This afternoon the wife of the victim and I paid a visit to the cityhall to make a check up on the mayor and what are the steps being done to implement any actions being taken to give assistance to the victim and his family on both sides of the fence.

Until now there have been no apologies given to either side of the family and the victims mother in Michigan State is getting pissed off after one month of mourning from this day.

I wrote down the proposal in front of Mark Monton and he told me to stop worrying about it and squeezed my hand as I firmly squeezed his letting him know that I was serious in making sure Zach's family is treated fairly and with justice.

I requested around P17.000.00 to the cityhall to give the assistance to the girl so she could get to Manila and stay there for a few nights until all documents are made out and the American Embassy has what they need in order to process the paperwork and the baby will be able to get her American father's socail security.

I also offered as a part of the price it was for two I who would accompany her and the baby to Manila and the A.E. I know where to stay that would make it a a one jeepney ride away from the consulate where she will need to go.

I also know where to guide her at the Embassy and help her translate as well.

Thursday i and the victims fiance will go back to Mayor at cityhall and get answer's as it has been long enough time already.

The mom of Zach's baby is running out of money.

The mom of Zach was stuck with a big bill and the loss of her son who can never come back no matter what but can come back only in memory.

The hospital bill was paid with funds from the account of Zack' and whats makes this case more maddening as time mi-anders on is that the blood bank would not release blood when the Dr. had requested the blood in order to save Zacks's life as he was losing it fast.

I could post a picture in here of Zach' laying on the morgue table so you can all take a visual look at what amount of pain he must of went through.

I asked some worker's at cityhall what's going on?

If this was them in this young mother's shoes how would they like to receive the run around?

Will post again another news when I get it.

Yea, I mentioned this incident to my relatives when I was back home, and they all were angry about the late/delayed response by the municipal government. Please extend our condolences to the mother and father of the victim, as well as the fiance' and child.

Yesterday "Pie" and I went to have a follow up with Mark Monton from the mayor's office.

Last Monday we set a proposal of what we needed in order to fly to Manila and have room and board payed for as well.
Including meals and ground transportation.

Yesterday Mark Monton from the cities gov. office informed us that when there there is a promo at the airlines with in two weeks and a month from now he will buy the tickets for us to get to Manila in order to process the baby's documents to qualify her for the socail security benefits of her late father life that was taken away by the driver with an expired pro driver's license .
I had asked Mark Monton for a written guarantee on his words and he said no need and that he would live up to his words to assist.

Then Mark Monton Mentioned my banner story I had written that the city needs to act on such matter and demands.

You would hopefully think that they have a liability fund for such stupididness the hearing is going well.
The driver is saying sori he knows he is the fault but the court still must follow the hearings. the next hearing is going to be on Feb, 1st.

Who cares where it comes from the baby's father is dead can you bring him back for any price?
Do I look like the city treasurer i am just pleased that we are getting some sort of care from the city government at all. Mo ba?

i wish this could open other driver's eyes to have valid DL's and get some insurances and follow rules!

I do not get the point of your question where is the budget coming from?

I know Mark had mentioned for the time being for this week the budget is not sufficeint enough?

If they are willing to come up with it as part of their apology then why ask questions?

The concern is for the baby here. They lose their apartment this week they are preparing to move out today the wife and the baby.

The accident is caused by the city anyone one knows traveling too close behind the vehicle in front of you and you hit it then you are automatically at fault.

The pictures were presented in yesterdays hearing where the body was laying on the road and where the truck had been in position after the impact.

Many witness's were out at that time and they are the one's who had taken the pictures of the accident scene.

The evidence of damage is in the passanger side smashed out right headlight.

I can not tell if your question is for concern or whether it is being sarcrastic becaause the next question you asked about investigation?

Do you have a doubt that it is not the fault of the city gov't?

I wouldn't think there should be a "liability fund" for stupidness.  If that happens, it's giving people -  in this case, government workers, the license to be stupid. 

Precious, I understand your frustration but no need to be fighty. The driver should be solely liable for this and if our provincial or city government has fund to help out victims, that is great.  My brother in law was killed while serving his country as a police officer.  He left behind a young wife (my sister, also a police officer) and three young kids - the youngest just turned 1 when his father died.  The government had some sort of pension but it stopped this month because it's is 5th death anniversary already.  It didn't make sense to me but such is life in the Philippines. As for the case of the victim's child, at least this poor child has grandparents  and family in the USA who may be able to support the baby and the victim's fiancee finacially.  Again, this is so tragic news and I know it's very difficult to the victim's parents and family here in the USA and more so to the child and to Pie but things happen beyond our control.  Financial support is very much needed especially to Pie and the baby but we can not demand this to anybody. That's my opinion which of course can be wrong.

And lastly, I and I think most of the TB people appreciate your concern and assistance to the victim's family.  You did good job!

A liability fund is not giving. A liability fund or liability insurance often saves you from being over sued.

The truck is a city owned which means logical to me to have liability insurance on it for such accidents and injuries including fatalities.

