SAN JOSE De BUENAVISTA, Antique, Aug. 11 -- The Department of Interior and Local Government (DILG) in this province on Friday morning served the suspension order of Mayor Genevieve Lim-Reyes of Caluya, Antique after she was found guilty of oppression by the Office of the Ombudsman.
DILG-Provincial Director Victorio S. Pagapulan served the order at 11:00 a.m. immediately after he received an official copy of the suspension on Thursday.
The DILG director, who was interviewed earlier this week, said he could not come up with an official statement until such time that he gets an original copy of the suspension copy and a memorandum from their DILG regional office.
The suspension order on Mayor Reyes came after the Ombudsman on its Decision dated June 5, 2017 but issued on July 27, 2017 under OMB-V-A-15-0159 entitled “Juliet Ramos vs Genevieve G. Lim-Reyes” found Mayor Reyes to be guilty of oppression and imposes upon her the penalty of suspension for six months and one day without pay.
The Ombudsman’s decision stemmed from Mayor Reyes to have unlawfully authorized the clearing operation on a five-hectare coconut farmland in Sitio Poocan, Barangay Tinogboc in February 2014.
The clearing operation was reportedly undertaken to pave the way for a housing project to relocate residents from Sitio Sabang to Sitio Poocan.
The Ombudsman, in its Resolution, ruled that “no sanggunian resolution supporting the housing project was presented as legal basis for respondent’s directive to clear and level the land. This reinforces the conclusion that the clearing operation was made without due process of law.”
The Local Government Code of 1991 promotes a policy of consultation prior to the implementation of certain projects consistent with the spirit of due process. (PNA)
