SC declares Sandiganbayan justice natural-born Filipino

The Supreme Court, sitting en banc upheld its declaration that Sandiganbayan Associate Justice Gregory Ong is a natural-born Filipino citizen and denied a plea to oust him as a magistrate of the anti-graft court.

"The pronouncements of the Court in both GR No. 179895 and GR No. 180543, and the finality of the decision rendered by the RTC on October 24, 2007... recognizing Justice Ong as a natural born citizen of the Philippines and directing the correction of the existing records of his birth and citizenship have already definitively settled the subject of the query posed by SP Villa-Ignacio," said the high court in its six-page resolution.

The case stemmed from a letter-query submitted to the SC by Special Prosecutor Dennis Villa-Ignacio, who questioned Ong's Filipino citizenship due to his Chinese roots.

Ong is vying for the post to be vacated by Sandiganbayan Presiding Justice Francisco Villaruz, who will turn 70 years old in June.

Ong was originally appointed by former President Gloria Macapagal-Arroyo as an associate justice of the Supreme Court, but his appointment was rejected by the SC en banc due to questions on his citizenship.

Despite this, then Executive Secretary Eduardo Ermita still announced Ong's appointment on May 16, 2007, after the compulsory retirement of SC Associate Justice Romeo Callejo Sr. The appointment, however, was recalled two days later.

Barely a week later, Kilosbayan Foundation and Bantay Katarungan Foundation filed a petition for certiorari with the Supreme Court alleging that Ong's appointment was “patently unconstitutional, arbitrary, whimsical and issued with grave abuse of discretion amounting to lack or excess of jurisdiction" because Ong is a Chinese citizen as indicated in his birth certificate.

In his defense, Ong said that while his parents were Chinese citizens, his father was naturalized as a Filipino citizen when Ong was just 11 years old. Ong said he was also able to secure a certification from the Bureau of Immigration and the Department of Justice that he is a natural-born citizen.

In late 2007, a Pasig Regional Trial Court had granted Ong's petition to be recognized as a natural-born citizen. In August, Arroyo appointed Ruben Reyes instead of Ong in the Supreme Court, after the latter withdrew his appointment due to the controversy. — DVM, GMA News