The water dept. should make sure that the persons working for them are properly licensed and insured for the job they are hired for.

The dump truck was on official business it was being taken home after delivering equipment used at the Christmas party.
The garage was locked to the motor pool so the boss instructed the driver to park the truck at his residence for safe keeping.

The police man story you told about is sad and maddening they should give a life time of assistance to policemen killed on duty.

Jason was not working n a high risk job working when he was killed it was sudden.
What frustrates the system is why they can not release blood to be bought in emergency situations such as Zach's case?
The blood was available for sale at 9:AM that's really stupid procedure when some one is losing blood they do not want to save a life here to bad since the blood is available for sale all 24 hours in a day?
Zach' might have been able to be saved if the Dr. could of administered blood into him  while he was losing it fast.

I do not honestly get the logics of this countries way of thinking when it comes to things such as this?

The system needs to made right for the people to be able to live a normal life and be treated in a humanitarian way.

If i was to ask Mark Monton where is funds are coming from I am sure knowing Mark he would not give out that kind of information.

All i know is Mayor had just about every banker management in his chambers having meeting for almost 2-3 hours.
I do not know the kinds of transactions going on inside as I did not ask it is not my business my mission is to make sure people in life who are dealt a bad deal need help in being picked up again to get back on their two feet.
Some People here some times lack compassion for others who are suffering shock and trauma and when this happens and they have no one to lean on when in this condition it can lead into a nervous breakdown and eventually affect that person for life.
If someone in my family is driving negligently in my families business back home and they killed some one on the road bet me my mom's insurance in our restaurants and her own monies would be awarded in a law suit to the family who had lost a loved one.

That budget is now coming from my publisher and the clients Atty. Alexander Lim.

Atty. Lim, called me to a briefing session to ask me if I would accompany "PIE" and her 6 months old baby girl to the American Consulate head office in Manila to have the baby's documents filed in order to qualify her for her late father's Socail Security Benefits.
Atty. Lim is the one to shoulder all expenses for us RT food, lodging, transportation while we are there. That's pretty darn sweet of him.

Atty. Lim, knows I am the only one from the media who has taken a specail care to this incident as I have also cared about other things I have written about as well. Some times as a media man and if your heart is into it you give of personal time to something as charitable as this to lend a helping hand.
Atty. Lim, feels that the way that the cityhall is handling both "PIE" and I by always by hiding from us as well as eluding us and let's add dickering with time and being pointed to the middle man in trying to get them to assist and be responsible for their negligence for the sake of the Baby left behind and her darling and more then ever pateint mother has been in this matter.

Atty. Lim Feels strongly along with me that Mayor Dan Neri Lim is just not wanting to put this as a priority matter as it should have been the day it hapend not 12-14  days or even a month after the fact.

1.) The driver of city owned dump truck was drunk at the time of the accident.

2.) Driving on 6 months expired pro license

3.) Driving a city owned dump truck home after the party for personal use of transportation,
after dropping of sound system from a company Christmas Party.

That's where the budget is coming from! Atty. Alexander Lim.

The mother of the victim back in the United States emails me just about every day trying to justify why things have hapend the way they did?

I am also comforting her and passing information onto her so she knows that her grand daughter and "Pie" are in good hands and we are doing what we can to help.

She has not received any condolences from the city water dept, or the city Mayor, even though during last weeks mayor report he mentioned that he wrote a letter to the American Embassy (Late pod).

Okay there is a change in flight scheldule do to plane conflict we are unable to go tommorow to Manila and next week I am a guest speaker for the provincail WCCD of the PNP seminar Christmas party.
So the airplane ticket will be reschelduled againf for valentines week.

Uhm......some one was not very happy when he said he might have to pay a penalty for me to change the date of the ticket.

Anyways things will be fine as he is depending and knowing that "PIE" will be in good hands at the Embassy in Manila.

The trip is postponed Atty. lim purchased the tickets already, and we will be have the appointment on the 14th at the embassy.
Today their was a another hearing with the fiscal and it went alright.

The motorcyclist was going fast because if going slow he would of had a better chance of living.

The truck driver did hit him and the impact was hard to the truck such as mirror's and dooors and one passanger side headlamp taken out.
The case is still on going.
Sorry it has been a while to post.
The internet here is unstable this past month.

That's great news, yes' I know I receive daily emails from Zachery's mom as well, as I am the translater and helper with Atty. Lim on this case.

Pie is back in Mabini with her baby from Zachery and living with her parents also.

Our tickets are already purchased through my publisher and loding and daily food allowance is already sponsored by him as well.
Thursday on valentines day Pie will have her appointment with the baby at the American embassy, I will also accompany her at the appointment.
I also interveiwed PO3 Fabio Maulas two days regarding the pre limanary hearing.

It's exactly the way I knew it to be all along.

Zachery's mom is upset but she has been very cooperative indeed.

Last Saturday during the Mayor's report I Let mayor Lim have it good over the radio. To avoid from being arrested (Joking) I hung up the phone.

