Sandiganbayan convicts Leyte mayor and an ex-mayor of Nueva Vizcaya of graft charges

The Sandiganbayan convicted Leyte, Leyte Mayor Arnold James Ysidoro and a former mayor of Nueva Vizcaya of graft charges.
          In a 26-page Decision, the Second Division of the Sandiganbayan found Ysidoro guilty of Illegal Use of Public Property penalized under Art 220 of the Revised Penal Code (RPC).
          During the trial, Prosecutor Generoso Plazo proved to the court that Ysidoro utilized four sacks of rice worth P3,280 and 16 kilos of mongo worth P616 or a total value of P3896 for a food for work program in 2001. The said items were intended for the Supplemental Feeding Program of the municipality.
          The First Division of the Sandiganbayan also convicted former Kayapa, Nueva Vizcaya Mayor Tony Dupiano of three counts of graft for different offenses.
          In a 69-page Decision, the Anti-Graft Court declared Dupiano; municipal accountant Angeline Tulas; SPO2 Bernabe Flores, Jr.; and driver Danny Leoncio; all of  Kayapa, Nueva Vizcaya, guilty beyond reasonable doubt of violating Sec. 3 (e) of RA 3019 (Anti-Graft and Corrupt Practices Act).
          During the trial, Prosecutor Ma. Hazelina Militante proved that the respondents were guilty of the offense charged when they acted in concert with evident bad faith and/or gross negligence to approve the reimbursement for the repairs of a Land Cruiser (SBL-666), a private vehicle owned by Dupiano, worth P27,055 in 1999.
          They were sentenced to suffer the penalty of imprisonment of six years and one month to seven years, with perpetual disqualification from public office; and to jointly and severally reimburse the Municipality of Kayapa the amount of P27,055 as civil liability.
          Dupiano, and  Property Custodian Designate Lunes Latabeng were also found guilty beyond reasonable doubt of Violation of the same law for the ghost delivery of construction materials worth P152,949.19 in 1999.
          They were meted the penalty of imprisonment of six years and one month to seven years, with perpetual disqualification from public office. They were also ordered to jointly and severally reimburse the Municipality of Kayapa the amount of P152,949.19 as civil liability.
          Dupiano was also found guilty of the same offense for diverting for his own personal use three truckloads of sand and gravel intended for the road concreting project of the Salinas-Mapayao Road in 1999.
          He was sentenced to suffer the penalty of imprisonment of from six years and one month to seven years, with perpetual disqualification from public office.
          In another case, the Second Division of the Anti-Graft Court found Trinidad Sibug, former Executive Director of the Office of the Southern Cultural Communities guilty beyond reasonable doubt of the crime of Failure to Render Accounts (Art. 218 of the RPC).
          A total of 12 Informations had been filed against Sibug for incurring a total of P1,256,994 in unliquidated cash advances from 1991 to 1997.
          Commission on Audit (COA) Circular No. 90-331 provides that cash advances should be liquidated within two months following the end of the year.
          However, the same was only liquidated in 2002 through deduction from her salary.
