where would that budget come from?
How was the investigation about the accident, any news to that?

That budget is now coming from my publisher and the clients Atty. Alexander Lim.

Atty. Lim, called me to a briefing session to ask me if I would accompany "PIE" and her 6 months old baby girl to the American Consulate head office in Manila to have the baby's documents filed in order to qualify her for her late father's Socail Security Benefits.
Atty. Lim is the one to shoulder all expenses for us RT food, lodging, transportation while we are there. That's pretty darn sweet of him.

Atty. Lim, knows I am the only one from the media who has taken a specail care to this incident as I have also cared about other things I have written about as well. Some times as a media man and if your heart is into it you give of personal time to something as charitable as this to lend a helping hand.
Atty. Lim, feels that the way that the cityhall is handling both "PIE" and I by always by hiding from us as well as eluding us and let's add dickering with time and being pointed to the middle man in trying to get them to assist and be responsible for their negligence for the sake of the Baby left behind and her darling and more then ever pateint mother has been in this matter.

Atty. Lim Feels strongly along with me that Mayor Dan Neri Lim is just not wanting to put this as a priority matter as it should have been the day it hapend not 12-14 days or even a month after the fact.

1.) The driver of city owned dump truck was drunk at the time of the accident.

2.) Driving on 6 months expired pro license

3.) Driving a city owned dump truck home after the party for personal use of transportation,
after dropping of sound system from a company Christmas Party.

That's where the budget is coming from! Atty. Alexander Lim.

The mother of the victim back in the United States emails me just about every day trying to justify why things have hapend the way they did?

I am also comforting her and passing information onto her so she knows that her grand daughter and "Pie" are in good hands and we are doing what we can to help.

She has not received any condolences from the city water dept, or the city Mayor, even though during last weeks mayor report he mentioned that he wrote a letter to the American Embassy (Late pod).

Okay there is a change in flight scheldule do to plane conflict we are unable to go tommorow to Manila and next week I am a guest speaker for the provincail WCCD of the PNP seminar Christmas party.
So the airplane ticket will be reschelduled againf for valentines week.

Uhm......some one was not very happy when he said he might have to pay a penalty for me to change the date of the ticket.

Anyways things will be fine as he is depending and knowing that "PIE" will be in good hands at the Embassy in Manila.

The trip is postponed Atty. lim purchased the tickets already, and we will be have the appointment on the 14th at the embassy.
Today their was a another hearing with the fiscal and it went alright.

The motorcyclist was going fast because if going slow he would of had a better chance of living.

The truck driver did hit him and the impact was hard to the truck such as mirror's and dooors and one passanger side headlamp taken out.
The case is still on going.
Sorry it has been a while to post.
The internet here is unstable this past month.

That's great news, yes' I know I receive daily emails from Zachery's mom as well, as I am the translater and helper with Atty. Lim on this case.

Pie is back in Mabini with her baby from Zachery and living with her parents also.

Our tickets are already purchased through my publisher and loding and daily food allowance is already sponsored by him as well.
Thursday on valentines day Pie will have her appointment with the baby at the American embassy, I will also accompany her at the appointment.
I also interveiwed PO3 Fabio Maulas two days regarding the pre limanary hearing.

It's exactly the way I knew it to be all along.

Zachery's mom is upset but she has been very cooperative indeed.

Last Saturday during the Mayor's report I Let mayor Lim have it good over the radio. To avoid from being arrested (Joking) I hung up the phone.

So many were wanting more........Mayor has never been so nice to someone when they have critisized him the way I did.
I think in the history of his reports he truly behaved after that and also his report this morning as maybe he was afraid I might have called him again telling him to do his job as a good mayor for everyone in the city.

He said just because Zachery was an American it did not mean that he has to handle this case as a priority?

Just who does he think he is when it is his city dump truck and driver who failed the right of way to Zachery and then the driver's Atty. Doni Piquero is representing the case?
What I do not get if he is terminated then why does he have a tax paid Atty.?

If Mayor does not want to take the blame then why does he have Doni Piquero the cities Atty. representing a terminated employee.

