will be dangerous, 7 angels told me about this. You may die in this car accident and the specialist may close this case as a driving mistake, but they are totally wrong. The murder is close to you…. And it will happen before 2000”
Juseleeno also send this warning letter to the time, Darlytelegraph and Guardian etc. new agents in England, but never published. The car accident was happened on 31st August,1997, 5 month after the warning letter was sent out. Just as the prophesy said that the case was closed as driving mistake. The accuracy of this prophesy is not only to predict the huge event but also the truth of the intrigue behind the event. There are a lot of rumors after the accident, Diana was killed by the England royal family centered by queen Elizabeth.

The prophesy said it will happen before 2000, though there isn’t exact date on, but this prophesy was sent to the president(FernandoHenriqueSilvaCardoso) of Brazil 2 years before the accident and mentioned about “from 1997 to 98 that Diana will die” etc.

? The second attack of World Trade Center, it is 911
Jeseleeno sent the warning letter to the president of USA in 1989, the warning letter had also published at a notarization office which run by Mr. Klicheeba in the town of Palana. This warning letter also predicted that the World Trade Center will get the first attack in 1993, though there was no exact date on but the second attack was clearly told 11th September,2001. Everyone knew the result, the first attack was happened on 26th Feb.1993 three and half year after the warning letter sent out, the parking place was blow up and many people injured, the second attack was happened on 11th Sept.2001, 13 years after the warning letter sent out, it is the 911.

The exclamatory thing is, this prophesy also told about Afghanistan and Iraq war will start after 911, after Iraq lost, the president Haisan will run to Adawr the middle of Iraq etc. are all in the letter, like you all know, the events in the prediction letter were happened one by one.

? Sumatra Indonesia earthquake
Juseleeno sent the warning letter about Indonesia Sumatra Earthquake to the India Embassy on 16th September, 1996, about 8 years before the disaster. This warning letter predicted that there will be 8.9 earthquake in Aceh Indonesia in the morning of 26th December,2004. India and Indonesia will be attacked by the tsunami. He sent the warning letter to the president of Indonesia on 30th April, 1997, the letter is about “ I dreamed that 7:00am 26th Dec, 2004, South Asia will be attacked by 8.9 earthquake, at the same time will get the tsunami, the area will be Aceh Indonesia, India, Malaysia, Sri Lanka, Thailand, Maladiv, Bombay. And many people will be dead……
The result is- the earthquake was happened at 07:58am 26th Dec. More than 200000 people dead, the biggest tsunami was about 30 meters, a lot people were dead by the tsunami. He also sent the same letter to Indonesia, Philippine, Thailand and other Embassies. He also got the thanks letter from these countries.

The thanks letter from Meigawadi said “ about the 2004 earthquake and tsunami, to prevent the disaster, we must do a lot of things, but in another hand, we can do nothing”. The thanks letter from Indonesia Embassy said “…..we will send this letter to our government, if you have any update information, please let us know”.

From above information, Juseleeno already predicted that there will be more than 200000 people die in the tsunami and earthquake 8 years before the disaster, he sent the warning letter with detail date on to these countries, but nobody did any preventive measures.

The writer pick up a few events which Juseleeno predicted for the future.

2007
Tornado attacked Brazil, thousands people dead.
2007 or July of 2008 Japan will get earthquake and get 30 meters tsunami.

The temperature will reach 58 degrees in many countries of Africa, at the same time will lack of water.
15th June, the New York stock market will be
The temperature in Africa will reach 58 degrees, it is unbelievable number, but in May 2007, people who travel around Africa said the temperature in Greece and Turkey are already 39-40 degrees, Iraq and Arabia is about 45-46 degrees, it is possible to happen in the summer but not in may, we can imagine that in the summer of 2010, the world will become warmer and Africa will get the high temperature.

2011
Will found the treatment for Cancer. But another new cancer will occur.
A serious disease will occur, it will be called ALS, People will die after 4 hours get ALS
Bird flu H5N1 will infect to human, 7300000 people will die till 2013.
Mr.Juseleeno’s prophesy is not only for the disease and earthquake but also for the exact name. For example the formal US president Gore famous book “ An Inconvenient Truth”. The name of tornado which will attack Brazil, and thousands people will die, the name of infectious disease ( ALS), the name for San Francisco’s earthquake ( the Big One) and etc. events.

2012
The area of glebe will be extended regarding the aridity and become desert, from 2015 till 2020, the trees will disappear in Amazon.
From 6th Dec. the sky will start the black cloud time, it is called weather cloudy.
Human start die because of the infectious disease’s overspread.
2013
Find the treatment for cancel except the brain cancel.
Bahamas of West Indies, from 1st Nov. till 25th the Volcano will break out and bring the earthquake too, after that will be 150 meters huge tsunami, about 80 meters tsunami will go to Caribbean, About 15 kilometer to 20 kilometer to USA , Brazil and other countries. The sea will go down 6 meters before the tsunami and the birds will move away too.
Mr.Juseleeno predicted that when the cats and dogs know the disaster is coming, they want to get away from the venue, they will have strange behaviors 24 hours before the disaster, so we can use that for the standard of judgement.

2014
The small planet will be closer to the earth and may knock together, the exist of this small planet will influent the issue of human live.

2015
In November, the average temperature will reach 59 degrees, many people will die, the world confusion will be bigger.

2016
In the middle of April, huge typhoon will attach some cities of China, about one thousand people will die.
The US president Bush will be in the hospital suddenly, has serious sickness.

2018
About the issue of small planet will be closer to the earth, the leaders of each country will gather together to discuss the countermeasure, Mr. Juseleeno already predicted in 2000, and informed the NASA of USA about the exist of the small planet. On 31st June,2002, NASA confirmed and called this small planet 2002ZNT7??

2019
May find out the science power solution, if the small planet knock together, 1/3 population of the world will die. Mr. Juseleeno predicted that the percentage for the small planet knock the earth will be 60% .
In June, the east sea of Japan will get the Tsunami, bigger then the Indonesia tsunami.

2025
Astronomer will find new planet, it may knock the earth again, the possibility will be 80%.

2026
In July, San Francisco will get huge earthquake, it is called “ the big one”, San Andreas Fault will be destroyed, California will disappear, a lot of crater will start again, the tsunami will be more than 150 meters.

2043
The world population reduced, about 80% people dead in the disaster.
Will 2008 Beijing Olympic Game be held smoothly?
As above said, in 2008, China will get 9.1 earthquake and more than millions people will die, according to Mr. Juseleeno’s prediction that the earth quake will be 13th September,2008, and Olympic will hold on 8th August-24th, In this schedule, the earthquake will happen after Olympic, but before the big earthquake, there will be a lot of small earthquake, it will make the country and people upset.
There will be a lot of small earthquake before the big one, although Juseleeno didn’t predict the exact date, but if we presume the small earthquake will happen one or two month before and it may be the period of Olympic, if so it may make the host and athletes give up. When the writer read this prophesy from Juseleeno, he suddenly remember the space time traveler John Titoer’s last word “ 2004 Athens Olympic Game will be last one”

But, if the earthquake is in the south of China, Nanning and Hai Nan, and there are no Olympic games, the Beijing Olympic Game will close successfully. But the problem is that China government is only care about the reputation and successfully of the Olympic game, ignore the small earthquakes, and no preparation before the big one. China may control the report, closed all the news . If so there will be a big disaster as the prophesy said. In Mr. Juseleeno’s warning letter said “ if there is no preparation to protect the citizens, will get huge loss’

Mr. Juseleeno also predicted that glacier period is coming.
He also has the right prophesy for the weather, one of them is, in 2003, Europe got high temperature, 29th October, 2001, the warning letter said “ the nature world will beat back to the world, the temperature of France, Germany and Portugal will become higher, more than ten thousand people will die, this disaster will happen between 2003 and 2004” . the truth is, the temperature in the summer of 2003 had reached the highest one which they’ve never had in Europe, about 35.000 people dead, especially France and Germany, about 14,000 people dead in France and 7000 people dead in Germany.

From Mr.Juseleeno’s prophesy, the earth temperature will get higher every year, till 2012, the temperature in Africa will reach 58 degrees and the same time will have serious water problem, after the temperature will be even higher, till 2015, the average temperature of earth will reach 59 degrees, a lot of people will die, the human will get frighten all over the world. If this is the truth, the countries will against each other because of the aridity and not enough food, Mr. Jeseleeno also predicted that there will be some new wars because of the aridity, but he didn’t have clear prophesy, but he felt it won’t be the normal war.

Anyway, the temperature is getting higher is not like the aerography said ( the speed is very slow), actually very quick. However the warmness seems not always incessancy, after the high temperature, a big part of ice of Greenland and South Pole will be dissolved and go to the sea, the circulation of the sea will be lower and become colder, it means a new glacier time. In Juseleeno’s prophesy seems also said after 2027, there will be a new glacier. Details of the prophesy as below:
The volcano of America yellow park will break out, the smoke and magma will go 1,600 kilometer far, Kansas, Nebraska, Montana will all get damaged. The break out of the volcano is not only in Yellow park, but also some other place in the world. these smoke will blot out the sun, the circulation of see will stagnate and active the cold phenomena.
??????????????
Eir and kol got Nobel award
As we all know, the formal president Gore dedicate on study of earth temperature, his famous book “ An Inconvenient Truth” was made to a movie and also get the Oscar award. Actually 19 years ago, Mr. Juseleeno already predicted about this, the phophesy had been published on Moon Magazine in June, in the end of may, before the publish, the editor told the writer about this, I really got surprised for a while..

According the letter which Juseleeno sent to Gore, this prophesy letter already inform Gore that from 1993 to 2001 he won’t be the vice president anymore, he will dedicate on protect the world environment activities, and he will write a book “An Inconvenient Truth” to become famous, the English letter Juseleeno wrote to Gore also told the books name and he will get the 2007 Nobel award, we will know this autumn, Let’s looking forward for the prophesy for Mr. Gorel. We can’t deny Mr. Juseleeno’s prophesy.

