The Supreme Court of the Philippines headed by Chief Justice Renato Corona has become a "truth obstruction" to the people as the new Aquino administration is setting off towards unveiling the evils of the past.
This was the common observation made by former OIC Gov. Victor de la Serna, a bar topnotcher and Fr. Ted Gapuz S.V.D., academic chair of Holy Name University during separate interviews by the Chronicle the day after the Supreme Court declared as "unconstitutional" the Executive Order # 1 of P-noy otherwise known as the Truth Commission.
The "syndicate" in the Supreme Court to insulate former Pres. Gloria Arroyo from persecution was manifested in several decisions on the moves of P-noy, stressed de la Serna, while Gapuz said that the action of the Supreme Court, in a layman's view, has become an obstruction of truth.
They also pointed out that even people who are not lawyers can see the daringly bias actions of the Supreme Court in trying to hide the evils of the past GMA regime.
Both also agreed that the mandate received by Aquino last election, of which he promised that he will not engage in corruption and he will go after GMA's lies, is more material than any decision by a Supreme Court.
De la Serna said that it had been thrice that the Supreme Court manifested its pro-GMA decisions on the moves of Aquino. The first time was when they issued a Temporary Restraining Order against the impeachment of Ombudsman Merceditas Gutierrez. The second time was when Aquino issued Executive Order declaring the midnight appointments of GMA as void, and the Supreme Court immediately made a judicial legislation by supplying a loophole in the Philippine Constitution in a decision that "the election ban on appointments does not apply to the Supreme Court". The third time was the recent move declaring the Truth Commission as unconstitutional.
Both de la Serna and Gapuz agreed that the pursuit of truth must be pushed by Aquino.
While de la Serna said that the Truth Commission may possibly be privately funded to continue, Gapuz said that any other form of a commission will do, as long as this will unveil the truth.
Gapuz added that truth is not personality-oriented but is intended for the welfare of the people.
As long as the people will not know about the truth of the past, it would be very hard to move forward towards a promising future. And the people will not know the truth if the same persons will comprise the Corona- headed Supreme Court, both stressed.
Both of them agreed that the people of all classes must support the moves of Aquino in unveiling the truth.
"Seeking and defending the truth is not a job assigned only to lawyers, but it is a responsibility of every being to know and seek the truth and so we have to make our own personal moves to support P-noy in his quest towards the truth", both concluded. ( Anthony Rañoa Aniscal )
