KAPA OFFICERS, PROMOTERS FACE ARREST OVER CRIMINAL CHARGES FILED IN COURT

The Securities and Exchange Commission (SEC) has moved closer to putting the officers and promoters of Kapa-Community Ministry International (KAPA) behind bars with the filing of criminal charges against the scamming group.

In separate Informations filed with the Bislig City Regional Trial Court Branch 29, the Department of Justice (DOJ) accused KAPA of “willfully, unlawfully and criminally” engaging in the selling or offering for sale or distribution of securities to the general public without a registration statement duly filed with and approved by the SEC.

Accordingly, the DOJ charged KAPA Founder and President Joel A. Apolinario, Trustee Margie A. Danao and Corporate Secretary Reyna L. Apolinario of violating Sections 8(8.1), 26.1 and 28 of Republic Act No. 8799, or the Securities Regulation Code (SRC).

The DOJ also indicted Marisol S. Diaz, Adelfa Fernandico, Moises Mopia and Reniones D. Catubigan for violation of Section 26.1 of the SRC for promoting the investment scam.

The DOJ further charged Diaz before the Rizal Regional Trial Court for violation of Section 28. It filed similar Informations against Mopia and Fernandico with the Quezon City Regional Trial Court Branch 93.

The concerned judges, upon finding of sufficient probable cause for the issuance of Warrants of Arrest, shall order the arrest of the indicted officers and promoters of KAPA, in accordance with the Revised Rules of Criminal Procedure.

So far, the SEC has verified that a Warrant of Arrest was issued by the Quezon City Regional Trial Court on December 2, 2019 against Fernandico.

The criminal proceedings stemmed from the complaint filed by the SEC on June 18, 2019 against KAPA for the unauthorized sale or offering for sale or distribution of securities to the general public.

In a resolution issued on September 25, 2019, the DOJ found probable cause to bring charges against KAPA, affirming the findings of the SEC.

The Commission found KAPA to have enticed the public to invest at least P10,000 in exchange for a 30% monthly return for life, without having to do anything other than invest and wait for the payout.

The SEC also found KAPA to have employed a Ponzi scheme, an investment program that offers impossibly high returns and pays investors using the money contributed by later investors.

Under Section 8(8.1) of the SRC, securities shall not be sold or offered for sale or distribution within the Philippines without a registration statement duly filed and approved by the SEC.

Section 26.1 further provides that it shall be unlawful for any person, directly or indirectly, in connection with the purchase or sale of any securities to employ any device, scheme, or artifice to defraud.

Section 28 adds that no person shall engage in the business of buying or selling securities in the Philippines as a broker or dealer, or act as a salesman, or an associated person of any broker or dealer unless registered with the SEC.

The SEC initially issued an advisory against KAPA in March 2017. It would later issue a cease and desist order on February 14, 2019 and an order of revocation of the KAPA’s certificate of incorporation on April 3, 2019.

In the interest of affected investors, the Commission, through the Anti-Money Laundering Council, likewise obtained a freeze order from the Court of Appeals on June 4, 2019 to preserve assets linked to KAPA.

Meanwhile, the SEC reiterated its advice for the general public to exercise more caution and discernment as certain supporters and promoters of KAPA peddled false information about the group’s supposed revival.

Only recently, the Commission called out Roger Abing Camingawan and Daniel Flash Villas for falsely claiming, in paid radio broadcasts from General Santos City, that KAPA successfully registered as a crowdfunding entity, pursuant to SEC Memorandum Circular No. 14, Series of 2019, among others.

KAPA, through its counsel on record, earlier disclaimed authorizing the publication of such false claims on social media and noted that only Catubigan and Ronnie Garay may speak on behalf of the group.

“We are committed to see the criminal proceedings against KAPA through to the end,” SEC Chairperson Emilio B. Aquino said. “We will pursue everyone involved in the investment scam that played havoc with the future of our fellow Filipinos, including those who continue to attempt to perpetuate it.”

A person found to have violated the SRC, or the relevant rules and regulations promulgated by the SEC, will face a maximum fine of P5 million or imprisonment of 7 to 21 years, or both.

Considering the use of Facebook and YouTube in the illegal investment scheme, the DOJ recommended that the penalty to be imposed against KAPA, its officers and agents be one degree higher than what is prescribed by the SRC, pursuant to Section 6 of Republic Act No. 10175, or the Cybercrime Prevention Act of 2012.

The SEC has secured convictions under the SRC since its enactment in July 2000.

In November 2015, for instance, the Makati City Regional Trial Court Branch 56 convicted spouses Saturnino and Rosario Baladjay, who operated a pyramiding scam through Multitel International Holdings, Inc., of 65 counts of violation of Section 8 of the SRC.