There are not much time for Human, from December 2007, the Black Cloud will extend all over the world, as Mr. Juseleeno predicted that if the human still keep the actuality, human will have terrible life from 2008 till 2012 , the black cloud will full of the sky before the disaster. If we want the disaster, and war stay away from us, the deadline for human is the end of 2007. Mr. Juseleeno expected the world consciousness will change in the end of 2007.

The situation is very serious now, if we still want to depend on other’s power, Mr. Juseleeno’s prophesy “ the black future” will happen. We must understand the serious situation, individual to individual, group to group, country to county, hold you own responsibility, take action, because the deadline will come soon.

Inability and tiny ability is totally different, inability is no matter whatever we do, it won’t help. But tiny ability mean more people contribute and the power will become strong. We have do start from ourselves, one people’s power is small but if we put everyone’s power together, It will be strong to change the future disaster.

Email this | Email the Editor | Print | Digg this | Add to del.icio.us NEW YORK â€" Any day now, “pregnant man" Thomas Beatie â€" a Hawaii-born Filipino â€" is scheduled to deliver his first baby.

Beatie, 34, whose birth name is Tracy Lagondino, is expecting a girl. Since his operation to make himself look more masculine, Beatie has legally asserted his right to be called a man and is now married to a woman named Nancy.

"[I consider this] an average pregnancy," Beatie told Oprah Winfrey on her show earlier this year.

The Portland, Oregon transgender appeared on the Oprah Winfrey Show where he revealed the circumstances of his pregnancy and announced his scheduled date with the stork on July 3.

Up until that public confession, many of Nancy’s relatives did not know she is married to a transgender.

"It’s an incredible experience," Beatie told Winfrey on his then five-month pregnancy, showing off his belly bump.

The New York Times reported Beatie’s pending delivery as "partly a carnival sideshow and partly a glimpse at shifting sexual tectonics."

Beatie told Winfrey he was born a woman, but underwent chest reconstruction and testosterone therapy that would transform her into a man. He decided to keep her female reproductive organs in the event the couple decided to have children, as Nancy’s womb was taken out in an operation 20 years ago.

'Monster' baby

This is Beatie's second pregnancy.

In 2007, he also tried to have a child but was heartbroken to find out he had an ectopic pregnancy. He was about to have triplets.

"It was a life-threatening event that required surgical intervention, resulting in the loss of all embryos and my right fallopian tube," Beatie wrote in the Advocate, a magazine catering to lesbian, gay, bisexual, and transgender (LGBT) individuals.

Instead of receiving sympathy after the abortion, Beatie said his family had a different take on it.

"When my brother found out about my loss, he said, ‘It’s a good thing that happened. Who knows what kind of monster it would have been,’" Beatie wrote in the Advocate last March.

Reports claim that Beatie has a Caucasian mother and a Filipino father.

“My Father calls intermittently," he told Winfrey, “I believe he loves me. He just can’t see me that way."

Nine doctors, nine months

Beatie said he and his wife have endured public scorn since they came out with their story on Oprah. They’ve been ridiculed by family and friends and discriminated against by health care professionals.

A total of nine doctors turned Beatie down when they found out about his condition.
Beatie disclosed to Winfrey that one of the doctors he saw told him his staff was uncomfortable working with someone ‘like him.’

"This is why it took over one year to get access to a cryogenic sperm bank to purchase anonymous donor vials, and why Nancy and I eventually resorted to home insemination," he said.

After looking around for willing doctors, Beatie finally found a helping hand from Dr. Kimberly James.

"As soon as I met them, obviously a very devoted couple, there’s no way that I felt I could turn them down," James said in the Oprah show interview.

Despite the social stigma, Beatie said he is "so lucky" to have such a loving, supportive wife.

"I will be my daughter’s father, and Nancy will be her mother. We will be a family," he said. The Times said there is no good language to describe Beatie’s situation.

"As the first pregnant transman to go public, Mr. Beatie has exposed a mass audience to alterations in the outlines of gender that may be outpacing our comprehension," the NY times says.

"Issues like these have made Mr. Beatie’s story so compelling; the sense that trans identity in the Webster sense of the prefix signifies some threshold state of being â€" ‘across’ or ‘beyond’ or ‘through.’" - with reports from Mark Joseph Ubalde, GMANews.TV

Have you ever felt exasperated when you bumped into someone at the store but absolutely couldn't remember their name? Sure, it happens to all of us.

Despite being the strongest computer on the planet, our brains do lapse. It's hard to blame them really. As humans, we spend much of or existence stuffing our brains with stuff. Some stuff is worthless, some of it's meaningful, some of it, well, it's just stuff and there is an endless amount of it.

No matter how powerful our brains are, they need recuperation time, to be kept in shape, and even an occasional charge. Think of it as a tune up for your brain. Skipping brain maintenance is as silly as the person wandering the parking garage because they forgot where they parked. Is that you? Are you that person? Sure. We all are at some point. No worries, there is hope.

Now I am not a brain surgeon and I am not going to suggest you do anything surgical or dangerous. I am however an astute student of human behavior, so I always look for simple ways to super charge my brain.

Here are some things you can begin doing as soon as today to begin the great brain tune up.

1. Eat Almonds
Almond is believed to improve memory. If a combination of almond oil and milk is taken together before going to bed or after getting up at morning, it strengthens our memory power. Almond milk is prepared by crushing the almonds without the outer cover and adding water and sugar to it.

2. Drink Apple Juice
Research from the University of Massachusetts Lowell (UML) indicates that apple juice increases the production of the essential neurotransmitter acetylcholine in the brain, resulting in an increased memory power.

3. Sleep well
Research indicates that the long-term memory is consolidated during sleep by replaying the images of the experiences of the day. These repeated playbacks program the subconscious mind to store these images and other related information.

4. Enjoy simple Pleasures
Stress drains our brainpower. A stress-ridden mind consumes much of our memory resources to leave us with a feeble mind. Make a habit to engage yourself in few simple pleasures everyday to dissolve stress from your mind. Some of these simple pleasures are good for your mind, body and soul.

* Enjoy music you love
* Play with your children
* Hug a stranger
* Appreciate others
* Run few miles a day, bike or swim
* Start a blog
* Take a yoga class or Total Wellness routine

5. Fast for a day
Fasting cleans and detoxifies our body. It is known fact that heavy food not only causes stress on our digestive system but also drains our brainpower. Fasting relieves toxic emotions such as anger, grief, worry, and fears - before they accumulate and cause disease. By cleansing toxic emotions, fasting strengthens metal clarity with increases memory, concentration, creativity and insight.

6. Exercise your mind
Just as physical exercise is essential for a strong body, mental exercise is equally essential for a sharp and agile mind. Have you noticed that children have far superior brainpower than an adult does? Children have playful minds. A playful mind exhibits superior memory power. Engage in some of the activities that require your mind to remain active and playful.

* Play scrabble or crossword puzzle
* Volunteer
* Interact with others
* Start a new hobby such as blogging, reading, painting, bird watching
* Learn new skill or a language

7. Practice Yoga or Meditation
Yoga or Meditation relives stress. Stress is a known memory buster. With less stress, lower blood pressure, slower respiration, slower metabolism, and released muscle tension follows. All of these factors contribute significantly towards increases in our brainpower.

8. Reduce Sugar intake
Sugar is a non-food. It’s a form of carbohydrate that offers illusionary energy, only to cause a downhill slump once the initial burst has been worn off. Excess intake of sugar results in neurotic symptoms. Excess sugar is known to cause claustrophobia, memory loss and other neurotic disorders. Eat food without adding sugar. Stay away from sweet drinks or excess consumption of caffeine with sugar.

9. Eat whole wheat
The whole wheat germs contain lecithin. Lecithin helps ease the problem of the hardening of the arteries, which often impairs brain functioning.

10. Eat a light meal in the night
A heavy meal at night causes tossing and turning and a prolonged emotional stress while at sleep. It’s wise to eat heavy meal during the day when our body is in motion to consume the heavy in-take. Eating a light meal with some fruits allows us to sleep well. A good night sleep strengthens our brainpower.

11. Develop imagination
Greeks mastered the principle of imagination and association to memorize everything. This technique requires one to develop a vivid and colorful imagination that can be linked to a known object. If you involve all your senses - touching, feeling, smelling, hearing and seeing in the imagination process, you can remember greater details of the event.

12. Sex
Our sexual imagination often empowers our ability to daydream, which strengthens our brainpower with greater imagination, visualization and association.

13. Control your temper
Bleached food, excess of starch or excess of white bread can lead to nerve grating effect. This results in a violent and some time depressive behavior. Eat fresh vegetables. Drink lots of water and meditate or practice yoga to relieve these toxic emotions of temper and violent mood swings.

14. Take Vitamin B-complex
Vitamin B-complex strengthens memory power. Eat food and vegetables high in Vitamin B-complex. Stay away from the starch food or white bread, which depletes the Vitamin B-complex necessary for a healthy mind.

Break Point

COMING in the wake of grisly crimes like the cold-blooded execution of nine persons in a bank in Laguna, the report that the Philippine National Police (PNP) leadership is supporting the revival of the death penalty does not surprise me a bit. It is typical of government incompetence and lack of depth to blame the brazenness of criminals on the absence of a powerful deterrent such as the death penalty.

Fed up with all the killings going on around him and afraid of his own safety, the ordinary citizen’s reaction is to agree. It is, however, not so much the absence of a death penalty that emboldens criminals as the proven and generally accepted inability of the police to capture the culprit of most murders. You could have a thousand death penalties but criminals would still continue boldly with their nefarious activities confident that the police are incompetent or corrupt enough to catch them.

For the death penalty to be a deterrent, criminals must first be identified, caught and brought to trial. If murder suspects are never caught and brought to trial, which is more often the case, who will you serve the death penalty to? Hence, if I were a criminal, the death penalty would not worry me a bit. I would only start to worry if the police suddenly developed competence in identifying and capturing me.

