City engineer under fire for not issuing certification

ILOILO CITY, July 2 (PNA) -– For not issuing a certification of a building and fencing permit needed for the construction of the Iloilo Guimaras ferry terminal located at the Parola, Iloilo City, the city engineer here is facing an administrative complaint before the Office of the Ombudsman Visayas for violation of Section 5 (a) of Republic Act 6713.
City engineer Roberto Divinagracia was charged by lawyer Vincent Pascal de Asis, president of the Integrated Bar of the Philippines (IBP) Guimaras chapter, for violating the law specifically the Code of Conduct and Ethical Standards for Public Officials and Employees as well as for committing a Conduct Grossly Prejudicial to the Best Interest of the Service under Section 22 (t) of Rule XIV of the Omnibus Rules Implementing Book V of EO 292.
The administrative complaint was submitted to the Ombudsman last Monday, June 29, 2015.
The complainant said the act of refusal of Divinagracia and his failure to respond to the letter request dated May 27, 2015, despite his receipt and subsequent reminders, was clearly a misconduct and an act unbecoming of a public officer.
De Asis said the certifications demanded from Divinagracia were vital for the protection of the people of Guimaras and those who will be affected by the implementation of the Iloilo-Guimaras ferry terminal.
On the other hand, the city engineer’s office through the Building Official Engr. Roberto Divinagracia issued a Notice of Illegal Construction dated March 25, 2015 for having No Building Permit to INJAP/City Mall in Parola city proper and to stop immediately all illegal building activities in the premises.
Jose Roni Penalosa, city zoning administrator, said a Notice Violation was issued by his office dated March 26, 2015 for starting construction works without first securing the necessary Locational Clearance from his office. (PNA)
