CALAPE – Incumbent Mayor Ernest Herrera’s archrival Dr. Sulpicio Yu in the mayoralty race in this town is facing disqualification charges filed before the Commission on Elections for violation of elections laws.
Petitioner Diosdada C. Ytaoc, of Calape, in her complaint urged Comelec to file appropriate information against Yu for violation of sections 4 and 6 of Republic Act 9006, or the Fair elections Act, relative to paragraph1 and 2 of Batas Pambansa 881, known as Omnibus Election Code.
The petitioner also asked the Comelec to punish Yu with one to six years imprisonment and to disqualify him to hold public office and deprivation of his right to suffrage if found guilty of the charges.
Yu’s violations arose from his campaign publication printed, which runs counter to the provisions of the aforecited laws, according to the petitioner. Yu caused the publication of his one whole page print ad in the weekly Sunday Post on April 1, 2007 and paid by his brother Engr. NelsonYu.
Ytaoc argued that this is a clear violation since the law provides that no such paid campaign print ads be published that exceeds more than one-half page in tabloid newspapers and one-fourth page in broadsheets.
Yu’s publication also bore no “political advertisement paid for†as required by section 4 of RA 9006, which appeared to be disregarded by Yu when he caused the said publication, the petitioner said.
Mayor Herrera earlier accused Yu, who was then the municipal health officer, of overcharging of ambulance fee when the latter charged patients of P400. Municipal Ordinance No. 97-09 provides only P200 of the said fee for payment of transporting patients from here to Tagbilaran.
Dr. Yu is also liable for failure to remit to the Treasurer’s office the collection of P400 ambulance fee in transporting patients to Tagbilaran.
Mayor Herrera is embarking on what he called “TREES†as his battlecry and platform of governance for development of Calape.
“TREES†stand for tourism & technology, reforestation, education, economy and security, he said, adding that these hopefully help reduce poverty of his constituency.
Under his official slate include Ruben D. Co, vice-mayor; and reelectionists councilors Edgar D. Co, Gerardo Cuadrasal, Gerardo Regalado, Teodoro Ruizol, Atty. Roldan Damalerio, Atty. Jose Jumang-it, and Eleuterio Zulueta and neophyte Antonio Tayabas. (RVO)