The majority of the murders of journalists and activists and ordinary citizens remain unsolved today. In Cebu City, some people have resorted to vigilantism to stem the tide of criminal activity yet the police remain clueless (or are they really?) as to who the vigilantes are. In all cases of unsolved murders, the standard excuse is that no witnesses have come forward.

Knowing this, criminals being criminals, they just threaten and silence witnesses and they are home free because we have a police force that cannot solve crimes unless a witness comes forward to identify the perpetrator. So, if I cannot be identified as perpetrator what death penalty do I have to worry about when I cannot even be brought to trial?

Ebb tide for the sea of criminality could come if criminals knew there is a competent police force to identify and catch them. This can happen when the police develop better forensic skills and apply the latest forensic investigation techniques to identify the murderers instead of perfunctorily charging unsolved crimes to the lack of eyewitnesses.

The death penalty is only effective as a deterrent if suspected murderers are caught even without eye-witnesses through forensic evidence. Police incompetence, not lack of death penalty, is emboldening criminals who are not even worried about penalties because they are confident the police cannot catch them anyway.

DEATH penalty was provided for in the 1973 Constitution, and it was carried out using an electric chair. But the 1987 Constitution abolished the death penalty, with the provision that, “unless for compelling reasons, involving heinous crimes, the Congress hereafter provides for it.”

After thorough deliberation by Congress, a death penalty law, or Republic Act 7659, was passed in 1994 specifically for heinous crimes such as kidnapping, murder and drug trafficking. It was implemented through lethal injection.

Congress at that time considered death penalty a deterrent to criminality. But studies showed that death penalty was mainly imposed only on the poorest, least educated and most vulnerable members of society.

Former president Joseph Estrada ordered the execution of seven death row convicts but strong opposition from the Catholic Church forced him to hold back. When President Arroyo took over in 2001, she declared a moratorium on executions following a strong lobby from the Church and the human rights group Amnesty International.

Before her visit to Rome two years ago, Arroyo’s allies in the Congress rushed the passage of the law that abolished the death penalty as a gift to the Pope. The Philippines was the 25th country in the Asia-Pacific region to end capital punishment in law or practice.

But with the recent crime incidents, like the one in Cabuyao, Laguna where bank robbers mercilessly killed eight bank personnel and a depositor, some senators are pushing for the re-imposition of the death penalty.

Sen. Juan Miguel Zubiri said he would like criminals convicted for crimes related to drug trafficking and multiple homicide penalized with death. He is getting the support of Sens. Loren Legarda, Panfilo Lacson and Bong Revilla.

If you ask me, I would say our legislators are like dancing the Sinulog. Urong-sulong. One step forward, two steps backward. I understand that some of those who voted for the abolition of the death penalty are still in Congress. Now they want to re-impose it? Don’t they know how much Congress spends to pass a law?

If Congress revives the death penalty law, we will be criticized by the Catholic Church and the international community. And do you think President Arroyo will sign a death penalty bill into law? Not within her administration.

In the first place, President Arroyo and Congress should not have abolished the death penalty. She should have let the death penalty law sleep during her term if she did not want to implement it being a religious and God fearing person.

With that, whoever will be the next president would still have had the option of implementing it. Under our Constitution, the President has the power to grant reprieves, commutations and pardons after the final judgment of conviction.

Again, according to some senators, there is now a need to re-impose the death penalty. They can be compared to a man who married a woman, divorced her and then married her again. Matod pa sa mga b***t, “mabuang ko.”

Anonymous Diary Blog / Kung Kamo Si Noy Kulas
May 20, 2008, 10:53:47 PM

Dear Noy Kulas,

Tuod,

Maayo ang among kahimtang.

Unsa may akong

CEBU CITY -- A man who was tagged responsible for a grenade blast that killed four people nine years ago was shot dead in Carcar City, Cebu Monday afternoon.

Allan Villegas Lapingcao suffered two gunshot wounds in the head, two in the chest and two in the back. He died instantly.

He was walking in Sitio Awayan, Barangay Poblacion 3 around 1:30 p.m. when the incident happened.

Two deformed slugs were recovered in the crime scene.

One gunman and three companions were tagged responsible for the shooting.

Initial reports did not say if they had a getaway vehicle.

Superintendent Teofilo Siclot, Carcar City police chief, said they did not have records of Lapingcao in the city, but there were reports he was involved in petty crimes.

He was also reportedly at odds with the group of Ryan Saducas of Barangay Liburon.

Lapingcao hails from Balao in the neighboring town of Barili but has reportedly been staying in Sitio Upper Lamacan, Valladolid, Carcar City, where his wife lives.

Siclot said Saducas’ group has threatened to kill Lapingcao.

Lapingcao’s name reportedly cropped up in their investigation on the shooting of a shoemaker in Barangay Valencia last month.

The death of Junmark Laogan was seen as a retaliation after the attack on Manuel Bacalan, 22, Roel Bargamento, 35, and Elmer Alcuizar, 49 in Sitio San Roque, Barangay Liburon the week earlier.

Lapingcao first got into trouble with the law when he was just 12 years old.

He was arrested for stealing roosters and fruits and got admitted to a rehabilitation center for minors in the southern town of Argao.

At 17, he was caught stealing an LPG tank in Talisay City.

He earned the nickname “Allan Demonyo” from inmates at the Cebu Provincial Detention and Rehabilitation Center for being a bully and constantly picking fights.

He escaped the facility in October 1994, after making jokes about bolting the jail. He was recaptured two hours later hiding under the Mananga Bridge.

He was reportedly a member of the “Suyop-suyop Gang” as he had a tattoo of the initials “SSG” in his right middle finger.

On September 25, 1999, he was tagged responsible for a grenade blast that killed four women and wounded 27 others, ending a benefit dance in Sitio Irid, Barangay Bitoon in the northern town of Daanbantayan.

He reportedly fled to Catigbian, Bohol right after the incident.

He was captured in January 2000, but not after a P105,000 bounty was offered for his arrest and after several months of police operations around Cebu Province.

He and brother-in-law Mario Fat were named respondents in the multiple murder and multiple frustrated murder case filed before the Municipal Circuit Trial Court in Bogo-Medellin-Daanbantayan. (MEA of Sun.Star Cebu)

Representative Beltran dies at 75 (12:43 p.m.)

MANILA -- Anakpawis Representative Crispin Beltran died Tuesday at around 11:48 a.m. after suffering from a bad fall in his home in Barangay Muzon.

Doctors from the Far Eastern University hospital said Beltran sustained lacerations in the head and brain injuries, which resulted to his death.

Beltran, 75, was trying to fix a leak in their roof and fell off on his way down.

In a TV interview, Beltran's daughter Ofel said her father fell about 14 feet from the ground.

She said they first brought their father to the North Caloocan hospital where he was resuscitated there.

They later decided to transfer Beltran to the Far Eastern University hospital where he was declared dead due to brain injuries.

According to Ofel, her father suffered several cardiac arrests.

But doctors clarified that the cause of the lawmaker's death was not due to cardiac arrest instead because of brain injuries. (Sunnex)

MANILA -- Government officials and private groups have offered a P1 million reward for a group of robbers who killed nine people during a bank holdup in Cabuyao, Laguna, police said Saturday.

Malacañang was also quick to assure that government is not too keen on reviving the death penalty law following the grisly bank robbery last Friday.

Police, on the other hand, are providing a round the clock security for the lone witness of Friday's bank robbery while a task force was created to go after the perpetrators.

In one of the country's bloodiest bank robberies, seven bank employees, a depositor and a security guard were shot in the head in gangland-style executions Friday, police said. One employee was hospitalized and in critical condition.

Police beef up security plans

Isagani Pastor, the lone survivor in the robbery and Rizal Commercial Banking Corporation's (RCBC) marketing manager, is still in a critical condition in a hospital's Intensive Care Unit.

Police failed to talk to Pastor as of press time Saturday due to his unstable condition.

There has been speculation the victims may have been killed because they knew some of the robbers. They were found sprawled on the floor of a branch of the RCBC in Cabuyao town, after suspicious customers alerted authorities when the bank failed to open as scheduled at 9 a.m.

Laguna Provincial Police Director Felipe Rojas said the Provincial Government and Senator Bong Revilla each offered P100,000 while a private group - Friends of the Philippine National Police - gave P800,000 to a reward kitty.

Rojas said two security guards initially reported missing have been taken in for questioning. Both denied involvement and are not currently considered suspects, he said.

He said both guards and all the victims were being tested to check if they had fired weapons. The guards are to undergo polygraph tests next week.

Rojas earlier said "many" robbers were involved "because this was a very complex operation." The robbers appeared to use the bank's back door.

On the other hand, Deputy Presidential Spokesman Anthony Rolando Golez Jr. said while the Palace is open to discussions on the matter, there is no proof the death penalty will deter crime.

"The Palace has a stand against the death penalty and we should discuss this thoroughly with the stakeholders. The Palace will be open if the discussions are open to talk about the death penalty," he said.

"But up to now there is no direct or scientific correlation between the death penalty and lowering of crime rates," Golez added.

The civil society group Volunteers Against Crime and Corruption (Vacc) said it supports the call for the revival of the death penalty.

"We urged the government to revive the death penalty and robbery with homicide should be included among the crimes punishable by death," said Vacc chairman Dante Jimenez during Saturday's press conference in Mandaluyong City.

Jimenez said they will offer assistance to the victim's families in the Laguna robbery.

He likewise urged the authorities to leave no stone unturned in the hunt for the perpetrators.

As of Saturday, the PNP has already formed "Task Force RCBC" to go against the perpetrators.

