Benham Rise

Benham Rise (coordinates: 119°30’E to 132°00’E and 12°10’N to 20°30’N latitude), also known as the Benham Plateau, is a 13-million hectare undersea region east of Luzon and is 40 meters underwater at its shallowest point off the provinces of Isabela and Aurora. It is bounded by the West Philippine Basin to the north and east. It is a seismically active undersea region and extinct volcanic ridge east of the Philippines, in the Philippine Sea which lies a number of Basins including the West Philippine Basin (WPB) of which inside the Basin is located the Central Basin Fault (CBF). The Benham Plateau region is located in the CBF and its basement probably represents a micro-continent. Several scientific surveys have been made on the feature to study its nature and its impact on tectonic subduction, including one about its effects on the 1990 Luzon earthquake, which devastated the northern city of Baguio. The area is currently claimed, as part of its continental shelf, by the Republic of the Philippines, which has lodged a claim with the United Nations Commission on the Limits of the Continental Shelf on April 8, 2009. Under the UNCLOS, a coastal state’s exclusive economic zone extends 370 kilometers (200 nautical miles) from its continental shelf, while its extended continental shelf extends for another 278 km (150 nautical miles). If the UN recognizes the Philippines’ claim, the country’s territory will increase to 43 million hectares from 30 million hectares. -- http://benhamrise.com/

Named after the American geologist Andrew Benham who discovered the shelf, the rise was mapped in 1933 but its connection to the Philippine continental shelf was validated only recently to justify the county’s economic claim. Despite its proximity to the archipelago, the plateau was previously not included in the territory of the Philippine Islands. On 8 April 2009, the Republic of the Philippines lodged a partial territorial waters claim with the United Nations Commission on the Limits of the Continental Shelf in relation to the continental shelf in the region of Benham Rise. It was submitted as part of petition expanding the archipelago's baselines and exclusive economic zone through a law that also included other claims involving disputed territories of the Kalayaan Islands (Spratly Islands) and Scarborough Shoal. Although the landform, in itself, is not disputed, the petition still received some criticism inside and outside the country because of its controversial nature. According to the government's claim, based on a set of guidelines by the Commission on the Limits of the Continental Shelf, the area satisfies the 350-mile constraint line since the outer limits of the continental shelf are located landward of the constraint line, which is located 350 miles from the baselines where the measurement of the breadth of the territorial sea begins. Benham Rise is not subject to any maritime boundary disputes and claims. The Congress of the Philippines enacted Republic Act No. 9522, also known as the Archipelagic Baselines Law, which is the basis of the claim. According to the document the region is bounded by the Philippine Basin on the north and east, and by Luzon on the west and south. It asserted that, according to scientific data based on seismic, magnetic, other geological features, the Benham Rise region is an extension of the Philippines’ continental shelf. -- http://benhamrise.com/

In summary, the baselines, the basis used for delineating the maritime territorial and jurisdictional zones (including the continental shelf), conform with the requirements of the UN Convention of the Law of the Sea (UNCLOS). The claim is only a partial claim since the law that allows the Philippines to expand its territorial boundaries also includes islands in the South China Sea. The Philippines may soon be able to provide its own energy needs if it obtains possession of Benham Rise, an underwater ridge to the east of Luzon which is believed to have mineral and gas deposits. The Philippines claim over Benham Rise is "very relevant" because scientific surveys indicate minerals and natural gas in the area. Solidified methane was found during mapping activities and the "probability is very high" there are oil deposits. There may be more natural gas than oil, and is considered better because it is cleaner. Benham Rise, which is bigger than Luzon, Samar, and Leyte combined, is being claimed solely by the Philippines because it is the only country within 200 nautical miles of the plateau.  -- http://benhamrise.com/

MANILA, Philippines - The Philippines may soon be the owner of an undersea land larger than Luzon and potentially rich in gas and oil, raising the possibility of energy self-sufficiency in the near future.

