The Commission on Elections has been asked to prohibit actress
Lucy Torres-Gomez to be a substitute candidate for her husband, actor Richard Gomez, who has been disqualified in the congressional race.
In a petition filed Thursday, Buenaventura Juntilla asked the Comelec, through Commissioner Rene Sarmiento, to deny Torres’ bid as a substitute candidate for the fourth district of Leyte, saying that since Gomez has been declared a non-candidate, he could not be “validly substituted as there is no candidacy to speak of, much less, a candidate to be substituted.â€
In the 9-page petition dated Thursday but made public on Friday, Juntilla cited the Supreme Court ruling in Fermin vs. Comelec, G.R. nos. 179695 and 182369, Dec. 18, 2009, stating that, “While a person who is disqualified under Section 68 is merely prohibited to continue as a candidate, the person whose certificate is cancelled or denied due course under Section 78 is not treated as a candidate at all, as if he or she never filed a CoC [certificate of candidacy].â€
