WN,

We just need to be realistic here. We all knew that corruption is super rampant in our country. Was there anybody being convicted of corruption? Imprisoned?

We all knew that they are corrupt. But to prove them in court is a different story. GMA is also corrupt. Impeachment against her does not work and we all knew the reasons. Do you believed that erap is not corrupt? erap was noted of much wrongdoings as president. although you can say he was not even convicted with the plunder. but in reality he did the plunder. just proving it in court is difficult, as you said, they can thwart the law. The justice system does not work as it meant to be.

Now, both GMA and Erap noted to be corrupt and have wrongdoings as President, You still want erap to be president? What for?

Now I do not understand the scenario here. When GMA was sworn IN by SC, where was erap then? If erap then thought he was illegaly ousted and when he thought he still had the legal rights to sit back in as president, was there a legal battle for him to be sworn back in as president? I never heard there was. Instead the legal battle for erap was impeachment and he was indeed impeached. He had a plunder case, and he was convicted. He was just pardoned by GMA and thats the fault of GMA.

Voluntary renunciation of the office for any length of time shall not be considered as an interruption in the continuity of the service for the full term for which he was elected.

The above quote, they will also argue that erap did not voluntarily resigned. We will have constitutional crisis here if that is the case. GMA supporters can pose disguise and do people power to oust her. So, VP Noli will take over. Come Election time, GMA can run again.

The "term six years" refers only to the maximum number of years an elected president can sit. It does not provide, that when a president is ousted, impeached, that he has all the six years to sit. Much more to be re-elected.

WN, you might want to include also the COMELEC people here in the list. The constitution did not mention implicitly or explicitly whatsoever that an elected president who has not finished his 6 years term is eligible to run again.

The strongest term that will knock on eraps head is the word "re-election". He was elected as president. If he did not finished his term for his stupidity, and he wants to run again, do we not consider it as "re-election"?  This is very simple.
It is not hard to understand this. Yes, I agree with you, they think that they are above the law and they will circumvent the law as much as they can because of greed.

But, the question here is, What can we do about it? When can we emerged from inside the cave? What will make us get to our senses?

The consitution again states that: Soveriegnty resides in the people and all government authority emanates from them.

We, the people are soveriegn. But I think it's not the case.

The President shall not be eligible for any re-election.

Argument:

"The President" - Yes this looks like to imply the sitting president
"Re-Election" - This applies to all other presidents who had been elected.

No Vice-President shall serve for more than two successive terms. Voluntary renunciation of the office for any length of time shall not be considered as an interruption in the continuity of the service for the full term for which he was elected.
