Ombudsman indicts PNP official, orders recovery of his P9-M unexplained wealth

     OMBUDSMAN Conchita Carpio Morales ordered the filing of five counts of perjury against P/CSupt. Eugene Gabriel Martin for not disclosing some of his properties in his Statement of Assets, Liabilities and Net Worth (SALN) as it ordered the initiation of forfeiture proceedings against him and members of his family to recover their alleged unexplained wealth amounting to over P9 million.

     In the 16-page resolution signed on 26 September 2012, Ombudsman Morales ordered the filing of perjury charges against Martin for his failure to disclose the following properties in his SALN:

     a. In his 1999 SALN, the residential lot located Cagaling, Palina, Pugo, La Union and the Cockpit Arena located at Cares, Pugo, La Union;
     b. In his 2000 SALN, the residential house and lot located at Sto. Tomas, Baguio City, the residential house in Barangay Irisan, Quezon Hill, Baguio City and the Mitsubishi L200 Strada under the name of his wife, Priscilla Marrero Martin;

     c. In his 2001 SALN, the Nissan Patrol M/T Wagon under the names of Priscilla and Kurt Walter (son);

     d. In his 2002 SALN, the house and lot in Barangay Fairview, Baguio City; and,

     e. In his 2003 SALN, the Cherokee Grand Jeep under the name of Priscilla.

     Martin is a graduate of the Philippine Military Academy Batch 1972 and was absorbed into the Philippine National Police (PNP) in 1991. He was promoted to Chief Superintendent, and was Acting Regional Director of the Police Regional Office in the Cordillera Administrative Region (CAR), at the time of the filing of the case.

     Ombudsman Morales also found probable cause to indict Martin before the Sandiganbayan for two counts of violation of Section 8 of Republic Act (R.A.) No. 6713 for failing to submit his SALN for the calendar years 2004 and 2005.

     The resolution stated that when Martin failed to declare some of his assets, “he did not only commit perjury but also a violation of RA 6713.”

     Apart from the said properties, the total undeclared international travel expenses worth over P269,000 of Priscilla, Kathleen Ira and Salma were also made part of Martin’s unexplained wealth.

     Under RA 6713, public officials and employees have an obligation to accomplish and submit declarations under oath of, and the public has the right to know, the assets, liabilities, net worth and financial and business interests including those of their spouses and of unmarried children under eighteen (18) years of age living in their households.

     The anti-graft body said that a certification from the PNP’s Directorate for Personnel and Records Management of the PNP stated that Martin had no available records of his SALN for 2004 and 2005.

     The ruling said that while some of these properties are registered under the names of Martin’s immediate family members, “they are treated and considered as his undeclared assets because his family members are not shown to have the financial capacity to acquire such hefty amount of properties.”

     In the same resolution, Ombudsman Morales also ordered the filing of a petition for forfeiture before the Sandiganbayan against Martin, his wife, Priscilla and their children, Kathleen Ira, Kurt Walter and Salma.

     Ombudsman Morales’ order was based on a complaint filed by the Fact-Finding Investigation Bureau of the Office of the Deputy Ombudsman for the Military and Other Law Enforcement Offices (FFIB-MOLEO), which alleged that Martin acquired assets that are disproportionate to his lawful income.

     The OMB’s FFIB-MOLEO alleged that Martin had a substantial increase in net worth of P929,427 in 2003 when his net worth reached P3,809,427 as against his net worth of P2,583,000 in 1999.

     Meanwhile, in a separate decision of even date, Ombudsman Morales found Martin guilty of dishonesty and meted upon him the penalty of dismissal from the service, with forfeiture of benefits and privileges, and perpetual disqualification to hold public office.

     â€œProvided, that in case respondent [Martin] is already retired from the government service, the alternative penalty of fine equivalent to one year salary is hereby imposed, with the same accessory penalties,” it stated.

     The decision further stated that Martin committed an act of dishonesty because of his deliberate failure to disclose all of his supposed properties in his SALN and for testifying under oath that the declarations are true and correct.

     â€œMartin’s failure to satisfactorily prove that his acquisition of properties, as well those of his family members, were within his lawful income and, his concealment of his assets in his SALN, constitute the administrative offense of dishonesty,” the decision said.