According to my interveiw with the PO3 who investigated the case he said that Piquero is trying to get Blanco to say things against the investigation.

Mark Monton never did call either Pie or I back in regards to getting any help?

PO3 also felt that Dan Lim was told way before I had ever mentioned it to him? but is trying to white wash the sittuation. I recorded the interveiw with PO3.

Manila Bulletin has taken an interest to this story and wants me to call them so they can come and interveiw Pie and I and they have instructed me to bring all of my printed media writinings about the case.

They are also curious as to why the other pioneer newspaper's kept silent over a tourist issue?

They also think it is rude of the mayor not to have lifted a finger as well.

I am not going to correct the spelling it is late here and I am tired.

Sorry everyone, it has been a while since I updated this post.

I am back from Manila and what a grueling time it was indeed. For Cleofe's part it went well for her baby daughter who is absolutley very darling fat, and cute.

We went to Manila as schelduled for our next day embassy appointment. We brought along also the grandmother who was just paid a plane ticket to take care of the bb after the embassy appointment oh' no instead the poor bb gets dragged all over Manila and ends up getting really sick instead as the grandmother did not do as was promised to have her plane ticked paid for which was just to make sure the baby was looked after and kepf well in between appointments.
While staying at the hotel room where it was clean.
I was correct in suggesting to "PIE" that it would be better to go to the embassy and apply for American national, and to start processing paper's for the bb to receive the bennefits of her late father.

"PIE" still has some things to do for the embassy but she is working hard at getting things done fo her bb and will be heading back to Manila alone this time.

She was instructed by persons at the NSO and the American Embassy that she must only spend the monies received for the bb and nothing more.

If she abuses such priveladge is found not being able to produce the receipts for the bennefit transactions then she will forfeit all monies awarded.

As for the Manila Bulletin Newspaper in Manila "PIE" was absent up to eight hour's due to traffic and getting around for finding things to give the embassy showwing pictures that she was pregnant.
So we did not have time to meet up with the Manila Provincail editor of the Bulletin.
I am so sorry she missed a bigger oppurtuinity to have this news go out of Bohol, since it is a tourist issue.

On the other hand i am happy that i was able to give some help for her and guide her to where she neede to be guided.

I am personaly exhausted from everything and i want to spend some time and energy for myself so i can concentrate on my families graduation this coming up couple of months.

Anyways "PIE" has not talked with me since she came back from manila. Maybe she no longer needs me?

I did talk with the Sr. writer from the "PIONEER" paper here in Tagbilaran and and asked him why he never bothered to report about the incident involving the American?

he replied that if he would of written it that his publisher who is the provincail tourism chairman here would of rejected the story, just like he did when the Japanese tourist were robbed near to Sierra boulinas.

His publisher will not publish bad things that happen to tourist here in Bohol?

Maybe he does not care about the safety of tourist from outside the country coming in here?

I just do not get it informing the public is the medias jobs in order to let the community know to be more vigilantin with in different parts of the island where becoming a conveinant criminal victim is more acessisble.

Thank you for assisting Pie and the family members affected by the loss of Zach. I can only hope that everything goes alright for the baby and the mother. Regarding your talk with the Senior writer in the Pioneer paper there, your conjecture that maybe the publisher did not care about the safety of toursts coming in and out of Bohol is kind of unbelievable to me because I always see in the news about tourists being victimized. Also, tourism has become the lifeblood (I may be wrong) of our Province and I don't think they would take for granted the contribution of the tourists to our economy there.

I saw this documentary by a guy from the States that he felt safer in Bohol than any place in the Philippines. He, however cautioned tourists to be careful and not be so "tempting". In any case, you being part of the media, or that Senior writer, isn't it your obligation to the public to expose this kind of inappropriate behavior by this publisher? Just asking, Precious.

By the way, did you say one of your kids is graduating this March?

yes' darling I have 3 kids graduating one from second grade elementary, and the other from high school, and another one from a four year course in computer programming,

I am pretty proud of myself to handle it as a surrogate mother and this ids the fourth graduation I have been able to support the kids with.

