Widows and women whose marriages have been annulled or dissolved should not be punished for marrying again or giving birth
within 301 days of their husband’s death or of the annulment and dissolution of their marriage, Senator Richard Gordon said.
A similar bill was filed at the House of Representatives by Congressman Guillermo Cua early this month.
This law against women as contained in the Crime of Premature Marriages in Article 351 of the Revised Penal Code will be repealed if Senate Bill 290 will be passed, said Gordon.
The present law penalizes the guilty with arresto mayor (six months and one day to six years) and a fine not exceeding P500.
“The purpose of the law in punishing premature marriages is to prevent doubtful paternity. It is intended to prevent confusion in connection with paternity and filiation, inasmuch as the widow might have conceived and become pregnant by her late husband or a woman might have conceived and become pregnant by her former husband in a previously annulled or dissolved marriage,†according to the explanatory note of the bill.
