A robbery suspect in the city will face court charges in connection with a robbery incident along Remolador extension, this city last Jan 20 this year.
The suspect identified as Percy Amizola, Jr. a resident of Belderol st., this city, was positively identified by the witnesses Jose Marie Pernia, Jr and Gerhine Rose Ampog as the person who barged into the room and carted away cash amounting to more than P200,000.
Amizola is known by the police as a prime rob suspect in other cases particularly in Cogon district, this city.
In a two-page order, City Prosecutor Romeo Chatto, duly approved by City Prosecutor Adriano Montes, reconsidered an earlier resolution after counsel of the complainant filed a motion for reconsideration.
The prosecutor said that corresponding information be filed against Amizola with the proper court based on the merit that the complainant, Marylnne L. Pernia and her husband, Jose Marie, who actually saw the respondent as the person who took away the bag of the complainant outside the house.
“There can be no doubt as to the positive identification of Amizola although at first only by appearance and not by name,†it was stated.
The prosecutor likewise stated that the non-verification of the motion for reconsideration by complainant is a reversible error which was rectified when complainant herself appeared before the office and confirmed that the motion for reconsideration was filed through her instance and swore that the contents are within her personal knowledge and belief. - The Bohol Chronicle