The court sentenced the Baladjays to serve seven years in jail for each count of violation for a total of 455 years and ordered them to pay the complainants a total of P8 million. In addition, Rosario was sentenced to suffer life imprisonment in a separate conviction for syndicated estafa, affirmed by the Supreme Court in July 2017.

JANUARY 09, 2020 - Senate Majority Leader Juan Miguel "Migz" Zubiri visits Gov. Douglas Cagas to donate relief goods to the quake-hit victims throughout the province of Davao del Sur.

Last November 2019, her wife, Audrey Zubiri, also visited the province in behalf of the Senator and personally distributed relief packs to the people.

Sen. Zubiri, together with Gov. Dodo Cagas, Vice Gov. Marc Cagas and Congresswoman Didi Cagas, visited the victims at Barangay Bangkal, Matanao, today, January 09, 2020.

The Local Disaster Risk Reduction and Management Officers (LDRRMO) of the ten municipalities and one city of the province have paid a courtesy call to Governor Nelson Dayanghirang at his office at the Provincial Capitol this afternoon.

The officers accompanied by the heads of the Provincial Disaster Risk Reduction and Management Office (PRDDMO), proposed their plans for the year including a benchmarking activity for solar-powered early warning systems which the LGUs plan to put in areas prone to floods.

In his discussion with the LDRRMOs, Governor Dayanghirang also emphasized the need to implement the community-based tsunami orientation and drills since Davao Oriental is a coastal province and is among the many areas in the country frequented by earthquakes, thereby also prone to tsunamis.
Governor Dayanghirang stressed that there should be no loss of lives due to disasters. He said that people should be made aware and that proper measures should be practiced. He also underscored the importance of putting up signages and provide guidance to the people on the protocols during evacuations.

To mitigate the effects of tsunamis, he also mentioned placing jackstone reefs in areas prone to tsunami. However, since this is expensive, he also emphasized implementation of a cheaper alternative which is the mass planting of mangroves. Mangroves not only serve as nursery ground of fish but also helps shield coastal areas from tsunamis and typhoons.
Meanwhile, among other concerns discussed were the improvement of communication systems and facilities as well as the proper coordination of action officers and concerned agencies in times of disasters.

LOOK! Governor Nelson Dayanghirang met earlier today with top executives of the Green Power Development Corporation of Japan, headed by Principal CEO Gen Kimitsuka and Consultant Jose Dante Mara.

The Japanese investors discussed with the Governor their intention of putting up a processing plant for whole coconut in the province. Based on the company’s proposal, they intend to supply coconut seedlings to farmers and buy whole coconut from them. They also intend to lease land, particularly in the ancestral lands, to put up processing plant, of which the Governor advised them to enter into an agreement with the Indigenous People’s communities.

To address the power needed to operate the plant, the company express its intent to explore putting up hydro and solar power.

The company is set to meet with the mayors of the different municipalities to discuss the business prospect. Governor Dayanghirang said that this is a welcome development for the province as he assured his full support to the investment opportunity that will help his constituents, especially the coconut farmers. "Our government must provide effective legal representation for the family of the domestic helper against the murderous employer in Kuwait. DFA should employ legal experts to pursue the case and ensure prosecution of the suspect," said KABAYAN Party-list Rep. Ron P. Salo, one of the authors of HB 5832 creating the Department of Filipinos Overseas and Foreign Employment.

HB 5832 provides P5 billion to the Assistance to Nationals (ATN) Fund for assistance, including legal aid, to Filipinos Overseas in distress situations.

Salo asked the “DFA to engage a battery of lawyers and ensure appropriate legal representation in all jurisdictions where there are OFWs, giving priorities to areas where there is high incidence of violence against OFWs."

"Moving forward, DOLE must develop new markets in jurisdictions where there is high respect for human rights and where our OFWs, particularly our domestic helpers, will be treated with respect and dignity. Train domestic helpers for other skills so they won’t have to work as DH where they are more prone to abuse, or worse, death," he added.

"Long-term, more job opportunities must be created in the country so Filipinos don’t have to work abroad," Salo added. (END)

PIA Davao City: Senator Bong Go is treating 157 kids from quake-hit towns in Davao del Sur, into chicken meal lunch at this moment at the Gaisano Mall in Davao City.

Earlier today, the children, aged 6-10 years old, enjoyed the bird show at Crocodile Park.

Sen. Go will later bring the children to SM City Mall to buy them toys as he promised and as part of the Senator's post Christmas treat.

The children are from the municipalities of Sulop, Padada, Hagonoy, Magsaysay and Matanao.

They were among those traumatized from the series of earthquakes in October and December that severely hit the province this year.

With 1,034,396 tourist arrivals in 2018, the US ranked third among the nationalities visiting our country according to the official data of DTI. That is 1/3 of all the 3.3M American tourists who visited ASEAN last year according to the ASEAN website.

