TEXT, CELLPHONE CALL HAGIP
Hindi lang netizens ang dapat mangilag sa Republic Act 10175 o ang Cybercrime Prevention Act of 2012, kundi maging ang cellphone users dahil puwede rin silang makasuhan sa pag-send ng text at phone calls.
Ayon kay Bayan Muna partylist Rep. Teddy Casiño, nalalagay sa alaÂnganin ang text at tawag sa cellphones dahil sa probisyon sa Section 3(c) na sumasakop sa pagpapadala ng impormasyon sa pamamagitan ng ICT media, kabilang ang voice, video at iba pang uri ng data.
“Section 3(d) meanwhile defines computers and computer system coÂvered by the law as “any type of computer device including devices with data processing capabilities like mobile phones, smart phones, computer networks and other devices connected to the internet,†ayon sa mambabatas.
Nakasaad din aniya sa Section 6 na pinapalawak ang sakop ng nasabing batas kabilang ang lahat ng krimen na nakasaad sa Revised Penal Code (RPC) at ng special laws, gamit ang information and communication technologies.
“This practically means that communications and data on any type of phone or ICT device are covered by this very repressive law.
This means if I text my friends that a certain candidate is a ‘cheap, second-rate, trying hard copycat,’ that person can haul me to court for violating the Cybercrime Law and have me locked up for 10 years,†paliwanag ni Casiño.
Kaugnay nito, nanindigan naman si Senate President Juan Ponce Enrile sa kahalagahan ng probisyon ng online libel.
Aniya, kung ang ‘traditional media’ na limitado lamang ang sinasakop ng pagpapakalat ng kanilang impormasyon ay sakop ng libel law, hindi naman makatuwiran na exempted ang netizens na sa buong mundo nakakarating ang kanilang mga mensahe.
“Kung hinusgahan ka na wala namang batayan, o kaya mag-threaten ka sa internet, o meron kang paÂlalabasin na palsipikadong information, you want to disseminate that, hindi mo na mabubura ‘yan, hindi mo na matatanggal ‘yan,†diin ng senador.
Sa nasabing libel law, sinabi ni Enrile na nakapaloob sa 1987 Constitution ang freedom of expression, gayundin ang probisyon na nagsasabing ‘no person can be deprived of life liberty and property without due process’.
