Former Pasay City Mayor Wenceslao Trinidad, 3 others, ordered charged for anomalous bidding of Pasay City Market

Acting Ombudsman Orlando C. Casimiro ordered the filing of criminal charges against former Pasay City Mayor Wenceslao Trinidad and three others for the anomalous bidding procedure for the construction of the Pasay City Mall and Market in 2003.
          In a 33-page Resolution, Trinidad, former City Councilor Jose Antonio Roxas, and Non-Government Organization – Bids and Awards Committee (NGO-BAC) Representatives Joselito Manabat and Alexander Ramos were ordered indicted for Violation of Sec. 3(e) or RA 3019 ( Anti-Graft and Corrupt Practices Act) in relation to  RA 9184 (Government Procurement Reform Act); and Art 237 of the Revised Penal Code (Prolonging Performance of Duties and Powers).
          Records showed that on 03 Oct. 2003, Trinidad issued an Invitation to Pre-Qualify/Apply for Eligibility and to Bid for the construction of the said building which has an approved budget of P500M to be funded through the issuance of Pasay City Kaunlaran Bonds.
          However, on 06 Oct,. 2003, Trinidad requested the newspaper to hold the publication of the Invitation pending approval by the City Council of an ordinance providing the budget for the said project.
          Thereafter, on 21 Oct. 2003, City Ordinance No. 2864. S. of 2003 was enacted authorizing the Bond Floatation by the City Government in the amount not exceeding P500M to fund the construction of the said complex and authorizing the City Mayor to negotiate, sign and execute contracts pertinent thereto.
          On 23 Oct. 2003, a Second Invitation to Pre-Qualify/Apply for Eligibility and Bid was subsequently issued by Trinidad. This was published in the Examiner News and in the Weekly Views.
          On 30 January 2004, Trinidad as PBAC Chairman called for a meeting of the Pasay City BAC (PBAC) and the “old” PBAC members attended.
          The project was awarded to Izumo Contractors, Inc. being the lowest bidder and a Memorandum of Agreement was signed between Cedric Lee, President of Izumo Contractors, Inc. and the City Government of Pasay through Trinidad.
          The Resolution said that the said IRR-A took effect on 08 Oct. 2003, while City Ordinance No. 2864, s of 2003 was enacted and approved only on 21 Oct. 2003, and the second Invitation to Bid was issued only on 23 Oct. 2003. Hence, “it cannot be denied that when the second invitation to bid was issued , the IRR-A of RA 9184 had already took effect.”
          The Resolution also stated that “the manner in which the ‘old’ PBAC was ordered constituted and conducted itself as such by respondent Mayor Trinidad vis-avis the bidding of the assailed construction project is highly irregular.”
          It said as early as 29 Dec. 2003, Trinidad has issued Executive Order No. 10, s. 2003, constituting the new PBAC and made it effective on January 2004. It said, “simply put, the new PBAC under RA 9184 is the legitimate body who should have conducted the bidding process no more no less.”
          The Resolution also pointed out that under RA 9184, the head of the procuring agency is not allowed to sit as member of the BAC.
