The Supreme Court (SC) has imposed a fine of P5,000 on a retired Regional Trial Court (RTC) judge based in Panabo City, Davao del Norte for “undue delay†in resolving a motion filed by a litigant in a civil case pending before his sala while he was still in government service.
The High Court’s Second Division promulgated on February 7, 2011 its decision finding retired Judge Jesus Grageda, then Presiding Judge of RTC Branch 4 based in Panabo City, guilty of violation of Code of Judicial Conduct for his failure to resolve the motion filed by Pio Angelia, a complainant in a civil case pending before the latter’s sala.
The SC fined Grageda in the amount of P5,000 to be deducted from his retirement benefits.
In a complaint against Grageda, Angelia claimed that Civil Case No. 54-2001 entitled Pio Angelia versus Arnold Oghayan was filed in 2001 but was dismissed on December 20, 2007 for failure to prosecute.
Angelia claimed his counsel filed a motion for reconsideration on December 28, 2007 but Grageda failed to act on it, prompting them to file an urgent motion for early resolution on July 28, 2008. Still, until filing the administrative case, the motion was not resolved. - PNA