Task Force RCBC will be composed of investigators from the Criminal Investigation and Detection Group (CIDG), Crime Laboratory, and Traffic Management Group (TMG), all from the Region 4-A command, and the Laguna police, said PNP spokesperson Nicanor Bartolome. (JMR/AH/Sunnex)

Flashfloods hit Negros Occidental
By Erwin Ambo S. Delilan

BACOLOD CITY -- One died and another was reported missing in Cauayan town while 531 families were displaced as flashfloods hit the province of Negros Occidental early morning Tuesday.

Police identified the fatality as Marilou Oliveros, 15, of sitio Santol, Barangay Guihulngan in Cauayan.

Oliveros's friend Melanie Ilardes, 15, also of the same sitio, is still missing as of this writing Tuesday.

Inspector Louie Figueroa, the town's police chief, said the two went to a benefit dance in a nearby sitio in the same barangay Saturday night. At around 11 p.m., they were on their way home and were crossing the Santol River "when they were reportedly swept away by the strong current."

Oliveros's body was found by Santol residents floating in the river Tuesday morning, said Figueroa. "But we're not stopping efforts to look for the missing girl," the police officer added.

Dave Cuajao, a staff of the Provincial Disaster Management Team (PDMT), said rescuers from the towns and cities in southern Negros are now searching for the missing girl.

Rescuers were also instructed to assist other flooded localities in the southern part of the province like in Binalbalbagan, Pontevedra, Hinigaran, Kabankalan, Cauayan, Sipalay, Hinoba-an, and Ilog.

Provincial Social Welfare and Development officer (PSWDO) Llane Garcia reported that as of 6 a.m. Tuesday, there were six barangays in Ilog hit by flashfloods, displacing 531 families with 2,655 individuals affected.

Garcia identified the areas as barangays 1, Calubang, Vista Alegre, Dancalan, Andulawan, and Delicioso.

Of the 531 affected families, 124 are from purok Embarkadero, Barangay 1; 100 in purok Mangga Vargas, Barangay Calubang; 56 from purok Mo-og, Barangay Vista Alegre; crossing Caubang, Barangay Dancalan has 96; purok Limbo, Barangay Andulawan with 28; and 127 in purok Libas-Talisay, Barangay Delicioso.

The PSWDO is coordinating with local government officials of Ilog for the needed assistance.

Some of the affected families are still housed at evacuation centers in their respective barangays.

Governor Isidro Zayco said he instructed the PSWDO, PDMT, and the Provincial Health Office (PHO) to be on alert due to the bad weather condition.

He wants PDMT to update him from time-to-time on the province's situation as rains continue to pound Negros Tuesday.

Cuajao, for his part, warned Negrenses against the possible occurrence of landslides in areas like Calatrava, Toboso, Escalante City, and Don Salvador Benedicto in the north, and Cauayan, Sipalay City, Hinoba-an, Ilog, and Kabankalan City in the south. (Sun.Star Bacolod/Sunnex)

17 people rescued after boat capsizes off Olango due to strong winds, waves

SEVENTEN people were rescued 30 minutes after their small motor boat capsized off Olango Island at past 4 p.m. Sunday.

The survivors, 15 passengers and two crew members, were headed to Barangay Sta. Rosa after attending the annual fiesta celebration in the adjacent islet of Barangay Caubian.

But as they reached the Olango Channel, the whether condition suddenly worsened, bringing strong winds and heavy rains.

Big waves continuously thumped their boat until it capsized, the victims told the Lapu-Lapu City Police Office.

No one was injured, though, as all 17 of them were immediately rescued by the other revelers who were in another boat that tailed theirs.

SPO1 Rodito Viovecente of the Lapu-Lapu City Police Office said four female survivors identified as Richel Pino, Ray An Malinao, both 18 years old; Eillene Buagaban, 35, and Rosalinda Malinao, 45, were brought by their rescuers to the police office to have the incident recorded.

The other 11 passengers and the crew members were taken to Sta. Rosa by the rescuers.

The incident occurred around the same time authorities issued a warning on weather disturbances this week, which could result in disasters and calamities.

With the heavy rains since last week, the Regional Disaster Coordinating Council (RDCC) 7 warned residents of flood-prone and landslide-prone areas to be cautious.

The warning was made in the general flood advisory the body issued for Central Visayas.

Office of the Civil Defense Executive Officer Rosario Cabrera told reporters yesterday that those living near mountain slopes should be on alert for possible flash floods and landslides.

She gave the same warning to those who live near or along rivers and streams and those in low-lying areas.

In Cebu, they expect bodies of water, such as the Guinabasan River, Mananga River and streams near the Carcar River Basin, to be affected by the “light to occasionally moderate rains for the next 24 hours.”

Similar warnings were given to the local disaster coordinating councils in Bohol for those near the Abatan River, Loboc River, Inabanga River, Ipil River and Matulid River.

They also warned those living near the Tyabanan River, Pagatban River, Bayawan River, Sipocing River, Siaton River, Candugay River, Tanjay River and Libertad River in Oriental Negros.

As of yesterday, Typhoon Butchoy was seen northeast of Basco, Batanes, but rains continued to pour throughout the day in Cebu.

It was expected to be outside the Philippine area of responsibility as of yesterday afternoon, but the Philippine Atmospheric Geophysical and Astronomical Services Administration (Pag-asa) said the Visayas area “will continue to experience occasional monsoon rains.”

Cabrera said they received situation bulletins every six hours and assured that the local disaster coordinating councils are always on alert during weather disturbances.

She added that search and rescue groups are also on call to respond to any disaster. (AIV/MEA)

MANILA, Philippines - A pending bill in Congress seeks to impose stiffer penalties, including longer prison terms and heavier fines, for parents or guardians who neglect their children or wards.

House Bill 2447 aims to amend Articles 276, 277 and 278 of the Revised Penal Code to clamp down on cases of abandonment and exploitation of children.

"It is considered a criminal act for parents and persons entrusted with the custody of minors to abandon them and not give them the proper education that they need," said the bill's author, Rep. Rufus Rodriguez in a statement posted on the Lower House's website.

The bill seeks to punish a guardian who abandons a minor with up to six months' imprisonment and a fine of up to P15,000.

Parents who abandon their children face a maximum of four months imprisonment and a fine of P50,000 to P100,000.

When a minor dies because of abandonment of his or her parent, the parent shall face imprisonment of up to eight years.

"Should a parent endanger the life of his or her child, she or she shall be punished by prision correctional in its medium and maximum periods," Rodriguez's bill said.

The bill also stipulates imprisonment of up to six months and a fine of up to P100,000 on parents who shall neglect their children of school age and deprive them of compulsory elementary education as mandated by the Constitution.

This penalty likewise applies to anyone who has responsibility over a minor and delivered the minor to a public institution or other persons without the consent of the parent or guardian or of proper authorities.

Imprisonment of up to six months and a fine of up to P100,000 shall be slapped against those who shall exploit minors.

Rodriguez said parental authority and responsibility under the Family Code include the caring for and rearing of children for civic consciousness and efficiency and the development of their moral, mental and physical character and well-being.

Parents and guardians are also mandated by the law to keep their children in their company, to support, educate them, to give them love and affection, advice and counsel, companionship and understanding, and to represent them in all matters affecting their interests, he added. - GMANews.TV

Email this | Email the Editor | Print | Digg this | Add to del.icio.us MANILA, Philippines - A Filipino security guard in Dubai was arrested Thursday night for allegedly killing his wife, online news site Khaleej Times reported Sunday.

The guard initially identified only as AF, was accused of killing his wife in a villa in the Al Twar area in Dubai in the United Arab Emirates.

Police sources said the man was referred to public prosecution Saturday.

Initial investigation showed the Dubai police received information at 9 p.m. Thursday that a woman had been stabbed by her husband in a villa located behind a gas station in the Al Twar area.

Officers from the Al Ghusais Police Station rushed to the site and saw the 31-year-old Filipina, identified as J, lying in a pool of blood with stab wounds.

She died while she was being brought to a hospital.

CID officials noticed the Filipina's husband hiding in the compound. On seeing the police, he tried to flee, but the police arrested him.

During interrogation, the man told the police that he entered into a heated argument with his wife while the two were having drinks in their room.

He said that he was enraged when his wife abused him, forcing him to stab her. He insisted his intention was not to kill her.

A woman neighbor said the couple had been living with her and other families in the same villa for a while and seemed happy. Neighbors had never heard them quarrelling.

But on Thursday night, the woman neighbor heard the victim screaming and the Filipino was seen rushing out of the room with bloodstains on his shirt. - GMANews.TV

MANILA, Philippines - A migrant workers’ group claimed that the Overseas Workers Welfare Administration’s (OWWA) admission that it lost about P70 million in pre-departure loans extended to overseas Filipino workers (OFWs) was merely a cover-up to the agency’s ineptitude in managing its funds.

John Leonard Monterona, Migrante-Middle East (Migrante-ME) regional coordinator, said Labor officials used the admission as an opportunity to stop the welfare programs given to OFWs and their families.

"OWWA has been mismanaging the fund, a compulsory collection of $25 per OFW, which is believed to have reached P10 billion held in trust by the government," said Monterona.

Labor Secretary Marianito Roque on Sunday said he decided to suspend the said OWWA assistance after the OFWs failed to pay their loans.

Roque said the OWWA allocated P100 million for the pre-departure loan program. However, he stopped the program when loans that were largely unpaid reached P70 million.

Monterona however claimed that Roque was "forced" to admit such losses after lawmakers were about to investigate the alleged misuse of OWWA funds.

During the public hearing of the House Committee on Overseas Filipino last week, Albay Rep. Edcel Lagman scored OWWA for not immediately adjusting the peso equivalent of the $25 OWWA membership fee when the dollar depreciated in 2007.

Monterona explained that the pre-departure loans for OFWs had been suspended right after the OWWA Omnibus Policies was passed and implemented by the agency’s Governing Board headed by then Labor secretary Patricia Sto. Tomas.