About three weeks ago I went on of mayor lim over the radio as a call in person of concern. Iuntill today have received the biggest pats on the back for my bravery to let him be told just the way it is seen.

Including compliments from Congressman Chatto and his aide Anthony who will be entertaining me this weekend about the matter with Zachery.

I am prety sure some paper's in Manila will be biting at the bait when they know of some tourist issues that are being kept from media leaks out ..................it's just a matter of time white washing publisher's will get their greedy grubs into deep stinky poo-poo!

I was able to text Cleofe earlier yesterday morning she says she was waiting on the American passports for both her baby and the baby's father, before anything else can be done.

I hope to talk with her soon as I have not spoke to her since last time we went to gether in Manila.

Vito, apparently its a mystery to me also i am going to text a friend of mine who is working in the court fiscal area where the case is being handled as of now and ask what is the latest?

All I know is what I was told was that Atty Don Piquero has asked the driver Blanco too contradict the affdavit and make it false some false statements.

What I do not get untill now if the mayor (who is lieing and i know it.) is saying he is the one to terminate the driver then why does he still get to be represented from the city atty and tax dollar's are paying for it?

Why then does mayor and the restof city hall shrug their shoulders and say it is not them and its the driver but yet if it is on the driver then why is the cityhall paying for the attorney to represent the driver?

Reminding everyone that the driver was driving home the city water truck intoxicated after a christmas party because of the garage for the utility the vehicles was already locked up.

When the head engineer had told me that blanco was driving the truck after the party he was to return back the sound system for the party in manga barangay this city of Tagbilaran.

What peeves me is the fact that some one is not 100% friggen honest here and whats new in this type of sad sittuation as I had heard it from the head engineer "NO ONE WAS IN THE TRUCK THAT NIGHT WITH BLANCO?" but according to the investigative affidavit he had persons in the truck with him.

Now this this is a tourism issue at hand and the news never made it out of Bohol as I have mentioned that Sr. writer Kit Bagaipo had told me that he felt himself that it should of been put in the paper of the chronicle and he said he felt bad because he knows Peter Dejarasco the publisher would of discarded the news as he is the tourism chairman in Bohol, and I was the only one who was able to get it published in two paper's?

Now since this is an international tourist it just seems it should be automatic for the province to vs the city on this issue, and case at hand.

Maybe I should take a tippy toe glance into the water department tomorow and take a chance of possibly getting my head shot off (LOL) and ask what are the up dates on Blamnco?

Why should they care what are the up dates it is no longer their concern afterall it was Eng. Wellington Pelongo told me that day of Jan, 4th, that he was the one to terminate Blanco for good?

I am still irked as to Mayor Lims comment that the victims common law wife make an appointment since the begining well she tried that several times throught the mayor's left hand man Mark Monton and to several attempts and no avail the victims common law wife gave up and is having her atty. handle it in court.
(WHat the hell is the baby who is the victim in this case left behind my the dead American sup[pose to just take a number wait her turn while the she was losing the roof and common daily needs that she needs untill now, as mayoy has still done nothing about it?) Make appointment oh dd the baby make an appointment to have her father killed by the water department truck?

Even though Cleofe is not speaking to me latley and lord only knows why (Maybe no load, or she is sick of no one caring?) Cleofe is a beautifull and bright woman I hope and pray that some one can help her and the bb? I know the two mom and bb are staying in Mabini with Cleofe mom.

I had made an appointment with Congressman Chatto to help me stress some points about a particular newspaper outlet that black outs tourist issues that happen bad here and for me to be a domesticated foreigner here and if i was to die out of danger because i was in a dangerous area and not aware of it because no one bothered to warn the public about it and kept it hid I guess I am not of safety and concern to the Boholanos as as a foreigner?

Unfortunantly my appointment was postponed at the last hour prior to meeting the congressman and i also was going to ask him he he was willing also to write a letter of apology and let the mom in the states know that he as a congressman will do his best to follow up and make sure things are handled justily and fairly.

If i do anything else in speaking with anyone about th matter Vito I will be happy to give what ever information I get for you all in Tubag.

