The Sandiganbayan found a former labor arbiter from Cebu City guilty of violating the anti-graft law and sentenced him to a jail term of six to nine years.
The anti-graft court said that the case against Ricardo Barrios Jr., of the National Labor Relations Commission (NLRC), stemmed when he modified a ruling which granted petitioner Eduardo Abella his benefits.
The CA ordered the Philippine Telegraph and Telephone Corp. (PT&T) to pay Abella his separation, back wages, back-leave benefits, 13th month and other allowances and other bonuses totaling to P1.4 million.
But Barrios altered the CA resolution by issuing a separate order directing the PT&T to pay Abella only P113,000 in separation pay.
Abella filed the complaint against Barrios at the Ombudsman, saying the former labor arbiter deprived him of other benefits due him.
In the 19-page decision promulgated Aug. 7, the Sandiganbayan’s Second Division pointed out that once a ruling attains finality, it becomes the law of the case regardless of any claim that is erroneous.
â€The writ of execution must conform to the judgment to be executed and adhere strictly to the very essential particulars,†the decision Associate Justice Teresita Diaz-Baldoz penned for Sandiganbayn’s 2nd Division read.
The anti-graft court also held that the guilt of the accused was established because of strong evidence offered by the prosecution to “overcome the presumption of his (Barrios) innocence.â€
The Sandiganbayan also barred Barrios from working again in government and ordered him to pay Abella about P25,000.
