Acting Ombudsman Casimiro orders the filing of criminal charges against a former prosecutor, 7 others for different offenses

The Office of the Ombudsman ordered the filing of graft charges against a former prosecutor and seven others for separate criminal offenses.
          In a resolution, Gaudioso Gilera, former 4th Assistant City Prosecutor of Malolos City Prosecutor’s Office was ordered charged for violation of RA 3019 (Anti-Graft and Corrupt Practices Act).
          Records showed that Gilera allegedly demanded for his benefit the repainting of his white Mitsubishi Lancer from one Macario Pagdanganan sometime in December 2004.
          Pagdanganan is a party in certain cases pending before Gilera.
          It was alleged that the repainting was demanded in exchange for a favorable resolution of his complaints.
          The Resolution said that, “The latter (Gilera) who is supposed to be the administrator of justice is now accused of causing injustice to the complainant. The condemnable acts of the respondent should not be tolerated as the public would lose trust and confidence in our justice system.”
          In a separate case, Acting Ombudsman Orlando Casimiro ordered the filing of graft charges against General Manager Godofredo Vicmudo, board chairman Gene Naval, and board of directors members Federico Fontanilla, Evangeline Javonillo, Rodrigo Gaun and Efren De Vera, all of Cordon Water District in Cordon, Isabela.
          The case stemmed from the officials’ non-payment of backwages to its two employees, namely: Felix Camangeg, bookkeeper and Mary Jane Aguinaldo, cashier.
          As of December 4, 2008, the said employees alleged that their accumulated salaries and benefits were—P273, 621.00 for Camangeg; and P244, 304.00 for Aguinaldo.
          Records revealed that the said amount comprised of salaries (for the period February 2007 to November 2008 and 78 days suspension), cash gift and 13th month pay.
          The Acting Ombudsman stated that, “It is indubitable that the award of backwages to the complainants was justified and their failure to receive the same is without legal basis.”
          Meanwhile, in another case, Danilo Collantes, former Provincial Engineer for the province of Rizal, was ordered charged for two counts of violation of Sec. 8 of RA 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
          In a resolution approved by Acting Ombudsman Casimiro, it found enough evidence to pursue the case in the proper court against Collantes for his failure to file his statements of Assets, Liabilities and Net Worth (SALN) for the Calendar Years 2001 and 2002.