"Such admission of OWWA losses is not new to us. We have been hearing the same old story. The OWWA Administrator usually admits losses of OWWA funds to cover up huge misuses and mismanagement of the fund," Monterona said.

Migrante-ME’s regional coordinator recalled an incident when former OWWA Administrator Virgilio Angelo claimed that the agency allotted P260 million in welfare programs and loans for OFWs "only to justify the transfer of a P4-billion OWWA Medicare fund to the Philippine Health Insurance Corporation (Philhealth) prior to the 2002 presidential election."

"We suspect more hidden misuses and diversion of funds have been done or charged to OWWA fund," Monterona said.

Monterona said that because the OWWA fund was perched at the P10-billion mark, it was prudent to consider lowering the OFW membership fees especially in a time of soaring prices of basic commodities.

"Lowering of OWWA membership fee and removal of other unnecessary government fees charged and collected from OFWs and aspiring alike would surely bring ease to OFWs and their families in time of economic crisis," Monterona concluded. - Mark Joseph Ubalde, GMANews.TV

Villar fears Hanjin is deceiving gov't
By Annabelle L. Ricalde

SENATE President Manuel Villar express apprehension that the South Korean Hanjin Heavy Industries Construction Co. Ltd. is trying to bluff the government by withdrawing the $2-billion shipyard facility in Villanueva, Misamis Oriental.

"Sa tingin ko puwede ring bluff lang naman pero tingnan muna natin kasi sayang din, kasi I was told na 40 mil ang kukunin nilang trabaho," Villar told reporters in a press conference during his visit in Cagayan de Oro City Friday.

But Villar is still counting the possibility that the government both the local and national will come up with a win-win solution to iron out whatever paradox that hounds the realization of the said project.

The senator also cited that Hanjin has committed some mistakes on their project particularly in Subic wherein they constructed a condominium in the middle of the forest without environment compliance certificate (ECC), which is a violation.

However, Villar said if the government cannot dissuade Hanjin from withdrawing the project this will cause a negative effect, adding that thousands have lost an opportunity for a possible job.

Villar declined to give comment on the possible reasons of Hanjin's desire to withdraw their billion-dollar shipyard project in Villanueva.

"I don't want to comment since wala akong masyadong alam sa problema sa Hanjin with the local government," Villar said.

Environment Impact Statement

But for the part of Engineer Alex Jimenez, chief of Environment Impact Statement Division (EISD) of the Environmental Management Bureau (EMB), Hanjin has yet to submit their Environment Impact Statement (EIS) before they can start the operation of the shipyard project.

Jimenez though emphasized that EMB has no problem with regards to Hanjin's application. "In fact, the EMB had already issued an environment compliance certificate (ECC) last April 28 while the certificate of non-coverage (CNC) for perimeter fencing and site clearing was issued last April 4 of this year."

The first ECC issued by EMB to Hanjin is for the 5-meter high and 1,207.213-meter length perimeter fence, training and lecture, and office building and support services compose of gas refilling station, sewerage disposal facility, and guardhouse projects.

"But the consultant of Hanjin has yet to finish some other documents for the EIS," Jimenez told Sun.Star Cagayan de Oro.

Jimenez said for Hanjin to secure another ECC for the shipyard operation they should first comply the EIS necessary procedures by conducting a public hearing, data gatherings, inventory of the area, scooping and among others.

Last April 23, Hanjin and Phividec representatives along with Department of Environment and Natural Resources (DENR), EMB officials conducted a public consultation in barangays Tambobong and Balacanas in Villanueva town Misamis Oriental.

"So far tapos na lahat ang preparatory procedure for the EIS, pero magdepende pa rin `yan sa consultant ng Hanjin kung kailan niya isa-submit ang mga documents," Jimenez said.

COTABATO -- More than a thousand mostly Christian settlers fled their farming village in southern Philippines after about 300 armed Muslim rebels occupied their land, the guerrillas and a mayor said Friday.

Moro Islamic Liberation Front (MILF) guerrillas entered the coastal village of Sangay in Kalamansig town on Wednesday, demanding food and confiscating rice recently harvested by the villagers, Kalamansig Mayor Rolando Garcia said.

The rebels told the frightened villagers to leave, sending them fleeing to Kalamansig town some three hours away by boat, Garcia told reporters. Kalamansig is in Sultan Kudarat province.

"I sent a peacekeeping force there to settle the problem amicably but they were forced to withdraw to avoid bloodshed," Garcia said of the 14-man police team sent to the area.

There were no immediate reports of fighting or casualties.

Garcia said he and village officials had hoped the rebels would stay only briefly as they have in the past, but the guerrillas remained in the village.

MILF spokesman Eid Kabalu said the occupation arose from competing claims to the land, but rebel leaders have not approved the action yet.

"This is due to overlapping land claims that have not been acted on," Kabalu told The Associated Press.

The MILF, who have been fighting for more than three decades to establish a Muslim homeland, agreed to a cease-fire with the government in 2003 while the two sides hold peace talks brokered by Malaysia.

Malaysian defense chief General Abdul Aziz Zainal was meeting with Philippine officials in Manila on Friday, including President Gloria Macapagal-Arroyo.

Abdul Aziz also planned to visit Malaysian cease-fire monitors in the south and Muslim guerrillas at a rebel camp, chief MILF negotiator Mohagher Iqbal said.

Kabalu said the MILF was in talks with officials to resolve the situation in Sangay, but that it was a local issue and government and rebel peace negotiators were not involved. He did not mention Abdul Aziz. (AP)

CEBU CITY -- A criminal case for violation of the Dangerous Drugs Act was filed Friday against former Cebu vice governor John Gregory "John-John" Osmeña for his alleged involvement in the importation of a shabu ingredient in 2004.

Justice Secretary Raul Gonzalez confirmed the filing of the charge in an interview with Sun.Star Cebu, even though officials from both the Regional Trial Court (RTC) Criminal Division and the Office of the Regional State Prosecutor have withheld the document.
Gonzalez said the Department of Justice (DOJ) will issue a formal statement on Monday, including who else were impleaded in the case and why.

The filing of the case, almost four years and two months after the issue broke out, caught the vice governor's camp in apparent surprise.

Lawyer Edgar Gica, counsel for the former vice governor, said the last time he heard from the state prosecutors handling the preliminary investigation on the case was two years back.

"The last pleading I filed was a memorandum in support of our prayer for dismissal. See how justice is dispensed by them?" he said. "I can only say that the case of John-John is seasonal and the elections are just around the corner," he added.

But Gonzalez, in the interview, said the department was very thorough in the preliminary investigation and maintained that this was among the reasons it took them years to issue a resolution.

"They know what is the basis for the resolution," he said, referring to the Osmeña camp.

Two justice department officials flew to Cebu City Friday morning and hand-carried the thick records of the case for filing before the RTC criminal division.

State Prosecutor Llena Ipong-Avila said the same officials later took the 7 p.m. flight to Manila.

The DOJ, not the Office of the Cebu City Prosecutor who otherwise had jurisdiction over the issue, conducted the preliminary investigation on the complaint.

In turn, the investigation stemmed from a National Bureau of Investigation (NBI) 7 fact-finding probe.

The probe centered on who was behind the March 5, 2004 entry of some 60 drums of a drug precursor to the Cebu International Port.

The shipment, believed to be worth over P3 million in 2004, was brought into the country by the firm Chifeng Arker Pharmaceutical Technology Co. Ltd., via the MV Intra Bhum.

The consignee was one Michael Cummings and his Coastside Ventures Inc., located at Unit E-19, King's Warehouse Plaza, Hernan Cortes St. in Mandaue City.

Law enforcement investigation subsequently traced the company to one Joebert Cuesta, Rorela Villegas and Ma. Rowena Roldan, all employees of the then incumbent vice governor.

Cuesta, who then sat as the vice governor's chief of staff, was identified as the former president of Coastside Ventures while Villegas represented the firm in a lease contract for a warehouse in Mandaue City where the shipment was to be delivered.

Roldan, on the other hand, was identified as one of Coastside's stockholders.

Article 2, Section 4 of Republic Act 9165, otherwise known as the Dangerous Drugs Act of 2002, penalizes the importation of any "controlled precursor or essential chemical." It provides an imprisonment lasting between 12 to 20 years.

A fine costing between P100,000 and P500,000 is likewise provided.

At the fact-finding stage, Gica submitted to NBI 7 a copy of the original articles of incorporation of Coastside Ventures Inc. showing no names of Osmeña's staff members as incorporators.

Only an amended version, per Securities and Exchange Commission records, mentioned two members of the vice governor's staff-Cuesta as president and Roldan as an incorporator.

Cuesta, in his affidavit, said he doesn't know why his name appeared on some Coastside documents. (KNR of Sun.Star Cebu)

ANGELES CITY, Pampanga - President Arroyo yesterday signed the order granting a 10 percent salary increase for government employees starting July 1.

"Yes, I already signed it, in time for Labor Day," Arroyo said in an interview at the Villanueva, De Leon, Hipolito, Cusi, Tuazon Law offices here, where the meeting of the regional tripartite wage and productivity board (RTWPB) for Central Luzon was held.

The President, accompanied by Labor Secretary Marianito Roque, conducted an unscheduled visit at the meetings of the regional wage boards for Central Luzon and the National Capital Region (NCR).

Arroyo said the visits were meant "not to exert undue pressure but just to see for myself how things are doing."

Arroyo earlier ordered regional wage boards to work overtime to come up with possible wage increases to help cushion the impact of the rising prices of oil and rice.

Overtime

"Instead of having the usual Labor Day ceremony, upon my request, the wage boards are doing overtime work today Labor Day. It is a no-work holiday for all, May 1, except for them," she said.

Labor groups in Central Luzon and Metro Manila are seeking an across-the-board wage increase of P60 and P80, respectively. The minimum wage in Central Luzon is P201 to P287 following a P9 increase that took effect Sept. 27, 2007. The minimum wage in the NCR ranges from P325 to P362 following a P12 increase effective Aug. 28, 2007.

