Bureau’s Action Team Against Smugglers (BATAS) In Action

𝗜𝗺𝗽𝗼𝗿𝘁𝗲𝗿𝘀 𝗖𝗵𝗮𝗿𝗴𝗲𝗱 𝗢𝘃𝗲𝗿 𝗣𝟮𝟰-𝗠 𝘄𝗼𝗿𝘁𝗵 𝗼𝗳 𝗠𝗶𝘀𝗱𝗲𝗰𝗹𝗮𝗿𝗲𝗱 𝗚𝗼𝗼𝗱𝘀
Press Release - The Bureau of Customs, through the Bureau’s Action Team Against Smugglers (BATAS), filed two (2) criminal cases before the Department of Justice (DOJ) against violators of Customs laws for misdeclaring P24 million worth of food and agricultural products.

A criminal complaint was filed against Potanion Trading for its alleged misdeclaration and unlawful importation of red onions last May 11, 2021 at the Manila International Container Port (MICP) with a total value of P835,924.64.

The importer faces one (1) count of violation of various provisions under Customs Modernization and Tariff Act (CMTA); and Section III (A) of Department of Agriculture Administrative Order No. 09, Series of 2010 in relation to Department of Agriculture Circular No. 04, Series of 2016 otherwise known as “Guidelines on the Importation of Plants, Planting Materials, and Plant Products for Commercial Purposes; and Department of Agriculture Administrative Order No. 02, Series of 2020, also known as the “Strengthened Guidelines in Monitoring and Evaluation of Local Production and Importation of Onion (allium cepa) and Garlic (allium sativum).

Another criminal complaint was filed against Hightower Inc. due to the alleged misdeclaration and unlawful importation of food and agricultural products worth P23,483,477.30. The violation was committed on separate occasions from February to March 2021 at the Port of Manila (POM).

The respondents violated pertinent provisions of the CMTA; Section 10 and Section 11 of Republic Act No. 9711, otherwise known as the Food and Drugs Administration Act of 2009; Section 37 and 38 of the Implementing Rules and Regulation of R.A. No. 10611; Section 3 (a), (h) and Section 4 (a) of Republic Act No. 10845, otherwise known as the Anti-Agricultural Smuggling Act of 2016; and Article 172 in relation to Article 171 of the Revised Penal Code (RPC), as amended.

The successful filing of the complaints was through the combined efforts of BATAS and the concerned Collection Districts.
