Tagbilaran City mayor Dan Lim is facing another complaint before the office  of the Ombudsman (Visayas) in connection with his order to cut-off electricity at the residences of a broadcaster and a radio technician of station dyRD.

Criminally and administratively held liable for the indiscriminate power disconnection were Mayor Lim and Teodoro Estoque, building official of the city government.

Jeremias "Jerry" Pabe, anchorman of dyRD's "Tagbilaran-By-Nite" and Gerardo "Gerry" Cajes, a radio technician filed the complaint last Friday citing the act of cutting their power connections as a violation of Sec. 3(e) of RA 3019 on Anti-Graft and Corrupt Practices Act.

Also included in the charge sheet were Engr. Eulogio Signe, Engr. Ray Grapa and Rotelo Lamdagan, Jr., all of Bohol Light Co. Inc. for conspiring with the mayor in the commission of the discriminatory power disconnection.

The mayor was charged for violation of Sec 3 of RA 3019 on corrupt practices of public officials which caused "undue injury to the party in the discharge of his official, administrative or judicial functions through evident bad faith."

The BLCI personnel were charged in their respective capacities having shown participation in the conspiracy, with the public respondents in deliberately depriving the broadcasters of their electric power service by arbitrarily and maliciously disconnecting the power service with no valid and legal reason.
         
It may be recalled that BLCI cut the power service at their residential houses after the mayor withdrew his warranty for Pabe and Cajes "due to conflict of interest."

The move of Mayor Lim drew massive indignation from the community.

During an interview with Cebu media after the filing of the complaint, Pabe said it was "plain and simple harassment" considering that he is connected with dyRD, the station which Mayor Lim has been attacking after the station continued in its series of exposes' of alleged anomalies at the city hall.

In denouncing the mayor's act, Cajes, for his part said he was an "innocent" victim of the on-going crusade of dyRD in exposing the mayor of his irregularities.

The public denounced Mayor Lim for such act viewed as part of his media harassment especially also that Pabe is running as an independent bet for city kagawad in the May polls.

It's already 19 days since the two residences were deprived of the basic benefits as the two households have no electricity.

In defending himself, the city mayor said he has the right to withdraw his warranty since Capitol Valley Subdivision Part II has no permanent connections before he assumed as guarantor for the residents to avail of the temporary electric service connections with BLCI.

But the complainants asked: where is the conflict of interest?

"Tagbilaran City is not Mayor Dan Lim nor Mayor Lim is not Tagbilaran," according to the complainants while strongly lambasting the mayor's act as oppression especially that of the 150 residential houses at the Capitol Valley only the two of them have their power lines disconnected upon orders of the mayor.

The city Mayor is facing a number of cases in the Ombudsman.

I felt terrible when I had heard about this the first from Jerry Pabe a friend of mine. I learned about it when Pabe told me the night before it happened that the Mayor had sent orders to shut off the electric of the two media men. I thought he was making a pun as he was just starting his campaign.

I thought he meant that Dan Lim was trying to fizzle out the "Electric Spark" on Jerry's campaign for city councilor!!! Pabe was getting ready to leave as he was speaking to me about Dan Lim. I was not able to ask him any questions on what he was saying.... I was using my own imagination I never thought that such an awful thing could be done by a mayor or anyone one else especially if the bills are paid up.

The following night Pabe came to the studio of dyRD to assist his substituting anchorman for his TBN program on how to hand over donations to people needing help. He was very sad looking and told me that the mayor of Tagbilaran had shut off his and Cajes's electric current going into their residents.

After hearing this news and after Tagbilaran By Night program was off air I went to station DYTR to ask some questions with anchormen who are on the side of the Mayor and was told some things....

I was told by an x program partner of Pabe that Mayor had shut off the current because "Many people had heard him all over Tagbilaran over the radio putting down and back biting the mayor." I thought how odd to hear this as I am helping Jerry every night in the studio with the indigents being that I am a (BOD) PRO of the TBN Club here in Tagbilaran.

I told this particular anchor man that it was impossible that Jerry was back biting mayor over the station produced TBN on dyRD. I have never heard this anchorman say one bad word about anyone over the radio. Even if a text clamo comes into the studio and if it is a personal attack against someone Jerry will not go live over air with it.

This anchorman being a long time veteran that he is he very caring and has a neat sense of humor and as a friend I have never observed him being malicious towards anyone.

Then when I asked again on the following week the same question as before to the anchorman at DYTR he changed his story that Pabe had attacked Mayor Lim during the campaign.....Confusing when people change their stories from one moment to the next. Isn't it not!).

I had put this in Tubag Bohol but it was a deleted topic by the next day.

I am curious to see how people will vote knowing this about Dan Lim?

No matter how mad person may get about one another it does not mean reincarnate some sort of similar acts of Hitler or impose some sort of Martial law against anyone.

Condemning persons without any basis and abusing your city administrative duties is not a way to solve any matters. What if Jerry could of had a relative on an oxygen tank or a person in his house hooked up to a machine to help make them live?

The anchorman of DYTR also told me; "It is not clear as to why the same also happened to the dyRD engineer the anchorman of DYTR concluded; "Or maybe it was because the engineer could of been included because he could of shut of the microphone when Pabe was back biting the mayor."

I know that Chronicle/dyRD is not happy about this type of treatment coming from a City's top administrator and same for the persons at Bohol Light who went along with it.

This is all public knowledge by now.

I really hope the people voting in Philippines make an election count for the better of everyone.

abuse of power gyod nga klaro, plain and simple.  maayo gani kay wa maapil ang abuse of water. (jok-jok-jok only.)

lain gyod tuod ning magpa-elect to public office unya mubo ug pabilo.  na, nakadaog ra ba gyod intawon ning tawhana.  tungod ba kaha kay sundog-sundog siya sa style ni binay sa makati o di ba kaha tungod kay di tantong kusog ang iyang kontra. 

this mayor needs to learn brinkmanship.

Where are the comments from people who live here in Tagbilaran City or in Bohol on this post? I am sure your all chomping on the bit having mouthfuls of what to say but maybe you are afraid knowing the consequences are there if you do.

Then there are those of you in the media who are using money to be kept shut-up about the real happenings here. They always say "Money Works!".

Some guys have the audacity to ask me how they are doing as a fair and equal media man?

I say what have you done to help out our colleague Jerry Pabe? What has the powerful Catholic Church done to help out a good brother?

Then come ask me what type of a media mover and equal media man radio man that you think you are.

I am sick and tired of listening to the same old fighting everyday over the radio the election is done move on... Would you please!!!

I know and I see the things happening here and I think it stinks!

I have more I want to say.... I had plenty I wanted to say during the election but I kept it silent thinking that people here would have wizened up about their voting choices. .....