Records of the two RTWPBs showed that there is 86.6 percent compliance with the wage increase in the NCR and 97.5 percent compliance in Central Luzon.

Aida Andres, NCR wage board secretary, said an increase in minimum wage in Metro Manila would benefit about 1.3 million to 1.8 million workers.

Of the number, 90 percent work for mostly micro, small and medium-scale enterprises.

She said that based on their assessment, a P60 to P125 across-the-board increase at this time may result in an increase in unemployment or displacement of workers of up to 914,000.

Roque said no new announcements were to be made in time for the Labor Day celebration except to reiterate and ensure the provision of additional non-wage benefits like the condonation of loan penalties for Government Service Insurance System, Social Security System and the Home Development Mutual Fund (Pag-Ibig) and the putting up of daycare centers in the work place, among other programs.

Schedule

He, however, said they expect the deliberations to be finished within the month and eventually "issue wage orders this month of May."

Roque assured workers of the commitment of the government to continue working until the wage orders are approved and implemented.

He also committed to hasten the drafting of the implementing rules and regulations (IRRs) to pave the way for the implementation of Republic Act (RA) 9481 or the "Act Strengthening the Workers Constitutional Right to Self Organization," which took effect in May last year.(Sunnex)

ANGELES CITY -- A former player of the Red Bull amateur basketball team in the Philippine Basketball League (PBL) was subdued by policemen while holding his own daughter hostage after a quarrel with his mother shortly before midnight Tuesday in Barangay Malabanias here.

Responding policemen under the supervision of Superintendent Felixberto Castillo, this city's police officer-in-charge, rescued the girl unhurt from the hostage-taking drama that lasted for about 45 minutes.

The team headed by Chief Inspector Rene Aspe, Angeles Police Station 4 chief, arrested the hostage taker identified as Ronald Guevarra Starling, 33.

Starling was clutching his daughter and holding a nine-inch long kitchen knife around her neck while screaming insults to the responding policemen as he told them to keep away from him.

Starling held his daughter inside their house along Don Juico Avenue in Clark View Subdivision and threatened to kill her to shoo away policemen.

He calmed down when Chief Inspector Luisito Tan, deputy station police chief, arrived and talked to him through the window, convincing him to give up.

Starling then let go of his 9-year-old daughter Krizia who was able to remove the rope that the former basketball star used to tie her hands and the tape on her mouth.

The suspect, who has reportedly developed alcoholism asked Tan to buy him several bottles of beer.

When Tan was handing the beer over to Starling, Aspe and his men found the opportunity to pull the girl to safety.

Using the backdoor of the house, Aspe and his men went into the house and rescued the girl.

Aspe said when they arrived at the scene, Starling screamed at them, threatening to kill anyone who will attempt to arrest him or rescue his hostage.

His mother, Elordita said Starling might have learned of her plan to put him again in a rehabilitation center.

She added that earlier, while his daughter was about to take a pillow, he grabbed and hogtied her then he informed his mother that he took hostage the child.

The mother quickly went out to call for help from barangay watchmen who, in turn, reported the incident to the Angeles Police Station 4.

Starling was charged with alarm and scandal.

Assistant City Prosecutor Ronald Leo Haban committed Starling to continued detention at the Angeles City District Jail. (Dante M. Fabian/Sunnex)

General Topic / Was early elephant an amphibian?
April 27, 2008, 07:54:18 PM

WASHINGTON: Scientists studying two very ancient elephants surmised that they were probably semi-aquatic mammals, eating freshwater plants.

"Molecular data from modern elephants share a common ancestry with the sirenians - aquatic sea cows and dugongs," said Alexander Liu of Oxford University, co-author of the report.

"Elephants may have an ancestor which was amphibious in its mode of life and we wanted to know if Moeritherium or Barytherium (existing 37 million years ago) was this semi-aquatic ancient relative."

"Unfortunately only fragments of the skeletons of these early elephants survive, so instead of looking at their bones we looked at the chemical composition of their teeth to determine what they ate and how they lived," he added.

Alex Liu, with colleagues Erik Seiffert from Stony Brook University (US) and Elwyn Simons from the Duke Lemur Center (US), analysed the oxygen and carbon isotope ratios within tooth enamel from both extinct species.

While carbon isotopes can give clues as to an animal's diet, oxygen isotopes found in teeth come from local water sources - and variations in the ratios of these isotopes can indicate the type of environment the animal lived in.

They compared the ratios of these isotopes to terrestrial animals from the same period and these results - when combined with results from studies of embryology, molecular data, and sedimentology - lead them to believe that Moeritherium was semi-aquatic.

Liu said: "We now have substantial evidence to suggest that modern elephants do have ancient relatives which lived primarily in water."

These findings were published online in PNAS.

Pinoy doctors in US health care scam to face probe

MANILA -- The Department of Health (DOH) asked the National Bureau of Investigation (NBI) to furnish them reports on the medical professionals allegedly involved in the United States military health insurance scam.

A Pentagon-run health insurance program has been gypped of more than US$100 million over the past decade in the Philippines, which local doctors and hospitals conniving with American veterans to submit fraudulent claims.

Arroyo Watch: Sun.Star blog on President Arroyo

A Filipino doctor was arrested in Guam in connection with the health care scam. He has pleaded not guilty to submitting US$2 million in counterfeit demands. However, there are some cohorts still in the Philippines who might be extradited to the US in the future.

Health Secretary Francisco Duque III said they would conduct their own investigation on local doctors who conspired with American war veterans in swindling the program of more than US$100 million.

"Our investigation will be based on the records and to unravel the identities of the professionals who are involved in this fraud," he said.

Duque pointed out that if the accusations were indeed true, the image of the country and its medical professionals would be jeopardized.

According to him, it is important that those local doctors accused of fraud should be investigated on whether they are also doing the same among local health insurance firms.

Justice Secretary Raul Gonzalez Sr., for his part, expressed willingness to cooperate with the US government in turning over any Filipino who may also be involved in the scam.

Gonzalez said there has been no official action yet sought by the US from the Department of Justice (DOJ), but Manila could only turn over a suspected Filipino once the US government has met all the requirements in the extradition treaty.

"We will (give it due course). There are certain requirements under the treaty that should be met. Like right now, there is a request for extradition for an Indonesian but we denied the request for extradition because they have not complied with the requirements of the treaty," he said.

He said part of the process is to await the adjudication of the local courts, stating that there is probable cause against the person before he could be extradited.

"The only downside there would be the legal maneuvers their lawyers here will do. Like in the case before of (former Manila congressman) Mark Jimenez, we complied with the extradition but there were certain hurdles that we have to do through the courts here because they went to our courts. Those are the things already beyond the control of the government because the court will issue writs, for example, we have to comply also with the orders of the local courts until we can have them resolved," he said.

A hospital group, which Gonzalez declined to identify, has recently been blacklisted by the US for anomalies ranging from overcharging of claims for veterans to manipulation of records to false representations.

"I think this hospital group was in Subic, in Angeles City and in Bacolod," he said. (FP/ECV/Sunnex)

Frequent masturbation may help men cut their risk of contracting prostate cancer, Australian researchers have found. It is believed that carcinogens may build up in the prostate if men do not ejaculate regularly, BBC News reported on Wednesday. The researchers surveyed more than 1,000 men who had developed prostate cancer, and 1,250 men who had not. They found that men who had ejaculated the most between the ages of 20 and 50 were the least likely to get cancer. Men who ejaculated more than five times each week were a third less likely to develop prostate cancer.

Sexual intercourse may not have the same effect because of the higher risk of contracting a sexually transmitted disease, which could in turn raise the risk of cancer. "Had we been able to remove ejaculations associated with sexual intercourse, there should have been an even stronger protective effect of ejaculations," Graham Giles of the Cancer Council Victoria, who led the researchers, said in the article.

The prostate produces a fluid that is incorporated into ejaculation, which activates sperm and prevents them from sticking together. Studies on animals have shown that carcinogens like 3-methylchloranthrene can be harbored in the prostate. Frequent ejaculation encourages the cancer-inducing fluids to "flush out." (The Advocate)

The money found hidden inside walls, suitcases and closets in one of Mexico City’s wealthiest neighborhoods came from the profits of methamphetamines sold in the United States, [DEA chief Karen Tandy] said.

Mexican law enforcement and the DEA worked for a year on the operation, she said.

Mexican federal agents also seized eight luxury vehicles, seven weapons and a pill-making machine during the raid in Lomas de Chapultepec, a neighborhood of walled compounds that is home to ambassadors and business magnates. Seven people were arrested and were ordered Monday to be held for three months while the investigation continues.

In addition to the dollars, officials found 200,000 euros and 157,500 pesos.

Mexican Attorney General Eduardo Medina Mora said the money was connected to one of the hemisphere’s largest networks for trafficking pseudoephedrine, the main ingredient in methamphetamines.

Mora said the ring had been operating since 2004 and was run by a native of China who had gained Mexican citizenship. The alleged gang leader is in hiding, possibly outside of the country, Medina Mora said.

The operation should reduce the supply of methamphetamine to the United States, where Mexican drug gangs control at least 80 percent of the market, Tandy said.

Surgeon’s lawyer says more names to be revealed, bares fate of student

AMID calls for sanctions on the team that performed the now controversial operation, Cebu Gov. Gwen-dolyn Garcia is renewing her call for Capitol to take over the primary and secondary services of the Vicente Sotto Memorial Medical Center (VSMMC).

And this time, she said the Capitol can take responsibility for the hospital’s tertiary first level services as well.

“If the Province will handle this, at least our constituents will be given better treatment because I see to it that they will be treated humanely,” she said, adding that the Local Government Code specifically provides that these services should be handled by the Provincial Government.

The governor said she has heard “so many horror stories from our constituents from the south of how rudely they were treated by (VSMMC) personnel.”