So many were wanting more........Mayor has never been so nice to someone when they have critisized him the way I did.
I think in the history of his reports he truly behaved after that and also his report this morning as maybe he was afraid I might have called him again telling him to do his job as a good mayor for everyone in the city.

He said just because Zachery was an American it did not mean that he has to handle this case as a priority?

Just who does he think he is when it is his city dump truck and driver who failed the right of way to Zachery and then the driver's Atty. Doni Piquero is representing the case?
What I do not get if he is terminated then why does he have a tax paid Atty.?

If Mayor does not want to take the blame then why does he have Doni Piquero the cities Atty. representing a terminated employee.

According to my interveiw with the PO3 who investigated the case he said that Piquero is trying to get Blanco to say things against the investigation.

Mark Monton never did call either Pie or I back in regards to getting any help?

PO3 also felt that Dan Lim was told  way before I had ever mentioned it to him? but is trying to white wash the sittuation. I recorded the interveiw with PO3.

Manila Bulletin has taken an interest to this story and wants me to call them so they can come and interveiw Pie and I and they have instructed me to bring all of my printed media writinings about the case.

They are also curious as to why the other pioneer newspaper's kept silent over a tourist issue?

They also think it is rude of the mayor not to have lifted a finger as well.

I am not going to correct the spelling it is late here and I am tired.

Sorry everyone, it has been a while since I updated this post.

I am back from Manila and what a grueling time it was indeed. For Cleofe's part it went well for her baby daughter who is absolutley very darling fat, and cute.

We went to Manila as schelduled for our next day embassy appointment. We brought along also the grandmother who was just paid a plane ticket to take care of the bb after the embassy appointment oh' no instead the poor bb gets dragged all over Manila and ends up getting really sick instead as the grandmother did not do as was promised to have her plane ticked paid for which was just to make sure the baby was looked after and kepf well in between appointments.
While staying at the hotel room where it was clean.
I was correct in suggesting to "PIE" that it would be better to go to the embassy and apply for American national, and to start processing paper's for the bb to receive the bennefits of her late father.

"PIE" still has some things to do for the embassy but she is working hard at getting things done fo her bb and will be heading back to Manila alone this time.

She was instructed by persons at the NSO and the American Embassy that she must only spend the monies received for the bb and nothing more.

If she abuses such priveladge is found not being able to produce the receipts for the bennefit transactions then she will forfeit all monies awarded.

As for the Manila Bulletin Newspaper in Manila "PIE" was absent up to eight hour's due to traffic and getting around for finding things to give the embassy showwing pictures that she was pregnant.
So we did not have time to meet up with the Manila Provincail editor of the Bulletin.
I am so sorry she missed a bigger oppurtuinity to have this news go out of Bohol, since it is a tourist issue.

On the other hand i am happy that i was able to give some help for her and guide her to where she neede to be guided.

I am personaly exhausted from everything and i want to spend some time and energy for myself so i can concentrate on my families graduation this coming up couple of months.

Precious, thank you so much for all your effort in ensuring that Pie and her baby will have a better future now that the baby's father is gone.  It was very noble of you to set aside your own family for awhile just so you could help them.  Way to go, Precious!  And thank you too for updating us.  It makes me feel good that Pie has money for the baby's needs.  God bless you, Precious!

Anyways "PIE" has not talked with me since she came back from manila. Maybe she no longer needs me?

I did talk with the Sr. writer from the "PIONEER" paper here in Tagbilaran and and asked him why he never bothered to report about the incident involving the American?

he replied that if he would of written it that his publisher who is the provincail tourism chairman here would of rejected the story, just like he did when the Japanese tourist were robbed near to Sierra boulinas.

His publisher will not publish bad things that happen to tourist here in Bohol?

Maybe he does not care about the safety of tourist from outside the country coming in here?

I just do not get it informing the public is the medias jobs in order to let the community know to be more vigilantin with in different parts of the island where becoming a conveinant criminal victim is more acessisble.

Thank you for assisting Pie and the family members affected by the loss of Zach. I can only hope that everything goes alright for the baby and the mother. It saddens me that the child will not grow up knowing her father or hear his voice. You have my sincere gratitude and respect for your helpful conviction.

Thanks for the update, Precious!

Regarding your talk with the Senior writer in the Pioneer paper there, your conjecture that maybe the publisher did not care about the safety of toursts coming in and out of Bohol is kind of unbelievable to me because I always see in the news about tourists being victimized.  Also, tourism has become the lifeblood (I may be wrong) of our Province and I don't think they would take for granted the contribution of the tourists to our economy there.

 I saw this documentary by a guy from the States that he felt safer in Bohol than any place in the Philippines.  He, however cautioned tourists to be careful and not be so "tempting".  In any case, you being part of the media, or that Senior writer, isn't it your obligation to the public to expose this kind of inappropriate behavior by this publisher?  Just asking, Precious. 

By the way, did you say one of your kids is graduating this March?
