The Department of Justice (DOJ) on Thursday asked the Court of Appeals (CA) to dismiss the petition filed by former Batangas Gov. Antonio Leviste, seeking to allow the conduct of a "special raffle" for his application for bail due to health reasons.
It can be recalled that Leviste was convicted of homicide and was sentenced to a jail term ranging from six to 12 years for the gunslay of his best friend Rafael Delas Alas.
Leviste asked the CA to conduct a "special raffle" to allow him to post bail as soon as possible while his motion to bail is pending.
The former Batangas governor argued that he could not stay any longer in prison because of the condition of his health.
The DOJ immediately blocked the motion, saying that granting the petition of Leviste would clearly show a "special treatment".
"That accused has just been convicted of the crime of homicide and to grant his motion for a special raffle will be conferring upon him a special privilege that is violative of the equal protection of the law clause of the Constitution," Senior State Prosecutor Emmanuel Velasco argued in his ex-parte motion he filed before the CA.
He added: "It will be giving him a special treatment, a treatment that has not been enjoyed by other persons who are similarly situated like him." - PNA
