Rebels In Bohol Will Surrender

Christmas 2007 may be the last Christmas of restlessness and apprehension for the 185 rebels in Bohol who have indicated to go mainstream.

Barring any more snags, at least five of the 11 bills Malacanang certified as urgent and needs to be passed by Congress before the yearend could be passed.

And of the five, the concurrent resolution in favor of Presidential Proclamation 1377 or the national general amnesty bill is one that gets through, Atty. Sedfrey Candelaria, Chairperson of the Government of the Republic of the Philippines Monitoring Committee said during a gathering at the Bohol Plaza December 19.

The granting of amnesty is very important to former rebels who want to go mainstream as it qualifies them for a safe conduct pass by the Provincial or City Peace and Order Council Amnesty Center (P/CPOC-AC). The Pass grants him the immunity from warrant-less arrests for offenses covered with the Proclamation, Bohol Provincial Peace and Order Council said.

Legal eagles in Bohol have hinted that despite the steps that the PPOC and Bohol PLGU have initiated to cater to local rebel surrenderees, there could be "stiff legal implications" if anybody gets interested in the way it is processing the surrender without a national amnesty proclamation.

It may be recalled that because of this, sectors here formally asked the President to offer amnesty to communist rebels during the Local Peaces and Security Assembly in Bohol last August.

The request, sectors believed, would formalize and institutionalize the national amnesty program as a means to put the backbone for national reconciliation and arrest the hounding insurgency problem in the country.

The President issued the Presidential Proclamation 1377 immediately in September, one which would need concurrence by Congress.

Covered by the amnesty proclamation are crimes of rebellion and other crimes incident in the pursuit of political belief as defined, whether punishable under the Revised Penal Code or special laws.

Eligible for the amnesty are members of the Communist Party of the Philippines, New People's Army, National democratic Front and other communist rebel groups who apply for amnesty under oath with the National Committee on Social Integration (NCSI) and the Provincial or City Peace and Order Council Amnesty Centers (P/CPOC-ACs) within the effectivity of the proclamation.

The National Committee on Social Integration (NSCI) issues the corresponding Certificate of Amnesty to qualified applicants after deliberations on the application but the filing does not at the same moment grant the amnesty.

The amnesty blanket also restores the grantee's civil and political rights lost or suspended by virtue of conviction for crimes covered by the proclamation.

The amnesty decree is part of the social integration program for former rebels as provided under Administrative Order No. 172 which the President issued on March 23, 2007.

According to Executive Secretary Eduardo Ermita, amnesty grantees are also eventually provided with access to the government's existing socio-economic services, things Malacanang consider as essential to attaining peace and reconciliation in the country.

Other than the amnesty proclamation, Executive Secretary Eduardo Ermita said the Cheap Medicines Bill, the proposed 2008 National Budget, the proposed amendments to the Electric Power Industry Reform Act (EPIRA) and the University of the Philippines Charter.
