Is the government serious in its campaign against pirated DVDs sold in the market?

This remains to be a million dollar question as pirated DVDs which were seized last Thursday afternoon during a raid conducted by operatives of the Optical Media Board (OMB) found their way back to the shelves barely two days after the raid.

A Chronicle team which visited yesterday afternoon the raided stalls along CPG Ave.,in front of Metrobank noticed brisk selling of pirated DVDs resumed as if already been given clearance to resume peddling these supposedly hot items.

OMB agent Manny Mangubat, head of the raiding team, told the Chronicle that the raid along CPG Avenue , near Unitop, was by far the biggest operation conducted in the province. He added that their recent raids in malls only yielded few pirated DVD's and CD's.

According to Mangubat, the operation that they conducted was pursued due to the constant complaints from the residents and a request of the Local Government Unit. In fact, he added that the raid was in coordination with the LGU and the local police.

Mangubat explained that the selling of pirated DVD's is a violation to Republic Act 9239 otherwise known as the Optical Media Act of 2003.

“Lahat po ng discs maging CD, DVD, Software, Games, Play Stations, may mga original copyright yan at bawal po kopyahin at ipagbili sapagkat nakaw po ito sa original na kopya at sa may-ari na gumawa nito”, (all discs including CD, DVD, software, games and play stations have original copyright and it's prohibited to copy and sell them because it's thievery against the original copyright and owner) Mangubat stressed.

Mangubat said that violators of the RA 9239 could face an imprisonment from thirty (30) to ninety (90) days and could be penalized from twenty five thousand pesos (P25,000) up to fifty thousand pesos (P50,000) if found guilty by the court.

However, the OMB officers cannot file even a single case against the owners and operators of the said pirated DVD's along CPG Avenue because the place was abandoned when the raiding team assaulted the area.

Mangubat pointed out that the vendors in the area were openly selling pornographic DVD's wherein children can easily observe it.

The team also confiscated voluminous items of pornographic DVD's.

According to Mangubat, the entire seized items will be presented to the office of the City Mayor.

The team was equipped with a Mission Order (MO) signed by Ronald N. Ricketts, chairman and chief executive of the OMB.