With Philippines ranking sixth out of ten with only 5.4M tourists, and trailing far behind our neighbors:

• Thailand - 1st with 29.8M tourists
• Malaysia - 2nd with 25.7M tourists
• Singapore - 3rd with 15.2M tourists
• Indonesia - 4th with 10.4M tourists
• Vietnam - 5th with 7.9M tourists

it would be easy to imagine that our current share of US Tourists could easily shift to better and more-preferred destinations in the region.

According to Philippine Statistics Authority, Tourism makes up 12.7% of the total Philippine GDP, and our total GDP increases on an average of 6% only per year. The loss of the 12.7% in our GDP will eventually cancel out our 6% growth.

Bottomline, with our tourism ranking, we can’t afford to lose a sizable portion of tourist arrivals and eventual business. (Data Source: DTI, PSA and ASEAN)

TAGBILARAN CITY, Bohol, December 28, (PIA)—Expect to be running, umm scampering along the world rated international trail runners when you negotiate the steep ascents and the tricky descents of the first trail ultramarathon in Bohol: The Alicia Ultra 2020, happening this February 23, 2020.

The Alicia Ultra 50KM has been rated under the International Trail Running Association (ITRA) as a qualifying race for all international races, runners earning ITRA points that will be used to qualify for the Ultra Trail Mt. Fuji in Japan and the world championship of trail running, Ultra Trail du Mont Blanc in France.

A first for Bohol, this inaugural ultramarathon also offers 25 kilometer Trail Run and 12 kilometer Fun Trail, according to race organizers: raceyaya.
 
Owing to the distance and the terrain, the 50KM Trail Ultra will start on Sunday, 1:30AM at the Alicia Gymnasium and follows the established roads which occasionally break off into the notorious Alicia trails, runners in this category will have completed the route by late afternoon.

The 25KM Trail Run also leaves at 3:30AM, while the 12KM Fun Trail will start 5:30AM and hopefully finish before lunch.

Due to the highly technical climbs, app participants for the 50KM must have finished at least a 21KM trail run earlier to be able to join the race.

The harder trail courses are set over the luscious green rolling hills of Barangay Cambaol, where the huge part of The Alicia Panoramic Park (TAPP) also known as the Binabaje Hills are, through vast oil palm plantations, river banks and crossings, rice paddies, and off to the BatongPuti Cliffside Park past the highway to the lofty mountains of Cagongcagong and Del Monte, down to the plains and to the finish line.
 
Organizers said the highlight of the race is the chance to gaze upon the panoramic views of the Binabaje Hills on sunrise, even though the highest point of the route is just about 350 meters above sea level.
 
But, no matter how low the hills are, the short steep ascents, the slippery descents, and sun-exposed terrain offer enough challenge even to the most seasoned trail runner, organizers assured.

For those taking the 25 kilometers and the 12 kilometer fun trail, no pre-qualifications are required.

While the finishers in the ultramarathon can be qualified for the other ITRA races, organizers are yet to determine the equivalent points the finishers can earn for racing here.

Registration for early birds has since opened in November and are now on regular rates at PHP 2500 for the 50 kilometers, PhP 1800 for the 25 kilometers and P1500 for the 12 kilometer fun trail. 

The registration fee, includes the Alicia Ultra fully-sublimated event singlet, race bib, race timing chip, Alicia ultra-limited edition Multi-functional Headwear, Alicia ultra draw string bag and post-race meal.

Official race finishers will receive a finisher’s medal, finisher’s shirt for the 50KM and 25KM only, and ITRA points and UTMB qualification points to 50KM official finishers.

Men and women podium finishers for each category will receive trophies, sponsor items, and cash.

As of December 28, only 154 slots remain in the 50 kilometers ultra, 133 slots for the 25 KM and 179 slots for the 12 km fun trail.

The Provincial Government of Bohol through Gov. Art Yap and Vice Gov. Rene Relampagos, members of the Provincial Board and the Management Executive Board with LGU Valencia led by Mayor Kat Lim, and the Office of Congressman Edgar Chatto honored today the late former Vice Gov. Concepcion Lim.

In the Holy Mass officiated by Fr. Lito Geangan, he emphasized the certainty of death, the perfection that awaits in the kingdom of God, and this season of hope, which promises togetherness with Nang Inday someday.

Former Provincial Administrator Ae Damalerio, former Board Member Dr. Yul Lopez, and Board Member Molex Cepedoza relived moments with the motherly Nang Inday in various capacities as public servant and on a personal level.

Cong. Chatto for his part recalled closeness shared with Nang Inday who he calls his partner as then mayor of Balilihan and as mayor of Valencia in 1988 when they also became president and Vice President of the League of Municipalities Bohol Chapter. Their relationship deepened by continued partnership until their stint as governor and vice governor from 2010 to 2016.

