Ombudsman dismisses own employee for mulcting

THE Office of the Ombudsman (OMB) dismissed its records officer assigned at the Office of the Deputy Ombudsman for the Military and Other Law Enforcement Offices (OMB-MOLEO) upon finding substantial evidence of acts of Grave Misconduct, Serious Dishonesty and Conduct Prejudicial to the Best Interest of the Service.
In a Joint Resolution approved on June 7, 2013, Ombudsman Conchita Carpio Morales approved the recommendation of the Internal Affairs Board (IAB) to dismiss from the service Juan Dita Dela Cruz, Administrative Officer III of the OMB-MOLEO, after he was found to have demanded and received the amount of P30,000.00 from P/SSupt. Pedro G. Ramos in 2007 to facilitate the issuance of a clearance that the latter needed for his promotion.
The principal penalty of dismissal from the service carries with it the accessory penalties of cancellation of eligibility, forfeiture of retirement benefits, perpetual disqualification from holding public office, and bar from taking civil service examinations.
The Joint Resolution also found probable cause to criminally indict Dela Cruz for Direct Bribery under Article 210 of the Revised Penal Code, violation of Section 3(e) of Republic Act (RA) No. 3019 (Anti-Graft and Corrupt Practices Act), and violation of Section 7(d) of R.A. No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
The case stemmed from a complaint which Ramos and his witness SPO1 Jessie Caranto filed in December 2012.
The Joint Resolution states that the acts of Dela Cruz “clearly constitute corruption and a willful design to violate the law.â€
It added that his actions “did not reflect the integrity, and the discipline expected of him as a public servant. He failed to live up to the image of the outstanding and exemplary public official that he was. He sullied government service instead.â€