During the Senate finance committee's hearing on the proposed 2012 budget of the Department of Environment and Natural Resources (DENR), Secretary Ramon Paje said the United Nations Convention on the Law of the Seas (UNCLOS) may approve the Philippines' claim over Benham Rise by mid-2012.

Located at the country's eastern seaboard beside Aurora and Isabela provinces, Benham Rise is an extinct volcanic ridge with an area of 13 million hectares.

Paje said it is rich in solid methane and probably even oil, based on initial studies of the DENR.

"We've been saying this in the past. This country can provide for its own energy," he told reporters after the hearing. "We believe that with the deposits we can find in Benham Rise, we can substantially provide power in the country."

Paje added Benham Rise has enough deposits to enable the country to export gas.

Once the UNCLOS approves the Philippines' claim, he said the Philippine government may already issue contracts for exploring the area, like what is being done in the Malampaya deepwater gas field off Palawan.

"That will now provide the legal basis for the entry or execution of exploration agreements with private companies," said finance committee chairman Sen. Franklin Drilon.

The Philippines submitted its application for ownership of Benham Rise to the UNCLOS in late 2008.

Unlike the Spratly islands in the West Philippine Sea, no other country claims Benham Rise.

China: Philippines can't claim Benham Rise

MANILA, Philippines — The Philippines cannot claim Benham Rise as its own territory despite it being part of the country's 200-nautical mile exclusive economic zone, Beijing said.

In 2012, the United Nations Commission on the Limits of the Continental Shelf approved the submission of the Philippines in 2009 with respect to the limits of its continental shelf in the Benham Rise region. This enables the Philippines to carry out exploration and development of natural resources in the area.

"But it does not mean that the Philippines can take it as its own territory," the Chinese Foreign Ministry said in a recent statement.

The Department of National Defense earlier confirmed that Chinese survey ships have conducted oceanographic research in the region.

The Department of Foreign Affairs had sent a letter to the Chinese Embassy in Manila to seek clarification on the reported incursion into the country's territorial waters.

The Chinese Foreign Ministry, however, said that the UN Convention on the Law of the Sea (UNCLOS) states that "a coastal state's rights over the continental shelf do not affect the legal status of the superjacent waters or of the air space above those waters, nor do they affect foreign ships' navigation freedom in the coastal state's EEZ and on the high seas, or their innocent passage through the coastal state's territorial sea as supported by international law."

Meanwhile, international law professor Professor Julian Ku of Hofstra University said that the Chinese Foreign Ministry's response to the issue is confusing and troubling.

Geng noted that the UN commission approved the Philippines' submission in 2009 claiming Benham Rise is on its extended continental shelf, but the spokesperson also claims that the UN approval does not mean that the region is part of the Philippines' territory.

"Actually, that's what it means. UNCLOS Art. 76(8 ) makes those [Commission on the Limits of the Continental Shelf] recommendations 'final and binding' if [the Philippines] accepts (it did)," Ku said on Twitter.

Paragraph 1, Article 77 of the UNLCOS states that a state has sovereign rights over its continental shelf for the purpose of "exploring it and exploiting its natural resources."

"The rights referred to in paragraph 1 are exclusive in the sense that if the coastal State does not explore the continental shelf or exploit its natural resources, no one may undertake these activities without the express consent of the coastal State," the UNCLOS states.

China cites 'freedom of navigation,' 'false information'

Chinese Foreign Ministry spokesperson Geng Shuang admitted that Chinese vessels sailed across the waters northeast of Luzon to for marine research last year.

The Chinese official said that their vessels were only exercising freedom of navigation and the right to innocent passage "without conducting any other activities or operations."

"The remarks by some individuals from the Philippines are not consistent with the facts," Geng said in a press briefing last Friday.

The reference to "freedom of navigation" and innocent passage stands in contrast to Beijing's repeated objection to the United States Navy's operations in international waters of the South China Sea, west of the Philippines.
