Panglao Police Laughs At Coercion Allegation

The policeman accused of coercing a potential witness in the Vivian Dumaluan rape-slay case laughed off the allegations against him saying everything that transpired was in accordance with law.

SPO2 Dominie Ragusta presented the assailed statement of Gorgie Marcele and his mother as proof of his assertion that it was Marcele who is fabricating stories when he allegedly recanted his previous statement.

Marcele was presented in a press conference Thursday called by former Panglao Mayor Doloreich Dumaluan.

"That's good," Ragusta replied when confronted about Marcele's allegations.

The policeman said this will make way for the truth to come out.

Ragusta admitted that he was the one who prepared Marcele's statement based on his account.

Contrary to his allegations made during a press conference organized by Dumaluan that he signed the affidavit in a Cebu resort, Marcele's statement executed on Oct. 23 was signed in the presence of Senior Supt. Edgardo Ingking, Bohol PNP provincial director.

The statement was notarized by Prosecutor Eric Ucat of the Bohol Provincial Prosecutor's Office.

Ragusta noted that to prove further that the statement was executed by Marcele on his own free will, he was even assisted by his counsel, lawyer Elmer Balbin.

"That is not the usual procedure but he availed of the services of counsel so that his interest is best served," the policeman added.

Before signing the statement, Marcele was informed of his rights guaranteed by the Constitution under the Miranda Doctrine.

According to Marcele, 22, he is a native of Barangay San Vicente, Tambulig, Zamboanga del Sur.

Marcele said he worked as a room boy at the Dumaluan Beach Resort owned by the former mayor at the time of the rape-slay.

Ragusta also presented a copy of the statement signed by Marcele's mother Estrella.

The affidavit, also dated Oct. 23, was similarly executed in the presence of Ingking and Balbin.

Like her son's statement, Estrella's statement was notarized by Ucat.

She was likewise informed of her Constitutional rights under the Miranda Doctrine. -- www.theboholchronicle.com
