PWD sector calls for amendment of New Building Code

Cebu City (6 October 2008) -- Persons with disabilities (PWDs) groups and advocates in Central Visayas are seeking an amendment of the National Building Code to incorporate the specifications of the universal standards of accessibility in compliance to the United Nations Convention on the Rights of Persons with Disabilities (UN-CRPD) which the Philippines is a signatory.

In a position paper that will be the subject for further discussion in a one-day 'Forum on Universal Design' organized by the Infrastructure Development Committee of the Central Visayas Regional Development Council this coming Saturday, October 11 at the National Economic Development Authority (NEDA-7), the PWD sector strongly calls for the promotion on the implementation of the specifications of the universal standards of accessibility in all future projects.

Members of the PWD sector through the Accessibility Monitoring Committee II, the Organization of Rehabilitation Agencies (ORA) and the Infrastructure Development Committee of the RDC-7 are behind the proposal to initiate the amendment of the New Building Code while they are seeking the support of other sectors that will be invited to the forum on Saturday.

Under Article 9 of the UN-CRPD, to enable PWDs to live independently and participate fully in all aspects of life, State Parties shall take appropriate measures to ensure to PWDs access, on an equal basis with others, to the physical environment, to transportation, to information and communications, and to other facilities and services open or provided to the public, both in urban and in rural areas.
These measures, which shall include the identification and elimination of obstacles and barriers to accessibility, shall apply to the following: buildings, roads, transportation and other indoor and outdoor facilities, including schools, housing, medical facilities and workplaces, information, communications and other services, including electronic services and emergency services.
State signatories shall also take appropriate measures to develop, promulgate and monitor the implementation of minimum standards and guidelines for the accessibility of facilities and services open or provided to the public; ensure that private entities that offer facilities and services which are open or provided to the public take into account all aspects of accessibility for PWDs; provide in buildings and other facilities open to the public signage in Braille and in easy to read and understand forms and promote access for PWDs to new information and communication technologies and systems, including the internet among others.

The country's Accessibility Law which is aimed at enhancing the mobility of PWDs by requiring certain buildings, institutions, establishments and public utilities to install facilities and other devices has not moved significantly for the last 25 years as government and private buildings and structures and public transportation remain inaccessible today, according to the group.

The group added that to some extent the Accessibility Law or Batas Pambansa 344 of 1983 has even to some extent aggravated the situation of non-compliance and wrong interpretation due to ambiguity in some provisions.

In fact, The Philippines lags behind its counterparts in the Asia-Pacific Region such as Hongkong, Singapore, Thailand, and Malaysia which are promoting the universal standards of accessibility, the group further stated.

The group is the first one nationwide to initiate moves for an amendment of the National Building Code. (PIA-Cebu/FCR)
