30-Year Martial Law Hangover

30-YEAR MARTIAL LAW HANGOVER:
MANY 1987 CONSTITUTION MANDATES ON ENABLING LAWS UNFULFILLED
 
The 1987 Constitution was largely a reaction by its Framers, the Constitutional Commission, to Martial Law and the Marcos era. Thirty years after the charter was ratified, Congress has yet to produce several crucial enabling laws the Constitution mandated.
 
Ineffective interface between citizens and civil society with their elected representatives is a factor. Some groups could also be preoccupied with their own concerns that they are unable to see the bigger picture.
 
Voter education and even basic education have simply failed in citizenship education. The basic ills of the economy remain unaddressed.
 
The lack of necessary enabling laws and responses to “as may be provided by law” provisions is too pronounced to be dismissed as isolated matters.
 
I am hopeful and optimistic that this 17th Congress, with its current leadership, we can fast track the enactment of these important measure. The President had in fact already issued an executive order on the Freedom of Information (E.O. no. 2, s. 2016). That was a good sign.
 
Here are some key unfulfilled mandates:
 
Freedom of Information (Article III, Section 7)
 
The right of the people to information on matters of public concern shall be recognized. Access to official records, and to documents, and papers pertaining to official acts, transactions, or decisions, as well as to government research data used as basis for policy development, shall be afforded the citizen, subject to such limitations as may be provided by law.
 
Presidential Succession (Article VII, Section 8, second paragraph)
 
In case of death, permanent disability, removal from office, or resignation of the President, the Vice-President shall become the President to serve the unexpired term. In case of death, permanent disability, removal from office, or resignation of both the President and Vice-President, the President of the Senate or, in case of his inability, the Speaker of the House of Representatives, shall then act as President until the President or Vice-President shall have been elected and qualified.
 
The Congress shall, by law, provide who shall serve as President in case of death, permanent disability, or resignation of the Acting President. He shall serve until the President or the Vice-President shall have been elected and qualified, and be subject to the same restrictions of powers and disqualifications as the Acting President.
 
Forest Limits Law (Article XII, Section 4)
 
The Congress shall, as soon as possible, determine by law the specific limits of forest lands and national parks, marking clearly their boundaries on the ground. Thereafter, such forest lands and national parks shall be conserved and may not be increased nor diminished, except by law.
 
Law Prohibiting Political Dynasties (Article II, Section 26)
 
The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law.
 
Lawmaking is not just the work of Congress. It is a mandate to the entire nation. After the elections, citizens must keep pushing, must tell their public servants what laws are needed, how laws must be implemented, and that courts must be fair and impartial.
 
I am but one voice, one representative among many. I am positive, though, that with the influx of political neophytes who bring in fresh perspectives and new solutions this 17th congress, we will finally end the 30-year Martial Law hangover and enact the needed enabling laws in the current session.
