A Regional Trial Court (RTC) judge temporarily stopped the Department of Interior and Local Government, the National Police Commission and the Philippine National Police from relieving the provincial police director of Bohol saying it might affect the current efforts of preventing election-related violence due to the presence of suspicious armed men.
Regional Trial Court Branch 49 Executive Judge Fernando Fuentes III issued a 72-hour ex-parte temporary restraining order on the memorandum issued by Police Director Abner Cabalquinto terminating the designation of Police Senior Supt. Anthony Obenza as acting provincial director and designating Police Senior Supt. Rodolfo Llorca as officer-in-charge of the Bohol Police Provincial Office based at Camp Dagohoy.
The TRO took effect last Wednesday, a day before Cabalquinto's memorandum to Police Regional Director Lani-o Nerez was supposed to take effect, though it (memorandum) was dated April 8, 2010 and was received at the Police Regional Office (PRO)-7 on April 13.
Fuentes acted on Gov. Erico Aumentado's petition for an injunction order to prevent Sec. Ronaldo Puno of DILG and Napolcom, Police Director General Jesus Versoza and Cabalquinto and all other persons acting under their authority - including Nerez - from enforcing the memorandum.
The injunction case had been set for special raffle on April 16.
In his capacity as governor, Aumentado strongly cited in his petition that Obenza "has shown the capacity to neutralize the use of guns, goons and gold in Bohol by some congressmen, in order to promote and preserve an honest, orderly and peaceful election in the province".