Salamat daghan for the well wishes as much as for the complimens on my probing of this case.
I am so truly let down as a human and a media person and a friend here on two big major write ups that were done by myself and both not having any results and hidden by other media outlets.
I am so pissed off with how I was being talked down to at a press conference by mayor Dan Lim today who thought that he could say some words as if smuggly wuggly and i did not play stupid instead my comments made him silent.

Mayor knows better then to insult this big woman! Over my dako body!

That bb was made out of love, so does that mean just because she was made out of love in your country and born in the Philippinese that she has no rights to get help when her father was suddenly taken away?

what is the logic in the thinking around here? The father was just back from work and settling in and making plans for a wedding.
He arrived her in November was killed with in a month that he was here.

Last Saturday I talked to congressman Edgar Chatto and he said he would assist with the embassy in manila if need be but as far as moral obligations it is the mayor.

I also told the mayor that it was his moral obligation to help. .........he went silent and I changed the subject as other media was starting to gather close around the mayor.

It was better as I was on the verge of just about going crazy!

His words were what we in the western world are what we would call B----s--t in some sense of the matter!

I stopped writing about the case as here the politicians do not care about anything, they make their comments and their jokes and their words ff how good they are so they can get patted on the back.

The words said to me concerning the American and The Boholana mother of the hald American baby leave behind is cold hearted and haunting in some sense.

Here is what took place today during a media pres conference concerning exspired medications from Botika Katawahan.

Prior to the meeting getting under way mayor asked me how was the sittuation with the girl that I was trying to get help for the one who has no personality as he said it several times.

I asked him for a clarity on what he meant by "No personality?" he told me that she was not married to the American so she has no rights to claim anything from the city but instead to go after the driver who was driving the city owned water works truck.

I said to him what saves her as far as rights are concerned is that she had a baby by him and the little girl qualifies for American National.
He said it was not good to ask from the city anything to help the bb and to sue the driver involved. (What does the driver have?) he has no blood to barely squeaze for his own family let alone being sued?

Mayor just keeps nodding his head as if no way does she get or deserve anything.

City prosecutor 1. Hon. Bibiana Bautista branch 7 of Tagbilaran city has found probable cause against Peter Ermilio Blanco Y Polinar one quasi offense here which is Reckless Imprudence Resulting to Homocide and Reckless Imprudence Resulting to Damage to property.
â€œArticle 365 lies in the execution or an imprudent or negligent act that, if intentionally done, would be punished as a felony.
The law punishes the negligent or careless act, not the result therof. The gravity of the evidence is only taken into account to determine the penalty; it does not qualify the substance of the offense.
As the careless act is single whether the injuries result should affect one person or several persons, the offense remains one and the same. It cannot be split into different crimes and prosecutions.â€ (People vs. Buan. Promulgated March 29, 1968, 65 O.G. 6127).
Findings
There is a casualty in this case, Mr. Raczok, a citizen of the United States of America died as of a result of the incident. He was on board a motorcycle when the incident happened. The driver of the dump truck was unscathed.
The extent of the damage at the front portion of the dump truck indicates that a strong impact landed on the right front side of the dump truck with an expired license. In fact he has been driving with an expired license since June 30, 2007.
The motorcycle of Zachery Raczok was also situated at the right side of the intersection.
Generally, when two vehicles approach or enter an intersection at approximately the same time the driver of the vehicle on the left shall yield the right of way to the vehicle on the right xxxâ€ section 42 of R.A. 4136).
The private complainant claimed that even if the dump truck was not there the motorcycle would still hit the fence opposite its direction with the speed it was driving. It is not in consonance with human nature for a person to ram his driven motorcycle on a fence situated right in front of him by over speeding and driving straight to it.
Probable cause is established against respondent for reckless imprudence.
An investigation was conducted by P03 Fabio Maulas last December 22nd, 2007 around 1:50 oâ€™clock dawn. He had received a call for police assistance regarding the accident that night of Razcok and Blanco.
Blanco was said to be driving home after a party and driving friends home early AM.
Raczok was on his way home after visiting with friends that evening.
Wherefore, premises considered, let a case for Reckless Imprudence Resulting to Homicide and Damage to Property be filed against the respondent.
The two separate cases for Reckless Imprudence Resulting to Homocide and Reckless Imprudence Resulting to Damage to Property are hereby ordered dismissed.
Court case is still pending for further decisions.