The Sangguniang Panlalawigan presented resolution expressing sympathy and condolences to the bereaved family and paying tribute to Nang Inday’s worthy contribution to the upliftment of Bohol.

Former chief of staff Atty. Filipina Piollo-Asoy led SP employees in a song offered for the former Vice Governor.

Nang Inday was fierce in her love and care as she was in her leadership.

She will be laid to final rest tomorrow, December 28, 2019 at Valencia Cemetery. The requiem mass will be held at 1:00 in the afternoon at Sto. Niño Parish in Valencia.

Gov. Nonoy's burial in Cebu City on Dec. 30, 2019

On behalf of the family of the late former Bohol Governor Constancio “Nonoy” Chatto Torralba, nephew First District Rep. Edgar Chatto has announced the burial of his uncle in Lahug, Cebu City on December 30. 

A requiem mass will be held at the St. Therese of the Child Jesus Parish Church on Edison St. in Lahug at 1pm on the same day. 

Torralba’s remains lie in state at the Cosmopolitan Funeral Homes, Nivel Hills, also in Lahug.

Torralba’s daughter Dely Torralba-Tubio sent this message to her Bohol congressman cousin, “Edgar, many have asked if Papa’s body  will be brought to Tagbilaran City. Pls relay this message: To all Boholanos – We regret that due to time constraint, we won’t be able to bring our father to Tagbilaran to be in his beloved province for the last time. Your outpouring of consoling words and prayers has eased our great loss and are deeply appreciated.”

Torralba was a visionary leader, according to Chatto who had himself served as governor from 2010 to 2019.

The new Bohol Panglao International Airport---implemented and completed in Chatto’s nine-year term as governor---was conceptualized by Torralba, who was then undersecretary of the Department of Transportation and Communications (DOTC). The agency is now the Department of Transportation (DOTr).

Even with his failing health and on the wheelchair, Torralba was toured at the new airport by Chatto few months to its inauguration and opening last year. (See photos)

Among Torralba’s other notable contributions to Bohol was the expansion and modernization of telecommunications in the province; revival of the implementation of the irrigation project in Pilar; completion of the detailed engineering  studies of the Bohol Circumferential Road Project, its approval by the national government, and inclusion for funding by the Overseas Economic Cooperation Fund (OECF) of Japan. The project was conceived under the BIAD Program of Bohol in ‘80s.

Torralba initiated the Panglao Island Tourism Estate (PITE).
He espoused the establishment of the Ubay Coconut Seed Garden, which was calculated to supply the need for hybrid coconut seedlings throughout the Visayas.

The yearly Sandugo celebration and other essential programs in the province are also considered as Torralba legacies.

Gov. Nonoy, as we was fondly called, was a self-made man.

He was educated in Bohol, Cebu and Manila, with his elementary years spent in Patrocinio, Cortes, Bohol. He became a certified public accountant (CPA) and was in the private sector. He worked in the General Milling Corp. before his appointment to the DOTC as undersecretary in Cory’s time.   

Torralba had served as governor of Bohol in 1988-1992.

The soft-spoken and humble Torralba is survived by his wife Genoveva Lopena-Torralba and their eight children---Luz. T. Crystal, ;leur de Liz T. Tubio, Cristituto L. Torralba (+), Constancio L. Torralba, Jr., Carl L. Torralba, Genevieve T. Pfaff, Marissa T. Pagdanganan, and Cliven Alain L. Torralba.

Patay ang driver  sa motorsiklo nga si Elmer Fulguerina , 48 anyos, minyo, taga purok  3 brgy. Catarman  lungsod sa Dauis   samtang angol ang duha ka Russian  National nga sakay sa tricycle nga sina  Pet`r  Carchanog , 59 anyos, ug si Liubov Carchanova , 57 anyos, kasamtangang  nag renta sa usa ka hotel didto sa brgy. Tawala Panglao.

Matud pa ni Police Corporal  Richard Quindajen Dauis Pnp nga sa mga pasado alas 11:20 sa buntag kagahapon nga nagdagan ang duha ka sakyanan sa managlahing direksyon didto sa  purok 6 brgy. Catarman, Dauis  diin  si Fulguerina kalit lang kining mi swerve ug mipaingon sa lugar  sa tricycle nga gimaneho ni Bryan Brenx Mendez, 23 anyos, taga purok 1 brgy. Tangnan , Panglao    nagbangga ang duha ka sakyanan nga nakaingon sa pagkadisgrasya. Daling gidala sa tambalanan ang motorista ug  ang duha ka Russian  ug  pag-abot sa hospital giatiman dayon  sila apan si Fulguerina namatay  kini  gumikan sa grabeng kondisyon niini samtang ang duha ka foreigner gipauli ra tungod sa minor injuries nga naangkon.
