Written By Kit BagaipoThe state prosecutor for Central Visayas found “sufficient probable cause†against a ranking officer of the Bank of Commerce Tagbilaran Branch implicated in a multi-million swindling of bank clients.
Regional state prosecutor Llena Ipong in Cebu City reversed the omnibus order of Tagbilaran City Prosecutor Romeo Chatto, who dismissed the complaint filed against bank officer Ada Marie Gallego-Mascariñas for two counts of falsification of commercial documents.
It may be recalled that Gallego-Mascariñas was accused by Bank of Commerce clients of falsifying their bank accounts, involving the issuances of checks that bore forged signatures of the complainants.
The city prosecutor dismissed the charges for insufficiency of evidence after a preliminary investigation.
One complainant, Sercio Manigque, represented by lawyer Lord Marapao IV, filed a petition for review at the Regional State Prosecutor.
In its resolution, the regional prosecutor said that “the purpose of a preliminary investigation is to establish probable cause and to secure the innocent against hasty, malicious and oppressive prosecutions.â€