Mr. Gibson, we are all sorry for what happened to Zach. It is pretentious to say that I know how you feel because I don't think anybody can delve the pain you his parents felt because of his sudden demise. My update is not much because we here in the Philippines just finished the Holy Week and what a wonderfull one is what at that.
In my six years of being here hard to imagine it was my very first time to stand through a four hour mass and topped off with a procession of the crowning of the Blessed virgin Mary.

Prior to attending mass that evening I had discussed some private matters on what might be the next steps of the case.
I had given My publisher who is Pie's Atty. some advice and I hope it will work and I will keep texting to the every lovely lady Pie as she is in Manila getting her documents completed to work on getting what she needs to get done for the next hearing.
Atty. is fed up with the city govt attitude and had hinted around that he might go after the city next on negligence or something on that line.
Atty. is nice and has been very good with Pie and her family here, he sponsored the trip to Manila after my suggestion to Pie and him that the baby qualifies for American National and also for the benefits of her late father.
When I had accompanied PIE to the cityhall asking mayor to sponsor a trip for Pie and her child and for I to get the darling and very alert BB of their's to manila all Mark monton could do was to scoff and give us the old do not call us we will call you!
Which is total b***.
Mayor then makes a public announcement over the radio that Pie should make an appointment?
b*** call again make an appointment on what should be a priority?

I'm sorry in this country there is way too much leniency given to persons who commit crime and if this was to happen in my country Blanco the driver would be behind bars on day numero uno!

I am glad despite all that has happend and with Pie keeping a strong head, I hope some day Zach's mother will petition for her grandbaby and Pie and have them in America she would love those two precious women close to her forever.
Pie is a strong and very attractive strong minded person who knows what she is doing to make it right.
Hello Mr. Gibson we have never met, but I am happy to see you stepping in to let persons know how you feel.

I am learning things rather slowly as in why the owner of the dYRD and the Chronicle likes to keep things bad that happen to tourist white washed because he also owns a travel agency here in Tagbilaran.

Other then being the provincail Chairman on tourism. It makes even more sense now.

This week more evidence was submitted on both attorneys from both sides.

Another court hearing will take pace on May 15th.

American Embassy has ordered DNA samples from both the parents of Zackery and also the baby and her beautiful Boholana mother Cleofe Tutor.

The embassy has seeen pictures with Cleofe pregnant with her daughter but says it is not enough yet to satisfy them that it is her natral mother and he is the natural dad.

DNA samples are no longer attainable from the father as he was cremated in Cebu first week of Janurary before being flown back to the parents home town in United States.

Cleofe Fe was able to open up with more media personalities this week as well for the first time.

Untill now despite what very small monies she is receiving for her and baby she looks terrific and beautifull as always.

Your all very wellcome. i wish we could start a fund to help pie and baby go to and from manila to do the embassy work that is still required the attorney helping her is so good but yet still busy.

The news is hard to get as it is sensitive for the victims remaining behind so i am sorry if some times i am slow in giving out more info.

PLease let me know on what we can do to help with this sittuation since the city still has not done anything regarding this matter to assist.

Sad up date its for you to make what you can on this?

I received a very upsetting text from my dear friend Cleofe today who has been keeping me up to date with her case that is being handled by my publisher Atty. Alexander Lim, of the Bohol standard Newspaper.

She told me that the provincail hospital is not able to come up with the log book registry of the guard or any records of the victim before they transferd his live body to Ramiro where he eventually had end up passed away at?

If you recall earlier in the blog i mentioned that i had an interveiw with the investigating traffic cop who sais to me that the driver Blanco should have been the one to yeild on the dominating road.

Now he is a liar in the courts going back on his word to protect himself from the mayor.

Sad but oh so true.

Tommorow I plan to go to the provincail hospital and ask around and come up with some answers as to how can the records of such a case be not around?
This was an international was it not?