“These questionable goings-on involve primary and secondary services. You connect the dots and figure it out…This highlights the fact that indeed there is a need for radical change, especially in the attitude and delivery of services of VSMMC,” said Garcia.

Capitol’s proposal to take over the hospital’s primary and secondary services was first brought up in 2006, when the Department of Health (DOH) made the offer. No agreement was reached, however, after DOH officials later withdrew their offer.

Garcia said Capitol is willing to discuss all issues so the provincial government could assume responsibility in handling primary and secondary services “primarily for the good of our constituents.”

Rude treatment

“If this person (Jan-Jan) was humiliated by the behavior of this surgeon and nurses of that incident, let me tell you that our constituents undergo the same rude treatment,” said Garcia.

As this developed, Dr. Philips Leo Arias, whom the health department identified as the head surgeon in the Jan. 3 surgery of a 39-year-old patient at the VSMMC, aired his side yesterday through lawyer Merlo Bagano.

The patient, a florist from Barangay Basak-Pardo, Cebu City, underwent a procedure to remove a body spray canister that got stuck in his rectum through a male sex partner. The operation was captured on camera and uploaded to YouTube, a video sharing website.

Arias was identified as part of the medical team attending to Jan-Jan, the patient, along with Dr. Angelo Alinawagan, assistant surgeon; Dr. Max Joseph Montecillo, surgeon assigned in an adjacent operating room; Rosemarie Villareal, nursing attendant; and Carmiña Sapio, circulating nurse.

In a radio dyAB interview, Bagano said Arias has always been professional and did not make fun during the operation.

In the video, the surgeon could be heard giving out instructions. But Bagano said it wasn’t Arias who called the canister as “baby.”

The lawyer also said that the emergency operating room was at first only confined to the medical team involved. Then other persons started coming in and making noise behind the doctor.

The video captured people giggling, jeering, and cheering before and after the canister was taken out.

‘Relieved’

Bagano said that Arias’ act of laughing was “merely an expression of relief.”

He said there was still a “high-ranking official” in the operating room at that time, whom Arias could not identify yet.

Eventually, as the joint investigation of VSMMC and DOH continues, more names will be added to the list, the lawyer said.

VSMMC media liaison officer Dr. Emmanuel Gines said Arias is a resident surgeon under training in the Department of Surgery.

He explained that a resident physician has an on-call consultant or senior doctor for every case.

“The case is presented to the consultant. A resident doctor is supervised but it is not necessary that a consultant has to be present in the operating room especially if the consultant is confident on the skills of the doctor. But before every case, a consultant and a resident doctor meets to discuss,” he said.

He, however, could not answer if there were consultants during Jan-Jan’s operation. But he assured that there was a discussion of the case between the doctor and the consultant before the operation. He added that a consultant is part of the hospital’s fact-finding committee.

Bagano also said that Arias had assured the patient that the video taken during the operation would remain confidential. When he saw it was uploaded to YouTube, he
immediately approached VSMMC administration and asked them to investigate.

VSMMC, in a press briefing earlier, said they did not take the incident lightly and immediately created a fact-finding committee even without receiving a formal complaint.

Security reasons

Bagano said they hope the public will understand that for security reasons, Arias chose to remain quiet. He was set to meet the Arias family yesterday to discuss the case.

In a separate interview with dyLA, Bagano said a student of Gullas School of Medicine uploaded the video to YouTube and the student was not able to graduate because of the incident.

Health Secretary Francisco Duque, in a GMANews.TV report, said they will use the video in the filing of charges.

“But we have to determine first the specific liability of each respondent,” he said.

Commission on Higher Education (Ched) 7 Director Enrique Grecia, for his part, asked that the student not be blamed as he was only “misguided.”

Still, it is up to the school to give due process to the student before imposing sanctions.

“I suggest that the hospital revisit the operating room policies. Probably, they need to prepare a new set. I believe that the curriculum of nursing program is enough for the nurses and doctors to be qualified,” he said in a TV Patrol News report.

Meanwhile, Cebu City Mayor Tomas Osmeña, in an ABS-CBN TV Patrol report, called for the cancellation of the licenses of the medical team.

The Integrated Bar of the Philippine Cebu chapter also called for an investigation of the person who inserted the canister into Jan-Jan’s rectum. The group said he should also be sanctioned.

Ched’s technical committee on nursing education chairperson Dr. Maria Teresita Sinda, meanwhgile, suggested the revocation of the license of the clinical instructor (CI) of the student nurse who uploaded the video.

Ched will wait for the action of the Professional Regulation Commission (PRC). PRC, for its part, is waiting for a formal complaint on the case before it can investigate.

Seeing there was clear violation of the code of ethics, the PRC said that sanctions for misconduct could range from suspension to revocation of licenses. (With GMD)

Calayan couple faces P26M suit over cosmetic surgery (4:45 p.m.)

MANILA -- A naturalized American citizen has filed a P26-million suit against cosmetic surgeons Manny and Pie Calayan before the Makati City Prosecutor's Office (MCPO) over a phalloplasty surgery that appeared to have gone awry.

Louem Martinez, 34, currently engaged to a Filipina, complained that he is now "physically incapacitated" and "mentally devastated" as he could no longer perform sexual acts because of constant pain in his deformed sexual organ and scrotum.

Aside from the civil damages, Martinez also filed criminal cases of reckless imprudence resulting in serious physical injury and obstruction of justice against the Calayan couple, who owns and operates the Calayan Surgicenter in Legaspi Village, Makati.

In his complaint before Assistant City Prosecutor Dennis Raja, Martinez said he was working in the US when he got to know the Calayan Surgicenter through its website last year.

He then got interested in the "Penile Enlargement/Thickening and Lengthening Services" the Calayans were offering, so he went to Manila in March last year to check it out.

During personal consultations with Manny, Martinez said the surgeon assured him of his expertise in such operation, which he boasted to have been performing at the rate of two operations per month with the use of a chemical called aqua gel.

Further, Manny told Martinez that his "penis enlargement/widening" operation would enlarge, widen and lengthen the penis without any deformity, sagging, bumps and without any side effect. (AH/Sunnex)

Priest defends medical team in surgical scandal (4:50 p.m.)

MANILA -- A church official on Wednesday rushed to the side of the doctors and nurses involved in the surgery scandal in Cebu City.

Monsignor Achilles Dakay, spokesman of the archdiocese of Cebu, said the scandal that happened at the Vicente Sotto Memorial Medical Center (VSMMC) should not be blamed solely on the doctors and nurses but it should be the person responsible for the indecent incident.

“They seem to forget the whole thing. They are blaming the doctors for what they do but I think they should blame the guy for what he did,” Dakay said.

He also admitted that the incident also indicated the weakening moral guidance among the Cebuanos and the spreading homosexuality in the province.

“We would like to feel sorry for what’s happening here and maybe we could be partly to be blamed for it,” he lamented.

The prelate said the Catholic Church sympathized with the homosexuals because they did not choose to be that, but committing homosexual acts would be “another thing”. (MSN/Sunnex)

Duque names doctors in surgical scam
By Nancy R. Cudis

MANILA -- The Department of Health (DOH) finally named on Tuesday three doctors, a nurse, and a nursing attendant involved in the January 3 surgery of a florist at the Vicente Sotto Memorial Medical Center (VSMMC).

The procedure to remove a body spray canister from the 39-year-old patient's rectum was captured on camera and uploaded to YouTube, a video-sharing site.

Arroyo Watch: Sun.Star blog on President Arroyo

DOH Secretary Francisco Duque identified the doctors and nurses as Dr. Philips Leo Arias, head surgeon; Dr. Angelo Alinawagan, assistant surgeon; Dr. Max Joseph Montecillo, who is assigned to an adjacent operating room; nursing attendant Rosemarie Villareal; and circulating nurse Carmina Sapio.

In a press conference on Tuesday morning, Duque clarified that formal charges have not yet been filed against the doctors and nurses.

He said his office still has to send a show-cause letter, asking them to explain why they should not be charged.

In four to five days, a DOH central office lawyer will personally hand the letter to the five personnel through the VSMMC administration.

Their answers to the letter will be evaluated, while a formal investigation will be done jointly by the hospital and the DOH.

The investigation will include assessment of the gravity of offenses committed and the corresponding sanctions, before formal administrative charges can be filed.

Duque, however, said they still have to identify the person who posted the video clip on YouTube.

The video shows more than 10 people in an operating room shouting, giggling, and jeering, especially after the canister was removed.

One of the medical staff even opened the canister and sprayed it around.

The video also captured several individuals taking footage of the operation using cellular phones.

The patient, who wanted to be identified only as Jan-Jan, was unconscious all that time.

The controversy started when the video was uploaded to YouTube, reportedly by a nursing student, and shared through mobile phones, prompting the VSMMC to investigate.

The hospital's fact-finding committee found just three doctors and a nurse as the ones involved.

It recommended that an administrative complaint be filed against them for possible violation of provisions of Republic Act (RA) 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees.

The hospital also issued a "stern warning" to one doctor and three nurses and advised them to be more cautious in performing their duties as supervisors.

The DOH in Central Visayas, which conducted its own inquiry, likewise pointed at the three doctors and the nurse as the ones who should be investigated.

It sent a copy of its own report to Duque last Monday.

But in an ANC report, Duque told a press conference that another nurse was involved. He said more than 10 people were actually in the operating room, including students, consultants and trainees.

He said the names of the others might be added to the list of who should be charged after the preliminary investigation, which may take a month to complete.

While he considered the case as isolated and commended the medical team for a successful and well-performed operation, he said the DOH will not tolerate their behavior.

"It could have been a very good and ideal case for people who would like to learn alternative procedures. It could have been a commendable operation but the plus factor was lost because of the issue," he said.

He pointed out the violations: not confining the room to the medical team involved; not prohibiting the use of cellular phones while an operation was ongoing; taking footage without the patient's consent; and lack of respect for the patient, as manifested by the jeering, laughing, and cheering captured by the video.

