Supreme Court must resolve issue fast

      The only remaining hitch in the incumbency of President Gloria Macapagal Arroyo as the 14th president of the Republic is the suit filed by Lawyer Oliver Lozano assailing the legality of the oath of office of Arroyo due to the absence of Estrada's resignation. The lawyer contended that there was no valid resignation of President Estrada in contemplation of the Constitution which allows the assumption of the vice president to the presidency. In a statement of President Estrada last Wednesday he declared that he was merely on leave and that Arroyo was only acting president. He declared that he was now reassuming the presidency.
      The Estrada declaration augurs as a threat to peace. The earlier this is settled, the better for the country in its search for recovery.
     The suit filed before the Supreme Court was the same body which resolved en banc authorizing the Chief Justice of  the Supreme Court to administer the oath of President Arroyo during that fateful noon of January 20. However, last Wednesday, the former President Estrada has announced that he was reassuming his position as President and that President Arroyo who was already sworn in as President should give way to him since he she was only an Acting President, according to Estrada's legal advisers.
      Since a suit has been filed with the Supreme Court contesting the validity of the taking of oath of President Arroyo, the Supreme Court should promptly pass judgement on such a situation in order to prevent a hiatus in the presidency.
     It may be recalled that it was the same Supreme Court justices who unanimously authorized Chief Justice Hilario Davide Jr. to administer the oath of office to President Arroyo. It should be the same body which should officially dismiss the petition of Lawyer Lozano.
     To allow the case to remain unresolved is not in keeping with good governance since two persons are claiming the office of president.
     The situation is conducive to confusion if the matter is not resolved promptly as this might affect the international standing of the country as a member of the family of nations. It shatters the good image of the country before the eyes of the community of nations. If the matter is not settled, a stima of instability hovers over the government.
     But a simple common sense can easily resolve the issue. Since it was the Supreme Court which authorized the assumption of office of President Arroyo and it was before the same court where the suit was filed it will be the same body which will resolve the issue. And there can be no other decision of the court but to uphold its en banc resolution and defend the validity of the oath administered to President Macapagal.
