Calape Election Protest Thrown Out

The electoral protest on the election results in Calape town was dismissed by the Regional Trial Court, Branch 48.

It was the first among the many cases decided upon by the court pertaining to the 2010 electoral protest.
The case filed by Ma. Aileen D. Veloso, who landed 9th in the May 10 election, was junked by the court after she failed to place a filing fee worth P3,000.
         
Veloso, the protestor garnered 6,789 votes while protestee Gaudencio G. Marapao, who landed in the 8th spot, garnered 6,795 votes.

Both ran for the 8-seat Sangguniang Bayan in Calape town among 18 aspirants.

Protestee Marapao, thru his counsel Atty. Lord R. Marapao IV, pointed out in the counterclaims that the election protest was insufficient in form and content and prayed for the dismissal of the case and claimed for moral and exemplary damages and attorney's fee.

According to RTC Judge Pablo R. Magdoza, the electoral protest filed by Veloso "requires the revision or examination of ballots, or the verification or re-tabulation of election returns, or may require bringing copies of other election documents and paraphernalia to court…the protestant shall make a cash deposit with the court, in addition to the filing fee of P3,000".