"Obviously there was a bridge of protocol," Duque said.

Duque added that the head surgeon, being the "captain of the ship," should have ensured that protocol was followed.

He said the DOH can only file administrative complaints and impose sanctions ranging from suspension to dismissal from government service.

Criminal complaints can be filed before the Office of the Ombudsman, he added, while the Professional Regulation Commission can look into the matter once the agency receives the complaint.

The PRC can reprimand those involved or even suspend or revoke their licenses.

"There is no whitewash (in our fact-finding). There is no such thing in our vocabulary. The patient should not worry. We will make sure that necessary penalties or sanctions are meted (out). But we have to understand that (the five medical staff) are presumed innocent until proven guilty, and not the other way around," Duque said in a radio dyLA interview.

He also requested that the competence and credibility of the attending medical team should not be confused with the "insensitive" behavior committed during the operation.

Dr. Jucel Ann Jumao-as, Philippine Nurses Association (PNA) Cebu chapter public relations officer, agreed with Duque and urged the public to look at both sides of the story.

"The doctors and nurses did good in the operation and in past operations. The call for revocation of their licenses is too much, as their licenses are what feed their families. While an operation should not be treated as a circus, we should also look at the circumstances on how and why the patient got into that situation," she said.

Apart from the DOH's preliminary investigation, the House of Representatives' committees on professional regulation and civil, political, and human rights were also asked to conduct a joint inquiry, in aid of legislation.

Akbayan party-list Representative Risa Baraquel, deputy minority floor leader, submitted a resolution asking for an inquiry yesterday afternoon, and it was approved.

"The condemnable conduct of the doctors, nurses, interns, and medical attendants involved in the incident displayed a blatant disregard for human dignity and human rights," she said.

Baraquel also asked that Congress exercise its oversight and legislative powers "to contribute to the efforts to stop the burden of oppression and stigma carried by the lesbian, gay, bisexual, and transgender community."

She believes that the incident required legislative intervention "to imbibe and deepen the principles of human rights and human dignity among medical professionals, nurses, and nursing students."

Sun.Star Cebu tried but failed to get a reaction from Dr. Gerardo Aquino, VSMMC chief, who was reportedly attending to a family emergency.

A lawyer, who said he represented the nurses and doctors, said his clients will call for a press conference anytime soon to answer the issues raised against them.

A woman, who identified herself as mother of Dr. Arias, also called Sun.Star Cebu and said her 29-year-old son is willing to answer the charges when the case is brought to court.

She said they have three lawyers handling the matter.

She also told radio dyLA that Arias was innocent and not "demoralized" by the incident.

She admitted, though, that the family is hurt and worried why the son she raised well is accused of misconduct. She called it unfair for her son to be included since there were consultants supervising the operation.

The woman also appealed to members of the media, especially radio commentators, not to make conclusions about her son's capacity as a doctor just because of the incident.

Dr. Arias, she said, is generous, attending to calls even at night and giving out free medicines.

Dr. Arias, who got married just last year, spent three years as a VSMMC resident doctor after graduating from a reputable Cebu City university.

Meanwhile, Jan-Jan, a Basak Pardo, Cebu City resident, is "happy" that the identities of the doctors and nurses are now made public as it would not just strengthen his complaint but also hasten its resolution.

"Jan-Jan is grateful for the way the doctors and nurses saved his life by taking the canister out. But he is not appreciative of the way they behaved," said Barangay Captain Dave Tumulak, who is helping him.

Jan-Jan's camp is pursuing civil action for damages against the doctors and nurses this week, and will file a separate complaint with the PRC. (With CYR of Sun.Star Cebu/MSN/Sunnex)

Beating The Odds: Beauty Queen With Cerebral Palsy
Reporting
Kristine Johnson LAS VEGAS (CBS) ? The Miss USA pageant gets underway Friday night in Las Vegas, and while it's a dream come true for all the contestants, it's a heroic accomplishment for one participant in particular.

Miss Iowa, 20-year-old Abbey Curran, made it a longtime goal of hers to compete in a pageant that some may have thought would never be possible.

"This is such a dream come true, bigger than a dream come true would be," she says.

It's a dream that's bigger for Curran because the college sophomore has cerebral palsy, a neurological disorder than affects muscle movement and body control. She is the first person born with a disability to compete in a Miss USA contest.

It's been a dream of hers since she can remember.

"I used to dress up and we had a giant window seat with platforms. I would dress up with boas and wigs and sing "Here she comes just a walkin' down the street," and I would make my whole family watch this show every night," she recalls.

Her family always stood behind her and pushed her to make her dream a reality.

"We always told her she can do whatever she set her mind to: 'You know you can do it, you can do whatever you want, you just have to try and might have to try harder than somebody else, but you can do whatever you want," says Katie Curran, Abbey's mother.

And Abbey has maintained a confident attitude that helps keep her going at college, where she has a full workload and even time for extracurricular activities like piano lessons.

"I say that cerebral palsy doesn't have me, I have cerebral palsy, and so I'm not going to not compete for Miss USA just because it looks different," she says.

And if being a full-time college student and competing in the pageant isn't enough, she's also learning how to pilot a plane.

"It's a blast! It's fun. I can't run that well so to be ina plane that just soars through the skies, it's amazing," she says.

Meanwhile, navigating a beauty pageant is just one more challenge she's tackling.

With a little more than a day to the big event, Abbey says it still doesn't seem real, but she says stepping onto the stage will feel like heaven.

"To think I'm here in Vegas â€" going to be on that stage where every beautiful woman stood before â€" it's so dreamy," she says.

Doctors may lose licenses over surgery scandal

CEBU CITY -- A video posted on YouTube showing doctors laughing while removing an object from a patient's rectum may lead to charges against the surgeons and cost them their medical licenses, officials said Wednesday.

And even after the apology by Vicente Sotto Memorial Medical Center (VSMMC) officials, the patient is still considering filing a civil suit for damages against the medical team.

Hospital official to patient: Sorry

UNETHICAL and scandalous.

That’s how several doctors described the behavior of Vicente Sotto Memorial Medical Center (VSMMC) doctors and nurses during the operation to remove a perfume canister from the anus of a male patient.

Doctors involved in the operation were seen laughing boisterously during the operation, which was recorded on video. A video clip was later uploaded to the video sharing website YouTube.

Dr. Emmanuel Gines, VSMMC media liaison officer and emergency room department head, said in a radio interview that they will apologize to the 39-year-old patient identified only as Jan-jan because of the embarrassment he suffered.

Gines said at least six doctors, including Dr. Ariel Arias, are being investigated. He could not say how many nurses were placed under investigation.

A five-member body tasked to look into the controversy is expected to release its findings this Friday.

Isolated case

Gines, a surgeon, said that taking a video and laughing at a patient while he is being operated on is inappropriate.

“On the question of the behavior of the doctors and nurses, it was really improper,” he said.

He said their investigation began even before the scandal came out in the media because the hospital leadership is concerned about the incident. He urged the media to just wait for the committee’s report.

While admitting that the incident placed VSMMC in a bad light, Gines assured the public that what happened to “Jan-Jan” was an isolated case that will not occur again.

“We have enforced and strengthened our (privacy) policy as far as the operating room and anywhere of the sections in the hospitals after this incident, especially the banning of cellular phones with or without cameras,” he said.

In a separate interview, Basak Pardo Barangay Captain Dave Tumulak said Jan-Jan is bent on filing a complaint and has already executed an affidavit against the doctors and nurses, some of whom were shown in the video.

Jan-Jan will also complain before the Department of Health (DOH), the Professional Regulations Commission, and the Office of the Ombudsman Visayas.

Dr. Wyben Briones, a neuro-surgeon for 30 years connected with VSMMC and hospitals like Chong Hua and Velez, said doctors are bound by their profession to respect the patient’s privacy.

Sacred

“For us, that (privacy) is sacred. No doctor or nurse shall announce that somebody is suffering from an illness or that somebody is positive of AIDS (Acquired Immune Deficiency Syndrome),” Briones told TV Patrol World.

Briones, who is also an Emergency Rescue Unit Foundation (Eruf) member, said that it is really objectionable for somebody to take videos of an operation and upload it to YouTube for all the world to see.

What is acceptable, he said, is for a doctor operating on a patient to allow young doctors and nurses to witness, as long as the aim is to educate them further.

“Di ta ma-doctor kon wa pa ta tudlo-i or wa pa ta mo-agig (we could not be doctors if we do not go through) training. And the Sotto hospital (VSMMC) is a teaching hospital. But what happened here is a violation of ethical standards”, he added.

Briones said non-resident doctors and nurses who are not on field duty are not even allowed to witness an operation.

Conference

In his case, he said, he only allows neuro-surgeons to witness him treating his patients if it concerns their profession.

As of press time last night, Tumulak, Jan-Jan and his lawyer were still having a conference to come up with an airtight complaint.

Tumulak said they will also include Dr. Gerardo Aquino Jr., VSMMC chief medical officer, who was in Manila attending to an official business when the operation happened.

Tumulak said Jan-Jan is demanding for the hospital to furnish him the official records of the Jan. 3 operation for easy identification of all doctors and nurses involved.

Dr. Susana Madarieta, DOH 7 director, said they will review the result of the VSMMC investigation to ensure that there is no whitewash. (EOB)

World Daily News / Nagtago sa bugas, silotan
April 15, 2008, 09:07:11 AM

(Mel Coronel)

Patient to sue hospital over anal surgery video

CEBU CITY -- A 39-year-old homosexual is planning to sue a medical team after he saw in a cellular phone of a friend last Friday a circulated video footage of the operation to extract a perfume canister stuck in his anus during a sexual act.

The operation on the man, who only wants to be identified as "Jan-Jan," was done at the Vicente Sotto Memorial Medical Center (VSMMC) last January 3 yet, but the video footage has been circulating through cell phones since then and was even uploaded in the video-sharing web site, YouTube.
